A. CALL TO ORDER

The July 2, 2007, meeting of the DeSoto County Board of Supervisors was called to order by Supervisor Bill Russell, Board President.

Chief Deputy Charlie Brown of the DeSoto County Sheriff’s Department was present and did open the DeSoto County Board of Supervisors meeting in a regular session to hear any and all business to come before the Board. The following were present:

The official minutes of the Board of Supervisors were read for the month of June, 2007, pursuant to Section 19-3-27 of the Mississippi Code of 1972, Annotated. Supervisor Jessie Medlin made the motion and Supervisor Tommy Lewis seconded the motion to approve the minutes of the Board of Supervisors, with clarifications made by the Supervisors for the month of June 2007. The motion passed by a unanimous vote.

Notice is hereby given that the contract between the Board of Supervisors of DeSoto County, Mississippi, on the one part, and Lehman-Roberts Company, on the other part, dated 06/05/06, for the construction of Project No. STP 1966 (7) B being a section of Byhalia Road in Desoto County, Mississippi, has been fully and completely performed and final settlement thereunder has been made on 04/05/07.

This notice is given under Section 31-5-53, Mississippi Code of 1972, in pursuance of the authority conferred by order upon the Board of Supervisors of Desoto County.

F. CITIZENS CONCERNS

1. Animal Shelter – Appeal of Decision to Destroy Vicious Animal

The Director of Administrative Services Vanessa Lynchard explained the timeline concerning the incident with the two pit bull dogs belonging to Steve Adam Starkey which lead to this appeal. She said this incident on appeal originated on February 23, 2007, when two pit bull dogs attacked and killed a german shepherd dog while it was tethered on its owner’s property. Both pit bull dogs were originally reclaimed by Mr. Starkey on March 26, 2007.

On May 9, 2007, one of the animals was caught running at large by Desoto County Animal Control Services and later it was destroyed in accordance with the Desoto County Animal Control Ordinance.

Since that time, the DeSoto County Animal Services has been unable to inspect the confines of the second vicious animal. Recently, the animal was located and brought to the Animal Shelter. Animal Services recommends the animal be destroyed in accordance with the guidelines of the Desoto County Animal Control Ordinance on keeping vicious animals and which Mr. Starkey had accepted responsibility for complying with the ordinance to keep the animals, but has failed to do so. She said that since the first dog was apprehended while running at large, Animal Services has gone to extensive lengths to locate the second dog and inspect the confines when they realized Mr. Starkey no longer resided at the address where he originally received approval to reclaim the dogs.

Vanessa said that several issues have occurred during our efforts to enforce the ordinance regarding the second vicious animal as follows:

1.) Animal Services has made numerous attempts to inspect the conditions where the second previously determined vicious animal is being kept.

2.) At the last hearing Mr. Starkey indicated he was moving to Barbee Road, yet he would not tell Animal Services his exact address.3.) During the weeks since the May 21st hearing, Mr. Starkey has not answered our telephone calls.4.) Animal Services has been unable to inspect the new residence and has confirmed Mr. Starkey is no longer residing at the Starlanding and Sullivan Road address and we had been unable to locate the second pit bull dog.5.) Mr. Starkey has told us he does not know the current address where he is living.6.) Mr. Starkey has made several deceptive attempts to collect the remains of the first dog that was destroyed while refusing to let us inspect the other animal.7.) Mr. Starkey told Animal Services that the second animal was run over by a truck and buried and he refused to show us the site of the grave.

Vanessa said that, in short, the public is not being protected from the vicious animal and Animal Services has determined that Mr. Starkey does not take his responsibility seriously for keeping the vicious animal, therefore, DeSoto County Animal Services recommends that the second vicious animal owned by Mr. Starkey be destroyed in accordance with the Desoto County Animal Control Ordinance.

Steve Adam Starkey addressed the Board of Supervisors requesting an appeal on the decision to destroy the second pit bull dog belonging to him.

Mr. Starkey said that he transferred his insurance to his new address. He said he has a concrete slab and fence but has not put it up yet. He said the insurance company told him the fence is not sturdy enough.

Supervisor Bill Russell asked Mr. Starkey why he has not already built a cage since he is already keeping the animal under the guidelines for keeping a vicious animal. Mr. Starkey said the other cage is at his mother’s house but it is not at his current residence. Mr. Starkey said he does not want to spend the money to buy the cage until he knows what the Board of Supervisors is going to do regarding the animal.

Supervisor Bill Russell told Mr. Starkey that when he first appeared before the Board, he asked Mr. Starkey to please do what he was supposed to do with the second dog. Supervisor Russell said he knows, when dealing with two animals, one can cause the other animal to act more viciously. He said Mr. Starkey gave the Board his word that he was going to keep the second dog according to the Animal Control Ordinance.

Supervisor Allen Latimer said it breaks his heart to support destroying this animal. Supervisor Latimer told Mr. Starkey when he appeared before the Board before, he was being given another chance with the second animal and the Board of Supervisors expected Mr. Starkey to go by the regulations. Supervisor Latimer said he does not like to do this but based on past behavior, Mr. Starkey has not done what he had responsibility to do and what he said he would do regarding keeping the second animal.

Supervisor Bill Russell made the motion and Supervisor Allen Latimer seconded the motion to deny the appeal and uphold the decision and recommendation of Animal Services to destroy a vicious pit bull dog owned by Steve Adam Starkey et al. The motion passed by a unanimous vote. See Exhibit F.1

1. Tax Assessor – Presentation of Tax Rolls

Tax Assessor Parker Pickle presented the total appraised value for 2007 in the amount of $10,446,654,221 and explained that this represents an increase of $805,598,056 above

2006 in appraised value. He also presented the total assessed value for 2007 in the amount of $1,437,266,692 which represents an increase of $90,457,983 above 2006 in assessed value.

Supervisor Eugene Thach asked if this includes personal reassessment. Mr. Pickle said no, that comes next year.

Supervisor Tommy Lewis asked what the appraised value was last year. Mr. Pickle said $9,641,056,165.

Mr. Pickle said the Desoto County Tax Assessor’s Office completed 5,927 homestead exemption applications this year. He said no other county touches that record.

Chancery Clerk Sluggo Davis said the rolls will be here for the next 30 days for people to review their assessed value.

This day came on to be considered by the Board of Supervisors of DeSoto County, Mississippi, the matter of equalizing assessments of real and personal property for the year 2007, and the Board affirmatively finds and adjudicates that Parker Pickle, Tax Assessor of DeSoto County, has completed and filed the 2007 real and personal assessment rolls of DeSoto County, Mississippi, and in accordance with the provisions of Section 27-35-81, Mississippi Code 1972, has delivered the said rolls in legal form to the Clerk of the Board of Supervisors of this county on or before the First Monday of July 2007, and that said Assessor has made and appended to said real and personal rolls the affidavit in the form and as provided by law.

NOW THEREFORE, it is ordered that this Board of Supervisors will immediately at its July 2, 2007 meeting proceed to equalize such rolls and will cause to be assessed any person, or thing, found to be omitted, and correctly value any property found to be undervalued, and do all things required by Section 27-35-87, Code of 1972, and other laws, and cause all corrections to be made in the said rolls, and will complete such equalization at least ten (10) days before the August, 2007 meeting, and upon adjournment will immediately by newspaper publication notify the public that such rolls so equalized are ready and open for inspection and examination.

Supervisor Jessie Medlin made the motion and Supervisor Eugene Thach seconded the motion to accept the preliminary tax rolls and open them for inspection by the public. The motion passed by a unanimous vote. See Exhibit H.1

2. Accounting

a. Approval of Late Bills

At the recommendation of the Comptroller Tom Arnold, Supervisor Tommy Lewis made the motion and Supervisor Allen Latimer seconded the motion to approve a late bill for the Board members and County Administrator’s travel expenses in the amount of $2,657.16. The motion passed by a unanimous vote. See Exhibit H.2.a

b. Transfer of Metro Seized Funds

At the recommendation of Comptroller Tom Arnold, Supervisor Tommy Lewis made the motion and Supervisor Jessie Medlin seconded the motion to authorize and instruct the Chancery Clerk, pursuant to Section 41-29-185 of the Mississippi Code of 1972, as amended, to transfer the following forfeited funds that were seized by Metro Narcotics:

c. Claims Docket

The Board of Supervisors questioned a claim for medical services at the DeSoto County Jail. Later in the meeting, Comptroller Tom Arnold said that this individual had been indicted for armed robbery. He was picked up in Vaiden, MS. He jumped off of the balcony in the jail pod and seriously injured his foot. Mr. Arnold said the individual was held at the Regional Medical Center in Memphis awaiting a mental evaluation by

Tennessee officials. Mr. Arnold said the prisoner was finally released to the county and efforts are being made to have a mental evaluation done in Mississippi.

In accordance with Section 19-13-31 and Section 19-11-23 of the Mississippi Code annotated, Supervisor Eugene Thach made the motion and Supervisor Allen Latimer seconded the motion to authorize the Chancery Clerk to pay the bills as presented by the Comptroller. 3. Tax Exemption Requests

a. Parker Hannifin – Personal Property – 5 Years

President and CEO of Desoto County Economic Development Council Jim Flanagan introduced Marsha Spencer and Jason Klein of Parker Hannifin Corporation. Ms. Spencer said that Parker Hannifin has invested $1.5 million dollars in an expansion. Ms. Spencer said this project is to recover energy and save fuel. She said that Parker Hannifin is doing research and development in this area and has hired several new engineers into the company. She said Parker Hannifin is anticipating a lot of business from this venture.

Supervisor Eugene Thach said the average wage listed is very good. Supervisor Allen Latimer asked how long Parker Hannifin has been here. Ms. Spencer said that Parker Hannifin has been in Desoto County since 1984. Supervisor Latimer said that the reason for the tax exemption being offered to companies is to offer jobs in DeSoto County and it is good to make efforts in that area.

Supervisor Jessie Medlin said that Parker Hannifin has been a good company in Desoto County and they have been in the county for a while.

Supervisor Jessie Medlin made the motion and Supervisor Eugene Thach seconded the motion to approve a five year personal property tax exemption for Parker Hannifin in the amount of $1,535,406.95. The motion passed by a vote as follows:

b. Quebecor World – Personal Property – 5 Years

President and CEO of Desoto County Economic Development Council Jim Flanagan introduced Dean Redden and Dan Leever from Quebecor World and are seeking a tax exemption on personal property for Quebecor.

Mr. Redden thanked the Board of Supervisors for the opportunity to ask for a tax exemption. He said when the company decides to buy new equipment the tax exemption opportunity helps the company decide where to put that equipment. He said this expansion will give Quebecor more capacity. Mr. Redden explained that Quebecor closed two operations in other areas last year and a lot of that business was transferred to Olive Branch.

Supervisor Allen Latimer said he assumes Quebecor will give the first shot at those jobs to people of Desoto County.

Supervisor Eugene Thach and Supervisor Allen Latimer expressed interest in Quebecor hiring Desoto County employees.

Supervisor Jessie Medlin said a few years ago Desoto County got a grant to widen Hacks Cross Road and this company helped toward meeting the requirements of that grant.

Supervisor Jessie Medlin made the motion and Supervisor Eugene Thach seconded the motion to approve a 5 year personal property tax exemption for Quebecor World in the amount of $17,939,869.00. The motion passed by a vote as follows:

c. Pottery Barn – Real & Personal Property – 10 Years (MOU)

President and CEO of Desoto County Economic Development Council Jim Flanagan introduced Mark Aquadro, Attorney representing Pottery Barn, and Britt Balkcom from Pottery Barn. Mr. Aquadro said Pottery Barn is finishing work that was originally approved under a Memorandum of Understanding in 2004. He said this application is for that part of the building approved under the MOU. He said that this distribution center is now 1.2 million square feet. Mr. Balkcom said the building for which the company is requesting an exemption is one of the three buildings on Polk Lane.

After discussing the contributions of Pottery Barn to Desoto County, Supervisor Jessie Medlin made the motion and Supervisor Allen Latimer seconded the motion to approve a real and personal property exemption for ten years as formally approved under the Memorandum of Understanding for Pottery Barn in the amount of $14,195,370.00. The motion passed by a vote as follows:

d. Future Electronics

Mr. Flanagan introduce Mark Aquadro and Mick Leazer from Future Electronics requesting a tax exemption for personal property for ten years. Mr. Leazer said this expansion is a shot at going into the internet for Future Electronics. He said the opportunity is to reach out to engineers and assist them while they are in the development process of designing components. He said this expansion will start the fourth quarter of this year. Mr. Leazer said the initial run did not really separate Future Electronics from other companies. He said this is the second phase of the build out. He said that Future Electronics is making modifications to the existing building.

Supervisor Jessie Medlin clarified that this is part of a larger project and is included in the Memorandum of Understanding that was originally approve by the Board of Supervisors.

Supervisor Eugene Thach made the motion and Supervisor Allen Latimer seconded the motion to approve a ten year, personal property tax exemption for Future Electronics according to the terms of the Memorandum of Understanding that originally approved the exemption. 4. DCAOP – Renewal of Lease with ABCO

At the recommendation of the Grants Administrator Joyce Herring, Supervisor Tommy Lewis made the motion and Supervisor Jessie Medlin seconded the motion to approve an extension of the lease agreement with ABCO Realtors for the DCAOP office for a term set to expire June 30, 2008 at $600 per month or $7,200 for the year with minor changes from the previous lease as indicated in Exhibit H.4. The motion passed by a unanimous vote. See Exhibit H.4

5. Sheriff’s Department

a. Approval of MOU - Personnel Conducting Urban Training (RUT) within DeSoto County, MS

b. Approval of MOU between DeSoto County and Naval Special Warfare Group One

c. Approval of MOU between DeSoto County and Gulf Coast Regional Fugitive Task Force

County Administrator Michael Garriga presented three documents for the approval for the Desoto County Sheriff’s Department as follows:

a. MOU- Personnel Conducting Urban Training (RUT) within DeSoto County, MS

b. MOU between DeSoto County and Naval Special Warfare Group One

c. MOU between DeSoto County and Gulf Coast Regional Fugitive Task Force

Board Attorney Jody Neyman said the Navy has been training in and around Desoto County for 16 years but have decided to make it a policy to get an agreement in writing. He said his law office has reviewed the documents presented and everything looks fine.

Supervisor Tommy Lewis asked about giving the residents some sort of notice. Supervisor Lewis said he can remember some sort of training going on and people did not realize it was training and there was quite a stir. Mr. Neyman said this is mainly survival training so it may not be necessary to notify the public as it might be with other types of training.

Supervisor Bill Russell made the motion and Supervisor Jessie Medlin seconded the motion to approve the agreements as follows:

a. MOU- Personnel Conducting Urban Training (RUT) within DeSoto County, MS

b. MOU between DeSoto County and Naval Special Warfare Group One

6. Planning Commission – Surplus Equipment Declaration and Internet Auction

Planning Director Jim McDougal said that the vehicle in question has 112,000 miles and is starting to cost the department a lot of money in upkeep. Mr. McDougal said currently the Planning Commission has use of a vehicle to replace this one.

Supervisor Eugene Thach made the motion and Supervisor Allen Latimer seconded the motion to approve to declare the 1996 Ford F-150 Pickup Truck, property number 14014 and vin number 2FTEF15N2TCA74063 as surplus and authorize it to be sold at auction. The motion passed by a unanimous vote. See Exhibit H.6

7. EMS – Change in Cellular Provider/Plan for Ambulances

County Administrator Michael Garriga said that EMS has requested new cell phones and plans, moving from Cingular Wireless to Cellular South for three ambulances in the county. He explained that the ambulances stayed with the Cingular analog plan to allow EKG tests to be transmitted by phone before actually arriving at the hospital. He said that

type of technology is no longer supported by Cingular Wireless and they requested the county to use Cellular South for Medic 2, Medic 6 and Medic 9.

Supervisor Tommy Lewis made the motion and Supervisor Allen Latimer seconded the motion to approve three cell phones with the “700 Anytime Minutes” plan with Cellular South at a cost of $29.99 per month for Medic 2, Medic 6 and Medic 9 for the EMS Department. The motion passed by a unanimous vote. See Exhibit H.7

8. Bids Under Advisement - Approval of Bid for Craft Road

County Consulting Engineer Daniel Murphy presented the bids received for Craft Road for county project number CO-17(30) to cut down a hill at the intersection of Craft and Allison Roads. Mr. Murphy said the engineer’s estimate was $118,000. The bids were presented as follows:

9. Department of Road Management

a. BCAP Program

Road Manager Russell Dorris presented information regarding the Beaver Control Assistance Program. Mr. Dorris explained that the opportunity to rejoin the Program could be possible during the next year. He explained that due to limited funding, participation in BCAP has decreased each year for several years. Mr. Dorris said that USDA would like to make BCAP available in all 82 counties but the cost to counties will increase under any offering which allows all counties to participate. He said the USDA has estimated the cost to range in the $5,000 to $6,000 level per county, if current levels of participation are sustained in 2008. He asked if the Board of Supervisors is interested in having the Desoto County participate in the Beaver Control Assistance Program.

Supervisor Jessie Medlin asked if the county will get a benefit out of the Program to cover the excess cost. Mr. Dorris said yes.

Supervisor Eugene Thach made the motion and Supervisor Tommy Lewis seconded the motion to approve acknowledging that the county is interested in participating in the Beaver Control Assistance Program for the coming year. The motion passed by a unanimous vote. See Exhibit H.9a

b. Starlanding Road Overpass Bid

Road Manager Russell Dorris, County Engineer Andy Swims and Assistant Engineer Scott Young and Bob Bailey of Pickering Engineering, came before the Board of Supervisors to discuss the Starlanding Road Overpass bid. He said the project estimate from State Aid was $6.7 million. Mr. Bailey said they received six bids as follows and two were disqualified as incomplete. Talbot Brothers was the low bidder and the price was higher than the original estimate for the project:

Supervisor Jessie Medlin asked if State Aid is okay with the bids. Mr. Dorris said State Aid recommends that we go ahead if we can find the difference in the funding.

County Administrator Michael Garriga said funding is available in the county. He said we originally budgeted more for this project because we were not expecting the additional $2.5 million in federal funding for the project. He said the bid is actually $8,426,907.56. He said there is $8.8 million in the budget. He said we will have to come up with $3.6 million to send to State Aid. Mr. Garriga said, in addition, the county is responsible for engineering fees and those fees are budgeted.

Supervisor Eugene Thach asked if accepting the bid after June 30th is acceptable. County Administrator Michael Garriga said it is his understanding this is a State Aid contract and not a county project and the project was already programmed.

Supervisor Jessie Medlin asked why this one is being handled differently than other State Aid projects.

Supervisor Bill Russell said, if this is approved today, is there any idea about a timeline for the project. Mr. Bailey said it could be one month or more than six weeks from today before the project starts. Supervisor Russell asked if we know when the road will be closed. Mr. Bailey said no. The road will not be closed immediately. Mr. Bailey said there are liquidated damages after 280 working days for the project.

Supervisor Eugene Thach said we have heard about this project for over 15 years. He said the conditions at that site have been a thorn in the side of the Board of Supervisors and we are concerned about an accident happening at the railroad. He said it did not look like it would happen and the Board of Supervisors are overjoyed that the project will start in July.

Supervisor Allen Latimer said he thanks the Board for their tremendous support during this project.

Supervisor Tommy Lewis asked what made the bids incomplete that were turned down. Mr. Bailey explained the inconsistencies in the bids that were not considered.

Supervisor Allen Latimer made the motion and Supervisor Eugene Thach seconded the motion to accept the low bid as presented from Talbot Brothers in the amount of $8,426,907.56 and authorize payment to State Aid. The motion passed by a unanimous vote.

Supervisor Bill Russell said he thanked Supervisor Latimer who has done a good job in keeping the community involved and informed about this project. See Exhibit H.9.b

c. Add-Ons to Road Register

The motion passed by a unanimous vote. See Exhibit G.10.e.f.

10. Olive Branch Tax Collector Building Update

County Administrator Michael Garriga said the county needs to plat the property out as a commercial subdivision lot and have it recorded regarding the Tax Collector Building in the City of Olive Branch. Mr. Garriga said it is his understanding that the road was constructed by the county and it was really an access road and not a public road. He said the city has had some discussion about dedicating the property to the city so it can become a city street.

Supervisor Jessie Medlin said that will be fine if the city is planning to maintain the road. Mr. Garriga said that the building should be advertised later this week.

Supervisor Medlin said he does not think the road has been named so it will need to be named.

Supervisor Jessie Medlin made the motion and Supervisor Eugene Thach seconded the motion to approve dedicating the street near the Olive Branch Tax Collector’s Building to the City of Olive Branch and to have plans drawn up and the property surveyed for the Olive Branch Tax Collector’s Building and to authorize going out to bid and opening the bid. The motion passed by a unanimous vote.

11. Animal Control Services – Personnel

Supervisor Bill Russell made the motion and Supervisor Jessie Medlin seconded the motion to accept the resignation of Amy Spillers from Desoto County Animal Services effective June 26, 2007. The motion passed by a unanimous vote.

1. Fire Department – 4th of July Fireworks

County Administrator Michael Garriga said because of the considerable rain during the past couple of weeks, there will be no issue with allowing fireworks in the county for the 4th of July.

2. Solid Waste Plan

Supervisor Jessie Medlin asked if we are going to meet all of the deadlines for the Solid Waste Plan. County Administrator Michael Garriga said he thinks so. He said we must file a plan but we can handle that in house.

Supervisor Jessie Medlin said we need to resume discussions on expansion of the rubbish pit. Mr. Garriga said the plan says we must conduct an analysis of the property. He said that we have options under the current contract to work with Allied Waste on this effort.

Supervisor Bill Russell said we probably should be talking to the Starlanding Rubbish Pit about our options there. Supervisor Russell asked if we should direct Solid Waste Manager Jim Bearden to look into finding a spot for another rubbish pit. Supervisor Jessie Medlin said the Board already did that 10 years ago but determining a location has been difficult. Supervisor Allen Latimer suggested looking at the southwest part of the county.

Supervisor Jessie Medlin said the one at Olive Branch is a Class A facility. The Board of Supervisors discussed this need and agreed that it should be a priority for the county to address this issue.

3. Metro Narcotics

County Administrator Michael Garriga said we are getting ready to submit a grant for Metro Narcotics. He reminded the Board that we were denied funding last year so the Board compensated the budget for the operations for the Metro Narcotics Unit. He said we are getting ready to submit our grant but it was communicated to us two weeks ago that we would not be considered for the grant this year. He said he plans to contact the Governor’s office and send emails to our Senators about this issue. Mr. Garriga said he knows there are concerns that we have only two entities participating in our Metro Narcotics Unit. He said our seizures and forfeitures are up. Mr. Garriga said this is another example of the county compensating for the state.

Supervisor Jessie Medlin said he was in the meeting and the gentleman from the Department of Public Safety told the county that our grant application would be considered this year. He asked who made this decision. Mr. Garriga said he is not sure. He said without the committee looking into it that awards the grant, a predetermination that our grant not be considered would not be fair.

Supervisor Allen Latimer asked if any reason was given for not considering Desoto County’s grant application. Mr. Garriga said it was because the Board compensated the department by funding their budget last year and they determined that the county has money to support that department.

Supervisor Jessie Medlin said he would like to know if there are other counties that were dropped last year were picked up this year. Mr. Garriga said he can find that out and report back to the Board.

Supervisor Jessie Medlin asked if the Board Members will get a copy of that letter. Mr. Garriga said he does not know if they will use the committee again for the grant but he will see that the Board is copied on any correspondence.

Supervisor Bill Russell suggested requesting a meeting with the Governor on this issue. The Board of Supervisors agreed.

4. I-269

Board Attorney Jody Neyman said the Board of Supervisors recently approved a Resolution of Intent to borrow the $275 million for the construction of I-269. Under the statute the county is required to run a Public Notice telling the citizens of the county about this issue. Mr. Neyman said, under law, the public had until 9:00 a.m. today to file a protest. He said since no protests have been filed and there is no reason for delay he has a Resolution that indicates there have been no protests to the bond issue. Mr. Neyman said we need approval of the Resolution stating there were no protests to the bond.

Supervisor Jessie Medlin said that we have told them we want to know what the plan is for the road. Supervisor Medlin said he recently found out about a meeting that was held about realigning Fairview Road and he had no idea there was a meeting. He said the state should keep the county in the loop regarding this project.

Supervisor Allen Latimer made the motion and Supervisor Eugene Thach seconded the motion to approve a “Resolution of Desoto County, MS (the “county”) declaring the intention of the county to authorize the borrowing of an amount not to exceed $275 million by entering into a loan with the Mississippi Development Bank for the purpose of financing certain capital improvements which shall consist of the design, right of way acquisition, construction, improvement, expansion and extension of U.S. Interstate 69 eastward from Interstate 55 in the county to its intersection with U.S. Highway 78 at the county/Marshall County, Mississippi boundary line or any other highway, road and/or bridge improvements in the county together with related improvements and infrastructure, (collectively, the “Highway Project”) and for other authorized purposes under the act” as adopted on June 4, 2007, was duly published as required by law; that no petition or other objection of any other kind or character against the loan described in the resolution was filed; and authorizing the loan.

After having duly published the notice of intent and having no petition submitted in opposition therefore be it resolved by the governing body of Desoto County according to the terms defined in Exhibit I.4.
