Fair •13-20 February @ Chalong TempleWat Chalong Fair 2013. Wat Chalong (or Chalong Temple) Fair is probably the biggest of all temple fairs on the island. The fair lasts seven days each year and is a colourful, crowded, aromatic, noisy but fascinating spectacle.

Old Phuket Town Festival •15-17 February 2013 @ Old Town on Thalang, Krabi and Phuket RoadsThe popular Old Phuket Town Festival is held at the heart of the Old Town on Thalang, Krabi and Phuket Roads and along the famous Soi Rommanee. Thalang Road and Soi Rommanee will be converted into walking streets during the festival. Expect colourful entertainment including a Phuket Baba Light Show, a rickshaw tour around the streets, cultural parades, Chinese opera performances, Chinese folk dancing troupes and more. Activities start from about 3pm til midnight each day.

Please tell us a bit about yourself.I was born in Bangkok, and working with the TAT I’ve been based in Rayong province as well as the TAT offi ce in Los Angeles, which is responsible for all of North America. My family, including my son, aged 25, are living in Bangkok.

Before coming here to work, had you been to Phuket before?Yes, the fi rst time I came to Phuket was about 15 years ago. There were not a lot of tourists then compared to now. The cost of living was still low and, aside from Patong, the beaches were not so crowded.

When you have free time in Phuket, what do you like to do?I’m lucky that my offi ce is in Phuket Old Town. I like to go out to eat chicken rice or noodle soup. Some of my favourite restaurants are Uptown and Raya in Phuket Town, and for seafood I go to Kan Eang @ Pier in Chalong. I love to play golf, and Phuket has some excellent golf courses.

What are the main priorities for you and your team at TAT Phuket?The TAT domestic offi ces normally work to promote their destinations to Thai tourists, but in Phuket we also promote the island to overseas tourists. We have two jobs: the product side and the marketing side. For Phuket, we do not focus much on the marketing because it’s already well known. The priority for us is in improving the product, and we coordinate with other organisations to discuss issues such as dealing with garbage and improving the electricity supply.

What are the main challenges Phuket is facing as a growing tourism destination? We worry about the quality of the product. The beaches, infrastructure, airport, highways, traffi c – all of these things need to be managed properly and made better. When I go to other countries I see that people follow regulations. Here, there’s a lack of discipline and on this we need to improve.

How important is the marine leisure industry (yachting / luxury boat trips) for Phuket tourism? We see this as our new potential market, in addition to other markets we’re targeting including honeymooners and the cruise liner market. Recently we discussed the budget for the next fi scal year 2014-2015 for the development of a convention centre, a deep-sea port and better linkage with other countries by sea – Malaysia, Singapore, even Myanmar. A new ferry route connecting Phuket to Krabi and Langkawi is in discussion. Phuket already

has some excellent marinas including Royal Phuket Marina and Boat Lagoon. We will continue to encourage the private sector to develop and improve Phuket’s marinas, as the private sector can do a much better job than the government in this area.

The island seems to be sliding towards ever-cheaper mass ‘full-packaged’ tourism, which is sure to put off higher-spending, independent, tourists – not to mention the impact on local tourism-related businesses, such as restaurants. Do you see this as a problem? We talk about this often. Phuket’s growth is very high and it creates some diffi cult situations. In terms of marketing we’re emphasising the high-quality markets such as golf tourism, weddings, MICE [meetings, incentives, conventions and exhibitions], and medical tourism. At the same time we have to support local people, the small-to-medium enterprises who may not be able to off er a fi ve-star experience, so we have to fi nd a way to balance these.

In 2012, Phuket enjoyed one of its best years ever in terms of tourist arrivals. What do you think are the main factors for Phuket’s continued growth?Phuket has avoided some of the problems faced by other tourist destinations in Thailand in recent years, like the fl ooding in the North and riots in Bangkok. Phuket has had political stability and in comparison with other places the costs are not so high. The “Amazing Thailand, Amazing Value” promotion has been a success for Phuket and Thailand as a whole.

The Asia Super Yacht Rendezvous

The Asia Super Yacht Rendezvous took place on the 16th - 18th December in Phuket. Sail and motor yachts over 100ft were invited to join in the festivities taking place over the three days, on and off the waters of the Andaman coast. This exclusive event is by invitation only and hosts Asia biggest gathering of super yachts in the region.

One of this years sponsors, Helicam Co Ltd”, were positioned on the bow of Helix - a 45m Feadship designed by De Voogt Naval Architects. The large bow provided ample space to launch the mini helicopters to achieve aerial photos and video while the rendezvous took place.

During the 3-day event parties were held at the Xana Beach Club (Host Sponsor) for all participants with live entertainment and games for all.

120 gm crabmeat1 pc soft shell crab½ pc avocado, peeled, pitted and diced50 gm yellow mango, diced20 gm shallot, brunoise30 gm tomatoes, peeled, seeded & diced

Ingredients (serve 2 portions)

MethodFor salad: in a salad bowl add the crabmeat, avocado, yellow mango, tomatoes and shallot. Add olive oil, cilantro then season with salt and lime juice to taste. For the soft shell crab: season with salt and pepper and coat with breadcrumbs. In a non-stick pan, heat the olive oil to medium heat then pan-fry the soft shell crab both sides until golden brown and cooked.

To serve: on centre plate put arrange the crabmeat salad into round 'mould' in the centre of a plate, then top with soft shell crab and garnish with mixed herb salad and drizzle with the basil oil and balsamic reduction.

Lemongrass founder, Bobby Duchowny, studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

“I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls.

Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market.

What started, several years ago, as a modest enterprise has blossomed into a successful operation off ering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be.

I was pampered with the “Be Balanced” package; a 3-hour experience that left me feeling relaxed and refreshed. As the high season continues in Phuket and other Thai resort destinations, visitors and residents alike will seek to fi nd new accommodation, often in the form of property rentals. Renting property in Thailand is generally governed by the Civil and Commercial Code, which provides specifi c rights and obligations on both tenant and landlord (or, in legal parlance, lessee and lessor).Such rules apply to all forms of rental arrangements, from a week-long holiday apartment to decades-long land leases. This article will present an overview of Thai property rental regulations, with a focus on the rights and liabilities of the lessor and lessee.

Time Requirements and Lease RegistrationsThe law requires that leases with terms greater than three years are registered at a government Land Offi ce.This requirement therefore doesn’t apply to short-term apartment or house rentals, but is applicable to most land or building lease arrangements in resorts, assuch leases are usually long-term in nature. In any case, the maximum period of a lease in Thailand is 30 years. At the end of the 30-year period, the lease term may be renewed for an additional 30-year period, though such renewal is ultimately at the discretion of the parties, and not required by law.

Rights and Liabilities of the LesseeUse of the Property Lessees are required to use the leased property in a manner that is “ordinary and usual”, or as described in the lease agreement. In other words, if a residential property is rented, a lessee cannot use it to operate a commercial establishment. As such, it is important that the lease agreement clearly states the purpose of the rental (e.g. residential, commercial). The lessee must then comply with that purpose.

Payment of RentOf course, a lessee’s primary obligation to the lessor is to pay rent.If a lessee fails to pay rent, the lessor may terminate the agreement. In the event that rental payments are due on a monthly basis or a longer interval, the lessor has the obligation to provide at least 15 days notice that the rental payment is due. A well-drafted lease agreement should clearly specify the terms of the rental payment as well as when payment is due. Further, the lease agreement should contain a provision governing security deposits and their return to lessees at the end of the lease period. Contractual ambiguity regarding the return of a security deposit can easily lead to a dispute between lessor and lessee.

Sub-leasingGenerally, a lessee cannot sublease rented property, unless the lease agreement expressly provides for this. In such cases, the sub-lessee (i.e. the party renting from the lessee) is directly liable to the lessor. For example, if the sub-lessee fails to pay the rent, the lessor can make a claim directly against the sub-lessee. As with most instances regarding lessee’s rights, if a lessee intends to sub-lease, or at least wants to have the option, it is important that such option is stated in the lease agreement.

AlterationLessees are not permitted to make any alterations to the rented property without the owner’s permission. If a lessee does make such alterations without permission, the property must be restored to its original state and the renter is liable to the lessor for any loss or damage resulting from the changes. While long-term lessees may perceive the property as “theirs” due to the length of the lease term, such renters should remember that they are nonetheless subject to the law’s restrictions on alterations. As a result, such lessees should ensure that they obtain permission before making any unpermitted changes to the property to avoid disputes with owners.

Rights and Liabilities of the LessorCondition of the Property and DefectsThe lessor is obligated to provide the rented property to the lessee in a state of good repair. It is thus recommended that prior to renting a property, a potential lessee examines the property for defects and requests that any defects are repaired as a condition of rental. Note, however, that under the law, the lessee still has the right to terminate the lease agreement if defects exist after taking possession of the property. What is more, the lessor is legally responsible to repair any defects in the property which arise during the lease term.

Conclusion When renting property in Thailand (or anywhere), renters and owners should ensure that their lease agreement specifi cally takes into account each party’s rights and obligations. Ambiguous or silent provisions have the potential to give rise to disputes and costly litigation. As such, lessors and lessees should be aware of Thai laws governing renting property, and enter into well-drafted agreements accordingly.

Phuket Thai Hua Museum The oldest Chinese school in Phuket, Thai Hua School was built in 1911 and has now become the Thai Hua Museum, serving as a community and exhibition centre for baba arts and culture.The museum is a two-storey building with the upper level balconied internally to look down on the ground fl oor. Many of the exhibits and artifacts relate to the art and culture of China. Some of the old schoolrooms still remain as they were in the past with old school desks and photographs of former students.The Phuket Thai Hua Museum is on Krabi road. It’s open on Tuesday through Friday from 1 to 8pm and Saturday and Sunday from 9am to 8pm. Entrance is free. It's certainly worth a visit.

Old Phuket TownMuch of Phuket’s development has taken place in the last ten years and the building style is resolutely modern – some say, stridently so; but parts of Phuket City are little changed from a hundred years ago. At that time the island was a busy trading port and supported a thriving tin mining industry. The then captains of industry built their prestigious homes in the Sino-Portuguese style. Narrow housefronts ornately decorated with red and gold, the mystic signs representing sacred guardians of the access, yielded to storied accommodations with tall ceilings and interiors often incorporated delightful gardens. Nowadays the streets in the Chinese quarter have transformed themselves into busy thoroughfares featuring antique shops, speciality restaurants and more. Well worth a visit.

Tri Property CEO Adisorn Vivakanond is a pioneer of creative urban living concepts that have transformed the lifestyle real estate landscapes of Bangkok and Phuket. Tri Property fi rmly established its niche in the residential property market in 2009 with the launch of 'Proud Condominium' in Bangkok, followed by 'Proud X2', both in the capital's Cheangwattana district.

In 2012, the CEO with noteworthy lineage and a Thai-western education in design and construction, led Tri Property's highly successful debut in Phuket with Zcape Condominium in July, followed by the launch of Zcape X2 Condominium in December.

When did you set up the business? in 2009 in Bangkok, just as the eff ects of the credit crunch in the USA were being felt around the world. At fi rst we focused on bringing aff ordable accommodation options to Bangkokians with Proud and Proud X2 condominiums. The combination of a compact condo concept in a convenient location proved very popular. With Phuket's growing population (about 9,000 new residents each year) we saw a similar need for Tri Property's unique brand of aff ordable housing on the island.

What were you doing before? I've always been involved in real estate. In the early years my time was split between Thailand and the United States, where I attained master's degrees in Construction Management from Western Michigan University and then Environmental Engineering from San Fransisco State University, before returning to settle in Bangkok.

The next fi ve years were very productive. I went straight into real estate as a project manager but I'd always had a strong desire to make a unique contribution to the residential real estate market, so Tri Property was established and I haven't looked back since.

What’s unique about Tri Property? Our aim is to stand out as a leader not a follower, which we achieve with attention to every detail. For example, when we embark on a new project, we physically test everything − from the durability of the furniture to the comfort of the seating and bedding.

Tri Property's residential projects are unique for each location as they're determined by real market demands and incorporate cutting-edge designs for multi-purpose space and convenience.

What are your main challenges? We aim to stay ahead of the curve with design innovation for the next generation that's practical, tasteful and stylish, which sometimes means we have a

particular concept that we want to develop and then have to fi nd a way to make it possible. This usually requires input of expertise from a range of diff erent skills.

What's your main target market? We're always thinking ahead to the needs of local residents. Zcape and Zcape X2 are well suited to singles, couples and small families with 'multi-dimensional' lifestyles.

What's your approach to marketing Tri Property? Before launching Zcape in Phuket we did extensive research on the needs of the local residential market and directed our marketing campaign at creating awareness among local buyers and regional investors.

What do you like most about what you do now? If the customer is happy, I'm happy. It's fun to improve people's lifestyles and always good to know that our condo owners get great value for money and will always feel they made a sound investment.

And what do you like least…? I'm perfectionist, so anything that doesn't meet expectations can be annoying.

What do you expect to achieve within the next 3-5 years? We'll continue to develop Tri Property's niche in the market with stylish and practical housing in prime locations. Thailand joining the ASEAN Economic Community (AEC) in 2015 is exciting for the country and the region. As such, we aim to bring more trendy accommodation opions to the global real estate market.

What do you see as your biggest successes to date? I'm pleased to say that all our projects to date have been successful in terms of their marketability and being right for the market demands, which of course equates to happy customers. Both Zcape Condominum and Zcape X2 have been very successful. However, for me, the real mark of success is having a great team in which everyone enjoys their job and has a feeling of fulfi llment in bringing new and exciting living concepts to the market.

What is your over-riding ambition at this stage in your life? The future for Tri Property is bright and I'm looking forward to one day leaving a legacy of lifestyle innovations that will last many lifetimes.
