with this requirement will be evaluated based on the revised criteria detailed below:
“List two (2) dewatering projects for the Project Manager, Project
Superintendent and Project Engineer which included continuous dewatering to a
depth greater than 20 feet below groundwater surface elevations for a
construction area of at least 1 acre. Specifically provide the following information:

No. A minimum 84-inch diameter steel casing pipe will be
required to facilitate placement of the 66-inch diameter
reinforced polymer mortar (FRPM) carrier pipe within
TxDOT right-of-way for the tunnel crossing under Hwy 77.

Are fiberglass tee base manholes allowed for the “composite
manholes” on package 2 – lift station? FRP tee base manholes
are allowed in the gravity siphon.

where air release valves are not at a high point in the pipeline.

clarify the height and number of logs required for the 48” pipe.

seems to indicate that gates are either embedded or surface
mounted, not wall thimble mounted. Please clarify type of
mounting.

Wall Thimble: There are no wall thimbles nor is there a gate
schedule for the gates at the headworks tie-in structure.

Dear Mr. Leist:
This letter is in regard to information received November 16, 2017, and subsequentsubmittals received December 21, 2017, January 4, 2018, and January 15, 2018, concerning aproposal by the City of Waco to construct a transfer lift station and force main in the city ofWaco, McLennan County, Texas. This project has been assigned Project Number SWF-2016-00086. Please include this number in all future correspondence concerning this project.
Under Section 404 of the Clean Water Act the U.S. Army Corps of Engineers (USACE)regulates the discharge of dredged and fill material into waters of the United States, includingwetlands. USACE responsibility under Section 10 of the Rivers and Harbors Act of 1899 is toregulate any work in, or affecting, navigable waters of the United States. Based on thedescription of the proposed work, and other information available to us, we have determined thisproject will involve activities subject to the requirements of Section 404 and Section 10.
We have reviewed this project under the pre-construction notification procedures ofNationwide Permit General Condition 32 (Federal Register, Vol. 82, No. 4, Friday, January 9,2017). We have determined the discharge of dredged or fill materials into waters of the UnitedStates associated with this project appears to qualify for Nationwide Permit 12 for Utility LineActivities. To use this permit, the permittee must ensure the work is in compliance with thespecifications and conditions listed on the enclosures and the special conditions listed below.Additionally, all activities must comply with the water quality certification conditions of the TexasCommission on Environmental Quality (TCEQ) located at http://www.swf.usace.army.mil/Portals/47/Users/053/21/821/NWP%20201 7%20Texas%20401 cert.pdf.
The special conditions are as follows:
1. The permittee shall use a phased cofferdam system for the crossing of the Brazos Riveras depicted on the “Inverted Siphon Plan & Profile Sheet I of 2” received via electronicmail January 15, 2018, prepared by Lockwood, Andrews & Newman, Inc. The phasedcofferdam system shall be used to maintain low flows of the Brazos River.

2. The permittee understands and agrees that, if future operations by the United Statesrequire the removal, relocation, or other alteration, of the structure or work hereinauthorized, or if, in the opinion of the Secretary of the Army or his authorizedrepresentative, said structure or work shall cause unreasonable obstruction to the freenavigation of the navigable waters, the permittee will be required, upon due notice fromthe Corps of Engineers, to remove, relocate, or alter the structural work or obstructionscaused thereby, without expense to the United States. No claim shall be made againstthe United States on account of any such removal or alteration.
Failure to comply with these specifications and conditions invalidates the authorization and mayresult in a violation.
Our verification for the construction of this activity under this nationwide permit is valid untilMarch 18, 2022, unless prior to that date the nationwide permit is suspended, revoked, ormodified such that the activity would no longer comply with the terms and conditions of thenationwide permit on a regional or national basis. The USACE will issue a public noticeannouncing the changes when they occur. Furthermore, activities that have commenced, or areunder contract to commence, in reliance on a nationwide permit will remain authorized providedthe activity is completed within 12 months of the date of the nationwide permit’s expiration,modification, or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization in accordance with 33 CFR 330.4(e)and 33 CFR 330.5(c) or (d).
The USACE based this decision on a preliminary jurisdictional determination (PJD) that thereare waters of the United States on the project site. A PJD is not appealable. At any time youhave the right to request and obtain an Approved Jurisdictional Determination (AJD), which canbe appealed. If it is your intent to request an AJD, do not begin work until one is obtained.
Our review of this project also addressed its effects on threatened and endangered species.Based on the information provided, we have determined this project will not affect any specieslisted as threatened or endangered by the U.S. Fish and Wildlife Service within our permit area.However, please note you are responsible for meeting the requirements of General Condition18 on endangered species.
The permittee must sign and submit to us the enclosed certification that the work, includingany proposed mitigation, was completed in compliance with the nationwide permit. Thepermittee should submit the certification within 30 days of the completion of work.
This permit should not be considered as an approval of the design features of any activityauthorized or an implication that such construction is considered adequate for the purposeintended. It does not authorize any damage to private property, invasion of property rights, orany infringement of federal, state, or local laws or regulations.
