INTRODUCTION

This introduction is tiot part of the licence and does 1101 purport to be a legal interpretation o f tlie licence.

The licence sets oitt in detail the conditions tinder which Irish Water wi l l control and manage the waste water discharges from the agglomeratioii covered by this licence.

Tlie Templemore Wastewater Treatment Plant (WWI'I') was designed to cater for a popiilatioii equivalent (P.E.) of6,OOO. The P.E. o f the agglonieration i s 2,502. The influent to the WWI'I' consists primarily of domestic wastewater. ' i l i e WWTP is a combined activated sludgeifixed f i lm system, with clarifier, as well as ferric dosing (pre-aeration) for phosphorus removal. The treated effluent form the Templemore aggloiiieration i s discharged to t l ie Upper River Suir (WFD Code: IE-SE-I6_3997).

Tlie legislation governing this licence relates specifically to, and is restricted to, the regulation and coiitrol of waste water discharges from the agglomeration. Therefore any odour or noise issue that may be associated with tlie waste water works including t l ie treatment plant cannot be addressed by this licence.

By virtue o f Section 17(4) o f the Water Services (No. 2) Act 2013, the application for this licence is deemed to have been made by lrisli Water and this licence is granted to Irish Water.

DECISION & REASONS FOR THE DECISION

Tlie Environmental Protection Agency is satisfied, on t l ie basis o f the information available, that subject to compliance with [ l ie conditions o f this licence, any discharges from the agglomeration served by the waste water works w i l l comply with and wi l l iiot contravene any o f tlie requirements o f I<egulation 6 o f tlie Waste Water Discharge (Authorisation) Regulations 2007, as amended.

I n reaching this decision the Environmental Protection Agency has had regard to the requirements and objectives o f Regulation 6 0 1 the Regulations and has considered the application and stipporti~ig documentation received from tl ie applicant, and t l ie report o f i ts inspector.

A screening for Appropriate Assessment was undertaken to assess, iii view o f best scientific knowledge and tlie conservation objectives o f tlie site, it' the activity, individually or iii combination with other plans or projects i s likely to liave a significant effect 011 a European Site(s). 111 this context, particular attention was paid to the European site on t l ie Lower Suir (SAC site code: 002 137) and tlie Agency considered, for t l ie reasons set out below, tliat t l ie activity is iiot direclly connected with or necessary to tlie management o f those sites as European Sites and tliat i t can he excluded on t l ie basis of objective scientitic information, that the activity, individually or iii combination with other plans or projects, w i l l have a significant effect on a European site, and accordingly the Agency determined that an Appropriate Assessment ol'the activity was not required.

Tlie Templemore W WTP effluent receives secondary treatment (including phosphorus removal). As determined by tlie i i iass balance ca lc i t la t io~ i~ in the receiving water impact assessmelit of the inspector's report, the discharges from t l ie WWI'I', as limited by this licence, are not expected to impact on the status o f tlie receiving water. Furthermore, data from tlie monitoring stations between the 'I'empleniore discharge and tlie Lower Suir SAC indicate t l iat oxygenation and nutrient conditions are well within their respective good status EQSs, as specitied in the European Conimunities Environmental Objectives (Surl'ace Water) Regulations 2009, as amended.

I. I Statutory Obligations

I. 1 . 1 This licence i s for tlie purposes of Waste Water Discharge licensing under the Waste Water Discharge (Authorisation) Regulations 2007, as amended, only and nothing in this liceiice shall be construed as negating the licensee’s statutory obligations or requirements under any other enactments or regulations.

The discharge(s) to waters from tlie waste water works shall be controlled and tnanaged and sliall take place as set out in this licence. A l l programmes required to be carried out tinder tlie terms of this licence become part o f th i s licence.

For tlie purposes o f this licence, the locatioii(s) of the waste water discharge(s) authorised by this licence idare as presented on Drawing No. 8.3 of [lie application.

I .7 Treatment Capacities

I .7.1 ‘The licensee shall, on an aiiiiiial basis, undertake an assessment o f the remaining organic and hydraulic treatnieiit capacities within the waste water works (design capacity of plant, less flow-load calculation for representative period).

The licensee shall maintain such available capacity within the waste water works as i s necessary to etistire that there i s iio environmental risk posed to tlie receiving water environment as a result of t l ie discharges.

Where tlie licensee determines, as part o f those assessnieiits undertaken iii Condition I .7. I above, that the remaining treatment capacity will be exceeded within tlie ensuing three year period, tlie licensee sha l l notify the Agency and seek a licence review, as appropriate.

No sample o f the discharge taken at a time when unusual weather conditions are adversely affecting l l ie operation o f the waste water treatment plant, shall be taken into account iii determining compliance with Condition 2. I of this licence. A replacement sample shall be taken within 72 liotirs of cessation o f the tinusual weather conditions. The licensee dial1 report tlie sainple result including any justification o f tlie bas is for excluding the sample in the Anniial Environmental Report.

On any occasion where uiiiisual weather conditions affect the operation o f tlie waste water works the licensee shall use i t s best endeavours to mitigate tlie effect o f llie iiiiusiial weather conditions.

Monitoring and analysis equipment sliall be operated and maintained as necessary so that monitoring accurately reflects the discharge (or anibient conditions where that is the monitoring objective).

l'he licensee shall clearly label and provide safe and permanent access to al l oil-site sampling and monitoring points and to off-site points as required by the Agency.

The licensee shall ensui-e that a person in charge or a nominated deputy s l ia l l be available to meet with authorised person(s) o f the Agency at al l reasonable times and s l ia l l a l low access to the waste water works or other premises that the Agency reasonably considers may contain informatioii pertaining to a discharge from those works or other premises.

The liceiisee shall establish and maintaiii corrective action procedures and shall take corrective action should the specitied requirements o f this licence not be fulfil led. The responsibility and authority for persons initiating further investigation and corrective action in tlie event o f a reported non-conformity with this licence shall be defined by the licensee.

The licensee shall establish and maintain a programme Tor iiiaintenance and operation of al l plant and equipment to ensure that tin unauthorised waste water discharges take place. This programme shall be based on the instructioiis issued by the ~naniifacturer/supplier or iristaller of the equipment. Appropriate record keeping and diagnostic testing sliall support this iiiaiiitenaiice programme. The licensee sliall clearly allocate responsibility for the planning management and execution o f al l aspects o f this programme to appropriate personnel

The location, frequency, methods aiid scope o f nionitoring, sampling and analyses, as set out iti this licence, may be ametided with tlie agreement of the Agency fol lowing evaluation o f test resiilts.

Storm Water Overflows

The licensee sliall prepare a PRTR report for tlie primary and secondary discharges. Condition 7. Financial Charges and Provisions

7. I Agency Charges

7.2 Environmental Liabilities

7.2.1 The licensee sliall as part of l l i e AEl l provide an aniiiial statement as to the nieasiires taken or adopted in relation lo l l i e prevention o f environmental damage, and the tinancial provisions iii place in relatioii to the underwriling o f costs for remedial aclioiis following anticipated eveiits (including closiire) or accidenlsiincidents, as may be associated with discharges or overflows from the waste water wot-ks.

7.2.2 The licensee shall arrange for the complelion, by an independent and appropriately qualified co~isultant, o f a comprehensive and fitlly costed Environmental Liabilities Risk Assessment (ELKA) to address the liabilities from present or planned discharges. A report on this assessnient shall be submitted to the Agency for agreement as part o f the second AER (required under Condition 6.8). The ELRA shall be reviewed as necessary lo reflect any significant change to tlie volume or character of effluent discharged, and in any case every three years following initial agreemenl (the results o f the review shall be notified as part o f the AER).

As part o f the measu~-es identified in Condition 7.2.1 the licensee shall, to the satisfaction or t l ie Agency, make financial provision to cover any liabilities identified in Condilion 7.2.2. The amount of indeninity held shall be reviewed and revised as necessary, but at least Iriennially. Proof o f renewal or revision of such financial indemnity shal l be included iii tlie atiniial ‘Statemenl of Measures’ report identified in Condition 7.2. I.
