INTRODUCTION

This licence relates to the Spiddal agglomeration in County Galway. Tlie current population equivalent (p.e.) of the agglonieration is 693. There are no identified sources of industrial waste water in Spiddal. There is no waste water treatment plant (WWTP) serving the Spiddal aggloniei-ation. Tlie priniaiy discharge (SWOOI) is the outfall of untreated effluent li-om the. agglomeration to Galway Bay. There are designated bathing water areas at Tra na mJ3an and Ceibli an Spideil. The licence requires a new WWTP to achieve specified emission limit values from 22 December 201 5 .

Tlie licence sets out in detail the conditions under which Irish Water will control and manage the waste water discharges from the agglomeration covered by this licence.

The legislation governing this licence relates specifically to, and is restricted to, the regulation and control of waste water discharges from the agglomeration. Therefore any odour or noise issue that niay be associated with tlie waste water works including the treatment plant cannot be addressed by this licence.

By virtue of Section 17(4) of the Water Services (No. 2) Act 20 13, tlie application for this licence is deemed to have been made by Irish Water and this licence is granted to Irish Water.

DECISION & REASONS FOR THE DECISION

The Environmental Protection Agency is satisfied, on the basis of the information available, that subjecl to compliance with the conditions of this licence, any discharges from the agglomeration served by tlie waste water works will comply with and will not contravene any of tlie requirements of Regulation 6 of the Waste Water Discharge (Authorisation) Regulations 2007, as amended.

In I-eaching this decision tlie Environmental Protection Agency has had regard to the I-equirenients and objectives of Regulation 6 of the Regulations and has considered the application and supporting documentation received from the applicant and the report of its inspect or.

A screening for Appropriate Assessment was undertaken to assess, in view of best scientific knowledge and tlie conservation objectives of the site, if the activity, iiidividually or in combination with other plans or projects is likely to have a significant effect on a European Site(s). In this context, particular attention was paid to the European Sites at Black Head - Poulsallagh Complex SAC (Site Code: 000020), Galway Bay Complex SAC (Site Code 000265) and h i e r Galway SPA (Site Code: 004031) and the Agency considered, for tlie reasons set out below, that tlie activity is not directly connected with or necessary to the inanagenient of those sites as European Sites and that i t can be excluded on the basis of objective scientific infomiation, that the activity, individually or in combination with other plans or projects, will have a significant efrect on a European site, ancl accordingly tlie Agency cleteniiiiied that an Appropriate Assessment of the activity is not requirecl.

I n pursuance of the powers conferred on i t by the Waste Water Discharge (Authorisation) Regulations 2007, as amended, the Environmental Protection Agency (the Agency), uncler Regulation 2S( 1) of the said Regulations grants this Waste Water Discharge Licence to Irish Water, Colvill House, 24/26 Talbot Street, Dublin 1, Company Register Number 530363, as by virtue of section 17(4) of the Water Services (No. 2) Act 2013, the application for this licence is cleemed to have been made by Irish Water and this licence is granted to Irish Water. The licence authorises the discharge of waste water from the waste water works servicing the Spiddal agglomeration described below, subject to conditions listed in Part TI, with the reasons therefor and the associated schedules attachecl thereto.

1.1.1 This licence is for the purposes of Waste Water Discharge licensing under the Waste Water Discharge (Authorisation) Regulations 2007, as amended, only and nothing i n this licence shall be construed as negating the licensee's statutory obligations or requirements under any other enactments or I-egulations.

The agglomeration is the area outlined in red on Drawing No. Revised Attachment B1- Spiddal, Date 10/09/2014 of tlie application. Any reference i n this licence to agglomeration shall inean the area thus outlined in red.

The discharge(s) to waters from the waste water works shall be restricted to those listed and described in Schedule A : Discharges arid Discharge Monitoring, of this licence and shall be as set out i n the licence application or as iiioclified under Condition 1.6 of this licence and subject to the conditions of this licence.

The discharge(s) to waters from the waste water works shall be controlled and managed and shall take place as set out in this licence. All programmes required to be carried out under the teniis of this licence becoine part of this licence.

Treatment Capacities

1.7.1 The licensee shall, on a n annual basis, unclei-take an assessment of the remaining organic ancl h ydrau I ic treat inen t capacities within the waste water works (design capacity of plant, less flow-load calculation for representative period).

The licensee shall maintain such available capacity within tlie waste water works as is necessary to ensure that there is no enviroiuiiental risk posed to the receiving water enviroiinient as a result of the discharges.

1.7.3 Where the licensee deteiiiiines, as part of those assessments undertaken in Condition 1.7.1 above, that the remaining treatment capacity will be exceecled within the ensuing three year period, the licensee shall notify the Agency and seek a licence review, as appropriate.

1.7.2

Infrastructural Works

1.8.1 Where a treatment plant associated with the agglomeration waste water works requires infrastructural improvements to the wastewater works that are subject to the European Conuiiunities (Environmental Impact Assessment) Regulations 1989, as amended, the licensee shall notify the Agency.

Where the licensee has received approval in accordance with the Planning and Developiiient Act 2000, as amenclecl, for the infrastructural improvements in Condition 1.8.1 above, the licensee shall seek a deteniiination from the Agency as to whether a review of the Waste Water Discharge licence is required.

For parameters other than pH, cBOD, COD and Suspended Solids, eight out of ten consecutive composite results shall not exceed tlie emission limit value. No individual result similarly calculated shall exceed the emission limit value by niore than 20%.

2.1.2 Discrete Sampling

No cBOD, COD grab sample value shall exceed the emission limit value by more than 100% or Suspeiided Solids grab sample value shall exceed the emission limit value by more than 150%. For all other parameters, except pH, no grab sample value shall exceed tlie emission limit value by more than 20%.

2.2 No sample of tlie discharge taken at a time when uiiusual weather conditions are adversely affecting the operation of the waste water treatment plant, shall be taken into account i n determining coiiipliaiice with Condition 2.1 of this licence. The licensee shall clearly label and provide safe and permanent access to all on-site sampling and monitoring points and to off-site points as required by the Agency.

Tlie licensee shall ensure that a person i n charge or a nominated deputy shall be available to meet with authorised person(s) of tlie Agency at all reasonable times and shall allow access to the waste water works or other premises that tlie Agency reasonably considers may contain information pertaining to a discharge -from those works or other premises.

Tlie licensee shall, prior to tlie date for submission of tlie second AER (required under Condition 6.S), carry out an investigation for tlie identification and assessment of storm water overflows. A report on tlie stonii water overflows shall be submitted to the Agency as part of the second AER. All storm water overflows shall be in compliance with tlie criteria for storm water overflows, as set out in the DoECLG ‘Procedures a i d Criterin in Relrition to Storm Wciter O v e ~ f l o ~ s ’ , 1995 and any other guidance as niay be specified by the Agency.

Tlie licensee shall carry out an assessment of storm water overflows at least once every three years thereafter and report to the Agency on each occasion as part of tlie AER. Priority Substances

4.1S.1 Tlie licensee sliall undertake a risk based assessment of the discliarge(s) i n order to iclenlify the relevant priority substances for monitoring. This assessment shall be undertaken iii accordance with "Guiclance on tlie Sci-eening for Priority Substances for Waste Water Discliarge Licences" issuecl by the Agency. Monitoring for tlie iclentifiecl priority substances or pollutants shall be cai-riecl out at least annually.

The licensee shall take sucli measures as are necessary to reduce or eliminate priority substances i n the dischai-ge(s). Implementation of tlie measures identified sliall be reportecl on iii tlie Programme of Improvements (required under Condition 5.1).

Tlie licensee shall submit the location of all discharges from tlie new waste water treatment plant, including primary discharge and s t o m water overflow (6E, 6N grid reference) to tlie Agency, at least six months prior to tlie coininencement of operation of the new waste water treatment plant.

The licensee shall put in place a programme of ineasures for the gathering, recording and retention of inforination i n relation to the infrastructural components of the waste water works. This inforination shall be in the form of "As-Constructed" drawings and electronic inapping tools, or i n any other format as required by the Agency.

The licensee shall can-y out an assessment of the impact of the cliscliarge(s) fi-om the waste water works on the microbiological quality (including viruses) of the shellfish in the adjacent designated shellfisli waters i n consultation with the Sea Fisheries Protection Authority (SFPA), the Marine Institute and B o d Iascaigh MIiara (BIM). The assessment, including a timeframe for installation of UV or other appropriate clisinfection as consiclerecl necessary, shall be submitted to the Agency within eighteen inonths of the date of grant of the licence where i t is identified in the assessment that UV or other appropriate disinfection is required.

Where the assessment outlined i n Condition 5.6 indicates that the dischai-ge(s) are having a cleleterious microbiological (iiicludiiig viruses) effect on the quality of shellfish in the adjacent designated shelltish waters, the licensee shall install UV or other appropriate disinfection s y s t ein wit 11 i n t lie t i inefra nie id e nt i l i ed .

Where a UV or other appropriate clisinfection system is installecl the licensee shall ensure that it is operating to the designed disinfection efficiency at all times.The disinfection efficiency of the system shall be measured to cleinoiistrate that the system is operated within its design range.The records from this verification process shall be recorded and i n a i 11 t a i lied .

Reason: To provide for the improvement of the waste water works on a planned basis having regard to the need for on-going assessment, recording and reporting of matters affecting the receiving water environment.

Condition 6.

6.1

Notifications, Records and Reports

The licensee shall notify the Agency's headquarters in Wexford, or to such other Agency office, as soon as practicable after the occurrence of any incident (as defined in this licence). This notification shall be in such foniiat as specified i n Guidance to Licensees/COA holders on the Notification, Management and Cominunication of Environmental Incidents issued by the Agency and as a minimuin shall include the following: the date, time, location, details, nature, cause, extent and ranking of the

The licensee shall record all sampling, analyses, measurements, examinations, calibrations and maintenance carried out in accordance with tlie requirements of this licence.

The licensee shall, within six montlis of date of grant of this licence, ensure that a documented Emergency Response Procedure is in place, that addresses any emergency situation that may originate on-site. This procedure shall include provision for minimising tlie effects of any emergency on tlie environment. This procedure shall be reviewed annually and updated as necessary.

The licensee shall submit to the Agency, by the 28th February of each year, a n AER covering the previous calendar year. The licensee shall notify the Agency, as soon as is practicable, where a discharge from the waste water works has ceased permanently.

Reason: To provide for the collection and reporting of adequate information on the activity.

Condition 7.

7.1

Financial Charges and Provisions

I The licensee sliall pay to the Agency a n a n n u a l contribution of €2,962.77 or such sum, as the Agency froni time to time determines, having regard to variations in the extent of reporting, auditing, inspection, sampling atid analysis or other functions carried out by the Agency, towards the cost of monitoring the discharge as the Agency considers necessary for the pet-foniiatice of its functions under the Waste Water Discliarge (Authorisation) Regulations 2007, as ametided. The first payment shall be a pro-rata amount for the period from the date of this licence to the 31st day of December, atid shall be paid to the Agency within one month fi-on1 the date of the licence. hi subsequent years the licensee shall pay to the Agency such revised annual contribution as the Agency shall from time to time consider necessary to enable pet-foniiance by the Agency of its relevant functions under the Waste Water Discharge (Authorisation) Regulations 2007, as amended, and all such payments shall be niade within one tiionth of the date upon which demanded by tlie Agency.
