Great  Rivers  Habitat  Alliance  

Current  Work  

Our  single-­‐most  important  issue:  GRHA  is  challenging  the  legitimacy  of  blighting  productive  farm  ground,  flood  plain,  and  open  space.  GRHA  and  co-­‐plaintiff  St.  Charles  County  have  challenged  the  city  of  St.  Peters  to  determine  if  natural  flood  plain  and  family  farms  can  be  called  blighted  under  state  law.  The  trial  portion  of  the  case  has  just  concluded  after  over  four  years  of  legal  wrangling.  If  victorious,  taxpayers  will  no  longer  be  forced  to  finance  flood  plain  developments  through  Tax  Increment  Financing  (TIF).    •          GRHA  is  working  toward  the  reform  of  the  U.S.  Army  Corps  of  Engineers;  the  entity  ultimately  responsible  for  allowing  the  mass  destruction  of  our  nation’s  flood  plains.  GRHA  has  joined  the  National  Wildlife  Federation  and  several  other  like-­‐minded  conservation  groups  to  form  the  Water  Protection  Network.  This  coalition  of  over  150  environmentally  dedicated  groups  aims  to  change  the  Corps  style  of  “business  as  usual”  and  to  provide  citizens  with  genuine  accountability.    •          GRHA  has  partnered  with  the  National  Wildlife  Federation  to  stop  FEMA  from  disregarding  the  Endangered  Species  Act  when  it  issues  a  flood  plain  map  revision.  This  case  is  pending.    •          GRHA  legally  challenged  the  issuance  of  a  Letter  of  Map  Revision  from  FEMA  to  the  city  of  St.  Peters  for  its  Lakeside  370  development.  FEMA,  as  has  been  proven,  disregarded  its  own  regulations  when  issuing  this  revision,  which  now  enables  this  property  to  be  enrolled  in  the  National  Flood  Insurance  Program,  a  program  now  over  $20  billion  in  debt  and  growing.  Unfortunately  GRHA  lost  this  case  due,  not  to    lack  of  merit,  but  to  a  system  designed  to  thwart  review.        •          GRHA  issued  a  legal  challenge  to  the  city  of  St.  Charles  for  blighting  and  issuing  a  tax  abatement  for  approximately  100-­‐acres  near  Highway  370  for  more  industrial  development  of  the  100-­‐year  flood  plain.  This  development  has  been  delayed  indefinitely.      •          GRHA  has  partnered  with  Ducks  Unlimited  to  pursue  several  large  private  conservation  easements  in  the  100-­‐year  Confluence  Flood  Plain.  These  easements  preserve  the  land  as  it  is  in  perpetuity,  with  the  goal  of  eventually  assembling  enough  parcels  to  effectively  create  a  wall  of  protection  against  commercial  development  in  the  Confluence.  

Victories  

•        Passage  of  Missouri  Senate  Bill  225  in  2007,  which  prohibits  the  use  of  tax  increment  financing  in  100-­‐year  flood  plains  across  the  state  and  ensures  the  right  to  discharge  firearms;  a  vital  component  in  preserving  hunting  in  the  flood  plain.  This  bill  was  spearheaded  by  close  GRHA  ally,  the  NRA.  While  it  has  been  a  huge  step  forward,  it  still  contains  exceptions  for  land  within  one-­‐half  mile  of  an  interstate  highway,  making  GRHA’s  challenges  in  St.  Peters  and  elsewhere  still  necessary.    •        GRHA  halted  the  expansion  of  the  Smartt  Field  Airport.  Owned  by  St.  Charles  County,  Smartt  Field  was  slated  to  receive  a  runway  expansion  through  a  federally  funded  grant,  which  would  have  allowed  light  jets  to  land  in  the  heart  of  the  Mississippi  Flyway;  a  flyway  containing  two-­‐thirds  of  our  nation’s  migratory  waterfowl.  GRHA  was  able  to  convince  the  county  council  to  pass  on  the  expansion  plan,  saving  taxpayers  another  flood  plain  folly,  not  to  mention  saving  pilots  the  trouble  of  navigating  through  flocks  of  birds.        •        GRHA  prevailed  in  court  over  the  city  of  St.  Peters  when  we  proved  city  officials  had  misled  its  own  residents  about  the  true  costs  associated  with  issuing  bonds  to  build  the  Lakeside  370  project.  This  resulted  in  the  true  costs  being  revealed  and  required  the  city  to  have  all  required  permits  in  place  before  issuing  the  bonds,  saving  taxpayers  money  in  the  process.          •        GRHA  halted  “Shoe-­‐String”  annexations  by  the  city  of  O’Fallon,  preventing  further  wholesale  commercialization  of  the  Confluence  Flood  Plain.
