Pursuant to the powers under the Fisheries (Commercial Dive) Rules 2011("the Rules") that were delegated to the Director (Marine Resources) on 19 August 2015 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), I determine that the dates of closing of the commercial dive fishery to the activities of the take of Heliocidaris Erythrogramma sea urchins in State waters in Georges Bay are as follows:

from 4 September 2016 to 31 December 2016 inclusive;Where Georges Bay is defined as State waters enclosed by an imaginary line commencing at Grants Point then following the line of high water around Georges Bay to St Helens Point then running straight to the point of commencement. rule 9(3) of the FisHeries (abalone) rules 2009Pursuant to the powers under the Fisheries (Abalone) Rules 2009 ("the Rules") that were delegated to the Director (Marine Resources) on 19 August 2015 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), I determine that the dates of closing of State waters of the commercial abalone fishery in “State waters adjacent to the north-west and west coasts of Tasmania” and in “north-east waters” to the activities of the take and possession of greenlip abalone (Haliotis laevigata) are as follows:

from 31 August 2016 to 31 December 2016, inclusive;where “State waters adjacent to the north-west and west coasts of Tasmania” is defined to mean the area of State waters adjacent to the north-west and west coasts of mainland Tasmania bounded in the west by the line of longitude 144° East, bounded in the south by the line of latitude 44° South, bounded in the east by an imaginary line commencing at the intersection of the line of longitude 145° 06’ 17.82” East and the line of latitude 40° 17’ 06.77” South, then running due south to the line of latitude 40° 40’ 53.37” South, then running due west to the line of high water at Guyton Point, then following the line of high water in an approximately north-west direction to Little Creek, then running due west to the line of longitude 144° 51’ 01.60” East, then running due south to where it meets the high watermark on mainland Tasmania (~ at point of latitude 40° 44’ 20.02” South), then following the line of high water approximately west and south to the line of longitude 145° 06’ 17.82” East via Woolnorth Point, then running due south to the line of latitude 44° South, and bounded in the north by the line of latitude 40° 17’ 06.77” South;

and where “north-east waters” is defined to mean: those State waters off the north-east coast of Tasmania within an area bounded in the west by an imaginary line beginning where the line of longitude 147° 27’ 00” East meets the high-water mark of the north coast of the mainland of Tasmania in Anderson Bay, then running due north until its junction with the line of latitude 40° 39’ South, then due east along that line of latitude to the limit of State waters, and bounded in the south by the line of latitude 40° 59' 43" South running from Eddystone Point due east to the outer limit of State waters.

For the purpose of this public notice, “possession” does not include greenlip abalone on a fishing vessel that is transiting the part of State waters closed to the abalone fishery if the greenlip abalone possessed on the vessel were legally taken from a part of State waters that is open to the abalone fishery and, while the fishing vessel is transiting the part of State waters closed to the abalone fishery, a person does not dive from, or enter the water from, the fishing vessel or any other vessel used from the fishing vessel.

The holder of a fishing licence (abalone dive) can not on a fishing trip enter the water by swimming or diving in both an open and a closed part of the fishery regarding the same species.

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Inland Fisheries (Seasons and Waters) Amendment Order (No. 2) 2016

This order prescribes, for a fresh 5-year cycle under the whitebait fishery management plan, the years during which, at restricted periods, whitebait may be taken in various rivers.

(2) Legal Profession Amendment Regulations 2016

These regulations amend the Legal Profession Regulations 2008 to prescribe –

(a) $8.7 million as the amount the Guarantee Fund is to exceed before the Trust must advise the Minister that the Guarantee Fund has exceeded that amount; and

(b) the fee that must accompany an application for a costs assessment.

(3) Major Infrastructure Development Approvals (Waddamana to Risdon Vale Electricity Transmission Line Project) (Revocation) Order 2016

This order revokes the following orders made under the Major Infrastructure Development Approvals Act 1999 due to the completion of the major infrastructure project established by those orders:

The commercial greenlip abalone fishery in State waters off the north-west, west and north-east coasts of Tasmania is being closed from 31 August 2016 until 31 December 2016 inclusive

as part of arrangements to control the total amount of greenlip abalone harvested in these areas in the interest of resource sustainability. These closed areas relate to commercial fishing for greenlip abalone in fishing blocks 48 (except for sub-block 48A), 49 and 5 and down the west coast and to commercial greenlip abalone fishing in fishing sub-blocks 31A, 31B, 39A, 39B, 40A, 40B and 40C only.

This order amends Schedule 1 to the Misuse of Drugs Act 2001 by adding certain substances to the list of controlled drugs, correcting the name of certain substances on that list and specifying a trafficable quantity for certain substances on that list.

This proclamation amends the proclamation notified in the Gazette on 9 November, 1994, as Statutory Rules 1994, No. 161, by revising –
