Request for Proposals

The Board of Selectmen for the Town of Charlton is soliciting Statements of Qualifications from licensed, professional architects to serve as project architect/designer for the Accessibility Modifications (the Project) for the George C. McKinstry III Building 37 Main Street, Charlton, Massachusetts 01507.

Design should be sensitive to the historic value of the Town Hall as a part of the town common.

1) General Information

i) Sealed Proposal Submittals for Accessibility Modifications for the George C. McKinstry III Building 37 Main Street, Charlton, Massachusetts 01507 will be received by the Municipal Building Committee through the Office of the Town Administrator, c/o Robin L. Craver, 37 Main Street, Charlton, MA 01507, 508-248-2206, until 2:00 PM E.S.T., Tuesday June 23, 2009. Proposal Submittals will be received, time stamped and submitters of proposals will be acknowledged.

ii) Prospective bidders may obtain a Request for Qualification package, which is available for pick-up during the week, excluding holidays, Monday- Wednesday -Thursday: between 8:00 am and 3:30 pm; Tuesday, 7:30 am and 7:00 pm: and Friday: 9:00 am and 12:00 pm in the Board of Selectman/Town Administrator at 37 Main Street, Charlton or call 508-248-2206 for email copy.

iii) Please submit six (6) copies of the proposal no later than 2:00 PM E.S.T., Tuesday June 23, 2009.  Proposals received after the deadline will be returned unopened.  No facsimile of proposals is permitted. No e-mail submission of proposals is permitted. Proposals will be publicly opened.

2) Project Description

i) The Town of Charlton seeks plans and specifications to make the George C. McKinstry, III Building, 37 Main Street compliant with the Americans With Disabilities Act, Massachusetts State Building Code (780 CMR), Massachusetts Elevator Regulations (524 CMR),Massachusetts Architectural Access Board (521 CMR) requirements, all other applicable codes and regulations.

ii) The designer will be responsible for presenting schematic designs to the Municipal Building Committee for review and approval, followed by complete designs and specifications for the proposed modifications.

iii) The design(s) shall include, but is not limited to all; building and employee protection, demolition, construction, electrical, plumbing, HVAC, masonry, carpentry, and finish surfaces.

iv) The designer shall refer to the Town of Charlton Accessibility Plan, dated December 2007. (pages attached)

v) For the George C. McKinstry Building the Project shall include:(1) Interior and exterior vertical access(2) Main front stairway modifications(3) Front walkway modifications(4) Service window modifications(5) Lower lever abrupt changes of floor level(6) Main level public restroom modifications(7) Lower level public restroom modifications(8) Archive and secure file storage facilities(9) Office /Department space utilization

vi) The goal of the Project is to maintain the buildings’ character and provide lasting, safe, maintainable, compliant entryways, vertical and horizontal access, public service and employee accommodations.

vii) Preference will be given to designs that include the use of material that minimizes future maintenance, limits the number of joints between materials, provides a soft and welcoming appearance, and avoids the use of asphalt paving.

         5) Designer’s Fee

i) The fee for the Design and Construction Services shall be negotiated, not to exceed fifty thousand (50,000) dollars.

6) Program/Services Required

i) Meet, as needed, with the Municipal Building Committee.ii) Visit the site to ascertain conditions.iii) Preparation of site and conceptual design plans.iv) Gain approval of project design.v) Test work area(s) for hazardous materials in any form, including without limitation

asbestos, asbestos products, polychlorinated biphenyl (PCB) or any other toxic substances.

vi) Provide as part of construction documents and specifications abatement plan for hazardous materials.

vii) Provide construction document and specifications.viii) Monitor work for adherence to drawings and specifications (if required).

7) Submission Requirements

i) The following should be submitted by each firm in order to be considered:(a) Cover letter outlining contact person for the Charlton Municipal Building

Committee including name, job title, address, email address, telephone number and fax numbers.

(b) Organizational chart of including all team members and subconsultants.(c) Five separate project references with the names and phone numbers of persons

who are familiar with the work performed.  The owner shall have express permission to contact the references listed.

(d) Submittal of additional information related to the applicant’s Proposals and experience to perform the work (letters of reference, samples of project methods utilized for comparable projects, etc.) is highly recommended.

(e) Completed Certificate of Non-Collusion (attached).(f) Certificate of Tax Compliance (attached).(g) Copies of Insurance Certificates.

8) Selection Procedures

i) The Town of Charlton will review all proposals and select the finalists based on:(a) Prior Similar experience.(b) Past Performances on projects.(c) Design and proposed materials.(d) Demonstration of overall project understanding and insights into local

conditions and potential issues.(e) Clarity of the proposal and creativity/thoroughness in addressing the scope of

work.(f) Financial stability.(g) Any other criteria the committee considers relevant such as professional

registrations, scope of services offered and appropriateness to the needs of the owner and quality of past work.

ii) Finalists may be required to appear for an interview with the Municipal Building Committee.

iii) The committee will select the applicant and will then engage in fee negotiations with the select firm.  If a fee cannot be successfully negotiated with this firm it shall be removed from consideration and negotiations will commence with the firm ranked second by the committee and so on.

9) General and Special Provisions

i) The Charlton Board of Selectmen as the Awarding Authority, acting on the recommendations of the Municipal Building Committee, reserves the right to reject any and all proposals and to waive any informalities or irregularities as it deems fit in the best interest of the Town of Charlton.

ii) All proposals and materials submitted for consideration shall be considered public information unless clearly marked as PROPRIETARY by the submitter.

iii) The applicant, and any subconsultants of the applicant selected, shall be expected to comply with all applicable federal, state, and local rules, regulations, and laws as they apply to the project(s) without limitation including all federal, state, and local bidding, environmental, and safety rules, regulations, and laws in the performance of services.

iv) The consideration of all proposals and the subsequent selection of the successful applicant shall be made without regard to race, color, sex, age, handicap, religion, political affiliation or national origin.

v) The successful applicant, and all sub-consultants of the successful applicant, shall adhere to the provisions of the Fair Employment Practices Law of the Commonwealth (Chapter 151B of the Massachusetts General Laws).

vi) The successful applicant, and all sub-consultants of the successful applicant, shall assure the Awarding Authority that it will carry out the performance of services in full compliance with all requirements imposed by or pursuant to Title VI of the Civil Rights Act of 1964 (78 Stat. 252), and any executive orders of the Governor of the Commonwealth as such may from time to time be amended.

vii) The provisions relating to non-discrimination and affirmative action in employment shall flow through all contracts and subcontracts that the successful applicant may receive or award as a result of this contract on behalf of the Awarding Authority.

viii) Minimum Insurance Requirements: The successful applicant and any and all consultants and sub consultants of the successful applicant shall provide and maintain throughout the term of the contract and any extension or renewal thereof the following insurance with companies that are authorized and licensed in the Commonwealth of Massachusetts to issue policies for the coverages and limits so required.

(a) Workers' Compensation Insurance as required by the laws of the Commonwealth of Massachusetts and employer's liability in the amount of $500,000/$500,000/$500,000

(b) Commercial General Liability Insurance, $1,000,000 each occurrence and $2,000,000 aggregate limit. Such coverage shall also be in effect for three (3) years from the date of final payment of the construction contractor.

(c) Automobile Liability Insurance - Combined single limit of $1,000,000.

ix) Indemnification. The successful applicant shall agree to indemnify and hold harmless the Town of Charlton and its officers, employees, boards, commissions, committees agents and representatives from and against all claims, causes of action, suits, damages and liability of any kind which arise out of the negligence or willful misconduct of the successful applicant or its officers, employees, agents and representatives regarding the project manager services to be performed by the successful applicant regarding the Charlton Town Hall accessibility project.

Public Buildings: George C. McKinstry III Municipal Building

Name: George C. McKinstry III Municipal Building Location: 37 Main StreetFunction: Municipal building, senior center, CHIP-IN Site. Responsible Party: Board of SelectmenGeneral Description or Obstacle Which Limits Mobility or Access: The McKinstry Building serves as multi-purpose municipal office building housing a number of town offices, senior center and CHIP-IN (food distribution). Generally, the building is moderately accessible, with a number of required modifications for full accessibility compliance. The more obvious need is the provision of internal; vertical access between the lower and main floor levels. Currently, each level can only be reached independently through separate access/egress doors or using interior stairs. No internal lift or elevator exists. The existing accessible parking is non-compliant as is the intended “accessible routes of travel”. In fact the paved walkways are extremely unsafe due to the location of catch basins with large grates and abrupt elevation drops as well as excessive cross-slopes. The gazebo on the common in front of the McKinstry Building is wholly non-compliant. Most of the rooms and facilities on the lower level require basic modifications such as door hardware, accessible signage, compliant coat racks and corrective action on “ramps”. In addition, both bathrooms require modifications for full compliance. Most of the interior stairways require changes to existing railings. Similarly, on the main floor level, most offices require the removal or raising of existing signage as they currently protrude into the accessible route of travel. In addition, non-compliant door hardware, counters and lack of brailled signage is a common occurrence. The Historic Commission Office is located on a third level which can only be accessed via stairs. As this is a public board providing public services, discontinuance at that location or relocation is recommended. Both men’s and women’s accessible bathrooms require modifications for full compliance. The men’s and women’s employee bathrooms are non-compliant but are not open to the public. It may be necessary to bring these into full compliance at a later time as a “reasonable accommodation.
