What do we specialise in?

Page 5: #1 Motoring Solicitors

Many speeding offences go unchallenged with motorists accepting the penalties. However, a

speeding conviction can be detrimental in a number of ways, especially if it means the risk of losing your

driving licence.

• Our specialist motoring offences solicitors recognise that a drink driving charge does not have to lead to a conviction.

• We will work with you to understand your case and advise you on whether a defence or Special Reasons are applicable, doing our utmost to keep you on the road

Drink Driving

• It is an offence to drive with various prescribed and illegal drugs in your system, over a certain level.

• #1 Motoring Solicitors will explore the exact facts of your case and the availability of a defence to drug driving.

The penalties for drug driving are severe, the loss of your driving licence for at least 12 months and the risk of a prison sentence.

Where a person reaches 12 penalty points they will be eligible for disqualification from driving under the ‘totting’ provisions.

#1 Motoring Solicitors can advise and represent you in respect of an Exceptional Hardship Argument. If Exceptional Hardship is accepted by the court, it will ensure that the driver either:

• Avoids the mandatory 6 months disqualification from driving

• The 6 month disqualification period is reduced to a lesser period. #1 Motoring Solicitors have been successful in countless applications to the Court to find

Totting up 12 Points

• If you are facing an allegation of dangerous driving then the prosecution must be able to prove beyond reasonable doubt that the driving in question fell far below the standards expected. • If you feel you have been wrongfully charged and would like to challenge the offence then we advise that you contact one of our specialist solicitors at the earliest opportunity.

• We have years of experience defending clients for dangerous driving and understand the importance of keeping you on the road.

Dangerous Driving

If you have been charged for driving a vehicle without insurance then we advise that you seek advice at the earliest stage. This is a serious motoring offence which could lead to a fine, penalty points and/or disqualification from driving.

• By law, you must have third party insurance if you are using your car on a road or in any other public place. You are also liable to prosecution for being uninsured if your car is parked on a road or in another public place.

Examples of Careless Driving offences include:

• Overtaking on the inside• Tailgating• Driving through a red light• Being inattentive to the road whilst tuning a radio or lighting a cigarette• Emerging from a side road into the path of another vehicle

The use of a mobile telephone or any other hand held electronic device whilst driving carries 3 penalty points and a fine upon conviction.

In more serious cases where the use of a mobile phone has resulted in clear danger or an accident, then a charge of dangerous driving or careless driving could be brought, carrying the risk of a disqualification from driving.

Our expert solicitors can advise you in respect of the potential defences available for this offence. The options include:

• You did not receive the Notice of Intended Prosecution or Summons within the statutory time limits.

• You exercised reasonable diligence in trying to ascertain who the driver was at the material time.

• You were not the registered keeper of the motor vehicle at the time the offence was committed.

• The prosecution should accept a speeding offence in place of the more onerous Section 172 offence, potentially reducing the number of penalty points to be endorsed on your licence.

A Notice of Intended Prosecution (NIP) must be given for certain prescribed motoring offences. Ordinarily, a Notice of Intended Prosecution must be given within 14 days of the date of the offence.

#1 Motoring Solicitors have represented clients who have demonstrated that they did not receive a Notice of Intended Prosecution from the Police. This can be for a variety of reasons, including failure of the postal

system.

“Jonathan Wilkins was recommended to me as an expert in defending drink drive cases – I had been charged with an offence of drink driving... It was very important that I received expert advice as if I was convicted of drink driving I would have lost my licence and lost my job.

...Through his hard work and expertise in motoring law, I saved my driving licence. I would highly recommend Jonathan, his team of lawyers and support staff to anyone who faces prosecution for a motoring offence and wants to save their driving licence”
