Senator Burton offered the following resolution:

WHEREAS, Many proud residents of Mansfield are visiting Austin to celebratethe distinctive attributes and achievements of their community during Mansfield Dayat the State Capitol; and

WHEREAS, Located in the Cross Timbers country of North Central Texas, southof Arlington, the settlement was first established by pioneers in the 1840s; in the late1850s, R. S. Man and Julian Feild built a gristmill in the area, at the crossroads thatlater became the center of the town, which was named for the two men; and

WHEREAS, Mr. Feild soon added a general store across the street from the milland became the town ’s postmaster in 1860; during the Civil War, the Man and Feildgristmill supplied meal and flour to fighting soldiers, and it later did the same forthose at United States Army outposts and Indian reservations in Texas and New

Mexico; though incorporated in 1909, the town remained a farming community untilthe suburban expansion of the Dallas/Fort Worth area brought many new residents;and

WHEREAS, Today, the city ’s more than 60,000 residents can enjoy 240 acres ofparks and a quality of life reflected in the town ’s inclusion on Money magazine ’s2012 list of the top places to live in the United States; and

WHEREAS, Mansfield will be led in 2015 by the members of its city council,including Mayor David Cook and Mayor Pro Tempore Larry Broseh, as well as BrentNewsom, Stephen Lindsey, Darryl Haynes, Cory Hoffman, and Wendy Burgess; alsocommitted to the town ’s well-being are members of the Mansfield Area Chamber ofCommerce, including its executive committee, Rob Schulz, Bry Acker, Joanie Pace,Grant Hall, David Harris, Kevin Allee, Leigh Ann Tipping, and Dan Phillips, its otherdirectors, Monty Goddard, Angel Biasatti, Michelle Canton, Jenny Conrad, MikeLeasor, Omar Pineda, Karen Tecklenburg, Katie Watson, Brendan Kelly, Louis J.Stefanos, and Jim Milligan, and its ex officio directors, Tom Blanton, ClaytonChandler, Dr.iJim Vaszauskas, and Scott Welmaker; and

(2)iion any public or private driveway, street, sidewalk or walkway, parkinglot, parking garage, or other parking area of an institution of higher education orprivate or independent institution of higher education.

(g)iiAn offense under Subsection (a), (a-1), (b), (c), (d), or (e) is a Class Amisdemeanor, unless the offense is committed under Subsection (b)(1) or (b)(3), inwhich event the offense is a felony of the third degree.

(h)iiIt is a defense to prosecution under Subsection (a) or (a-1) that the actor, atthe time of the commission of the offense, displayed the handgun under circumstancesin which the actor would have been justified in the use of force or deadly force underChapter 9.

(j)iiSubsections (a), (a-1), and (b)(1) do not apply to a historical reenactmentperformed in compliance with the rules of the Texas Alcoholic BeverageCommission.

(l)iiSubsection (b)(2) does not apply on the premises where a collegiate sportingevent is taking place if the actor was not given effective notice under Section 30.06.

SECTIONi____.iiSection 46.035(f), Penal Code, is amended by addingSubdivision (1-a) to read as follows:

(1-a)ii"Institution of higher education" and "private or independentinstitution of higher education" have the meanings assigned by Section 61.003,Education Code.

SECTIONi____.iiChapter 46, Penal Code, is amended by adding Sections46.065 and 46.066 to read as follows:

Sec.i46.065.iiCERTAIN REQUIREMENTS RELATING TO SALES AT GUNSHOWS.ii(a)iiA person commits an offense if the person knowingly sells a firearm toanother person in exchange for money or other consideration at a gun show withoutcomplying with the national instant criminal background check system in the mannerrequired by 18 U.S.C. Section 922 before completing the sale. A person who conductsa criminal background check as required by this subsection may charge a fee of notmore than $10 to conduct the check.

(b)iiA person commits an offense if the person knowingly sells a firearm toanother person in exchange for money or other consideration at a gun show and theperson does not maintain a record of the sale.

(c)iiIt is an exception to the application of Subsection (a)iithat the person towhom the firearm is sold:

(1)iiis licensed to carry a concealed handgun under Subchapter H, Chapter411, Government Code; or

(2)iiis a peace officer.(d)iiAn offense under Subsection (a) or (b) is a Class A misdemeanor.Sec.i46.066.iiCERTAIN REQUIREMENTS RELATING TO GUN SHOW

PROMOTER. (a) A gun show promoter commits an offense if the promoter, withcriminal negligence, permits the sale of a firearm to a person at a gun show organized,planned, promoted, or operated by the promoter without complying with the nationalinstant criminal background check system in the manner required by 18 U.S.C.Section 922 before completion of the sale.

(b)iiIt is an exception to the application of Subsection (a)iithat the person towhom the firearm is sold:

(1)iiis licensed to carry a concealed handgun under Subchapter H, Chapter411, Government Code; or

(2)iiis a peace officer.

(c)iiNot later than the 30th day before the date on which a gun show is held, thegun show promoter shall provide written notice of the date, time, and place of the gunshow to the local law enforcement agency of the county or, if applicable, themunicipality in which the gun show will be held.

(d)iiA gun show promoter shall conduct, or arrange for a person who is alicensed firearms dealer under 18 U.S.C. Section 923 to conduct, an instant criminalbackground check in the manner required by 18 U.S.C. Section 922 on any personwho purchases a firearm at a gun show organized, planned, promoted, or operated bythe promoter from another person who is not a licensed firearms dealer under 18U.S.C. Section 923. A person who conducts a criminal background check as requiredby this subsection may charge a fee of not more than $10 to conduct the check.

(e)iiA gun show promoter shall prominently post a notice in a form prescribed bythe Department of Public Safety stating the requirements under this section andSection 46.065 relating to an instant criminal background check.

(f)iiA gun show promoter commits an offense if the promoter violates Subsection(c), (d), or (e).

(g)iiAn offense under Subsection (a) or (f) is a Class A misdemeanor.(h)iiIf conduct constituting an offense under this section also constitutes an

offense under Section 46.065, the actor may be prosecuted under either section orunder both sections.

SECTIONi____.iiThe change in law made by Section 46.066(c), Penal Code, asadded by this Act, applies only to a gun show held on or after October 1, 2015.
