SALDANHA BAY LOCAL MUNICIPALITY: CLOSURE (DEPROCLAMATION) OF A PORTION OF MINOR ROAD 5547(LANGEBAAN): CHANGE OF STATUS TO MUNICIPAL STREETS

Under section 3 of the Roads Ordinance, 1976 (Ordinance No 19 of 1976), I hereby declare that the portion of the existing public road (Minor Road5547) as described in the Schedule to this notice and situated in the Saldanha Bay Local Municipal area, the location and route of which areindicated by means of an unbroken blue line marked A-B on plan RL.61/2, which is filed in the offices of the Chief Director: Road NetworkManagement, 9 Dorp Street, Cape Town and the Municipal Manager, Saldanha Bay Local Municipality, 12 Main Street, Vredenburg, 7380 shall beclosed.

Notice is hereby given that the Minister of Local Government,Environmental Affairs and Development Planning, properly designatedas Competent Authority in terms of paragraph (a) of State PresidentProclamation No. 160 of 31 October 1994, in terms of section 2(1) ofthe Removal of Restrictions Act, 1967 (Act 84 of 1967), and onapplication by the owner of Erf 1230,Vredehoek, removes conditionsB.1., C.(a) and C.(b) and amends condition B.2. contained in Deed ofTransfer No. T. 110714 of 2002, to read as follows:

Condition B.2.: ‘‘This erf shall not be subdivided unless the consent ofthe Transferor Company or its successors in title be had and obtained,nor may more than half the area of this erf be built upon’’.

SKRIFTELIKE KOMMENTAAR EN BESWARE

Artikel 33 van die Wes-Kaapse Wet op Dobbelary en Wedrenne, 1996(hierna ‘‘die Wet’’ genoem) bepaal dat die Wes-Kaapse Raad op Dob-belary en Wedrenne (hierna ‘‘die Raad’’ genoem) die publiek moet vraom kommentaar te lewer op en/of besware aan te teken teendobbellisensie-aansoeke wat by die Raad ingedien word. Dobbelwerk-saamhede word kragtens die Wet sowel as die Nasionale Wet op Dob-belary, 2004 gereguleer. Hierdie kennisgewing dien om lede van diepubliek in kennis te stel dat hulle voor die sluitingsdatum by onderge-melde adres en kontakte beswaar kan aanteken teen en/of kommentaarkan lewer op bogenoemde aansoek. Aangesien gelisensieerde dobbelary’n wettige besigheids bedryf uitmaak, word morele besware ten gunstevan of teen dobbelary nie deur die Raad oorweeg nie. ’n Beswaar watbloot meld dat iemand teen dobbelary gekant is sonder veel stawing salnie gunstig oorweeg word nie. U word hiermee aangemoedig om dieWet te lees en meer inligting te verkry oor die Raad se magte en dieaangeleenthede op grond waarvan besware ingedien kan word. Ditword in artikel 28, 30, 31 en 35 van die Wet uitgestippel. Lede van diepubliek kan ’n afskrif van die riglyne vir besware bekom, wat ’n gidsis wat die werking verduidelik van die regsraamwerk wat die indieningvan besware, publieke verhore en die Raad se beoordelingsproseduresreguleer. Die riglyne vir besware is verkrygbaar op die Raad se web-werf by www.wcgrb.co.za en afskrifte kan ook op versoek beskikbaargestel word. Die Raad sal alle kommentaar en besware oorweeg wat opof voor die sluitingsdatum tydens die beoordeling van die aansoekingedien word.

In die geval van skriftelike besware teen ’n aansoek moet die grondewaarop sodanige besware berus, verskaf word. Waar kommentaar tenopsigte van ’n aansoek gegee word, moet volle besonderhede en feiteom sodanige kommentaar te staaf, verskaf word.
