Based on Music & Media's exclusive figures, calculated from the European Top 100 Albums chart during the peri- od, EMI saw its album chart share grow to 27.6% in the first quarter of 2003, from 18% for the same period last year. The domination of EMI at the top of M&M's Euro- pean Top 100 Albums chart was total during the period, with Robbie Williams' Escapology, Massive Attack's 100th Window and Norah Jones's Come Away With Me trusting the top slot. In the UK, the com- pany managed by Tony Wadsworth posted an album chart share of 25%, up from 16% a year ago. Digital download initiatives are like London buses; you waitages for one to appear and then two come along at once.

Last week Apple launched its much -heralded iTunesMusic Service, attracting many plaudits not least from MrHip Hop himself, Dr Dre. At last, he said, here was systemhe could believe in. OK, it's currently unavailable outsidethe US, but it'd be churlish to dwell on the negatives at thispoint. Meanwhile, EMI announced its own download ser-vice offering some 90% of the company's not -insignificantcatalogue online, plus new material.

With such well -received schemes the industry could beforgiven for turning round to young consumers and saying"See?, now stop ripping us off!".

Yet few realistically doubt that illicit downloading ofcopyrighted music will go on for the foreseeable future.Some people will always want their music for free, plus thelure of using pirates, challenging the system and so forthappeals to youthful sensibilities. And anyway, ask musicfans, why traipse around different legitimate serviceswhen "one -stop shops" such as KaZaA-despite being ille-gal-satisfy demand?

File sharers per se aren't the problem, says the industry,rather it is that they carry music without the owner's per-mission. Fine. Then in addition to creating their own user-friendly systems, why not find a way of working with thesenetworks? Or maybe even buy them? True, Europe's indielabels tried dealing with Napster a couple of years ago, asdid BMG. But these failed not least because Shawn Fan-ning's creation was then seen as too much of a bete noir,and the big record companies thought they could controlthe direction of all things digital. One only has to look atPressplay and MusicNet to see how things can go awry.

Admittedly, the kudos of pirate "brands" such asKaZaA and Morpheus may well slip once they get intobed with the industry-as the former appears to bedoing with at least one UK indie-and there's still thehurdle of getting consumers to pay and the hum drumbut costly back office operations todeal with.

But the elements of a ready madeinfrastructure are there. Think of themillions already using systems likeKaZaA; millions of kids who like toswap stuff and who might eventuallybe persuaded to pay if the experienceand the end result are worthwhile.Makes waiting for that bus a bit easi-er to bear...

PARIS - France's ability to buck thedownward global sales trend appearsto be over. Sales for thefirst quarter of 2003 camein just under euros 285million, a 6.8% declinecompared with the sameperiod last year. This isthe second consecutivequarterly dip; the lastquarter of 2002 showed a6% drop compared to thesame period in 2001. Theindustry downturn comesduring a corresponding0.1% drop in the French economyoverall.

"The cloud that attacked all ourneighbours has finally arrived," saysGilles Bressand, president of label'sbody SNEP. France has been the glob-

al exception for almost three years,beating the downward trend withconsistently rising results. "Everyoneelse has been through years of crisis,

and maybe because we'vebeen expecting this, we'llbe able to cope with it bet-ter," he adds, pointing tothe French airplay quo-tas, its export bureau,and recent economicgrowth as factors thatwill work in the industry'sfavour. Single salesremain strong, rising4.2% in volume and 5.3%in value. Albums, howev-

er, have registered a major drop of10.1% in volume, and 11.3% in value.Exactly 3 million fewer albums weresold during the first three months of2003 compared to last year.

director general, says France hasbeen hit by two factors: Internetdownloads and rising DVD video pop-ularity. In the past six months, DVDvideo sales have skyrocketed inFrance, competing for CD sales. ButRony sees this as a temporary boom:"DVD is new and consumers areattracted to new things, but peoplewill get used to it over time."

The French industry is fightingInternet piracy with legal threats andjudicial reminders. From January 1to April 3, 2003, two Napster "clones"have been closed down in France,removing 3.35 million MP3 files fromillegal distribution, and 82 otheraccounts and sites have beenremoved, eliminating another 58,129MP3 files and 3,743 albums. "Wedon't want to criminalise sites," saysRony, "we just want to make themresponsible."

Apple launch undetered by court judgementby Juliana Koranteng

LONDON - In the same week that theUS courts ruled that the controversialpeer -to -peer (P2P) file -sharing freedigital music services are legal, a newradical paid -for service was launchedby Apple Computers.

Called iTunes Music Store, the newservice launched on April 28 with200,000 authorised songs licensed bythe five major labels and is currentlylimited to the US.

Unlike the subscription -based ser-vices that effectively rent the songs,iTunes Music Store enables customersto own individual tracks at 99 UScents each or albums at US$9.99(euros 0.88/8.86).

Customers logging on can listen toa preview before purchasing. Theycan then burn copies to blank CDs ortransfer paid -for songs to Apple's iPod

portable players. The newest 30G ver-sion of the iPod MP3 player, smallerthan a cigarette packet, can store upto 7,500 songs.

The service is limited to Apple Maccomputers featuring the iTunes 4 soft-ware, and will be compatible withMicrosoft's Windows PC s by theyear's end. Additionally, Apple hasdecided to encrypt the songs in theACC (Advanced Audio Coding) musicfile, which is said to be more reliablethan the open, but ubiquitous, MP3files.

Industry -watchers welcomed thenew service. "We've always saidyou've got to give the consumer thechoice and this is the model that willenable [legitimate] online services toexpand their user base," says RebeccaUlph, music and entertainment ana-lyst at Forrester Research in London."It's also a great way of introducing

new people to the concept of payingfor [digital] music."

Meanwhile, the record industrywas dismayed when a US FederalCourt ruled that P2P servicesGrokster and Morpheus, which enabletheir users to swap copyright songsfor free, are legal. The judge reasonedthat since the platforms aren't basedon centralised computer servers likethe bankrupt Napster, Grokster andMorpheus' owners aren't responsiblefor people who used their technologyto infringe copyright works.

The labels plan to appeal, butGrokster president Wayne Rosso sayshis company will lobby the US gov-ernment to impose statutory compul-sory licensing on copyright works.Noting the new Apple service, Rossosays: "The labels still just don't get it.At 99 cents a track, they still can'tcompete with free."

Spanish ratings sensation continues climbby Howell Llewellyn

MADRID - Soaraway SoftAC network Kiss FM hasstunned the Spanish musicradio scene by notching upa million daily listeners inless than a year.

The year's first officialEGM ratings survey of theyear (covering January -March 2003) shows thatKiss has chalked up 1.15million average daily lis-teners, a figure that waspublished in time to cele-brate the station's firstbirthday on April 13.

"We could not haveasked for a better firstbirthday present," saysKiss FM director MarcVicens. The new figuresmake Kiss FM the thirdbiggest music radio net-work in the country, with afurther 353,000 daily lis-teners than it had in EGM'slast survey covering Sep-tember -November 2002.

In the correspondingsurvey of 2002, Kiss FM's

predecessor network OndaCero Musica (OCM) hadjust 101,000 daily listeners.

Kiss FM was forged outof the embers of the formerOCM, and is owned andprogrammed by the RadioBlanca group, while OCMparent company Onda CeroRadio (OCR) supplies thetechnical infrastructureand studios. The network'sformat focuses on balladsand romantic songs, with80% of content being mel-low oldies from the '60s tothe '90s, aimed at a broad24-50 year -old age group.

"There's still more for usout there," predicts Vicens."People are still falling inlove with us. We've just hiton the right consistent ele-ments for our audience."

Vicens believes that thepre -Iraq war atmospherealso helped Kiss FM' in thelatest ratings sweep. "Oursongs are literally aboutpeace and love," he says.Opinion polls around thattime showed that, despiteofficial governmentapproval for the war, morethan 90% of Spaniardsopposed it.

BRUSSELS - Flanders' par-liament has approved adecree that ends the abilityof Flemish radio regulatorVCM to award licences.

The VCM was founded inDecember 1997 with a twintask of issuing radio licencesand being responsible for theterritory's radio regulation.However, the VCM's credibil-ity has been under fire fol-lowing its award of Flanders -wide commercial licences to4FM and Q -Music, with fourof Flanders' political partiessupporting the proposal towithdraw VCM's power togrant radio licences.

The VCM's award in 2000of the first ever Flanders -wide licences to 4FM and Q-

sial in Flemish radio circlesbecause established radiocompanies such as RadioContact and NRJ wereignored in favour of newcom-er groups, a controversy thatwas further fuelled by southBelgian group Deficom'stake-over of 4FM just oneyear later.

The VCM will now playonly an advisory role in thelicensing of commercial sta-tions, but it will maintain itsresponsibility for radio regu-lation. The final approval ofthe award of licences to com-mercial radio stations willnow be subject to theapproval of the Flemish Gov-ernment.

"The fact that the VCMalso decided which stations

been a constant issue of dis-cussion in the government,"says Flemish media ministerDirk Van Mechelen, "but Iwant to point out that theVCM's authority in regula-tion [matters] has never beena problem."

Van Mechelen is con-vinced that the proposition ofdecree meets most of the crit-icisms surrounding theVCM. "Today, we are prepar-ing an FM frequency plan forlocal, urban and five regionalstations. I expect that theFlemish government willdeal with the plan on May 9.The whole procedure hasbeen approved by the StateCouncil on April 22, ready forfurther approval by the gov-ernment."

ON THE BEATUK ROCK TOPS POP SHOCKLONDON - For the first time ever UK salesof rock albums have outstripped those ofpop. According to UK labels' body the BPI,rock albums accounted for 31% of sales in2002, against 30.3% of pop long -players,sales of which slipped back despite high-

profile releases by the likes of RobbieWilliams, Gareth Gates and Will Young.According to the BPI, rock sales were boosted by newreleases from acts such as the Red Hot Chili Peppers,Foo Fighters (pictured), Nickelback, Coldplay andOasis, plus catalogue compilations from the likes ofNirvana, the Rolling Stones and Queen.

NRJ GROUP TURNOVER UP 2.7% IN FIRST HALFPARIS - Despite tough market conditions, NRJ Groupannounced revenues for the first half of their 2003 fis-cal year (October 2002 to March 2003) of euros 157.2million, up 2.7% on the same period the previous year.The growth was more apparent during the first quarterof the fiscal year, with a 6% rise in revenues. NRJ notesthat business slowed in March, due to the conflict inIraq, which prompted several advertisers to postponedcampaigns. Another bright spot, according to theFrench radio group, is the 14.9% growth in interna-tional revenues, mostly due to the full integration ofNRJ's Austrian station in Vienna, which is now 95%-owned by the group. Excluding NRJ Vienna, interna-tional revenues rose by 1.8%. In a statement, NRJ'smanagement says it remains "confident about the evo-lution of its revenues" during the rest of the year.

HEDSTRoM'S NEW EMI ROLE ANNOUNCEDLONDON - EMI finally confirmed last week ThomasHedstrom's appointment as EMI Recorded Music Con-tinental Europe COO (M&M, May 3). His new role willsee him assume day-to-day supervision for the region(ex France, Germany, Italy and Spain, whose EMIpresidents will continue to report directly to theregion's chairman/CEO, Emmanuel de Buretel) plusthe Middle East and Turkey. In addition Hedstr6mwill have functional responsibility for licensing activi-ties and for continental European marketing. Prior tohis arrival at EMI Hedstrom was VP eastern Europeat Universal Music International, based in London.

One of the major problems Internet broadcasters faceis that there are no economies of scale. In fact, unliketraditional radio, each new listener costs more,because each requires additional bandwidth. In theindustry, this is often called the "success paradox". All-

Cast endeavours to solve that problem with its inven-tion of peer -to -peer streaming, a cascade in whichusers invisibly become distributors of the stream. Itintegrates with most existing hardware and mediaplayers, and company asserts that saving of 80% arepossible although 30% is more typical. The UK's Vir-gin Radio has run trials of AllCast, but most of its cus-tomers are small independent or specialist stations.

ZPR gets permission to go for Goldby Cesco van Gool

WARSAW - ZPR, the War-saw -based owner of PolishCHR network Radio Eska,has received the authorisa-tion of national regulatorKRRiT to launch a secondnational network, Gold FM.

ZPR's radio group opera-tions director Marius zWozniczka refuses to indi-cate which format the newnetwork will use, althoughits name suggests that itwill almost certainly be anoldies station. That wouldsee ZPR go head -to -headwith the Gold -formatted sta-tions controlled by the AgoraRadio Group.

Says Wozniczka: "Whilewe are building the RadioEska network in towns withmore than 100,000 inhabi-tants, with Gold FM we will

go after 25-49 year -olds intowns with over 200,000inhabitants. That age groupmight still be narroweddown, depending on the out-come of ongoing research."

At the moment, ZPR has21 Eska-branded stations,and foresees expanding thisnumber to 30. The first GoldFM stations will open thisspring in Warsaw, Poznanand Torun. ZPR is aiming forGold FM stations in Poland's10 biggest metropolitanmarkets.

In Warsaw, competitionfor listeners is intensifying.Last month the re -launchedSoft AC Radio Plus networkentered the market, andautumn 2002 saw the launchof Radio 94 (Rock) and RadioPiN (News/Talk), whileexisting stations are reposi-tioning themselves. After

slowly sliding down the rat-ings table for the last twoyears, last month RadioKolor dropped its all -'80s for-mat for a more female -ori-ented Soft AC. Public nation-al station Polskie Radio Tro-jka, in an effort to regain itsposition in the 25-45 demo-graphic with a tight AC for-mat, has dropped all non -mainstream music duringdaytime.

Although in WarsawAgora's Gold -formattedRadio Pogoda recentlybecame the number one sta-tion among its aged 30+ tar-get audience, Wozniczka isconvinced ZPR's Gold FMnetwork can also become asuccess. "There's still morethan enough room in War-saw," he says. "It's all aboutfinding your niche and fulfill-ing the needs of listeners."

MEPs demand tougher piracy sanctionsby Leo Cendrowicz

BRUSSELS - Europe'selected assembly is readyto push for stiffer sanctionsagainst music pirates, twokey members of the Euro-pean Parliament havepromised.

Speaking at an anti -piracy seminar in Brusselson April 23, UK Labourmember Arlene McCarthyand French conservativeJanelly Fourtou said theywould jointly call for mea-sures that go well beyondthose proposed in Januaryby the,European Commis-sion, the EU's executive.

The parliament's LegalAffairs Committee is due todiscuss the Commission'sso-called EnforcementDirective next week. "Themusic and film industrieshave serious and legitimateconcerns which this direc-tive does not address, such

as the illegal downloadingof content on the Internet,"said McCarthy. "While thisis not an easy area to tack-le, we must be concernedthat peer -to -peer exchangesare being used as a mediumfor paedophiles to exchangepornography."

McCarthy admitted thatEU governments wouldface a tough decision aboutharmonising sanctions forthose found producing ordisseminating pirate mate-rial, but unless tough pun-ishments were dealt out,piracy would continue.

Fourtou told the meet-ing that for some youngpeople, piracy has become apart time hobby, or anational sport, and that theEU had to show that itcaused real damage, andnot just on an economiclevel. She said the situa-tion had deteriorated dra-matically in recent years

and warned that tacklingpiracy would become amore pressing issue whenthe EU embraced easternEuropean countries, astheir enforcement proce-dures were currently morelax than in the existing 15EU members.

The Euro-MPs' concernswere echoed by the musicand movie industries. TheIFPI's head of enforcementlain Grant said a strongand effective EU Enforce-ment Directive was urgent-ly needed. "The Commis-sion's current proposal, asit stands, is a missedopportunity," he said. "TheCommission's proposalfails to introduce desper-ately needed measures tostem the epidemic of piracyand counterfeiting inEurope. That is why weneed your help in gettingthis Directive back ontrack."

Viva CEODieter Gorny says he wants the channel to"get out beyond the 2% [audience share] music TVghetto". The channel's viewers had got older, he says,while younger viewers were watching Viva Plus.Viva's music format would also move from singlestowards album -tracks. ITALIANS FACE FINES FOR POSSESSING ILLEGAL MUSIC

MILAN - As of April 29, Italian citizens caught in pos-session of illegal CDs face fines of up to euros 154, whilerepeat offenders must pay up to euros 1,032. These andother measures are part of the European Union Copy-right Directive which comes into effect in Italy on thatdate. Sellers of illegal CDs are subject to three-yearprison sentences and fines of euros 103 for each illegalcopy seized, while the distribution of music on theInternet via P2P file -sharing software is also to betreated as a crime. Italy becomes the third EU nation,after Denmark and Greece, to implement the Directive.

High flying Senardi is second to NuNMark Worden profilesStefano Senardi, formerpresident of PolyGram Italyand founder of NuNEntertainment, one of thecountry's leading indielabels.

n January record executives sat upand took notice when StefanoSenardi's indie label, NuNEntertainment, signed Simply Redfor Italy. And they were similarly

impressed the following month whenthe band's single Sunrise, went to thetop of the country's airplay charts andthe album Home went in at numberone in the official albums sales chart.

Yet this was just one of severalcoups that NuN, which has a staff ofseven, has pulled off since the formerPolyGram Italy president set it upthree years ago, as a joint venture withEdel, whose Italian office handles bothits distribution and administration.

For Alessandro Massara, GM of V2Records, the 46 -year -old Senardi is"without doubt the Italian record exec-utive I admire the most. He built up agreat roster at PolyGram and he hasdone the same at NuN. Nor has he feltthe limitations of size: on the contrary,he has turned them to his advantage."

Gut reactionFor Sony ATV Publishing director,Chuck Rolando, whose projects withNuN have included the Roman reggaegroup, Otto Ohm, "Senardi is imagina-tive and intuitive, which are all -too -rare qualities these days. When hehears a new piece of music, the firstissue is his gut reaction as to whetherhe actually likes it, while the potentialcommercial applications come sec-ond-with most people it tends to bethe other way round."

The domestic section includes ayoung singer -songwriter (Pinomarino),two established singer -songwriters whohad left their majors, (Paolo Turci andAlice), a veteran Italian jazz showman(Nicola Arigliano), a Florence -based"sort of world" group (Govinda) and an"Italian Asian dub" DJ duo (FeelgoodProductions) whose LP Funkadelicahas been licensed to over 20 countries.

As for foreign artists, NuN hasdeveloped licensing deals with PalmPictures that have helped breakCousteau and 1 Giant Leap in Italyand is known to be exploring possibili-ties with Ryko.

Yet there is a third element to theNuN output, namely soundtracks andcompilations, such as two by CBE net-work Radio Deejay's morning presen-ter Pabio Volo-pop, rock and soulclassics in Il Volo (his surname literal-ly means "the flight") and Latin songsin II Vuelo-as well as a series ofthemed ambient selections for art gal-leries, fashion houses, restaurants,clubs and hotels.

Of all NuN's 40 or so albums, thebiggest sellers so far have been 50,000units for Cousteau's first album and30,000 for Paolo Turci's Questa Parte Di

Mondo, but Senardi thinks that, intoday's market, record sales should beseen as just one source of income-NuN's publishing outfit, NuN Flowers,is also an integral part of the business.Funkadelica's single, The Feelgood Vibe,became a popular TV jingle. "The albumsold 15,000 copies, but the mostimpressive revenue was from Fiat, whoused it for a pan-European ad cam-paign," says Senardi of Funkadelica.

In fact he thinks the CD has almosthad its day: "It just isn't sexy anymore.If you go into a record store now, you'llfind far more exciting products likeDVDs or video games. The CD eitherhas to be revamped, by adding book-lets or photos, or else it must become alot less expensive."

Nor are price and piracy the onlyproblems: "It's also a question of quali-ty. A lot of CDs are poor, with too manyfiller tracks. Many of them contain 60minutes of music, three of which areactually any good."

Senardi sees the recent DVD boomas an encouraging sign. Even if NuNhave only released one so far, for1 Giant Leap, he says: "We have atleast 30 DVD projects in the develop-ment phase, and not all them neces-

From earning five LPs a week to running a labelStefano Senardi was born in theLigurian town of Imperia in 1956 andbegan working in a record store when hewas a literature student at GenovaUniversity. `They paid me five LPs aweek, which provided the basis for avinyl collection which now extends to19,000 LPs," he says. In 1979 he saw anad in the national daily, II Corriere dellaSera. `They wanted someone who lived

in Bologna, owned a car, had completed national service andspoke English," he recalls. "Even if I didn't fit any of theserequirements, I applied for the job anyway and was pleas-antly surprised when they offered it to me!"

Senardi began working at leading indie label CGD, whichwas then "the home of Italian light music", and his first bosswas Caterina Caselli, a former singer who was beginning anew life as a record executive. Senardi recognises thatCaselli "taught me a lot". He worked for her fledgling Ascoltolabel, on projects involving avant-garde artists like MauroPagani, and for the Messaggiere Musicali retail outfit.

During the '80s Senardi was hired by WEA, where heproduced the Frank Sinatra compilation which sold an

impressive 450,000 units in Italy. When Warner boughtCGD from the Sugar family in 1989, Senardi went back toCGD, first as marketing manager and later as MD.

In 1992 Senardi offered the presidency of PolyGram Italy.He says: "The company had a large staff but it was under-performing and we took it to the number one position. Ourroster included Zucchero, Jovanotti, Franco Battiato, BiagioAntonacci and Gianna Nannini, but we also re -launched injazz and classical." He is particularly proud of Blackout-"asort of indie within a major"-that developed CarmenConsoli, Subsonica, Modena City Ramblers, Negrita, CSIand Tiromancino.

The PolyGram experience came to an end with theUniversal merger in 1998. Says Senardi: "I was offered ajoint presidency, but this wasn't viable and I quit." A periodof soul-searching followed, during which former mentors likeCaterina Caselli, EMI's David Munns and Alain Levy,encouraged him to "follow his path" and the result was NuN,a joint venture with Edel. He recalls: "I'd go to [Edel founderand chairman] Michael Haentjes with things like businessplans, and he'd say, `Look, I don't need to tell you, you knowwhat to do.' That was incredibly motivational."

NuN haven't done much with theinternet, although Senardi takes theindustry to task for having panickedand failed to see its potential as a com-mercial, or at least promotional, tool."The internet isn't going to destroy themusic industry in the same way thatvideo didn't destroy the film industryand it's foolish to see it as the greatevil," he says, even if he admits "there

that should beclosed down".

Even though Senardi was a majorlabel executive for much of his career,he clearly enjoys life in the indie world."Things move so much faster and youcan change strategy as you go along,"he says. "And the business processitself has gotten a lot faster in the lastcouple of years."

Pooling resourcesSenardi also sees the need for theindies to pool resources as their inter-ests move away from those of themajors. A keen participant at MEI-the annual indie gathering at Faenzain November-he believes "this year islikely to see some new grouping forItaly's indies. At the moment 15 ofthem are exploring ideas."

When Senardi was at the helm atPolyGram, he worked under the aus-pices of Alain Levy and David Munns,and when the duo took over at EMI acouple of years back the Italianrumour mill had it that he would moveto EMI, even if this was not to be.Would Senardi himself like to returnto the major fold? "That's a very diffi-cult question and I have to say I don'tknow the answer. Right now, this maybe one of the hardest periods of mycareer in commercial terms, but artis-tically and personally speaking, it hasbeen the most rewarding. I think whatI'd really like would be for NuN to bebigger-I feel that it's mine."

Zomba Italy MD Roberto Biglia, aformer colleague from PolyGram days,agrees that Senardi is an indie man atheart: "Stefano has had a great career,but I genuinely believe that he is doinghis best stuff now."

Eins provides an adult alternativeNew and alternative -leaning music is normally asso-ciated with stations targeted firmly at the youngerdemographics. However, Berlin and Brandenberg'sRadio Eins is a rare example in Europe of a stationthat aims to serve an older, "adults only" audiencewith a radical and challenging music mix. MichaelLawton reports.

t was not part of the glamorousEcho Awards ceremony on aSaturday night in mid -February,watched by millions on TV, but,the day before, in a Berlin hotel,

a few extra Echo awards werehanded out by the German musicindustry. One was for "best mediaperformance", and it went this yearto Potsdam -based public stationRadio Eins. Even if the event wenta little unnoticed on the day, RadioEins made the best of it, withwhole page adverts in the local list-ings magazines, a proud banner onthe website, and regular mentionson air.

Radio Eins is an adult -leaningalternative music station, thoughit does also include a dash of morefamiliar mainstream AC and CHRmaterial from artists such asTravis and Pink to make the sta-tion more digestable. Although notnecessarily precisely formatted ina commercial radio type of way, thestation's music policy certainly hassome similarities with the AAA(Adult Album Aternative) formatfound in the US. Station managerHelmut Lehnert says, "I think wedeal with music very competently.Nowadays most stations are onlyinterested in fast -selling product;nobody wants to use music whichsells well to carry other material,such as newcomers or outsiders."

Radio Eins was jointly foundedin 1997 by two public broadcasters,Brandenburg's ORB and Berlin'sSFB, and was the product of thedecision to rationalise the publicradio landscape in a region wheretwo small public broadcasters werekeen to cut costs. The new stationreplaced SFB's cultural station B2,which formerly broadcast to Berlin,

and ORB's entertainment stationRadio Brandenburg, which hadbroadcast to the surrounding stateof Brandenburg. "It was tough forthe people from both stations in thebeginning," says Lehnert. "Theyidentified with their work, and itwas a big psychological effort ontheir part to understand that wedidn't want to work against them."

Lehnert came to Radio Einsfrom a position as the successfulfounder of Fritz, the region's alter-native youth station whichemerged from a similar merger fiveyears earlier.

The station's five music editorsmeet once a week to discuss theirenthusiasms and settle on the cur-rent playlist. "We don't do anyresearch," says head of music PeterRadszuhn, "and there's no one dic-

Radio Eins sees itself as havinga real responsibility for music,according to Lehnert. "We have ajournalistic approach-that meanswe offer information about music,we offer new music, and there mustbe some news value to what weplay." About half the music is lessthan three months old, and about athird of that is domestic Germanrepertoire. It means that Eins isconsistently nurturing newartists-Radszuhn says thatZweiRaumWohnung and Wir Sind

Helden, two bands which haverecently moved from local tonational prominence, were bothdeveloped through airplay at thestation.

"The Echo [award] proves thatthe record companies respect whatwe do," claims Radszuhn. Lehnertagrees, although he accuses recordcompanies of running up the wrongroads in recent times. "Theyhaven't seen that they need toencourage real new talent if theywant to make money," he says. "Wewon't play the song fromDeutschland Sucht Den Superstar[Germany's version of Pop Idol],because it's only there to make

tatorial music boss who decideseverything. We argue over themusic and then reach a consensus."

The station has some 25,000tracks in its library, and the hottestrotation is only about 14 spins perweek. The rotation for current hitrecords is even lower, as-explainsRadszuhn-"those songs which arealready established don't need tobe pushed". The station also bene-fits from its 17 specialist musicprogrammes at evenings and week-ends, and the expertise which theirpresenters (such as the UK's John

Among Berlin andBrandenburg's radio stations,Radio Eins is by far the largestsponsor of concerts -70 this year-ranging from The Rolling Stonesand Oasis in arenas, to Germanbands like Wolfsheim and DeutschAmerikanische Freundschaft inmedium-sized venues. Linked tothe concerts there'll be interviewswith the artists and featured CDs.In addition, says Radszuhn, "We

have one of the best outside broad-cast vehicles in Berlin, and we tryto get the rights to record the con-certs. Then we can broadcast themand complete the circle".

It's perhaps this sense of com-pleteness which above all elsecharacterises Radio Eins. The sta-tion treats its listeners as roundedgrown-ups with a wide range ofinterests, in accordance with thestation's strapline: "For AdultsOnly." Not only is music coveredintelligently; news and currentaffairs are important, with well-known commentators featured inregular spots. There are also mag-azine programmes covering litera-ture, media, travel, science andfilm. Twice an hour there is "what'son" information about events in theregion: even if you don't go, you feellike you know what's happening inthe worlds of theatre and concerts,readings and clubbing.

As a public station, Radio Einscan't afford to pay big money forpresenters, so it develops its ownair talent: Volker Wieprecht andRobert Skuppin of the drivetimeshow or Anja Caspari of the after-noon show have turned into well-known regional figures. There isalso an emphasis on personalitypresentation beyond breakfast.

Radio Eins's MA figures suggestthe public, as well as the critics,appear to appreciate the format,giving the station a steady increasein listener numbers ever since itlaunched six years ago. The mostrecent MA figures revealed a fur-ther 33% boost in audience, bring-ing the total to 242,000 listeners aday in the Berlin and Brandenburgregion. That's nowhere near themarket -leading stations, whichattract around 750,000 listeners aday, but it's an impressive returnfor a non -mainstream station.

Alithe rides on a popular currentby Lisa Pasold

When the single Moi...Lolita climbed into thetop 10 of pop charts across Europe two yearsago, Corsican singer Alizee was only 16 yearsold. But, as the protegee of French pop veteranMylene Farmer, Alizee (now 18) is on track tobecome much more than just a child prodigy,one -hit wonder.

Her second album Mes Courants Electriques(Polydor) entered the French charts at numbertwo after its release on March 18 and is poised tosweep across Europe.

"She's a real European priority for us," saysLondon -based Gill Kinnersley-Hill, manager forinternational repertoire at Universal MusicInternational. "We believe in her and we're seeingher as a star."

The first single from the album J'En Ai Marrehas already been a massive hit in France, and is atnumber 28 on the Eurochart Hot 100 Singles, butcan it equal Moi...Lolita's pan-European success?

The initial signs are good. In Spain the singlehas already reached the top 10 (the album wasreleased April 21) and the video of J'En Ai Marreis the second most -requested track on MTV's feedin Italy, where the album was released on April 24.

The single is being released simultaneously inFrench and English-with J'En Ai Marre becom-ing I'm Fed Up in translation.

"We manufactured a radio single with both ver-sions, but I have to say most markets are going forthe French," says Kinnersley-Hill. "Alizee herself

is so French, she has that sort of appeal."The Alizee story began in 2000, when Mylene

Farmer and writing partner Laurent Boutonnatwere looking for a new teenage singer to be thevoice for their song Moi...Lolita. Alizee turned outto be a perfect fit, and their single sold 1.5 millioncopies in France alone. The Farmer-Boutonnatteam went on to produce and write Alizee's firstalbum Gourmandises, which sold four millionunits worldwide and collected NRJ, World Musicand M6 awards.

The current set Mes Courants Electriques keepsthe Farmer-Boutonnat formula intact.

The international version of thealbum contains four English tracks in total, includ-ing I'm Fed Up, I'm Not 20, Amelie and Youpidoo. InFrance, Universal is exploiting the internationalinterest in Alizee to generate press at home.

Kinnersley-Hill explains: "What's interesting inFrance is how the press campaign is feeding offher international success, promoting how wellshe's done elsewhere and feeding it back to pro-mote the new album."

The UK release date has yet to be confirmed,although it is expected to be out in August orSeptember. There is also talk of a US release,which will take time to develop. Alizee begins tour-ing France in August of this year. "You can't faulther," says Gill Kinnersley-Hill, "she's done every-thing right."

Irish Kings fizz through 2003

Recalling the angular, grungytunefulness of US alternative rock-ers Dinosaur Jr and The Pixies,Future Kings Of Spain are pickingup both critical acclaim andcelebrity plaudits in equal mea-sure.

Their first live performance wassupporting Dinosaur Jr frontman JMascis in Dublin at the end of2000, after which they were signedby UK indie Red Flag Records. Thefollowing year in September theirdebut single, A Place ForEverything And Everything In ItsPlace, was heralded by UK rockmagazine Kerrang! as "blissful".

Fugazi producer Ted Niceleythought the same, and invited theboys over to his New York studio torecord their self -titled debut albumat the end of 2002. "We sent him aCD and he absolutely loved it,"explains Tinca Leahy, director ofRed Flag, who founded the label in

London with her brotlier Ben."Niceley hadn't produced anythingfor a couple of years since GirlsAgainst Boys and this spurred hiscomeback to New York."

The new album will be releasedin the UK on an as -yet -unspecifieddate in June according to Leahybut, despite the growing interest inthe act, there are still no plans torelease any material outside oftheir home territory.

"We're looking into [continental]European distribution and licens-ing at the end of this year, but wewanted to concentrate on the UKfirst," explains Leahy, adding:"ITB, their agent, are looking atEuropean festivals this summer,particularly in Germany at RockAm Ring."

Radio support has come primar-ily from the UK alternative outletsXfm and Steve Lamacq's show onRadio 1 (the BBC's national publicCHR station). But it was in Irelandthat the act first hit the airwaves."I first came across Future KingsOf Spain playing live in Dublinand was immediately impressed bytheir sheer `ballsy' enthusiasm,"says John Walshe, presenter onDublin CHR station FM104, whosays he was hooked on the melodyand power of the band's debut EP.

"Then, the second single, Face IKnow, blew me away. It fizzes withraw energy, and quickly became astaple of my weekly playlist.Having heard a sneak preview ofthe album, I'm convinced thatthese guys are going to be some ofthe stars of 2003."

MASTER JACKSONJackson's Utopia EP (Sound ofBarclay/France), the follow-up tothe sublime Jackson & HisComputer Band EP, provides moreevidence that this intensely original23 -year -old artist is one of the majorplayers of the post French Touchgeneration. comic twist. Based on fairly routine, almost'60's -sounding, chord changes, the track is allabout the lyrics. The words deal with theappeal of Madonna over other well-knownfemale pop stars. It has been picked up bystations across Europe, including Emap's BigCity network, a group of CHR-formatted radiostations in the north of England. AndyRoberts, group programme director for EmapPerformance, says it's the type of trackstations need to have on their playlist. "It's areally great, feel -good, accessible, rock -poprecord," says Roberts. "It's got that singabilitythat a wide audience can tune into-from thekids to office workers. It's just one of thosetracks that comes along that you have to play.It's a good record to have." The track is takenfrom the act's new album The Androids, out onMay 19.

radio several weeks ago. Gray had a bit of amountain to climb after her relativelydisappointing last album The Id, which failed toscale the heights of her first set, On How Life Is.But When I See You is a much more positiveouting for the singer-an uptempo party trackwith a funky groove finished off by Gray'sdistinctive vocals. Written by Gray, lyrically thetrack opens with the line "It's been three weekssince I screamed and hung up on you."Luxembourg CHR station Eldoradio has playedthe track 250 times since its radio release inFebruary and now has the song on mediumrotation. Head of music Dave Glosener thinks hewill be playing it for a good while yet. "It's a verysummery song," he says. "It's typical Macy Gray.The first time we heard it we knew it would be ahit. By a needle -thin margin, Room 5 featuring OliverCheatham's Make Luv (Noise Traxx) noses pastlast week's one -week chart -topper Benny Benassi'sSatisfaction (Energy).

Although Make Luv (Noise Traxx) has benefit-ed from a slight increase in play in Europe's clubs,its real boost comes from specialist dance retail,which has seen a 19.7% increase on last week forthe track. This is only the third time a Belgian -signed track has hit the top-and they are all bythe same person, Vito Lucente. Previously, therewas My Feeling (PIAS) in December 1999 andThrill Me (PIAS), in February 2002 both releasedunder the pseudonym of Junior Jack.

Italian Benny Benassi's Satisfaction (Energy)has been less lucky this week and drops down tonumber two. Benassi has experienced a supportdrop at dance retail, which unfortunately for himisn't counterbalanced by his comparative increasein club plays.

Elsewhere in the top 10, US rapper 50 Cent's InDa Club (Interscope) climbs from number six fornumber five.

Three tracks enter the top 10 this issue.Tomcraft's Loneliness (Kosmo) returns to numbereight from number twelve, while Lambda's HoldOn Tight 2003 (Alphabet City) jumps from number13 to nine with a new entry in The Netherlands.Meanwhile Let It Rain (Liquid) by 4 Strings rock-ets up the chart to number ten from number 29,with local entries in Germany, Austria andHungary.

The biggest gainer in terms of club play -only, aswell as biggest overall gainer and highest of fourre-entries, is the Nightcrawlers' Push The FeelingOn 2003 (4th & Broaway/Urban). One of a numberof '2003' versions of older tracks around at themoment, the track jumps from 611 to 33 with localdance chart rankings in Germany and Belgium.

The second -highest this week is Marc EtClaude's Loving You 2003 (Alphabet City) at num-ber 38 (from 160). The new push comes from dancestore chart debuts in the UK and Ireland.

Daniel Akermann, who is programme con-troller at the Stockholm outlet of NRJ Sweden'schain of (CHR) stations, Sweden, says theColdplay single is a good example of a slow -burn-ing track. "In general I've seen in the last year aclear tendency towards much more slow -growingproduct and I see labels trying to adjust to that,"he says. "And, whereas before they were in fast-moving product -line thinking mode, Coldplayespecially is an example of where the record com-pany stands its ground and keeps working it. AndI think they will prevail in the end."

A faster -moving artist is Justin Timberlakewho, after building his fanbase with his first twosingles, has another big hit on his hands withRock Your Body (Jive). "It's a great song," saysAkermann. "It's funky and fun and makes you feelgood. There's not much competition in that arenanow and I think he'll go far with it."

Two places below Timberlake, at number 11, isCraig David featuring Sting with Rise & Fall(Telstar). And one place below that are Sugababeswith Shape (Island), which uses the same Stingtrack. "We haven't decided which one to go withyet, but we like the Sugababes, version best, andthat's what we're leaning towards," commentsAkermann. "But I'd love to know how come twoversions were released at the same time."

Although Room 5 featuring Oliver Cheatham'sMake Luv (Positiva) is a number 15 this week (upfrom 22)-and has been a number one chart hit inthe UK-Akermann hasn't been sent the trackand is not aware of any release plans for Sweden.

Further down the chart Kelly Rowland's (pic-tured) new single Can'tNobody (21) jumps ahead ofher last one Stole (23 thisweek), both on Music World.NRJ is not playing the newtrack yet, but supportedStole. "Unfortunately shehad to cancel her concerthere when the war brokeout," says Akermann. "Thatwould have been a good pro-motional opportunity tolaunch the new single."

Another single NRJ has yet to add is R Kelly's lat-est outing Ignition (Jive), which is this week'shighest new entry at number 40. The station is,however, a strong supporter of Daniel Bedingfield.His single If You're Not The One (Polydor) is at 38this week, up nine places.

Among local acts NRJ are playing are TheSounds with their new single Rock'n'Roll (WarnerMusic Sweden), Alive by Dabuzz (Bonnier) andDiamonds And Motor Cars (Universal), the newsingle by female artist Dilba, who Akermannbelieves has pan-European potential.

of the year," says internationalexploitation manager Paula Narea."Fifteen excellent songs, of which atleast seven are potential singles."

The five college students from thenorthern Basque city of San Sebastiansigned with Sony four years ago andrecorded Dile Al Sol with leading pro-ducer Alejo Stivel. The album went onto sell nearly 800,000 units in Spainand 56,000 abroad.

Talk of session musicians recordingsome of the album mattered little, andthey were rumours the band did almostnothing to deny.

But the surprise was to come withthe second album, El Viaje De Copper -pot. More accomplished, this albuminvited no talk of session men. It soldmore than 1.1m units in Spain -thesecond -highest selling Sony MusicSpain album of all time -and 600,000units abroad, 400,000 of which were inMexico.

No surprise then that Sony isputting a great deal of effort into LoQue Te Conte Mientras Te Hactas LaDormida. The album was releasedsimultaneously in Spain, Mexico, Cen-tral America, Venezuela, Colombia andEcuador, a week later in the US,Argentina and Chile, and is set for apan-European release later this year,with an emphasis on France and Italy.

The first single, Puedes Contar Con-migo, was on high rotation on most ofSpain's mainstream radio playlists inthe two weeks before the album'srelease. "Puedes Contar Conmigo isperfect music for spring weather," saysFrancisco Herrera, director of CadenaSER's latino station Cadena DIAL. "LaOreja has developed into an enjoyablemature band. What we have here isdelightful Latin pop."

A May -to -October tour of Spainwill be punctuated by a short tour ofMexico and the US in June, while afull tour of the Americas will takeplace at the end of the year. "This isthe moment for La Oreja to become amajor force in world music," saysNarea. She adds the secret of theband's appeal is based on the vocals ofAmaia Montero and the lyrical treat-ment of the "difficult world of love".

Indeed, the apparent simplicity ofthe song structures is given addedverve by Montero's handling of thelyrics. She has an authority in hervoice and is a major focus of the band'slive shows. "I'm more expressive now,and I sing each song from inside me,"she says. "It's hard to believe the evolu-tion between the records, the develop-ment is reassuring. Lo Que Te ConteMientras Te Hacias La Dormida tooknine months to write and three monthsto record, and I think we've achievedan important emotional punch."

Guitarist Pablo Benegas says thealbum title refers to the rugged path oflove. "It's very suggestive to think of alover saying things to his partner thathe probably wouldn't say to her facebecause he thinks she's asleep." Amaiaadds: "And she pretends to be asleep tohear beautiful things."

Nana Mouskouri leadsartists in VAT campaignby Leo Cendrowicz

BRUSSELS - As the campaign toreduce VAT on music heats up, a coali-tion of artists is piling onthe pressure for the Euro-pean Commission to recom-mend a cut in the tax.

Greek artist and formerMEP Nana Mouskouri (pic-tured) is leading the cam-paign, writing to all 20European commissioners,saying that the current VATrates mean there is effec-tively an unfair tax bias against musicin Europe. "Why should music be dis-criminated against in comparison toother cultural products that currentlybenefit from reduced VAT rates, suchas newspapers and magazines, as wellas entrance tickets to cinemas, the-atres and zoos?" she wrote.

"The talent of European artists isthe driving force behind a dynamic cre-ative sector that has gained recogni-tion throughout the world. A VATreduction on recorded music wouldincrease access to culture for everyone,particularly for young people." She isbacked by an Artists' Petition on VAT,signed by Coldcut, Andrea Bocelli,Laura Pausini, Patrick Bruel, JohnnyHallyday, Barbara Hendricks, PascalObispo, Helene Segara, Renaud and

hundreds of others, as well as Euro-pean music sector lobbies, representingmajor and independent labels, publish-ers and retailers.

The letter came as thecommission was about tobegin its inter -service con-sultation on the EU's VATDirective, with all itsdepartments commentingon any proposed revisions.VAT on music is currentlyset at 15%-25%, but theartists' coalition wants thisbrought closer to the 5%

minimum rate carried by other cultur-al products. The Directive lists prod-ucts and services where individual EUnations are authorised to cut VATdown, but commission officials werecautious about the chances that itwould result in a recommendation tocut the tax for music. "We have to lookat a number of factors, and at thisstage, nothing can be guaranteed,"says one official.

European ministers meet in Brus-sels on May 5-6 for an EU CultureCouncil. But the final decision will betaken by EU finance ministers, whoare proving hard to win over. Thefinance ministers are scheduled to dis-cuss the VAT revision either at theirJune 3 meeting in Luxembourg, ortheir July meeting in Brussels.

De Buretel notes that local reper-toire accounts for a good share ofEMI's success, with best-sellingalbums from Herbert Groenemeyerin Germany, Tiziano Ferro and Ser-gio Cammeriere in Italy, Mickey 3Dand Benjamin Biolay in France,Amaral in Spain, Saybia in Den-mark and Royksopp from Norway."Exploiting international repertoireand developing local repertoirewhich can then travel are two keyfactors in our strategy," he explains.

Despite this success there are stillfurther adjustments to be made toEMI's structure, says De Buretel,but he anticipates a good year due toa flow of releases between now andthe end of the year. "Our goal is togain market share overall, but espe-cially in Germany, France, Italy andSpain, and improve profitabilityacross the board," he says.

Thanks to Eminem and 50 Cent,Universal maintained a strong chartshare in albums during the quarter.

In addition, Universal dominated thesingles charts during the quarter,grabbing an impressive 40% share,almost the double from the same peri-od in 2002.

Sony Music's share dropped from23.2% to 11% year -on -year, as thecompany suffered from a lack ofstrong international releases (CelineDion's new album was released at thebeginning of the second quarter).However, the company managed goodperformances in countries such asFrance, Greece, Italy and Portugal,where the affiliates have strong localrepertoire sources.

BMG's positive last quarter perfor-mance continued in 2003, with thecompany (including Zomba) showinga 19.5% album chart share against11.2% a year ago. Warner Music,which had a very strong first quarterin 2002, dropped dramatically in2003, due to a lack of new releases.The company's significant recentreleases, including Linkin Park andMadonna, will show up in the secondquarter results.

"We are frankly stunned by thisnews and by its timing and even ifthere had been some disagree-ments in recent months over poli-cy, the networks in question hadgiven no indication whatsoeverthat this was on the cards." saysRNA secretary-general SergioNatucci. As recently as April 15,[the stations concerned] allapproved the appointment of a newpresident [Edoardo Montefusco,owner of the Rome -based AC CHRnetwork, Radio Dimensione Suono]and a new budget. The letter ofresignation, which was sent whileItaly was in an extended holidayperiod, merely announced theirintention to leave, without offeringany explanation. We're going tohold a meeting in the next fewdays in order to try and find out[the reason]."

The main cause of the riftappears to be the issue of digitalradio. Lorenzo Suraci, owner ofRTL 102.5 -which is unrelated tothe pan-European group of thesame name -says: "I'm sorry thatSergio Natucci should express sur-prise, but I can't believe that hehasn't noticed the numerous com-plaints that have been made byRNA members over the past 12months. Basically, we want themove towards digital radio, whichis currently in the experimentalphase, to accelerate. [The] RNAhas been way too slow, havingadopted a policy of waiting to seewhat TV is doing. We think thatradio has to move by itself."

In reply, Natucci responds: "AllI can say is that both RNA and itssister DAB Club have been highlyactive in promoting digital licencesand we have often been at oddswith [public broadcaster] RAI."

Asked whether there were plansto form a new representative groupwhich might include some of thenetworks that had previouslystayed out of RNA, Suraci says:"There are no plans at the moment,but I wouldn't exclude [the possi-bility]." Nor did Suraci rule outconsolidation among Italian net-works in the near future, "even ifthere isn't any sign of it at themoment".

Former BBC Radio 1 and Emap executiveTrevor Dann has returned to his roots as abroadcaster. From May 6, he'll bepresenting BBC Radio Cam-bridgeshire's weekday breakfastshow with Emma Maclean. Dann(pictured with Maclean) had mostrecently been working as a consul-tant for the Emap PerformanceNetwork, after his full-time rolewith Emap ended. Together with Matthew Ban-ister-who now presents for national BBCnews/talk station Radio 5 Live-Dannrelaunched BBC Radio London as GLR, andrepositioned national CHR station BBC Radio 1 inthe early '90s.

And finally, AP reports that a judge in the UShas dismissed a lawsuit filed by two men who tat-tooed a radio station's call letters on their foreheadsin a publicity stunt. Richard Goddard of Colona,Illinois, and his stepfather, David Winkleman,had sued a DJ and Cumulus Broadcasting, theparent company of K -O -R -B of Davenport, Iowa.They claimed the station didn't follow through on apromise to pay them $30,000 a year (euros 26,855)for five years for getting the tattoos done...
