1. Introduction

1.1 Purpose

The purpose hereof is to ensure work safety of all persons endangered by falling when performing work in heights and above a free depth.

1.2 Scope of validity

The directive is binding for all employees of the Company and to employees of other organizations when performing construction, assembly and maintenance work and work related thereto as per the Government decree no. 362/2005 Coll., on closer requirements regarding work safety and health protection at worksites with hazards of falling from heights or to depths.

2. Definitions, Terms

Definition / Term Explanation

Company/employer ČESKÁ RAFINÉRSKÁ, a.s.

Work in heights and above free depths

Work in heights and above free depths is considered such work and activity of a person, at which he/she is endangered by a fall from height, to depth, slumping or tumbling. At such activity, the person must be secured against fall. The duty to provide the person or the worksite with some of the herein mentioned protective aids must be stated on the Permit-to-Work.

Qualification for work in heights

Work in heights may only be performed by persons who are fit for the job in terms of their health and qualification, in line with relevant legal regulations and internal standard of the Company.

Employee of the Company A natural person who is in a labor-law relationship with the Company based on an employment contract or agreement, or a natural person holding a job position in the Company based on other agreements and contracts.

Employee of another organization

Contractor and all persons that, on behalf of the contractor, provide specific performance to Company.

Contractor A legal entity or a natural person that is in a commercial-law or a civic-law relationship with the Company and, as a contracting party (debtor), provides or is bound to provide contractual performance (or a mandatory performance resulting from the contractual relationship) to the Company.

Temporary construction structures

Scaffolding.

Ordering party Usually an employee of the Company and/or an employee of another organization with decision-making authorities who requires the work “in height” to be performed in order to fulfill the contractual relationship with the Company.

3. Responsibilities

Management employees of other organizations are responsible for individual steps of the process. Issuers of the Permit-to-Work in the Company approve the work procedures of contractors and check the

work safety during the work performance.

4. Securing against fall

Protection of persons against fall must be ensured by a collective or a personal securing at all worksites and access roads located in any height above water or above substances jeopardizing, in case of a fall, the life or health of persons, e.g. through burning, acid burns, acute poisoning, suffocating, and at all other worksites and access roads, in case they are located 1,5 m or higher above the terrain level or if the free depth below them exceeds 1,5 m..

Company’s employees may only work in heights in cases when they are protected by collective securing (protective handrail, scaffold, etc.).

In case of work, at which personal securing needs to be used to protect against a fall (protective harness with accessories), a contractor shall be called to perform such activity that has the necessary qualifications and personal protective aids for working in heights or that uses an equipment to be able to perform the work required.

The decision on the way of performing the work shall be made by a maintenance technician, project manager, authorized employee of the Administration Department, in case of an emergency situation – the shift manager/ foreman.

The protection against fall shall be ensured by the employer, preferably using collective protection means, which are mainly technical structures, e.g. protective railings and fences, lids, retaining scaffolds, fences or nets, and temporary building structures, e.g. scaffoldings or working platforms.

4.1 Collective securing

Protective and retaining structures (protective railing, protective fencing, scaffolding, lids, retaining fencing, retaining scaffolding, protective nets) must be sufficiently firm and resistible against outside forces and undesired influences and fitted so as to safely bear the expected load. Their maximum load must be proven by a static calculation or by another binding instruction (ensured by the assembling organization). When erecting a scaffold (see the directive no. 425 “Scaffolding”), it is necessary to adhere to the way of marking the scaffold’s status.

4.2 Personal securing

In cases a contractor needs to use the personal securing, personal securing means for work in heights shall be used, i.e.:

� personal protective aids against falls from heights (fall capturing system), � personal aids for positioning at work and preventing falls from heights (work positioning systems). All personal securing means for work in heights must meet the requirements of the Government decree

no. 21/2003 Coll., stipulating technical requirements regarding personal protective means. The owner of the personal securing means is responsible for their record-keeping and testing. Training of persons who perform or manage work in heights with a use of the personal securing means

takes place once in 12 months; medical checks take place once in 3 years, persons under the age of 21 and above the age of 50, once per year – management staff of contractors are responsible.

Prior to commencing the work, risks must be assessed, which relate to the work to be performed, with the participation of representatives of the contractor to do the job and the ordering party (issuer of the Permit-to-Work, party defining the conditions for the Permit-to-Work, contractor and possibly also other disciplines

impacted). At the risk assessment, it should be taken into account whether the work to be performed should be performed by several persons with the objective to mutually secure each other.

In connection with performing work in heights, the following rules must be followed.

4.2.1 Personal securing means must, in terms of their parameters, comply with the Government decree no.

21/2003 Coll., stipulating technical requirements regarding personal protective means. 4.2.2 Personal securing means must be regularly inspected and tested at least once per year, unless

stipulated otherwise by special regulations. Functional tests of the personal securing must always be performed after each extraordinary event (catching a person, extreme load, etc.).

4.2.3 Prior to use of the personal securing means, the person performing the work in heights is bound to

visually check their completeness, operability and fault-free condition. 4.2.4 When using the personal securing means, the points of anchoring must be selected so as to allow for

their safe securing and anchoring during the whole time of performing the activity in the place of hazard.

4.2.5 The length of the fall when using a safety belt may be at most 0,6 m. When using a safety harness without a fall energy absorber, the length of the fall may be at most 1,5 m, with a fall energy absorber at most 4,0 m.

4.2.6 The safety belt must not be used for capturing a fall. It only serves to prevent reaching the fall-off edge. 4.2.7 When transferring to another point of anchoring, the person performing the work in heights must at all

times be secured by the personal securing. 4.2.8 The developer of the technology or work procedure is bound to define the suitable means of personal

securing and the point of anchoring. (ensured by the construction contractors). It simple work is concerned, for which no technology procedure is necessary, or situations, which could not be described in the work procedure, the point of anchoring and/or the suitable means of personal securing shall be defined by the person managing the work in heights. The point of anchoring must be sufficiently resistant in the direction of the fall.

4.2.9 Rope loops, knots or bindings on ropes must not be used as personal securing of persons at work in

heights, at climb or descend, unless it concerns use of climbing rig or speleological equipment or industrial climbing equipment and aids, agents and means made and used for such purpose.

4.2.10 In case a safe anchoring of the personal securing means for work in heights is not possible, another way

of performing the work needs to be selected (use a scaffold, high-lift truck, etc.).

5. Securing against fall of items and materials

5.1 Materials, tools and aids must be placed or stored in heights in such a way that they are, during the work as well as upon the completion thereof, secured against falling, slipping or being blown off by the wind.

5.2 It is prohibited to hang tools on parts of clothing, unless it is specially made for such purpose or unless a

suitable equipment/rig is used.

6. Securing underneath the point of work in height a nd its surrounding

6.1 Areas, above which a work is performed, must always be safely secured to prevent jeopardizing of persons and interests of other persons.

6.2 The following can be considered a safe securing of the endangered areas:

� fencing the endangered area using a caution strip and information signs, � use of a protective structure at the level of the worksite in a height, or a use of emergency/rescue

structure, � fencing using a two-bar railing with the minimum height of 1,1 m with the bars attached to supporting

poles with sufficient stability, � for short term work with simple tools and work aids, unless they exceed the duration of one work

shift, it is sufficient to mark the endangered area by means of a one-bar railing or a rope attached in the height of 1,1 m,

� guarding the area by an entrusted person (in cases of short term activities and in cases when the above safety measures cannot be deployed).

6.3 Protective zone fencing the endangered area must have a width from the edge of the worksite or work

floor of at least:

� 1,5 m at work in a height of from 3 m to 10 m, inclusive, � 2 m at work in a height of from 10 m to 20 m, inclusive, � 2,5 m at work in a height of from 20 m to 30 m, inclusive, � 1/10 of the height of the structure at work in a height of above 30 m.

6.4 In places of transporting materials to heights using pulleys (manual or machine), the protective zone hall

be extended by 1 m in all directions from the ground plan profile of the transported load.

7. Work above each other

7.1 Work above each other may be performed only exceptionally, if there is no other way due to operating-technical reasons. The technology procedure (at complicated work) and orders of the chief of the work (at simple work) must contain a way of ensuring the safety of persons at lower work levels.

7.2 Below the points of pulling, lifting and lowering materials, sufficient free handling area must be ensured.

During the whole duration of such work, access to the danger area must be prevented for all persons who are not designated for this work.

8. Throwing items and materials

8.1 Throwing items and materials to worksites, roads or similar areas located lower is generally banned in the Company. An exception from this ban can be exceptionally granted only based on the risks assessed in so-called “danger of delay” cases when a record is made about it and when all the parties involved agree with this activity – the issuer of the Permit-to-Work, the party defining the conditions of the Permit-to-Work, the contractor and a representative of the HSQ Department; and only under the following conditions:

� the landing place will be secured against presence of persons (by means of eliminating the traffic

with subsequent fencing and guarding the area) and its surrounding will be protected against possible bouncing or splashing of the thrown item or material,

� materials will be thrown using a confined shaft through to the place of storage, � it is prohibited to throw items, for which the landing place cannot be anticipated (sheets, boards,

etc.), or items, which could pull down the employee from the height, � if a dust or another undesired effect occurs when throwing the materials, protective measures must

be adopted, such as sprinkling the landing area, wrapping the item thrown, etc.

9. Vertical conveyance of materials, working means a nd items

9.1 Vertical conveyance of materials must take place at any given time in a controlled manner (e.g. by letting down – small bags, or using a crane).

9.2 In case of using bags, standard bags shall be used that are fitted with a hitch (with a guaranteed bearing

capacity) for a snap-hook. 9.3 A rope shall contain a snap-hook of guaranteed bearing capacity. The binding between the snap-hook

and the rope shall be made in an expert manner. The contractor shall ensure a complete product from the manufacturer, which shall be, as a whole, subject to inspections.

9.4 At vertical conveyance of materials, working means and items using a rope and a snap-hook, it always

needs to be ensured that under no circumstances the rope slips out of one’s hands and subsequently the lifted/let down item falls. A specific way of ensuring this shall always be defiined, with respect to the level of risk, by the working crew head or by his/her supervisor.

10. Work in heights using industrial climbing equipm ent (climbing rigs)

10.1 When a contractor performs work in heights using so-called industrial climbing technique, this contractor is responsible for ensuring that the work is performed by persons who are capable to do so in terms of their health and qualifications. Prior to issuing a Permit-to-Work with a use of the industrial climbing equipment, the person requesting the permit to be issued is bound to submit a “Certificate of qualification to perform work in heights using the climbing equipment” of all persons who are to perform this work.

10.2 All persons performing the work in heights using the industrial climbing equipment must be acquainted

and trained by their employer on using the personal protective aids for personal securing. With respect to the diversity of fall prevention systems for work in heights and above a free depth, the employer can have employees acquainted and trained by vendors of the personal protective aids for work in heights; the vendors shall then issue a certificate of the acquaintance and training. Persons performing the work in heights must use at least 2 ropes – a working one and a securing one. In case the securing rope does not reach the ground, it must end with a knot.

10.3 For work performed using the industrial climbing equipment, a risks assessment record shall be drawn

up. This record shall be an enclosure to the Permit-to-Work.

11. Use of mobile and lifting platforms

11.1 Mobile and lifting platforms and baskets must, in terms of their design, make and technical condition, comply with work safety regulations pertaining to technical equipment. Platforms and baskets must be fitted with suitable means to prevent a fall of persons or materials.

11.2 Detailed operating requirements and requirements regarding the design of such baskets or platforms and crane equipment are stipulated by the ČSN ISO 12 480-1.

11.3 Suitable means shall be used to prevent spontaneous rotation and tilting of a platform or basket (e.g. using a rotary hanger or hanging on several ropes).

11.4 The platform or basket needs to be checked prior to use to ensure sufficient safety of transporting persons. Records of such checks need to be drawn up.

11.5 The work platform may only be operated by a person possessing the proper qualification for such activity.

11.6 Prior to commencing the work activities, the high-lift platform must be firmly stabilized to prevent its toppling.

11.7 The maximum permissible load of the work basket must not be exceeded.

11.8 The work basket must be fitted with a protective railing with the height of at least 1,1 m.

11.9 When working from a high-lift platform, each person must be secured against falling.

11.10 Each high-lift platform must be equipped with equipment, which allows a safe transport from the height down to the ground in case of a power supply failure.

11.11 In case that during the work the high-lift platform extends to a public road, a permanent supervising person must be provided.

11.12 The area below the work performed from the basket must be ensured against entry of persons, as per the chapter 6 hereof.

11.13 Prior to commencing the work, the ordering party and the person responsible for the work to be performed shall carry out a risks assessment and determine measures to ensure safety of persons performing the work as well as safety of other persons who are present and work close to the area of transporting and working in heights using a platform or a basket.

12. Ladders

12.1 A ladder can only be used for short term, physically undemanding work with the use of simple tools. When climbing, descending and working on a ladder, the person working must face the ladder and must be able to hold on to it with both hands.

12.2 Ladders must not be used to carry items heavier than 15 kg or items with shapes or volumes preventing safe holding on to the ladder.

12.3 No work above each other is allowed on ladders. Climbing or descending on a ladder by several persons at the same time is also prohibited.

12.4 No work with the use of pneumatic tools, stud guns, chainsaws and other similar dangerous tools may be performed from ladders.

12.5 It is prohibited to use portable ladders as small bridges or catwalks.

12.6 Ladders used to climb up must exceed the target platform by 1,1 m. The overlap of the ladder may be replaced by fixed handrails or another fixed part of the structure, which can be reliably used for grasping.

12.7 To ensure stability, the ladder must be secured against sliding, moving sideways, knocking over or opening. The slope of a ladder must not be lower than 2,5 : 1.

12.8 Behind spokes of a ladder, there must be a free area of at least 0,18 m. At the ladder’s bottom, from the side of approaching the ladder, a free space must be kept of at least 0,6 m.

12.9 The ladder must be located so as to ensure its stability during the whole duration of its use. Portable ladders must be placed on a stable, solid, sufficiently large, not moving base in such a way that the

spokes will be horizontal. Suspension ladders must be attached in a safe way and, with the exception of rope ladders, secured against moving or swinging. A rope ladder may only be used to climb up or down.

12.10 Portable ladders must be secured against slipping by fitting the sides on the upper or bottom end with antiskid agents or other measures with a corresponding effect. Folding and extension ladders must be used in a way that individual parts are secured against mutual movement. Mobile ladders must be secured against movement prior to commencing the work and during the whole duration thereof. Portable wooden ladders longer than 12 m cannot be used.

12.11 Work on a ladder may only be performed in a safe distance from the ladder’s upper end – for a standard ladder, the permitted distance of feet is at least 0,8 m, for a stepladder it’s at least 0,5 m from the ladder’s end.

12.12 When working on a ladder when the working person’s feet are higher than 5 m above ground, personal protective securing against fall must be used.

12.13 Prior to each use, ladders must be visually inspected. Regular inspections/checks shall be arranged by the owner of the ladder in accordance with the user’s guide.

13. Temporary construction structures (scaffolding)

13.1 Temporary construction structures may only be used in a form, which is in line with the accompanying documentation and assembly and user guides pertaining to these structures. The assembly guide, including necessary additional drawings and documents, must be available to persons who assemble, use and dismantle the given structure.

13.2 If the necessary documentation is not available for a temporary construction structure or the

documentation does not cover the intended way of use, an individual calculation of firmness and stability must be made by a qualified person, with the exception of cases when the structure is assembled in accordance with a configuration contained in a Czech technical standard.

13.3 Depending on the complexity of the selected temporary construction structure, the qualified person

(directive no. 425 “Scaffolding”) shall propose a specific way of assembling, use and dismantling. 13.4 Temporary construction structures can be considered safe, provided that:

a) they are footed on a sufficiently solid ground or on a structure, the load capacity of which has been statically proven,

b) supporting parts are secured against sliding either by being attached to the basement or by another way with a comparable effect, which ensures stability of the scaffolding; mobile scaffolds are secured by suitable equipment against a random movement during the work,

c) they are made to compose a firm structure, secured against local as well as overall swerving, sliding or tilting,

d) they are sufficiently solid and resistant against outside forces and adverse influences; they are capable to bear the expected load and their function has been proven by a static calculation or another document,

e) dimensions, shape and equipment of the floors correspond to the nature of the work performed, the floors allow a safe passage and performance of the work in a suitable work position,

f) the floors are installed in such a way, that their parts do not slide during an ordinary use, there are no dangerous holes in the floors and between the floor parts and the vertical collective securing against falling,

g) moving structures are secured against spontaneous movements, h) work areas on them are accessible via safe routes (ladders, stairs, ramps or elevators).

13.5 Temporary construction structures can only be used upon having been properly handed over by a qualified person responsible for assembling them and taken over to use by a person responsible for using them. Based on an expert inspection, the person handing over the structure shall draw up a handover and takeover protocol confirming a full completion and equipment of the temporary construction structure. The handover and takeover protocol is not required for:

a) standard light work scaffolds with the height of the work floor of up to 1,5 m, b) mobile work platforms, unless their bearing parts have been dismantled when being moved to

another worksite – adjusting the bearing parts into a transportation position is not considered a dismantling.

13.6 Temporary construction structures must be regularly inspected in a way and in intervals, as defined in

the relevant documentation. If extraordinary circumstances occurred, which could have adverse influence on the safety of the scaffolding (e.g. adverse weather conditions), the inspection must be carried out immediately.

13.7 Scaffolding can be assembled, dismantled or substantially rebuilt only in line with the

assembly/dismantling guide contained in the original documentation and under the supervision of a duly qualified person. These activities can only be performed by employees who have been trained and whose knowledge and skills have been verified. The training includes acquiring the knowledge and skills, particularly concerning the following:

a) understanding the guide for assembling, dismantling or rebuilding the used scaffold, b) work safety during the assembly, dismantling or rebuilding of the given scaffold, c) measures to protect against risks of falling of persons or items, d) measures in case of changes of the weather conditions, which could adversely impact the safety

of the used scaffold, e) permissible loads, f) other risks, which may be related to the assembly, dismantling or rebuilding.

The contractor’s employee shall define the content and frequency of the training with respect to new or changed risks of work, ways of testing the knowledge and skills of attendees and the way of maintaining the training documentation.

13.8 Ladders cannot be used as a supporting or bearing element of the floors on scaffolds, with the exception

of ladders, which are designated for such purpose by the manufacturer. 13.9 To climb up or down between the floors of scaffolds, also wooden ladders can be used with the

maximum length of 3,5 m and with spokes installed into doubled sides of a sufficient firmness, as proven by a calculation.

If parts of temporary construction structures are n ot ready for use, e.g. during assembly, dismantling or rebuilding, access onto such parts o f the temporary construction structures must be prevented using a suitable barriers and marked w ith safety signs. Details of erecting scaffolds, authorizations including definitions of responsibilities are stated in the directive no. 425 “Scaffolding”.

14. Discontinuing work in heights

In case of adverse weather conditions, the employer is bound to ensure the work will be discontinued. At work in heights, the following is considered adverse weather conditions, which can significantly increase the risk of falling or slipping:

a) storm, rain, snowing or frosting, b) fresh wind with the speed of above 8 m.s-1, i.e. 28.8 km/hr., (wind strength of 5 degrees Bf) at

work on suspended work platforms, mobile scaffolds, ladders above 5 m of the height of work and when hanging on a rope in case of work positioning systems; in other cases a strong wind with the speed of above 11 m.s-1, i.e. 39.6 km/hr., (wind strength of 6 degrees Bf) ,

c) visibility in the place of work of less than 30 m, d) surrounding temperature during performing the work below -10 °C. In cases when, due to operational safety reasons, it is necessary to perform certain handling or another

activity from fixed platforms, galleries, scaffolds with collective securing means (firm handrail), also at the conditions stated above (see items a-d above), the relevant operation head/shift manager in cooperation with the HSSE & FP Specialist, shall adopt the measures to minimize the risks within the given hazardous situation base on the executed job hazard analysis. Then these handlings or activities may be performed.

Work in heights with personal securing means (safety harness) is prohibited in such cases.
