Suggested Motion:

“THAT , Council not approve the application by Bret Hogue and Amy Hogue to amend the Zoning By-Law of the Township of Lanark Highlands No. 2003-451 as amended, to rezone the land in Part of Lot 20, Concession 5, geographic Township of Lavant, now the Township of Lanark Highlands from Lake front Development (LD Zone to a Lakefront Development Exception Zone).”

BACKGROUND: At its regular meeting conducted on July 2, 2008, the Council received a verbal request for a donation to support Mr. Nick Tritton’s participation in the judo competition at the upcoming Beijing Olympic Games in Beijing, China. The Council directed that a grant application form be sent for Mr. Tritton to complete and submit for consideration. That direction was implemented. It was subsequently learned that at least one other municipal donation toward Mr. Tritton’s Olympic participation would be presented at a golf tournament and dinner fundraiser to be conducted on Sunday, July 20, 2008, in the Town of Perth – predating our Council’s next meeting by two weeks. In order to permit Lanark Highlands to be represented at that fundraiser and provide its support along with that of other donors, our mayor and councillors were polled by email and telephone to determine the willingness to approve the presentation of a $200.00 grant donation in anticipation of Mr. Tritton’s completed written request being received. All of the members indicated their support of that action.

RECOMMENDATION(S)

THAT: The Council confirm and approve the awarding of a grant in the amount of two

hundred dollars ($200.00) to Mr. Nick Tritton in support of his participation at the 2008

Olympic Games in Beijing, China.

BACKGROUND: Too late to be considered at the Council’s meeting conducted on July 2, 2008, the Township received a request for a donation to support the upcoming 2008 Perth & District Little League Minor Provincial Baseball Championship Tournament (in Perth, Ontario, July 27-August 1, 2008).

In order to permit Lanark Highlands to be represented as a donor at the tournament, the Mayor and Councillors were polled by email and telephone to determine their willingness to approve a $200.00 grant donation.

All of the members indicated their support of that action.

THE CORPORATION OF THE TOWNSHIP OF LANARK HIGHLANDS

BY-LAW NO. 2008-909

A BY-LAW TO CONFIRM THE PROCEEDINGS OF THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF LANARK HIGHLANDS

AT ITS MEETINGS HELD ON JULY 8th AND AUGUST 5th, 2008

WHEREAS, Section 5 of the Municipal Act, 2001 S.O. 2001, c.25, as amended, provides that the powers of a municipality shall be exercised by its council; AND WHEREAS, Section 9 of the Municipal Act, 2001 S.O. 2001, c.25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS, Section 5(3), provides that a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 9, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; AND WHEREAS, it is deemed expedient that the proceedings of the Council of the Corporation of the Township of Lanark Highlands at its meeting be confirmed and adopted by By-Law; NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the Township of Lanark Highlands enacts as follows: 1. THAT, the actions of the Council of the Corporation of the Township of Lanark

Highlands at its meetings held on the 8th day of July and 5th day of August, 2008 in respect of each recommendation contained in the reports of the Committees and each motion and resolution passed and other action taken by the Council of the Corporation of the Township of Lanark Highlands at its meetings is hereby adopted and confirmed as if all such proceedings were expressly embodied in this By-Law.

2. THAT, the Mayor and Proper Signing Official of the Corporation of the Township of

Lanark Highlands are hereby authorized and directed to do all things necessary to give effect to the action of the Council of the Corporation of the Township of Lanark Highlands referred to in the preceding section hereof.

3. THAT, the Mayor and/or Deputy Mayor and Clerk and/or Deputy Clerk are hereby

authorized and directed to execute all documents necessary in that behalf and to affix thereto the Seal of the Corporation of the Township of Lanark Highlands.
