You may have noticed a proliferation of property managers

in the last couple of years, well there’s a good reason for this. Four years ago tenancy regulations changed so that anyone could become a property manager and charge letting fees, (letting fees are one weeks rent plus GST). Prior to this you had to be a member of RIENZ. The reason I bring it up is to warn both tenants and landlords of some of the risks in not using a well-established and trusted manager.

Recently, a friend of mine rented a home in Herne Bay having been a homeowner for 20 years. The entire process was new to her. She came to me for advice such as: ‘Is it normal to sign a tenancy agreement right there and then at the house?’, and ‘the bond is quite significant, what guarantees do I have that my money is safe?’, were just some of her questions. It turns out that the property manager just sat her down at

the dining table pulled out a form taken from the MBIE website, took down her details and she was signed up!

Now my friend does not look at all dodgy but there were no reference checks or credit checks, so (a) could she afford the rent and (b) was she a person of good character?

It has been some months now, she has never had an

inspection and maintenance items that were raised at the beginning of the tenancy still haven’t been addressed. There are a couple of important aspects to this, such as, if something were to go wrong most insurance companies will not provide cover if the property hasn’t been inspected within a 16 week period. My friend is annoyed with the lack of response and so is very unlikely to renew her tenancy, so the client stands to lose a great tenant.

Further questions to ask yourself are; Is the rent held in a trust account, and if so

is it audited? Has the bond been lodged with the MBIE? Does the tenant and owner have 24/7 access in emergencies? Is anyone going to be around during the Christmas or school holidays? Does the property manager have access to a property

lawyer if there are difficulties in the murky interpretations of the RTA? Is there a support team should the manager get sick?

A solo property manager may have slightly lower fees and saving 1 percent on the bottom line might seem appealing - in

reality you may only be saving $6 per week. Or annually a few days rent which is easily compensated for by proactive management.

Does the property manager have access to a property lawyer if

there are difficulties in the murky interpretations of the RTA?

A large majority of individuals don’t often feel the sting of having

to send a tax cheque directly to the IRD. Unfortunately, businesses and employers are not quite so lucky. Although the numerous tax payments that a business must make to the IRD are mostly deducted from customers or employees, it still doesn’t take the pain out of having to write that cheque.

Employee & Contractor TaxesEmployers are one of the largest collectors of income tax. All employers are required to deduct tax on income paid to employees and certain types of independent contractors. The risk of not complying with this can be extreme and can carry a criminal prosecution.

Pay as You Earn & Tax on Scheduler Payments (PAYE & WT) – As the name indicates, PAYE represents tax that must be deducted from employee income (i.e. wages and salaries) at the time it is paid to the employee. To avoid this, compliance

contractors are often used, however note that industry specific contractors that are on the IRD’s tax on scheduler payments list still require withholding tax to be paid on their behalf.

Fringe Benefit Tax (FBT) – An employer who provides certain benefits to employees (i.e. company vehicle, insurance,

healthcare) are required to be registered for FBT and in most cases must calculate and pay FBT to the IRD on a quarterly basis.

Employer Superannuation Contribution Tax (ESCT) – From the 1 April 2012 ESCT was required to be deducted and paid on all employer Kiwisaver contributions at the same time as PAYE.

Passive Income TaxesFor tax purposes, passive income is a term used to describe interest, dividends and royalties. In almost all cases tax is required to be withheld on passive income.

Resident Withholding Tax (RWT) – In general, anyone who pays more than $5,000 of interest per year, to another New Zealand resident (excluding NZ banks) is required to register as an interest payer, deduct RWT from that interest, and pay it to the IRD.

Dividend Withholding Tax (DWT) – All dividends paid by a company to a New Zealand resident shareholder must attach tax at a rate of 33%. Generally companies will have already paid tax on profits at the company tax rate of 28%. Therefore a company will usually have to pay an additional 5% DWT (difference between 33% and 28%) to enable dividend payments to shareholders.

Non Resident Withholding Tax (NRWT) – NRWT must be deducted and paid to the IRD on most forms of passive income paid to non-New Zealand tax residents. Many New Zealand tax residents who have foreign loans get caught out by not realising they are required to pay NRWT on their foreign interest payments. If this is you, then contact me ASAP as NRWT may be the least of your worries.

Consumer TaxGoods & Services Tax (GST) – As a consumer we indirectly pay GST on the majority of products and services we use. A business that believes it will provide more than $60,000 of goods & services (except financial services and residential rental properties) over 12 months must register, charge, and pay GST at a rate of 15%. There are a number of options and payment dates for GST, so contact us if you’re not sure which one is right for you.
