Jim McCord was an artist. It would be disrespectful to him to refer to him as “lawyer turned artist”. Yes, he had a law degree and practiced off and on for several years. Mainly off. But Jim’s paintings were his reasons for living. Law was a way for him to make a little money here and there so that he could fill his soul with his art. Camille Dautrich, Art Columnist for the News-Leader, said this:
The first time I saw a McCord painting close to 30 years ago, it seemed like Vincent Van Gogh must have visited the Ozarks.
Little did I know that the intellectual who graduated a year ahead of me would be remembered for his Art, and not his legal ability. When Jim flunked the Bar Exam, tremors shot through the Law School like a cherry bomb in church. How could this happen to the Editor of the Washington University Law Quarterly who also was the number two student in his class? Rumors abound: he was drunk; or, after he started the exam, he became disgusted that it was so simple and just refused to participate; or, maybe he thought he was so smart that he didn’t need to study and didn’t bother to read the Missouri Appellate cases which, we all knew, were the foundations for at least some of the exam questions. The evidence leans toward the latter of those possibilities. Jim was an intellect who leaped from mountain top to mountain top. He deigned to explore the valleys frequented by the rest of us mortals. He did take the Bar exam again and passed it, obtained his LLM in Criminal Law at the University of Pennsylvania and worked for the Practicing Law Institute and Commerce Clearing House writing articles on legal
issues. He was the grandson of Ozarks’ folklorist, writer, poet and singer, Mae Kennedy McCord. Jim’s Washington University Law School career was legendary. I recall the first time I saw him in the hallways at the Law School, with a yellow pencil tucked behind his ear, holding forth on some obscure analysis of an English property law case. Several students were gathered around listening. Wow! He was one smart guy! During his Law School career, he was reputed to be an undercover investigator for Smirnoff Vodka. Smirnoff was concerned about local St. Louis bars selling low-quality vodka to unsuspecting patrons who had ordered high-end Smirnoff. Jim’s “job” as an undercover agent was to go to various bars and order shots of Smirnoff to determine if some low quality swill was being substituted. According to Jim, he was paid $20 per hour plus his out-of-pocket expenses which, obviously, were considerable. One day shortly after the law school holiday break, Jim returned with a richly detailed story about psychokinesis. One night, he was with a group of his friends down in Douglas County at a little country house drinking whiskey and, through the combined mental power of Jim and his Booger County friends, they were able to levitate the dining room table and suspend it in midair with the power of their minds. Yep. We believed that one, too. After his law school career, the next several years are a little hazy. One of Jim’s friends claimed he went to Ireland and joined the IRA in its on-going insurrection against the British. Another rumor was that Jim roamed around Europe for the next several years, painting and becoming friends with a host of European Royalty.
Take your pick on these stories. Maybe they occurred. Maybe not. But Jim was a person to whom these things could have happened. We wanted to believe them. I didn’t see Jim again for several years. Then, one day, I was in the Associate Circuit Courtroom of Tom McGuire when handcuffed prisoners clad in red jail garb were led in. Jim was one of the prisoners. He was limping and he had several bruises, scrapes and cuts on his face. He had gotten into a fight with a Highway Patrolman and finished in second place. By a lot! A few months later, we hired Jim as a runner and a researcher. We knew that sending Jim into the courtroom to deal with the minutiae of the criminal and civil cases we handled would be malpractice of considerable depth. He was with us, though, about two years. One evening at a legendary Plaza Towers Christmas party, I walked into a darkened office on the 7th floor to find Jim standing at the open window. The smell indicated Jim was not smoking a known-brand cigarette. “Jim, what’s going on?” The reply: “John, I’m pretty sure I can fly.” We had an engaging and lengthy conversation that evening. One cold evening he left the office rather late and as he was trudging across the parking lot toward the bus stop, I asked him if he needed a ride. His response was that he lived pretty far on the north side and that he was okay with taking the bus. I gave him a ride to a house on West Kearney Street that did not have lights. When I asked him if he “really” lived there, he told me that he lived “pretty close to the ground”. And he did. A few months later, Jim was hired by City Attorney, Howard Wright, to head up a special project to raise money for a survey at the City Land Fill to

determine its level of pollution. Jim was designated as the “Superfund Investigator.” The “mystery” of why anyone would actually “hire” Jim as an employee nagged at me for several years. A few days ago I asked Howard what could possibly possess him to hire Jim for that job. Howard laughed and said that he was always “intrigued” by interesting people. Jim, as the Superfund Investigator, did a “wonderful job” for the City, resulting in the recovery of a significant monetary sum from commercial users of the landfill to fund the survey. Jim believed he was like a Yugoslavian revolutionary partisan for Marshall Tito, living in the mountains and sending spies into the villages below. According to Wright, “Jim brought a social fury for environmental causes to his job with the City. He did a great job.”
What an interesting person. We are still talking about him years later and we still remember his remarkable personality and wit. But the thing for which Jim McCord will be remembered for, long after these stories are forgotten, is his art. He painted with gusto. He painted prolifically. He painted the scene and then the auras surrounding that scene. I hope you have the opportunity to see some of Jim’s paintings. They are treasured by those who possess them. They are stunning and are made even more so by the story of his legendary life. Jim was shaped by his brilliant mind, the urban/rural myths surrounding his personality, and his love of painting. He is a person who will be remembered for years and years for his art. His legal education helped him achieve his goal of being an artist who will be remembered.

Greene County Appreciates Our Jurors!
The first week in May was juror appreciation week in Missouri and the 31st Circuit found creative ways to thank jurors including posters, stickers marking the occasion and gift card raffles handed out by presiding Judge Michael Cordonnier.

We saw plenty of excitement on our second leg of the SMBA Tour de Courts as participants made their way to the Missouri Court of Appeals, Southern District. In the late afternoon of April 9th, our new members arrived at the Hammons Building, trekked past the fountain and the flag poles, and made their way up the elevator to the courtroom. Once inside, our gracious hosts, Judge Burrell and Judge Bates, taught our new members what goes on at the appellate level and how to prepare to argue before the Court.
Participants learned that Appellants face an intense uphill climb to win their case because almost every rule is against you. Because of this, handling your own appeal is especially tough and attorneys who focus on appellate practice often have a distinct advantage, much like cycling where climbing specialists accel at long hard climbs on a bike.
Their primary job is to identify reversible error, and the judges stressed the importance of bringing the appealable issues in front of the trial judge, getting a ruling, and making and preserving the record at trial. New members also learned successful appellate lawyers structure of their briefs to fit their arguments, but acknowledge facts and case law on both sides of the argument, ask the judges what they want the court to do, and recheck the case law right before oral arguments.

Practice Pointers with Judge Don Burrell and Judge Jeffrey Bates
After Stage 2, Judge Burrell and Judge Bates took the time to answer a few questions and offer advice that will benefit all our members.
Q: What are the top three things every lawyer needs to know about practicing in the Southern Appellate District (or in appellate court in general)?
Judge Burrell1) Don’t just recite the applicable standard of review – actually think about what it means and then apply that to your appeal to see your actual chances of prevailing2) Be prepared to answer the judges’ questions3) Admit any authority contrary to your position and explain why it does not apply or should be changed.
Judge Bates: The top three things to know about practicing before the Southern District are:1) Read Rule 84.04(d) carefully and follow the required format in drafting your point relied on.2) Make sure to comply with Rule 84.04(e) by explaining whether the point is preserved for appellate review; if so, how that was done; and the applicable standard of review.3) If you represent the appellant, remember that new arguments in your brief, not presented below, are usually not considered by us because the trial court had no opportunity to consider them before ruling.
Q: Before becoming a judge, what is the best piece of advice a lawyer/mentor gave you?
Judge Burrell: Try to find an area of law that you are attracted to and have some skill in and concentrate on that type of practice. Never give in to the temptation of telling a half-truth to a court or another lawyer. If you are found out, you will never be able to fully recover from it.
Judge Bates: An appellate court is not supposed to retry the case. Make sure you let the facts, as found by the factfinder, and the applicable law lead you to the outcome, not the other way around.
Q: Beyond the Bench: What are some of your hobbies and interests, and what do you do in your spare time?
Judge Burrell: kayaking, hiking, biking, making music
Judge Bates: My hobbies include scuba diving and underwater photography. I have taken several thousand photos on various trips since 1997 from places like Fiji, the Galapagos Islands, Cozumel and Belize. Other interests include reading books about history and cooking, especially Cajun dishes like crawfish etouffee and chicken and sausage gumbo. Whatever spare time I have left I spend with my two lovely granddaughters.

The Springfield Metropolitan Bar Association annual Law Day lunch was held on Friday, May 4, 2018 at Hickory Hills Country Club. The theme for this year’s Law Day was “Separation of Powers: Framework for Freedom.” Judges, bar members, public officials, honorees and citizens were on hand to hear keynote speaker, the Honorable John D. Ashcroft deliver the Law Day address. Springfield native and SMBA member, Ashcroft shared his unique perspective on separation of powers, having served in the executive branch as Missouri’s Auditor, Attorney General and Governor, in the legislative branch as United States Senator, and as United States Attorney General during the administration of George W. Bush. Following Ashcroft’s remarks, awards were presented in four categories: Distinguished Attorney, Judicial Excellence, Equal Access to Justice, and Liberty Bell Award.
The 2018 Distinguished Attorney Award, which is the highest honor given by the SMBA, went to Bill Hart. In presenting the award, Bryan Wade noted that throughout his career Hart has served as a mentor and a role model, demonstrating leadership, integrity, expertise, compassion and commitment both to the profession and the community.
The Judicial Excellence Award was presented to the Honorable Thomas Mountjoy. This award is recognizes judges who exemplify the highest legal and ethical standards and are actively involved in service to both the legal and non-legal community.The Equal Access to Justice Award, which recognizes individuals who provide significant pro bono services, was presented to Scott Smith.
The Liberty Bell Award, which recognizes non-lawyers who encourage respect for our legal system, was presented to Paula Baird, former principal at Immaculate Conception, for her work in promoting public education and dramatically increasing participation in the SMBA’s annual essay and poster contests. This year’s theme: Separation of Powers: Framework for Freedom inspired 300 entries in SMBA poster and essay contests. An awards ceremony was held April 7, 2018 to celebrate the young artists and authors entering those contests. The posters were on display at the Library Center for three weeks, during which time tens of thousands passed the inspiring display.
The recipient of the 2018 John D. Ashcroft Springfield Metropolitan Bar Association Scholarship was also announced at the Law Day lunch. Jacob Haskins, a rising 3L at Missouri University Law School, will receive a $2,000 scholarship to assist in completion of his studies.

The Equal Access to Justice Award was established to recognize those individuals who have made significant contributions to the mission of Legal Services of Southern Missouri, both through Volunteer Lawyers Project hours and judicare hours. Law School Scholarship
The John D. Ashcroft Springfield Metropolitan Bar Association Law School Scholarship had distributed more than $40,000 since its inception. This year’s recipient, Jacob Haskins is a rising 3L at Missouri University School of Law.
