MINUTES Thornbury Township Board of Supervisors Public Meeting Wednesday, October 7, 2020 The Thornbury Township Board of Supervisors held a Public Meeting, Wednesday October 7, 2020, via Teleconference, hosted at 6 Township Drive, Cheyney PA. Chairman Kelly called the meeting to order at 7:03 p.m. with a salute to the flag.

Chairman Kelly announced that that the Board previously held a brief Executive Session this evening regarding legal matters in real estate.

APPROVAL OF CHECK REGISTERS On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the General Fund check register in the amount of $320,689.73, for the period September 17, to October 7, 2020, was approved. Chairman Kelly called for comment. There was none. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $17,096.02, for the period September 17, to October 7, 2020, was approved. Chairman Kelly called for comment. There was none. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Escrow Fund check register in the amount of $600.00, for the period September 17, to October 7, 2020, was approved. Chairman Kelly called for comment. There was none. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the State Fund check register in the amount of $32,499.00, for the period September 17, to October 7, 2020, was approved. PARKS & RECREATION No one from Park & Rec was in attendance. Jeff Seagraves mentioned their upcoming Pumpkin Pick-Up, the Children’s Fishing Derby and a Drive-In Movie. HISTORICAL COMMISSION

Ric Miller reported on several items, the Properties studies are ongoing, two having been delivered, the third is being proofed the fourth and fifth are upcoming. He also mentioned the installation of the interpretive panels and the artwork for the wayside signage. Chairman Kelly complimented Ric’s new barn color. The Board thanked Ric. PLANNING COMMISSION No one from Planning was in attendance. Jeff mentioned the Sleighton School Subdivision and Mike Ciocco detailed that.

SEWER ADVISORY COMMITTEE Ted Jacquet had nothing to report. The Board thanked Ted.

ENVIRONMENTAL ADVISORY COUNCIL

No one from EAC was in attendance. Jeff mentioned the recent tree pick-up. LIBRARY BOARD Jean Mackenzie’s report was submitted and is attached. She mentioned their schedule and also mentioned the Ballot box installation. Lastly, she mentioned working on their exterior and their annual appeal letter will be going out soon. AGENDA ITEMS Ken Kynett reported on a Mortgage Satisfaction at 3 Elaine Drive. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the execution of the Mortgage Satisfaction Piece for 3 Elaine Drive by the Township Manager, was approved. Chairman Kelly called for comment. There was none.

Mike Ciocco reported on the Emergency Stormwater repair contract at Martin Park. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously ratifying the Martin Park Emergency Stormwater Repair contract with Steve Botella Construction & Excavation, Inc., for a total amount not to exceed $15,780.00, was approved. Chairman Kelly called for comment. Sheri was glad it was completed before the Fishing Derby. Mike Ciocco reported on the Emergency Road Repair Contract with A.F. Damon. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, payment for the Emergency Road Repair Contract with A.F. Damon, Inc., in the amount of $32,400.00, for the roadway at Old Gradyville and Slitting Mill Roads, as recommended by the Township Engineer, was approved. Chairman Kelly called for comment. There was none.

Chuck Faulkner reported on payment #3, for J.P. Smith Contractors. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, payment #3, for J.P. Smith Contractors, Inc., in the amount of $20,186.88, for the Equalization Tank Rehab Contract # 2020-02, was approved. Chairman Kelly called for comment. There was no comment.

Jeff Seagraves reported on advertising the preliminary 2021 budget. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, authorizing the advertising of the Preliminary Annual Township Budgets for fiscal year 2021, was approved. Chairman Kelly called for comment. There was none. Jeff Seagraves mentioned work being done at the Locksley Road Whistle-stop. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the proposal from Collinson, Inc., for the new Guide Rail Installation at the Locksley Road Whistle-stop, in the amount of $6,000.00, and also a contribution to the West Chester Railroad for structural repairs, in an amount not to exceed $3,900.00, were approved. Chairman Kelly called for comment. There was no comment.

Jeff Seagraves mentioned the annual Chester County Tax Collection Committee meeting. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, authorizing Jeff Seagraves to represent Thornbury Township Delaware County, as Voting Delegate at the annual meeting of the Chester County Tax Collection Committee, and approve our portion of the budget which is $342.17, was approved. Chairman Kelly called for comment. There was no comment. PUBLIC COMMENT Ric thanked the Board for the work being done at the whistle-stop and then mentioned the speeders on Dilworthtown Road are still running the stop signs. STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeff Seagraves

Jeff reported we plan to schedule the Fire Company and Rachel Kohl Library contributions for our meeting October 21, 2020. The Board of Supervisors approved making the contributions in the amounts approved in the 2020 budget. They are included in the check register from this meeting. Jeff requested that the Board of Supervisors approve a reduction in the rent payment for the Thornbury Preschool. They are currently operating at half capacity due to social distancing requirements related to the Corona Virus. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, a reduction in rent for the Thornbury Pre-School, for the duration of the Pandemic was approved. Chairman Kelly called for comment. There was no comment. Sheri agreed that this is a good thing because they provide a great service for our community. Chairman Kelly asked Ken to look into making it retro-active, as per Ric’s suggestion. We received a proposal from Chris Hauser for painting at the Township Building. We completed an inspection of the building and are recommending this be done this fall. Mr. Hauser provided a verbal quote of $9,975.00. We would recommend approval of this proposal. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the proposal from Chris Hauser Painting for the work to be done at the Township Building at a cost not to exceed $9,975.00, was approved. Chairman Kelly called for comment. There was no comment.

Minutes – Board of Supervisors Public Meeting – October 7, 2020 4 There is a Zoning Hearing scheduled for Monday October 12, 2020 for a dimensional variance for a deck at 42 Cherrydale Rd. We held a Movie Night and fireworks on Friday September 25. The Movie was “The Princess Bride”. The movie was well attended. The Park and Recreation board has recommended we do another event so we have scheduled Friday October 30, 202 for another movie. Jeff testified in a hearing before Judge Barnes in regards to the Flynn v. Sunoco proceedings before the PUC. Thornbury Township is an intervenor and he testified on the Township’s behalf. Sunoco is nearing completion of work on the Mariner East pipeline project in Thornbury Township. We have approved the substitution of a particular cherry tree. Jeff notified Andover HOA of the request on September 22, 2020, but to date have not received a response. Jeff approved the substitution as Sunoco indicated that they may not do any replanting unless they were able to complete the entire job. We anticipate their completion before the end of the calendar year. Jeff met with Cebele Rodriquez, from Delaware County, regarding the location of the ballot box which was approved by the Board of Supervisors. Ms. Rodriquez sent an email indicating that “the location the county selected for the ballot box was not suitable”. Jeff asked them to reconsider and offered several alternatives with the hope that we can have one placed at Thornbury Park. We are awaiting a response. We have the Annual Children’s Fishing Derby scheduled for this Saturday October 10, 2020 at Martin Park. This is one of the few activities we are able to hold as social distancing will not pose a problem. We have sent emails to Mike Ryan of the Argus Group regarding the status of their project at 183 Locksley Road. We have a conditional use hearing scheduled for Wednesday October 21, 2020. In his last communication with the township, on August 19, 2020, Mr. Ryan indicated that they intended to submit revised plans but we have not received any new plans as of today. We received notification from Wind River Environmental that they purchased Franc Environmental our sludge hauling contractor. Wind River sent a request for written consent from us to approve the change in assignment of the contract. Jeff spoke with a representative of Wind River to verify that there would be no changes to our service. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the assignment of the existing contract with Franc Environmental, Inc., to Wind River Environmental, LLC., for Liquid Sludge Removal and Disposal at the Thornbury Township Wastewater Treatment Plant, was approved. Chairman Kelly called for comment. There was no comment. Lastly, Jeff mentioned Locksley Road will be closed tomorrow from Dylan Court to Cheyney Road and we received notice from Adelphia Gateway will be proceeding with work on the valve station at Locksley Road. Chairman Kelly asked for clarification on the Ballot Box placement. Jeff confirmed that it is subject to the County’s approval. The Board thanked Jeff. TOWNSHIP ROADMASTER’S REPORT – Art Risley The Roadmaster’s report was submitted and is attached. Art was not in attendance. TOWNSHIP SOLICITOR’S REPORT – Kenneth Kynett, Esq. The Township Solicitor’s Report was submitted and is attached and Ken had nothing to add.

TOWNSHIP ENGINEER’S REPORT – Mike Ciocco, PE

The Township Engineer’s Report was is attached submitted. Mike mentioned activity on the Rain Garden this week. The Board thanked Mike.

Chuck received a draft copy of the NPDES Permit renewal for the treatment plant and everything has stayed the same and will be advertised for 30 days. Jeff mentioned our inspections and said we are looking into illicit connections. The Board thanked Chuck.

MANAGER’S REPORT

10-7-2020

3. We have been in contact with Megill regarding the items that need to be addressed for dedication. Megill intends to complete final paving this month.

4. We received a proposal from Chris Hauser for painting at the Township Building. We completed an inspection of the building and are recommending this be done this fall. Mr. Hauser provided a verbal quote of $9,975.00. We would recommend approval of this proposal. (MOTION)

5. The EAC distribution of the trees on October 3, 2020 went very well. There were a few trees that were not picked up, but they will be provided to residents that were on the waiting list.

6. The work on the Driveway at Martin Park was completed by Steve Botella. Mr. Botella was the lowest bid and we are seeking ratification of that contract. (MOTION)

7. The WC RR completed the work on the Locksley Whistle stop. The payment for that work is included in the agenda. We are meeting on Thursday with Collinson and WCRR regarding location of a proposed guide rail. I would ask the Board’s approval to move forward with the proposal from Collison in the amount of $6.000.00. (MOTION)

14. We are currently working on the 2021 budgets for the township. We will have the budgets completed with the intent of having the board approve final budgets at our first meeting in

December. I am requesting that the board approve advertisement of the preliminary budget to coincide with that schedule. (MOTION)

15. The Chester County Tax Collection Committee has submitted their proposed budget for 2021. The proposed allocation for Thornbury Township is $342.17. I am recommending that the Board of Supervisors approve this allocation. (MOTION)

16. We received a request from the Director of Glen Mills Schools, Chris Spriggs, to change the occupancy for their Academic building to allow temporary use of the building by the West Chester Area School District. I have asked Rich O’Brien to work with Glen Mills Schools personnel to address the request.

17. We have the Annual Children’s Fishing Derby scheduled for this Saturday October 10, 2020 at Martin Park. This is one of the few activities we are able to hold as social distancing will not pose a problem.

Township Solicitor, Kenneth D. Kynett Esquire, files the following report for October 7th, 2020:

1. Delaware County Ballot Drop Box License Agreement – Language of License Agreement should be settled except for finalizing location exhibit and hours of availability.

2. 183 Locksley Road – Township exhibits for October 21, 2020 Conditional Use hearing are prepared so that if no extension is provided and approved, Board can commence hearing immediately following its October Work Session meeting.

3. Duffer’s Outdoor Dining Zoning Appeal – The Board may recall that Duffers sought a variance in 2015 to allow outdoor dining. The Zoning Hearing Board denied the request and Duffer’s appealed. There has be no activity on the appeal since it was originally filed. We received notice from the Court of Common Pleas that the case would be terminated for inactivity which spans more than 2-years, unless one of the parties, the Township, the ZHB or Duffer’s files to keep it open. The only party likely to file is Duffers. The filing deadline is October 26th, 2020. If Duffers files, the Township and the ZHB will then have to participate in any further proceedings scheduled by the court as a result.

4. Township Rain Garden Contract – Reviewed contract and the Performance Bond and Surety qualifications to do business in Pennsylvania.

5. Copier Lease Termination – Worked with Township Administration on advance notice to terminate 2015 copier lease, return copier and remove stored information.

REPORT OF THE ENGINEER October Supervisor’s Meeting October 7, 2020

Work completed for the period:

Grading and Road Encroachment Permits – Reviewed several plans for grading and road encroachment. Construction inspections continue.

Planning Commission – Continued working with members on Ordinances and Subdivisions. Subdivision & Land Development Plans: Lawler Subdivision - Awaiting revised plans.

Daniels Subdivision – 425 Thornton Rd – 2 Lots – Conditional Final approval granted in 2016. Awaiting updated recording plans and agreements for signature.

APG at Locksley Road - 183 Locksley Road – 15 Lot Residential Cluster Development Conditional Use Plan. Review letter for revised plans issued. Planning Commission reviewed at July, 2019 Meeting. Awaiting zoning hearing scheduling. Soil scientist has reviewed the site soils and issued report. Developer still working on revised layout.

191 Creek Road – Lot Line Change Plan – Plan was withdrawn. 74 Locksley Road – 1,576 SF Accessory Structure Land Development – Plans received

and under review for October Planning Commission Meeting. Sleighton School – 3 Lot Subdivision – Approx. 1 acre in Thornbury out of 285 acres total.

80 acres proposed to go to Middletown Township. No development proposed. Plans received and under review for October Planning Commission Meeting.

Ordinances:

Sign Ordinance – PC forwarded ordinance to the Supervisors for consideration. Plant Materials List – Reviewed current Township Ordinance Plant Materials List and

issued our Landscape Architect’s recommendations for exclusions due to local blights and diseases. Reviewed with the Planning Commission in May. PC forwarded list changes to the Supervisors for consideration.

Crane Property – 24 Lot Subdivision – Roadway curb, stone, base course paving and binder paving has been installed for all roadways. Work continues on stormwater facilities, utilities, retaining walls, site, and multiple home lots. Lots 1, 2, 3, 6, 7, 8, 11, 14, 15, 16, 17, 18, 19, 20, 21, 23 homes are now occupied. House construction continues on Lots 5, 9, 10, 13, 24. Review of conversion of existing temporary CO’s to Permanent CO’s are ongoing. Black Bell Farm (Walton Lane) – 15 lot subdivision – Lots 1-14 (All new homes) are now occupied. Basin conversions to permanent are complete. Storm sewer has been line cleaned and video inspected and is under review by our office. Final inspection of public improvement areas completed and punch list has been issued to the developer. Awaiting corrections and paperwork for dedication. Final Paving is being scheduled for fall. Guilday Site – Lot 1, 2 & 5 houses are occupied. Lot 4 construction is ongoing.

Barrett’s Meadow – Project completed. Awaiting final notice from PA DOT on completion and start of maintenance period on their end. Sunoco Logistics – Sunoco has completed the 20” open trench connections of HDD sections. Valve station work has begun. Restoration work has also begun. NPDES MS-4 Program – 2018 Pollutant Reduction Plan and 2018 MS-4 permit submitted on September 9, 2017 & September 15, 2017, respectively. Continuing to work with PA DEP on revisions. Detailed updates to the storm sewer and qualifying watershed mapping has begun due to recent requests from PA DEP. Thornbury Park Parking Lot Expansion – Trainor Concrete & Paving completed final paving of the new and the original, parking lot including new striping on October 9, 2018. Minor corrections at the site are required to allow for final paperwork submission for closeout. Drainage improvements completed the week of January 7, 2019. Cheyney University Demolition – Yarnell Building has been demolished. Site has been stabilized. Erosion controls removed. Projects appears to be completed, awaiting final inspection request. Water Quality Improvement Project Grant – PA DEP Grant work must be completed by December 31, 2021. Contracts have been executed with All Seasons Landscaping and pre-construction meeting has been held. Work to begin within two weeks. Emergency Road Repairs – Emergency storm sewer repair areas have been surveyed, plans prepared and sent out to contractors for pricing. Thornbury Pre-School Roof Replacement – Draft plans prepared for slate or synthetic slate alternate bidding. Submitted to Township officials for review and comment. Martin Park Emergency Storm Sewer repair – Worked with multiple contractors to achieve most cost-effective emergency repair solution. Recommended award of work to Steve Botella Construction & Excavation in the amount of $15,780.00. Emergency culvert repair is substantially completed, with some minor restoration remaining.

ENGINEER’S REPORT REGARDING WASTEWATER ISSUES

October 7, 2020

Wastewater Treatment Plant

– WWTP – Painting of Equalization Tank

• Flow was restored to the Equalization tank on Monday September 14th. The system has

been operating since that date with no issues. The work has been essentially completed

with the exception of a few minor punch-list items.

– NPDES Permit Renewal

• The draft NPDES permit was received by the Township on September 19th. The effluent

limitations have not changed from the previous permit, however there is one additional

parameter (dissolved solids) required to be tested for. We are reviewing the remainder of

permit language to see if there are any other significant changes.

East Side District

– Wet Weather Flows to WWTP

• During wet weather events, there is a noticeable increase in flow to the plant. Previous

years’ television inspection of the sewer tributary to the plant have not revealed any

significant issues. Therefore, we suspect some level of illicit connections and/or

potentially other issues that are not readily visible via television inspection may be

contributing to this increase. We are working with Township staff and DELCORA to

develop a program to help identify these potential issues.
