Vidyapeeth, Pohli, Sardhana Road, Sardhana, Uttar Pradesh presented the case of the appellant institution on 25/08/2017. In the appeal and during personal presentation it was submitted that ''The appellant is a renowned Educational Trust popularly ~nbwn as Shri Tirupati Educational Welfare Trust, Meerut and has an appreciable contribution in the promotion of general Professional Education in the District. The Trust is basically ~triving hard to start an additional Course in D.EI.Ed. in its existing College for the benefit of the students in and around the area and imparting quality Education for which all the ~.ecessary infrastructure and facilities as required under the NCTE Norms was constructed ",sing all the Financial Resources that were contributed by the Society/Trust Members. D.EI.Ed. course on the grounds that "The institution has yet not submitted the latest Non-

Encumbrance certificate issued by the Competent Authority indicating that the land is free

from all encumbrances. The submitted NEC is only up to the year 2011. Hence, the

Committee decided that the application is rejected and recognition/permission is refused u/s

1,4/15 (3)(b) of the NCTE Act, 1993. FDRs, if any, be returned to the institution."

'i'; AND WHEREAS Sh. Ankur Agarwal, Adm. Officer and Sh. Sandeep Nagar,

Accountant, R.I.E.T. Vidyapeeth, Pohli, Sardhana Road, Sardhana, Uttar Pradesh presented

the case of the appellant institution on 25/08/2017. In the appeal and during personal

presentation it was submitted that ''The appellant is a renowned Educational Trust popularly

~nbwn as Shri Tirupati Educational Welfare Trust, Meerut and has an appreciable contribution

in the promotion of general Professional Education in the District. The Trust is basically

~triving hard to start an additional Course in D.EI.Ed. in its existing College for the benefit of

the students in and around the area and imparting quality Education for which all the

~.ecessary infrastructure and facilities as required under the NCTE Norms was constructed

",sing all the Financial Resources that were contributed by the Society/Trust Members. That

the Shri Tirupati Educational Welfare Trust, Meerut has already sent the reply of SCN issued

dated 02/03/2017 on 07.03.2017 by speed post along with the relevant documents as desired

AND WHE I,EAS Appeal Committee noted that applicant institution already stands

recognised for con~ucting B.Ed. & D.EI.Ed. programme with an annual intake of 100 seats

each since the years 2009 and 2016 respectively. After submission of online application dateS

31.05.2016 seekinb recognition for additional intake of D.EI.Ed programme, a Show Caus~

Notice (SCN) dat~d 02,03.2017 was issued to appellant institution on grounds of 'non

submission of Lat,.t Non Encumbrance Certificate (NEC) for Khasra No. 1687.' Appellant il1

1submitted NEC dated 06.03.2011 which he understood to be the latest

. .~,...one as possessed by him. Appellant after noting the decision, taken by NRC to reject th~

application, in the 66th Meeting held from 21 5t to 24th March, 2017 sent another letter to NR;2

dated 04.04.20171 enclosing therewith a certificate issued by Sub Registrar, Sardhana

(Meerut) intimatind that there is no encumbrance found on Khasara No. 1687. The appellaot

also submitted co~y of this NEC before Appeal Committee otherwise found to be availabl~I

on the regulatory file. Appeal Committee, therefore, decided to remand back the case to NRCI :

for further processing of the applications. .H'

AND WHEkEAS after perusal of the memorandum of appeal, affidavit, documents

available on recorbs an~ considering the oral a~guments advanced during the hearing, th~

Committee conclu~ed that the appeal deserves to be remanded to NRC for further processing

Pradesh dated 22.05.2017 is against the Order No. NRC/NCTE/NRCAPP-15198/266th

Meeting (Part-2)/2017/170182 dated 03/04/2017 of the Northern Regional Committee,

refusing recognition for conducting B.Ed. course on the grounds that "V.T. visited the

institution on 11.05.2016. The institution refused for inspection. Accordingly, the institution

was given SCN dated 09.09.2016. reply submitted by the institution dated 15.02.2017 is

pot accepted."

AND WHEREAS Dr. Anil Kumar Gupta, Director, Edify Institute of BTC,

Shahzadpur, Pauri, Mathura, Uttar Pradesh presented the case of the appellant institution

on 25/08/2017. In the appeal and during personal presentation it was submitted that Sh.

Harsh Bhaskar, Chairperson of the society met with an accident on 10.05.2016 and was

~amitted in a Hospital. The mobile phone was also lost and so due to non communication

with the Inspection Team, Inspection could not be conducted."

AND WHEREAS Appeal Committee noted that the Visiting Team Members had

recorded an observation dated 19.05.2016 stating that "Chairman of Edify College Mr.

Harsh Bhaskar was informed on his Telephone No. 9412255438 that his college will be

inspected between 16th May, 2016 to 18th May 2016 but he disagreed for the Inspection."(:

AND WHEREAS since V'T. was able to communicate with Sh. Harsh Bhaskar and

~ould not get a positive response for inspection, the refusal order on the ground that\"";',Ipstitution refused for Inspection' is justified. Clause 7(7) of the NCTE Regulations, 2014

stipulates that inspection shall not be subject to the consent of the institution. Appeal

~ommittee, therefore, decided to confirm the impugned refusal order dated 3.4.2017

issued by NRC, Jaipur.

WHEREAS the appeal of Pandit Mahaveer Prasad Tripathi Mahavidyalaya,

Vijapur, Sadar, Uttar Pradesh dated 24.05.2017 is against the decision taken in 267th

Meeting by the Northern Regional Committee, to refuse recognition for conducting

D.EI.Ed. course on the grounds that "The applicant institution has not submitted the reply

of the SCN issued by the NRC on 02.03.2017 within the stipulated time. Hence, the

Committee decided that the application is rejected and recognition/permission is refused

u/s 14/15 (3)(b) of the NCTE Act, 1993. FDRs, if any, be returned to the institution."

"AND WHEREAS Sh. M. Chaturvedi, President and Sh. Sanjay Srivastava,

Representative, Pandit Mahaveer Prasad Tripathi Mahavidyalaya, Vijapur, Sadar, Uttar

'\pradesh presented the case of the appellant institution on 25/08/2017. In the appeal

and during personal presentation following documents were submitted:

Nac dated 04.01.2017 issued by Mahatama Gandhi Kashi Vidya Peeth,

Varanasi.

Affiliation letter dated 15.09.2014 to prove composite status.

Certified copy of land documents.

Building plan.

'; AND WHEREAS Appeal Committee noted that a Show Cause Notice (SCN) dated

02.03.2017 was issued to appellant institution seeking written representation within 21

days and the decision taken by NRC in its 267th Meeting held between 5th to 7th Appeal,

2017 to refuse recognition on the ground of non submission of reply by the appellant

institution was in haste. But never the less the appellant had submitted online application

on 27.05.2016 seeking recognition for B.EI.Ed. programme without obtaining Nac from

the affiliating body. Clause 5(3) of NCTE Regulation, 2014 provide that application shall

be submitted alongwith NaC issued by concerned affiliating body and clause 7(1) of the,',

AND WHEREAS Sh. Govind Acharya, Secretary and Dr. Ved Prakash Sharma,

Principal, Tagore Teachers Training College, Kekri, Tagore Nagar, Ajmer Road, Kekri,

H'Rajasthan presented the case of the appellant institution on 25/08/2017. In the appeal

c~md during personal presentation it was submitted that "NRC had not objectively

4:onsidered and appreciated the detailed reply submitted by appellant in response to

i\he show cause notice. The impugned decision is not sustainable for the reason that

appellant had submitted the Non-encumbrance certificate with its reply, however, for

online apPlicatio~ dated 13.06.2016 seeking recognition for grant of 4 year Integrate~

programme of B.A. B.Ed.! B.Sc. B.Ed. Appeal Committee noted that in the onlin~

application the najme of parent society i.e. 'Tagore Bal Niketan Samiti Kekri' has no whe~~,

been mentioned whereas the documents enclosed with the online application such asm....•. ,

certificate of Registration of Society and (ii) Land documents do mention the name 'of.if:,

Society. The appellant institution is already conducting B.Ed. and D.EI.Ed. programme~I .

recognised by the NCTE.

I . ~AND WHEREAS Appeal Committee noting that a reply to SCN was submitted by

appellant institutibn on,21.03.2017 has reason to believe that a SCN was issued which

otherwise could ~ot be located on the relevant regulatory file. The documents sUbmitte~

by the appellant ih reply to SCN were not considered to be satisfactory. Appellant duri~~

the course of apJeal presentation on 25.08.2017 submitted copies of Non Encumbran~~,.}

Certificate (NEC) and Land Use Certificate both dated 21.04.2017 issued by Tehsildar'

Kekri. The institution is already recognised for B.Ed. & D.EI.Ed. programmes and is

situated within t1e jurisdiction of Nagar Palika, Kekri. supports these documents. A,~regards certified G:0PYof land documents, the applicant IStime and agam enclOSing zerox

copy of the certifibd land documents instead of original certified land documents. Appe':l.l

Committee is of Jhe opinion that submission of zerox copy and not the original certifi~9

copy of land docJments alone in respect of an existing institution should not be held as,~I :.l\.

valid ground for refusal. .

AND WHJREAS Since the appellant institution has applied for 4 year Integrate:

course of B.A. BlEd.! B.Sc. B.Ed., it would have been more important for the Regional

Committee to hate verified whether the appellant institution is well equipped to fulfil the

condition laid doJn in para 1.1 of Appendix 13 of the Norms and Standards for the 4 year,

programme. If tht appellant institution can satisfy integrating general studies comprisin~.,

Science (B.Sc., B.Ed.) and Social Sciences or Humanities (B.A, B.Ed.) and profession?I,;

studies compriSi~9 foundation of education, pedagogy of school subjects and maintain?,

balance between theory and practice, the application may be processed further. With the

above observation the case is remanded back to NRC. Appellant institution is required to

submit to NRC, Jaipur original certified copy of land documents within 15days of the issue

of appeal orders.

AND WHEREAS after perusal of the memorandum of appeal, affidavit, documents

available on records and considering the oral arguments advanced during the hearing,

the Committee concluded that the appeal deserves to be remanded to NRC for further

processing of the application. Appellant institution is required to submit to NRC, Jaipur

original certified copy of land documents within 15 days of the issue of appeal orders.

'Ramprasad Bohara College, Buhana, Rajasthan presented the case of the appellant

institution on 25/08/2017. In the appeal and during personal presentation it was

C'submittedthat "We have applied LUCs regarding Khasra no. 2480/2171 and 2479/2171

:~'6ftotal land area 5000 sq. mtrs. but at the time of reply of show cause notice we had

(received LUC of 2500 sq. mtr. only which we submitted. LUC of another 2500 sq. mtr.

'was pending at that time. we will show the LUC for total 5000 sq. mtr. land at the time

of hearing. we have got 5000 sq. mtrs. of land converted with us."

AND WHEREAS Appe~1 Committee noted submission made by appellant with

ahd during personal presentation it was submitted that "By mistake our institution have

AND WHEREAS Appeal Committee, however, noted that appellant institution i.s

not affiliated for conducting degree course and thus apparently does not fulfil the

requirement of para 1.1. of Appendix 13 of the Norms and Standards for 4 year Integrated

programme which aims at integrating general studies comprising science (B.Sc. B.Ed)'ty

submitted that "The applicant Trust, submitted its online application for grant of recognition forI,'

the academic session 2016-17 on 30/05/2015 for D.EI.Ed. programme (ERCAPP3235) with an

annual intake for 50 (one basic unit) and for B.Ed. programme (ERCAPP3237) with annual intake:::.,of 100 (two basic units) as a composite institute in the name of "Indian Institute of Education"

under "Ankur Educational and Welfare Trust". Relevant documents and an application fee of

R,s.3,00,000/- (Rs. 1, 50,000/- each programme) by local courier. The application trust obtained

NOC from West Bengal Board of Primary Education and the University of Calcutta in the nameq(qf[the Institution" besides, all other relevant documents including building plan in favour of the(~; .i(:lstitution/trust. The applicant trust, in its reply dated 11/02/2016 against show cause notice

vide proceedings of 202nd Meeting held on 18th_23rd January 2016 by ERC, NCTE,

Bhubaneswar, submitted in its written submission alongwith relevant documents with a prayer

Q.~ consideration for both the applications, which was unfortunately not considered by ERC,c'"NCTE. The applicant trust, at the time of submitting online application was in possession of

3723.08 sq. mts. (92.734 decimal) of Land and 3553.75 sq. mts. of Built-up area in the name of

the institute "Indian Institute of Education" which satisfied the norms for composite institution as~"",prr NCTE Regulation, 2014. The applicant Trust, before its online application, having all('!:

Appeal Committee vide F.No. 89-168/2016 Appeal/7th Meeting-2016, dated 04/07/2016 filed by

one Dr. Grahams H1omes,Kalimpong, Darjeeling, West Bengal, wherein the case was remanded

back to ERC, NCTE with undermentioned observation/facts/ground: "... Committee further noted

the submission mabe by the appellant stating that land was allotted to the founder member o}.,

the society during +rlY years of last century. The appellant institution has furnished copy of lan~

title certificate issued by paying fee to District Sub-Registrar, Darjeeling, Certificates issued byI

Dist. Land & Land reforms officer and Non-Encumbrance Certificate issued by Block Land and

Land Reforms Officer, Kalimpong also support the fact that land is recorded in the name of

Kalimpong also suJport the fact that land is recorded in the name of Dr. Graham's Homes Board'

of Management. ~ppeal Committee is of the opinion that registered land documents does not

necessarily mean CIOpyof sale deed of land documents registered in the office of Registrar/Sub-

(22/03/2016) ultimJtelY refused both the applications for D.EI.Ed. (ERCAPP3235) programm~,I . }.and B.Ed. (ERCAP.P3237) Programme. The applicant trust submitted the facts that NCTE

issued public noticl dated 9th March 2016 inviting online application for the academic sessionI

2017-18, however it was also noted on the NCTE Public Notice that "In case of Tamil Nadu and

West Bengal the d~cision about restriction on the TE courses shall be taken on receipt of theI '

input of the respective State Govt." it is to be observed that the Government of West Bengal did

, not provide any relommendation to NCTE regarding ban for the academic session 2017-18.I

Hence, the applicaht Trust/Institute has lost the opportunity to file a fresh application for theI .

academic session 2017-18. The applicant Trust also submitted the facts that NCTE issuedI .

public notice deciding not to invite/accept applications for the academic session 2018-19 for'

grant of teacher tr~ining institutions/programmes, published in the NCTE website http://ncte-

india.org. Thus, thelAPPlicant Trust/Institute has lost all the opportunity to file a fresh application

for the academic se~sion 2018-19. The applicant trust affirms that "Indian Institute of Education"I

where the Hon'ble Appeal Committee considered many cases and reverted back the matter to

the ERC, NCTE for reconsideration, analogous to the Applicant Trust/Institution. The Applicant).;

,Trust/Institute had no other alternative but to file an Appeal under Section 18 of the NCTE Act

1'993, with clean hand before the Hon'ble Appeal Committee to save the future of the institute.

The applicant trust/institute thus seeks for reconsideration of the case with the provision for

remanding back to the ERC, NCTE for further processing of the applications."h

AND WHEREAS appellant requested for condoning the delay in preferring appeal as

secretary of the institution was seriously ill during the period. Appeal Committee decided to

dondone the delay an~ take up the appeal on its merits.

WHEREAS the appeal of S.G.R. Mahavidyalaya, Yaduvansh Nagar, Talgram, Uttar

Pradesh dated 31.5.2017 is against the Order No. NRC/NCTE/UP-3219/266th (Part-4)

Meeting/2017/171215 dated 13/04/2017 of the Northern Regional Committee, withdrawing

recognition for conducting B.Ed. course on the grounds that "letter from the District Magistrate,

Kannauj dated 28.09.2016 reveals that the CLU No. 578 dated 02.06.2005 submitted by the

institution is fake. The Committee, therefore, decided to withdraw the recognition of the institution

(or B.Ed. course under Section -17 of the NCTE Act, 1993 for the next academic session."

."., .AND WHEREAS Sh. Ajay Pal Singh, Chairman, S.G.R. Mahavidyalaya, Yaduvansh

~agar, Talgram, Uttar Pradesh presented the case of the appellant institution on 25/08/2017. In:.~

the appeal and during personal presentation it was submitted that "The Letter no 578 dated

02.06.2005 stated to be CLU is not a CLU and it has never been claimed to be. We had applied"S'eeking recognition of B.Ed. Course to the NRC NCTE Jaipur on 24.10.2008 The application

was rejected on the following grounds (i) Resolution of Panchayat regarding approving of

building plan not submitted (ii) CLU not submitted Consequently, we had approached to thef",fAppeal Committee vide Appeal dated 18.08.2009 at that point of time. The appeal committee

was shown the CLU issued by UP Sanchalak Chakbandi Kannauj on 15.05.2009. There after

~he appeal committee justifying the validity of the CLU dated 15.05.2009 remanded the case to ."NRC vide order dated 08.10.2009. In the appeal order the CLU was categorically discussed and

accepted. A copy of the same is again enclosed which is a verifiable fact. The Letter No, 578

dated 02.06.2005 was got issued by an employee working with us through his relative (who was,",,..."working) in ADM Office at that point of time. When we realized that the employee has cheated

us in the form of taking money and arranging fraud document we have sacked him. Infect the

~etter no 578 dated 02.06.2005 was not meant for B.Ed course at all, but due to my sickness

the same was attached with file submitted to the NRC NCTE Jaipur which consequently resultedVi:into rejection of our application and could be reconsidered only after the issuance of CLU datedt, "~'5.05.2009 submitted to the Appeal Committee. It is important to mention here that after"remanding our case to NRC an inspection was carried out and at that time also our file was

time also at the second time. The Appeal Committee again having observed the CLU is genuin~1

recognition was granted. Therefore, the reason/ ground of withdrawal of recognition is neither-c.

based on fact nor justified as the CLU is not the document stated in the Complaint letter nor

recognition was granted on the basis of the so-called CLU dated 02.06.2005. The above •.(,

explanation may please be considered and recognition be restored which is the demand of the>

justice."

AND WHEREAS Clause 7(3) of the NCTE Regulations, 2014 reads as follows: w"Furnishing any false information or concealment of facts in the application which m~¥

have a bearing on the decision making process or the decision pertaining to grant of recognitio~:

shall result in refusal of recognition of the institution beside other legal action against it~

management".

dAND WHEREAS Appeal Committee noted that impugned order of withdrawal dated

13.4.2017 was issued after giving the appellant due opportunity to submit a written representation

on the grounds on which it was proposed to withdraw recognition. Appellant institution submitted

its reply dated 20.3,2017. Appeal Committee further noted that whereas appellant has admitted

submitting to NRC a letter no. 578 dated 2.6.2005 purported to have been issued by the office 'of{:~

D.M. Kannauj as a change of land use certificate, the appellant has also stated that the letter was~.,~

obtained by an ex-employee of the institution through one of his relatives. The letter dated

2.6.2005 was admitted to be a forged document but it was not reckoned to be a valid document

for grant of recognition as the appellant had subsequently submitted another CLU date.?

15.5.2009 issued by Dy. Director, Chakbandi, Kannauj. Appeal Committee noted that the

appellant did not derive any benefit on account of a bogus CLU dated 2.6.2005 and has admitted.V

its mistake.

\i1AND WHEREAS Appeal Committee further noted that recognition for B.Ed. programme

was granted to appellant institution vide its order dated 18.2.2011 and the above order also makes

a mention in para 2 and 6 thereof that appellant institution has not submitted the change of land

use certificate initially. The CLU dated 20.6.2005 which was subsequently alleged to be bogus.and was also accepted by the appellant to be bogus was submitted by appellant institutio'ri

alongwith application dated 12.11.2008 by the appellant seeking recognition. Had this CLU dated

2.6.2005 been accepted by the NRC, recognition would not have been refused on this ground by

an order of NRC dated 25.7.2009. Appeal Committee further noted that after the case was

remanded vide NCTE order dated 8.10.2009, inspection of the institution was conducted orr

9.2.2010 and copies of documents enclosed with the inspection report include the CLU dated

15.5.2009 which is found to be valid document relied on for the purpose of grant of recognition .•

AND WHEREAS there is no doubt that there was a misconduct on part of the appellant

institution, but it is still felt that the disputed document was not made use of for grant of recognition

and appellant has apologised for the lapse on its part. The institution was recognised for

conducting B.Ed. programme in February, 2011 and the penalty to withdraw recognition by issue

of impugned refusal order 13.4.2017 is not proportionate to the admitted misconduct moreso

when the alleged document was not 'made use of for granting recognition.Gv

"j; AND WHEREAS Appeal Committee, therefore, decided to reverse the impugned

withdrawal order dated 13.4.2017.

AND WHEREAS after perusal of the Memoranda of Appeal, affidavit, documents on

record and oral arguments advanced during the hearing, Appeal Committee concluded to reverse<-

the impugned refusal order dated 13.4.2017.

Regulation 2014. In view the above, the committee decided as under: The committee is of the

o'pinion that application bearing code No. ERCAPP3237 of the institution regarding recognition

for B.Ed. is refused under section 14(3)(b) of NCTE Act, 1993."

AND WHEREAS Sh. Rafik Ali Khan, Representative and Sh. S.K. Golam Ehiya,

Secretary, Indian Institute of Education, Naul, Shyampur, West Bengal presented the case of.-'the appellant institution on 25/08/2017. In the appeal and during personal presentation it was

submitted that 'The applicant Trust, submitted its online application for grant of recognition for

the academic session 2016-17 on 30/05/2015 for D.ELEd. programme (ERCAPP3235) with an

annual intake for 50 (one basic unit) and for B.Ed. programme (ERCAPP3237) with annual intake.j~of 100 (two basic units) as a composite institute in the name of "Indian Institute of Education"f!" ,-under "Ankur Educational and Welfare Trust". Relevant documents and an application fee of

Rs. 3,00,000/- (Rs. 1, 50,000/- each programme) by local courier. The application trust obtained

NOC from West Bengal Board of Primary Education and the University of Calcutta in the name

of the Institution" besides, all other relevant documents including building plan in favour of the

institution/trust. The applicant trust, in its reply dated 11/02/2016 against show cause notice

v.ide proceedings of 202nd Meeting held on 18th_23rd January 2016 by ERC, NCTE,';j .

Bhubaneswar, submitted in its written submission alongwith relevant documents with a prayero~of consideration for both the applications, which was unfortunately not considered by ERC,,,-'-,

NCTE. The applicant trust, at the time of submitting online application was in possession of

3723.08 sq. mts. (92.734 decimal) of Land and 3553.75 sq. mts. of Built-up area in the name of

the institute "Indian Institute of Education" which satisfied the norms for composite institution as

per NCTE Regulation, 2014. The applicant Trust, before its online application, having all(" .

one Dr. Grahams Homes, Kalimpong, Darjeeling, West Bengal, wherein the case was remanded

back to ERC, NCTE with undermentioned observation/facts/ground: n ••. Committee further noted

the submission made by the appellant stating that land was allotted to the founder member of

the society during early years of last century. The appellant institution has furnished copy of land.

applied for the academic session 2016-17 with liberty to file an appeal to the Applicant Institution

as per NCTE Act, 1993. ERC, NCTE, after passing of 9 month 10 days (approx.) from the receipt

of the hard copies of the online application (12/06/2015) to issuance of rejection order/(s),

(22/03/2016) ultimately refused both the applications for D.EI.Ed. (ERCAPP3235) Programme'

and B.Ed. (ERCAPP3237) Programme. The applicant trust submitted the facts that NCTE.

issued public notice dated 9th March 2016 inviting online application for the academic session,;,~'oI.i .(.

2017-18, however it was also noted on the NCTE Public Notice that "In case of Tamil Nadu anq'lI

West Bengal the decision about restriction on the TE courses shall be taken on receipt of the

input of the respective State Govt." it is to be observed that the Government of West Bengal did

not provide any recommendation to NCTE regarding ban for the academic session 2017-18.

Hence, the applicant Trust/Institute has lost the opportunity to file a fresh application for the

academic session 2017-18. The applicant Trust also submitted the facts that NCTE issued'

public notice deciding not to invite/accept applications for the academic session 2018-19 for

grant of teacher training institutions/programmes, published in the NCTE website http://ncte-'.1.,india.org. Thus, the Applicant Trust/Institute has lost all the opportunity to file a fresh application''!'

for the academic session 2018-19, The applicant trust affirms that "Indian Institute of Education';'V

has diligently portrayed its true position of the land and building on the aforementioned address.

Hence the applicant trust submitted ,its prayer for condoning the delay and allows/reconsiders

the Appeal Application. The applicant trust found proceedings from internet (NCTE website),

where the Hon'ble Appeal Committee considered many cases and reverted back the matter to

the ERC, NCTE for reconsideration, analogous to the Applicant Trust/Institution. The Applicant

Jrust/I nstitute had no other alternative but to file an Appeal under Section 18 of the NCTE Act

1993, with clean hand before the Hon'ble Appeal Committee to save the future of the institute.

The applicant trust/institute thus seeks for reconsideration of the case with the provision for

remanding back to the ERC, NCTE for further processing of the applications."

AND WHEREAS Appellant requested for condoning the delay in preferring appeal as

secretary of the institution was seriously ill during the period. Appeal Committee decided to

condone the delay and take up the appeal on its merits.

AND WHEREAS Appeal Committee noted that rejection order is only on the ground that• i ~

\and documents are in the name of SK Golam Ehiya Le. in the name of individual which is not

~cceptable.' Appeal Committee noted that the name of Sh. Golam Ehiya is mentioned as

Education', the applicant had furnished following documents:

Change of Land Use Certificate dated 29.10.2013 issued by office of Sub Divisional

Land and Land Reforms Officer, Uluberia, Howrah.

Land Possession Certificate dated 28.05.2015 issued by Block Land and Land

Reforms Officer, Shymapur-II, Howrah .

Building Plan in the name of India Institute of Education approved on 22.05.2015 by

Nirman Sahayak, Nakole Gram Panchayat.

Building Completion Certificate dated 19.01.2016 issued by Asstt. Enginner, Howrah Zila

Parishad .

...AND WHEREAS Appeal Committee after going through the details of case does not have

any iota of doubt about the ownership of land which rests with the 'Indian Institute of Education'.

p}ppeal Committee, therefore, decided to set aside the impugned refusal order dated 22.3.2016

and remand back the case to ERC, Bhubaneshwar for further processing of the case.

WHEREAS the appeal of Sorabh College of Physical Teacher Training, Kheda,

Committee, refusing recognition for conducting B.P.Ed. course on the grounds that "The

institution has not submitted any proof 1 evidence to prove that it is a composite institution

as per clause 2(b) of NCTE Regulations, 2014. A major portion of the land in the

possession of the applicant institution was not in the name of the society 1 institution at

the time of the submission of the application for the proposed course.? Non-Encumbrance

Certificate is not related to the concerned land. Hence, the Committee decided that the

AND WHEREAS Sh. Surendra Sharma and Sh. Vishnu Sharma, Representatives,

Sorabh College of Physical Teacher Training, Kheda, Hindauncity, Rajasthan presented

the case of the appellant institution on 25/08/2017. In the appeal and during personal

presentation it was submitted that Appellant had applied for grant of recognition of

B.P.Ed. course vide its application dated 29.06.2016 while making necessary

a~rangements with regard to physical infrastructure and 'facilities. In the reply of Show

ekuse Notice, appellant had submitted relevant documents which would clearly show

that the observations made by NRC in its 262nd Meeting had been removed by appellant.

So far as observation with regard to proof / evidence of "composite institution" under

Clause 2(b) of NCTE Regulations, 2014 is concerned, it is stated that appellant is already

running M.Ed., B.Ed. and STC courses and thus it is running multiple Teacher Training

courses and it satisfies the eligibility of being a composite institution. Appellant had.-c~'

submitted Non-Encumbrance Certificate pertaining to land of institution which is/was,,: .ffisued by the competent authority. Thus, a wholly non-existent ground has been taken

by NRC while rejecting the application. A wholly invalid and unwarranted ground ofi '

AND WHEREAS Appeal Committee further noted that appellant institution also

submitted copy of a building plan approved by Sarpanch, Gram Panchayat at Kheda,

Jamalpur, Hindon City, Rajasthan. This building plan mentions only two khasra number

i.e. 951 and 953/2, Karavli Road, Kheda. Online application also has only these Khasra,"

numbers on record. Appeal Committee is of the view that land located at other khasra

number which were not mentioned in the application and also the land purchased by the

appellant society after submission of the online application have no relevance. Clause.",

8(4) of the NCTE Regulations says that 'No institution shall be granted recognition unless

the institutions or society sponsoring the institution is in possession of required land on

the date of application.' Obiviously the ownership of land is required to be checked with

Rajasthan presented the case ofthe appellant institution on 25/08/2017. In the appeal

and during personal presentation it was submitted that the order of rejection has been

passed behind the back of appellant without giving any opportunity of hearing. The order

0f refusal dated 21.09.2016 as also the very show cause notice dated 3.12.2015 is bad

a'ild without jurisdiction for the reason that the affiliating body for D.EI.Ed. Course, Le.

Director, Elementary Education, Bikaner had already conveyed its policy to respondent

NRC vide letter dated 21.08.2016. Thus, there was no occasion for NRC to reject

~~pplication of petitioner on the ground that NOC of affiliating body had not been

submitted. It is stated that while passing the refusal order dated 21.09.2016, NRC has

overlooked the communication dated 21.08.2016 and has thus passed an order in a veryi.'casual and unwarranted way and that too on a non-existent reason. It is stated that the

Mlow cause notice had never been received by the appellant and therefore it could not

f5~replied. The respondent-NRC must be put to strict proof regarding dispatch of show,."cause notice to appellant. The Hon'ble Rajasthan High Court as well as the appellate

WHEREAS the appeal of Sorabh College of Teacher Training, Gudasi Road,

the Northern Regional Committee, refusing recognition for conducting D.EI.Ed. course on

the grounds that "The institution was given show cause notice vide letter dt. 03.12.2015

with direction to submit the reply within 30 days. The institution did not submit any reply

of show cause notice within stipulated time."

AND WHEREAS Sh. Surendra Sharma and Sh. Vishnu Sharma, Representatives,

S'orabh College of Teacher Training, Gudasi Road, Sawaimadhopur, Sawaimadhopur,

Rajasthan presented the case of the appellant institution on 25/08/2017. In the appeal

and during personal presentation it was submitted that the order of rejection has been

passed behind the back of appellant without giving any opportunity of hearing. The order

of refusal dated 21.09.2016 as also the very show cause notice dated 3.12.2015 is bad

ahd without jurisdiction for the reason that the affiliating body for D.EI.Ed. Course, i.e.

Director, Elementary Education, Bikaner had already conveyed its policy to respondent

NRC vide letter dated 21.08.2016. Thus, there was no occasion for NRC to reject

~'pplication of petitioner on the ground that NOC of affiliating body had not been

submitted. It is stated that while passing the refusal order dated 21.09.2016, NRC has

overlooked the communication dated 21.08.2016 and has thus passed an order in a very...casual and unwarranted way and that too on a non-existent reason. It is stated that the

show cause notice had never been received by the appellant and therefore it could not

fJe replied. The respondent-NRC must be put to strict proof regarding dispatch of show

cause notice to appellant. The Hon'ble Rajasthan High Court as well as the appellate

8bdy in similar facts and circumstances have given relief to the institutions once such~~order had been passed by appellate body on 18.04.2017 in an appeal which had been

AND WHEREAS Appeal Committee noted that appeal made by appellant'I .

institution is delayed by more than 6 months and no reason was given by the appellantI

for this delay. Similarily, the appellant had not replied to the Show Cause Notice (SCN)~

dated 03.12.2015 ,and in the appeal Memoranda it is stated that SCN was not received'j ,

by appellant institution. Appeal Committee does not find on the regulatory file any

communication from the appellant institution ever since it submitted online applicationII

dated 30.05.2015 till the date of appeal, seeking any status enquiry of the case.I

IAND WHEREAS Appeal Committee further noted that appellant institution ..

submitted online alpPlication on 30.05.2015 and applied for NOC from the affiliating bodyI

30.06.2015. Ther~ was no NOC from affiliating body till the issue of letter datedI

15.04.2016 in which the State Government (Deptt. Of Primary Education) conveyed a}

list of 12 Districts where NOC was deemed to have been given to new private institutio'1I

for starting D.EI.Ed. programme. Swai Madhopur is one of the twelve districts where the.I

Department of Primary Education, Govt. of Rajasthan has no objection to the opening

AND WHEREAS Sh. A. Kumar Chaudhary, Director, Bhavnath Chaudhary College

of Education, Maganpur, Durgapur (Diwanganj) P.O. - Koora, Pindrajora, Chas,r.jharkhand presented the case of the appellant institution on 26/08/2017. In the appeal

&lhd during personal presentation it was submitted that "they had applied to Director(:

Primary Education Department of Human Resource Development of Jharkhand

Government to issue no objection certificate for opening D.EI.Ed. course vide their letter

dated 18.05.2016. It was mentioned that the last date of online application to NCTE is

31.05.2016. Though they had applied for NOC to the Jharkhand Government well in

advance but the NOC was issued by them vide letter 09.08.2016. So, this is not fault

from their side. The delay in issuance of NOC is not attributable to them which wasi'

course can condubt D.EI.Ed course which is the mandatory requirement. Their Institution

has the required infrastructure to conduct the two composite courses.". I

IAND WHEREAS the Committee noted that according to the provisions of Clause i

5(3) of the NCTE Regulations, 2014 a No Objection Certificate (NOC) issued by the'"I

concerned affiliating body shall be submitted along with the copy of the on-line

application. Sincei the appellant institution obtained the NOC only on 9.8.2016 i.e. after.'

the last date of 15.7.2016 for submission of hard copies of the on-line application, the,

21.01.2017 pointing out the various documents which the appellant did not submit. While

there is no reply to this show cause notice as such, the file contains a letter dt. 17.04.2017

s~nt by the appellant enclosing some documents. The appellant, in this letter made af,.lreference to the NRC's communication dt. 26.03.2017, which is not available in the file.!!i::

~:r AND WHEREAS the Committee also noted from the file of the NRC that the

gppellant sent a communication to the NRC on a Rs. 500/- stamp paper and attested by a

Notary, which was received in the NRC on 21.04.2017. In this communication, the appellant

Institute has already submitted the approved Building plan signed by the Govt. Engineer

thdicating the name of the course B.A. B.Ed. / B.Sc. B.Ed. Khasra no. 2880, 2905,

3450/2905, totallan'd area 1.6 acres 6747 sqm. total build-up area 3184.34 s.q.m. and

frldicating the measurement of the multi-purpose hall as well as the other infrastructure

facilities such as class rooms etc. The institute has already submitted the non-

Encumbrance Certificate Issued by the Sub. Registrar, Tehsil Girva, Udaipur and

i'ridicating that the land is free form all encumbrances. The appellant with the appeal,

enclosed a copy of the Non-Encumbrance certificate dt. 07.04.2017 issued by the Sub-

the appellant institution on 26/08/2017. In the appeal and during personal presentation it was

submitted that "the Appellant had already applied for two Units vide Letter Dated 23 02 2017"

and thereafter vide Letter Dated 15032017. The Appellant had also applied to the Member

institution has submitted a list of one HOD and seven faculty members, decided to grant

recognition for one unit of D.EI.Ed. In these circumstances, the Committee concluded that the. ~

WRC was justified in granting recognition for one unit of D.EI.Ed. with an intake of 50 student~

and therefore, the appeal deserved to be rejected and the order of the WRC confirmed. ~""~;-'

AND WHEREAS the Committee noted that the appellant, with their reply to the Letter

of Intent enclosed minutes of the Section Committee for the teaching staff, in which the

Principal of Institute of Advanced Study in Education, Bhopal was a representative of th~

SCERT. The Committee also noted that the same representative has signed the statement

of staff profile. There is no formal approval of the concerned affiliating body to the faculty,recommended by the Selection Committee. In these circumstances, the Committee\:concluded that the WRC should immediately obtain from the appellant, the approval of ttie

Girls (P.G.) College, Jhunjhunu, Rajasthan presented the case of the appellant institution on

26/08/2017. In the appeal and during personal presentation it was submitted that "this college

i.~running U.G. & P.G. courses since 1982. This institution has applied for grant of recognition

. for B.A.B.Ed.lB.Sc. B.Ed. course online on 30.05.2016 and the hard copy of application was

submitted to NRC, NCTE on 10.06.2016. The NRC, NCTE has issued a show cause notice

i.pdicatingcertain deficiencies on 03.03.2017. This institution has submitted a reply of SCN

along with all required documents to NRC, NCTE on 17.03.2017. The NRC, NCTE hasI',

~~jectedthe application of this institution without considering the documents submitted by this

institution. 36700 sqm. of land of khasra No. 4381/1543 and 4382/1544 situated in village

D.P.Ed. as per NCTE Regulations. (b) In reply to SCN, the institution submitted its reply

vide letter dated 02.12.2016 received in ERC, NCTE on 09/12/2016. The ERC considered

the reply of the institution and obserVed that the institution is still deficient on the following

grounds:- (i) As per VT Report, the total built-up area was only 2150 sq. mts. (ii) Now,

the institution submitted photocopy of building plan of existing hostel building (Block-C),.,mentioning total built-up area 1368.26 sq. mts. out of which Ground floor having 684.13

~. mts. built-up area which was constructed after the inspection and the same is not

~:ccepted by the Committee. (iii) As per NCTE Regulation 2014, there is no provision for

re-inspection of the institution. In view the above, the Committee decided as under: The

Committee is of the opinion that application bearing code No. ERCAPP2362 of the

~~stitution regarding permission of D.P.Ed. Programme is refused under section 15(3)(b)

of NCTE Act 1993."

AND WHEREAS Sh. Manish Kumar, Jt. Secretary, Tirhut College of Physical

E;ducation, Jhaphan, Bochahan, Bihar presented the case of the appellant institution onr'

2:()/08/2017. In the appeal and during personal presentation and in a letter dt.

24.08.2017, it was submitted that liThe applicant institution is running B.P.Ed. course

with the permission of ERC. As required under NCTE Regulations, 2014, with a view to

rliake the institution composite" they applied for D.P.Ed. course. The building of the

institute comprising of Block A, Band C sanctioned by the competent authority provides

Certificate dated 11.02.2014 in respect of total built up area of the building i.e'. 52391.~~1" ,

Sq. Ft. which is equivalent to 4867.28 Sq. Mts. Thus, the applicant has the built-up area,1, ~.I

of 4867.28 Sq. MtiS.from 11.02.2014 itself. A copy of the sanctioned building plan andI '

building completion certificate are attached. It is evident from the sanctioned building ..•.

plan and building completion certificate, that the applicant has more than sufficient built~

up area much prior to even submission of application seeking recognition for D.P.Ed.I

course. Thus, the iERe was neither justified in issuing show cause notice nor justified in.,r

refusing recognitidm on the grounds mentioned in para 4 b of the refusal order datedR;

13.04.2017. Further, it is submitted that the applicant institution has all the necessary~

infrastructure for the sports i.e. 400 mts. standard track, football, hockey, volleyballN

Kabaddi, Kho Kho, Basketball, badminton, table tennis, ground and equipment etc.I .

Thus, the applicant institution has all the physical and academic infrastructure for running,,,,i '

DP Ed. course. Thus, the Applicant is entitled for recognition for running D.P.Ed. course

and the order dated 13.04.2017 of ERC deserves to be set aside."

AND WHE~EAS the Committee noted that the Visiting Team, who were als.qI

supplied with a copy of the building completion certificate dt. 11.02.2014, to which .~

reference has been made in the appeal, in their report, recorded that after physicC!,1;

measurement, the total built up area was 2150 sq. mts. (Block 'A'-1150 sq. mts + Block

'B'-1000 sq. mts). :The VT also suggested that the building plan and building completiolJ,!

certificate are required to be analysed by the ERC for taking necessary decision., .

AND WHEREAS the Committee also noted that the appellant, in response to the

decision taken by the ERC in the 206th meeting held on 26-27 February, 2016 to issue. .~

a show cause on the ground that the built up area of 2150 sq. mts reported by the VT is ~I

inadequate for B.P.Ed. and D.P.Ed. course as per NCTE Regulations, sent a letter dt. .:;I ~tl

29.02.2016 to the ERC. In this letter, the appellant submitted that the College decided

to allocate ground floor with a built up area of 684.13 sq. mts of the proposed hostel of";'.1

two floors, as no admitted students turned up for accommodation in the hostel. The",

appellant also suqmitted in this letter that building construction on full covered area of

built-up area of 4867.28 sq. mts from 11.02.2014 itself i.e. the date of issue of building

completion certificate.

AND WHEREAS the Committee, noted that there are apparent contradictions

between the submissions made in the appellant letter dt. 29.02.2016 and the appeal dt.

02.06.2017 and the VT reported availability of only 2150 Sq. mts on physical

measurement. In these circumstances, the Committee concluded that to get a clear and

authentic picture about the availability of built up area for the existing B.P.Ed. and the

proposed D.P.Ed. courses, the matter deserved to be remanded to the ERC with a

direction to get the institution re-inspected on payment of the prescribed fee by the

appellant, and take further action as per the NCTE Regulations, 2014.

26/08/2017. In the appeal and during personal presentation it was submitted that "the

if1lstitution was ready to conduct inspection but at that time, the on-going Assembly

Elections in West Bengal were held during that period. The State Election Commission

Highly alerted the area where their college is situated as sensitive. The agitated people

~Iosed the road on their political issues. So, the VT members did not agree to inspect

WHEREAS the appeal of Tarapada Dey Educational Institution, Srirampur,

Nabadwip, W.B. dated 30.05.2017 is against the Order No. ERC/236.8.6 (Part-

1I)/ERCAPP2855/D.EI.Ed./2016/52121 dated 05/04/2017 of the Eastern Regional

Committee, refusing recognition for conducting D.EI.Ed. course on the grounds that "a.

Show cause notice was issued on 23.12.2016 on the following grounds:- (i) Inspection

to the institution as well as letter to VT experts was issued on 09.04.2016. (ii) Dr. U.N.

Singh, VT expert vide letter dated 22.04.2016 reported that in spite of their sincere efforts.1'

!o get the inspection conducted, the institution did not agree to get the inspection on the

pretext of ongoing Assembly Election in the State of West Bengal. (iii) The Committee

noted that at the time of issuance of Inspection letter, the institution was not ready for

,?,onducting the inspection. (iv) As per NCTE Regulations 2014, inspection of the

institution is not conducted as per the consent of the institution. b. In response, the

institution vide reply dated 26.12.2016 (one the basis of proceedings uploaded in ERC

website) has requested for inspection of the institution, which is not accepted by the

0;ommittee. In view the above, the Committee decided as under: The Committee is of

the opinion that application bearing Code No. ERCAPP2855 of the institution regarding

recognition of D.EI.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993."

e: AND WHEREAS Sh. Nirbhik Dey, Secretary, Tarapada Dey Educational

Institution, Srirampur, Nabadwip, W.B. presented the case of the appellant institution on

26/08/2017. In the appeal and during personal presentation it was submitted that "the

il')stitution was ready to conduct inspection but at that time, the pretext on going,.~ssembly Election in West Bengal were held during that period. The State Election

Cbmmission highly alerted area where their college is situated as sensitive. The agitated

p:eople closed the road on their political issues. So, the VT members did not agree to

AND WHE~EAS the Committee noted from the file that while an inspection has not

been conducted [at all, there have been allegations against the institution by the VIimembers nominated for the inspection and counter allegations by the appellant institution

against the VT mbmbers. However, to get a clear picture about the preparedness of th~

appellant instituti~n to conduct the proposed course, the Committee concluded that th~. l:J"

matter deserved to be remanded to the ERC with a direction to get the institution.~~

AND WHEREAS Sh. Ramphool Choudhary, Secretary, Sunder TT College,

Mahapura, Jaipur, Sanganer Rajasthan presented the case of the appellant institution on

t~at they submitted their on-line application on 27.05.2016 and thereafter they did not

feceive any information.

AND WHEREAS the Committee noted that the file of the NRC does not contain

any show cause notice issued to the appellant institution. Further, the reply dated

27.4.2017 stated to have been considered before reusing recognition (as mentioned in

the order) is also not to be found in the file. In these circumstances, the Committee

ooncluded that the matter deserved to be remanded to the NRC with a direction to re-

institution does not respond to the above queries."

,\' AND WHEREAS Sh. Ram Sunder Pandey, .Founder, Ram Tej Bhagauti Prasad

Mahavidyalaya, Village - Dharsawan, Distt. - Bahraich, Uttar Pradesh presented the case of

the appellant institution on 26/08/2017. In the appeal and during personal presentation it was? "submitted that "the SCN was not received by the institution till today. Therefore, no reply SCN

~?s been sent. It is impossible to reply SCN dated 12.12.2016 by the so-called reply letter

~?ted 24.11.2016 mentioned in refusal order. The letter dated 24.11.2016 sent by the

ipstitution is related with the registration and bye-laws of the institution, which was sent during

checking of file and giving oral direction/order by the section officer at NRC office Jaipur. The

grounds mentioned in refusal order regarding not matching of land/plot number are due to

ehakbandi process in village Dharsawan. Gata No. 114 etc, of sale deed are old numbers

before Chakbandi and Gata No. 1859, 1861/1862/2 of Khatauni are new number after

Chakabandi process. The certificate of Chakbandi officer regarding this concern and the

~farmarked building plan is already attached in the file in process at NRC, Jaipur. Thesel .~

institution on 26/08/2017. In the appeal and during personal presentation it was submitted

tnat "this college is running U.G. & P.G. courses since 1994. This institution has applied

fOr grant of recognition for B.A. B.Ed.lB.Sc. B.Ed. course online on 30.05.2016 and the

hard copy of application was submitted to NRC, NCTE on 03.06.2016. The NRC, NCTE

has issued a show cause notice indicating certain deficiencies on 24.02.2017. That this

i'ristitution has submitted reply of SCN along with all required documents to NRC, NCTE

on 16.03.2017. The reply of SCN submitted by this institution was updated on NCTE

Portal on 21.03.2017, in which it is stated that as per land document Land is on private

lease basis which is not accepted as per Regulations 2014. Copy of status report of their

Mohammadabad Gohana, Mau, Uttar Pradesh dated 25.05.2017 is against the Order No.

NRC/NCTE/NRCAPP-13833/260th Meeting/2016/162564 dated 30/11/2016 of the

Northern Regional Committee, refusing recognition for conducting D.EI.Ed. course" on the

grounds that "as per VT report the institution has 2395 sq. mts. only. The reply submitted

in response to the show cause notice of NRC, NCTE dt. 10.02.2016 is not acceptable."

AND WHEREAS Sh. Ajit Kumar Singh, Chairman, Ram Naval Singh Smarak

rylahavidyalay, Bhikhampur-'-.Mohammadabad Gohana, Mau, Uttar Pradesh presented the

case of the appellant institution on 26/08/2017. In the appeal and during personal

p+esentation and in a letter dt. 26.08.2017, it was submitted that "as per VT report the

i;Hstitution has 2395 sq. mts. only. NRC failed to observe that the appellant has also

s'ubmitted the separate building Completion Certificates for the B.A. & B.Ed. and D.EI.Ed.

course. The expert visit team conducted the visit of the Appellant institution for the

D.EI.Ed. course only and they have only taken the documents in respect of the D.EI.Ed.

course because impugned order is bad in law because the LOI could not had been issued

ifthe appellant had not satisfied because the SCERT also conducted its visit and granted

the affiliation to the petitioner institution after verifying the infrastructural facility. The

~~pellant, in their letter dt. 26.08.2017 submitted that in response to the show cause.\4

ri'otice decided upon by the NRC in their 250th meeting held on 26-27, February, 2016 on

the ground of inadequacy of built up area, he sent a reply on 01.03.2016, which was

received on 03.03.2016.

AND WHEREAS the Committee noted that the NRC in the first instance in their

lKrder dt. 2.5.2016 granted recognition to the appellant institution for conducting D.EI.Ed.

SQurse with an intake of 100 students. Subsequently, the NRC in their corrigendum dt.

~i;:6.2016 deleted the names of certain institutions, including that of the appellant\ ~"".

institution, from th1eirrecognition order dt. 2.5.2016 as they decided to issue show caus~I

notices to them. NRC issued a show cause notice to the appellant institution on 10.6.2016, '. ,

on the grounds th~t the total built-up area in the possession of the institution is only 2395;

Sq.mtrs. which i$ just sufficient to run the existing B.Ed. course of two units. TheI

Committee notedl from the file that the appellant sent replies to the show cause notice

twice, one dated 1.7.2016, which was received on 6.9.2016 and another of the same datei ' ,

which was received on 5.10.2016. The Committee noted that the file of the NRC does nat

indicate the consideration of the replies submitted by the appellant and the building, "

completion certificates enclosed by them. In these circumstances, the Committee

concluded that the matter deserved to be remanded to the NRC with a direction to

consider the repllies of the appellant to the show cause notice dt. 10.6.2016 and take

further action as per the NCTE Regulations, 2014.,II

, WHEREAS the appeal of Swami Shivendrapuri Sanskrit Mahavidyalaya, Belauna

Kala, Mariyahu, Jaunpur, Uttar Pradesh dated 17.04.2017 is against the Order No.

NCTE/NRC/NRCAPP201616316/Bachelor of Elementary Education [B.EI.Ed.]/UP/2017-

18/2 dated 15/03/2017 of the Northern Regional Committee, refusing recognition for

conducting B.EI.Ed. course on the grounds that "SCN was issued to the institution on

~5.02.2017. The reply received on 21.02.2017 in the office of NRC was considered andc

the following observations were made:- A letter from the Registrar of the affiliating

University dated 22.05.2016, clearly states that land, building & other resources being

l:Jsedfor Shastri course shall not be used for the proposed B.EI.Ed. course. This implies

that the applicant institution is not a composite institution Hence, the Committee decided

(hat the application is rejected and recognition/ permission is refused u/s 14/15 (3)(b) of

the NCTE Act, 1993."

AND WHEREAS Sh. Ashim Duney, Secretary and Sourabh Dubey, Member,

Swami Shivendrapuri Sanskrit Mahavidyalaya, Belauna Kala, Mariyahu, Jaunpur, Uttar

Pradesh presented the case of th;e appellant institution on 26/08/2017. In the appeal and

during personal presentation it: was submitted that 'The applicant institute Swami.•..8hivendrapuri Sanskrit Mahavidyalay, Belauna kala, Jaunpur, U.P. has extra land andI>

Building for B.EI.Ed. course as per norms beside Shastri course infrastructure and

Governing trust has passed a resolution for same. In reference with same the Registrar,

Sampoornanand Sanskrit University Varanasi has issued a new letter no. G 1169/17 Dt.

19/03/2017 with approval of Vice- Chancellor stating the above mentioned fact that

proposed course may be conducted in the extra space available in the college premises

for which university has no objection. So kindly taking into notice the newly added fact

p1ease reconsider our application and grant us the recognition of proposed B.EI.Ed.~";

AND WHEREAS the Committee noted that the Sampurnand Sanskrit University,I •

Varanasi has giveh a new letter dt. 19.3.2017 conveying their No Objection for conductin"~,the proposed B.ELEd. course in the land and building available in the complex. Since the

objection raised by the NRC in their refusal order has been met, the Committee concluded

that the matter dekerved to be remanded to the NRC with a direction to consider the lett~t ,:.

of the university ~ated 19.3.2017 and take further action as per the NCTE Regulation~fI ••

2014. The appellant is directed to forward a copy of the university's letter dt. 19.3.201 V,,

submitted in appeal to the NRC within 15 days of receipt of the orders on appeal.II

IWHEREAS the appeal of Maa Rewathi College of Education , Mandla, Madhya, .

Pradesh dated 16.2.2017 agai~st the order no. WRC/NCTE/APP3118/254th/D.EI.Ed.

'(MP)/2016/169556 dated 20.6.2016 of the Western Regional Committee granting

.recognition for one unit of D.EI.Ed. programme whereas the application was for seeking

two units of D.EI.Ed. programme.

AND WHEREAS Sh. Abhishek Chobey, Representative, Maa Rewathi College of

Education, Mandla, Madhya Pradesh presented the case of appellant institution on

4.5.2017. In the appeal and during personal presentation it was submitted that "we have

sufficient built up area and given 1+15 staff profile for two units of D.EI.Ed. course".,

.r,~ AND WHEREAS Appeal Committee noted that appeal made by appellant is for

9,rant of recognition for two units of D.EI.Ed. programme where as the impugned

recognition order is for granting recognition for one unit (50 seats).

AND WHEREAS Appeal Committee noted that inspection of the appellant institution wasr-conducted on 19.11.2015 with a proposed intake of one unit of D.EI.Ed programme.

Appeal Committee noted that the Visiting Team had made certain adverse observation's

fi1 the report such as:

tv i) The location of the buil?ing did not match with the description given in the land

document.

ii) The existing building did not match with the approved building plan which has

been submitted to WRC.

iii) The building shown to Visiting Team by the management has eight

classrooms, four labs, one seminar room, common room, one multipurpose

hall with tin roof.

iv) Furniture and equipment did not have identification mark as per stock register.. !

AND WHEREAS Appeal Committee further noted that appellant institution was" .,J

issued a Show Cause Notice (SCN) dated 23.12.2015 but the adverse remarks made by

V.T. were not Communicated to the appellant. Appeal Committee further noted that basec:l

on an order of Hon'ble High Court dated 23.11.2015, WRC opted to process thpt

applications and issued a Letter of Intent (LOI) dated 26.04.2016 to the appellaBt'...•..;.

institution for D.EI.Ed. programme with an annual intake of 50 students. It is doubtful;':'{,

whether the adverse findings of the Inspection Team were ever brought to notice of

Hon'ble Court. As location of land and building itself did not match with the submitted

documents, there was no sanctity to find out whether the infrastructure is suitable since

a part of the structure was having tin roof also.

AND WHEREAS appellant during the course of appeal presentation stated th~t:

appellant institution is at present recognised for conducting 2 units of B.Ed., one unit of'.~.

BA. B.Ed. and one unit of D.EI.Ed. programme and built up area of 4034 Sq. Meter~~:

Appeal Committee, before taking a decision on the appeal filed by appellant, decided to

get a composite inspection for all the teacher education programmes applied for and

being conducted by the appellant institution strictly restricting the inspection to the land

and building for which documents were submitted. Report of the composite inspection

report has now been made available to the Appeal Committee.. .

AND WHEREAS Appeal Committee noted that the submission made by appellant\

seeking two units of D.EI.Ed. programme as against the one unit for which recognition'

was granted on 20.6.2016, is primality on two grounds i.e. it has sufficient built up area

and has given staff profile for two units". Appeal Committee further noted that impugned

recognition order dated 20.6.2016 does not specify any deficiency on the above grounds

and also does not mention any other reason for recognising only one unit and not two as

applied for by the appellant institution. :-~AND WHEREAS Appeal Committee further noted that the visiting team in iff

. ,inspection report dated 19-20 August, 2017 intimated that the institution is in possession ..'

of land measuring 4000 sq.mtrs. and a built up area of 4034 Sq.mtrs. The specifications

of land and built up area are the same as were mentioned in the affidavit submitted by

appellant at the time of applying 'for the programme. Appeal Committee further noted that

appellant institution on getting the LOI dated 26.4.2016 for one unit immediately wrote

back to WRC that it had applied for two units and LOI should accordingly be modified for

two units. WRC without intimating any reason for not giving two units, issued impugned

recognition order granting recognition for conducting one unit of D.EI.Ed. programme.

AND WHEREAS Appeal Committee considering that impugned recognition order

is devoid of any reason for not granting two units, decided to remand back the case to

WRC for issue of a speaking order disposing of the request made by appellant vide its

letter dated 26.4.2016 seeking modification in the LOI. The case is accordingly remanded

back to WRC for revisiting the case.

AND WHEREAS after perusal of the Memoranda of Appeal, affidavit, documentsfion record and oral arguments advanced during the hearing, Appeal Committee concluded

to remand back the case to WRC for revisiting its decision to grant only one unit of

D.EI.Ed. progamme.

NOW THEREFORE, the Council hereby remands back the case of Maa RewatiCollege of Education, Jantipur Road, Badi Khairi, Mandla, Madhya Pradesh -481661 to the NRC, NCTE, for necessary action as indicated above.
