Organicfest Vendor Agreement & Participation Terms: Please read participation terms and sign agreement on application form for the Organicfest terms herein:

1. Organicfest Vendor Application

a) Organicfest vendors application must be completed and submitted with signed agreement to the Organicfest Vendor Participation Terms and full payment.

b) Organicfest vendors participation must be in keeping with the mission of the festival to promote and market organic and green products and services.

c) Organicfest vendors agree to payment of booth space provided. If payment is not made, organizers have the right to cancel vendor registration.

d) Organicfest organizers have the right to refuse any vendors with products or services which do not meet the mission and theme of the event.

2. Organicfest Vendor Booth Sharinga) Sharing booth space is permitted with prior permission ONLY. Additional vendor application and fee will apply. Contact Debi: 828.253.2267

3. Organicfest Vendor Booth Space a) Organicfest organizers have sole discretion as to the placement of the vendors booths.

b) Organicfest vendors will be provided a 10 x 10 booth space.

c) Canopies and signage are allowed in your booth space only.

d) Canopies and signage must be secured in case of inclement weather with weights only ( booths will be set up on city streets...no staking canopy into street.)

e) Booths must be manned at all times during the event hours of 10am to 6pm.

f) Vendors must not break down booth before the closing of the event at 6pm.

4. Placing Rental Ordersa) Tables and chair rental is available. All orders must be placed by August 31, 2010

b) Rented tables and chairs must be picked up at the stage area. Volunteers will be available to help carry tables and chairs to vendor booths.

c) Rental tables and chairs must be covered with table covering for the event.

d) Rental tables and chairs must be returned to stage area at break down. Volunteers will be available to help carry tables and chairs to stage area.

5. Organicfest Food Vendorsa) In keeping with the theme of the event all foods and refreshments for sale or tasting at the Organicfest must be organic, especially any foods that contain by products from genetically engineered crops: canola oil, corn, soybean, rice and dairy (rBGH).

b) Beverages must be organic and served in paper cups (cans and bottles are prohibited by the City of Asheville at street festivals)

c) Organicfest food vendors must comply with the Bumcombe County Health Center Temporary Food Establishment regulations: http://www.buncombecounty.org/governing/depts/health/environment.asp

d) Organicfest food vendors must complete the Bumcombe County Health Center Temporary Food Establishment Application included with this packet.

e) All food vendors must supply two Certificate of Insurance* certificates for $1,000,000 WITH their Organicfest Vendor application. See Limited Liability section 13 for specific requirements. f) All food vendors must be set up and ready for inspection by the Buncombe County Health Department by 9:30 am.

6. Vendor Signage a) There will be no structures to hang signs on. You may hand signage on your canopy or table All signage and merchandise must secured in case of challenging weather.

7. Organicfest Set Up and Break Downa) Organicfest vendors will be responsible for setting up canopies, tables and chairs. Volunteers will be available to help vendors upon request.

b) Organicfest vendor set up and break down instructions will be posted on the Organicfest web site and emailed to vendors two weeks prior to the event.

8. Organicfest Vendor Booth Clean Up and Recyclinga) Organicfest vendors will be responsible for cleaning up their booth space completely including all boxes, canopy weights, trash... If any items or trash is left in or around vendors booth space vendor will be charged a clean-up fee of $50.00.

b) Organicfest vendors are expected to support the greening of the event by minimizing waste, using recycled and biodegradable items when possible. Recycling stations will beset up throughout the festival area.

9. Organicfest Safety and Emergency Plana) The Organicfest staff has an emergency plan in place for emergencies that may arrise during the event. First-aid will be available at the Organicfest Information Booth. Organicfest Emergency Contact: Tom Athos 828.279.2798

10. Weather Policya) The Organicfest is a rain or shine event. Be prepared for inclement weather with table coverings, secured canopy and signage.

11. Pet Policya) We love pets...however the City of Asheville does not allow pets to attend the Organicfest.

12. Vendor Cancellation Policya) Cancellation requests must be made in writing.

b) There will be no refunds on cancelled vendor spaces after July 31, 2010. Cancelled booth spaces will be donated to local non-profit organization.

c)The organizers of the Organicfest reserve the right to cancel vendor contracts at any time by returning payment.

13. Limitation of Liabilitya) Neither the organizers of the Organicfest, the volunteers or Asheville Parks and Recreation are responsible for the theft, loss or breakage of personal or booth materials.

b) All food vendors must include with their application ~ two separate Certificate of LiabilityInsurance certificates with $1,000,000 in coverage with the following listed as “Certificate Holder” and “Additional Insured” (in the Discription of Operations/ Locations/ Vehicles/Exclusions added by Endorsement/Special Provisions” section): (Sample enclosed in this packet) 1. 14. Termination of Eventa) If Organicfest organizers terminates this contract and/or the festival (or any part thereof), then organizers may retain part of an Organicfet vendor rental fee for expenses incurred up to the time such contingency shall have occurred and there shall be no further liability on the part of either party to the other. For purposes hereof, “cause or causes not reasonably within the control of event organizers” shall include, but not be limited to: fire, casualty, flood, epidemic, earthquake, explo-sion, accident, hurricane, tornado, governmental restraints, declaration of public emergency, strike, lockout, boycott or other labor disturbance, technical or other personnel failure, local, Provincial, or Federal, ordinances, rules, orders, or decrees.

15. Warranties a) The organizers of the Organicfest make no warranties beyond the terms and conditions of the Organicfest vendor contract.
