Note. Determining whether an accident is over three-day or over seven-day is not as simple as it may first appear.

To identify if an accident meets the criteria:

(1) don’t count the day of the accident; and

(2) count any other “consecutive” days on which the worker was “incapacitated for routine work”.

Note. If someone works on light duties it could become reportable due to their inability to do routine work.

What’s the situation on “over three-day” accidents?

We assist our clients frequently with Accident Reporting queries and RIDDOR reporting and accident investigation.

If you need any advice on this important topic, please do not hesitate to get in touch.

One of your staff recently had an accident and wasn’t able to work for three days. A colleague says the

accident is “reportable” is this correct?

Lost time reporting

In the past, employers were required to report accidents which caused more than three days of incapacity for work. This requirement came from the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR 1995).

These regulations were amended in April 2012 moving the point for reporting lost time accidents to seven days. This was one of several attempts by the government to reduce the burden of health and safety on employers. The altered requirement was also transferred into the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013.

The plan was to remove the over three-day reporting requirement entirely to make employers’ lives simpler. However, although the active reporting of lost time accidents doesn’t kick in until seven days, the government left in place the obligation to record over three-day accidents. Not doing so would have left Great Britain in breach of a European directive.

What must be recorded?

You must keep records of accidents which leave an employee unable to carry out their duties for more than three days. You must also record such accidents which affect self-employed workers if it happens on premises under your control. The details needed are: (1) the date and time of the accident; (2) the injured party’s full name and occupation; (3) the nature of the injury; and (4) a description of where and how the accident happened.

Tip 1 In practice the duty isn’t onerous, as the information to be kept is the equivalent of an accident book entry. But make sure you can distinguish over three-day accidents from other more minor ones in case an inspector asks to see your records.

Tip 2 The minimum time period to keep the records is three years, but in practice it’s sensible to keep them for longer in case of a delayed claim.

To summarise, you no longer need to actively report over three-day accidents to the authorities, but you do need to record

them. An accident book entry is sufficient, but make sure you can distinguish them from other more minor accidents.

Young WorkersYoung workers are those who are over the school leaving age of 16, but under 18. Employers need to take additional responsibility for such people because of inexperience in the workplace. Managers in particular have a responsibility for the supervision of all young people who work for them.

It should always be remembered that they are more vulnerable than experienced members of staff and therefore will require closer supervision and instruction.

Please request our free checklist to assist you in meeting your obligations towards the young people in your employment. It highlights the general issues that will need to be addressed and you can add to it depending upon your own workplace situation.

The Trainer: Who is Ian Sandall?

Ian Sandall has, for the last 25 years, been producing , directing and writing video. He is based in Cheshire but literally works all over the world.He has worked on everything from Network TV to music videos, drama to comedy…. From multi-camera productions with massive crews to shooting by himself in an African jungle!
