I, Robert Gott, Director (Marine Resources), acting under Rule 14 of the Fisheries (Commercial Dive Rules) 2011 and delegated authority under Section 20(1) of the Living Marine Resources Management Act 1995, hereby determine:
that the maximum live weight of Periwinkles (molluscs of the Genus Turbo) which may be taken in the period from 1 September in any year to 31 August in the following year from the Commercial Dive Fishery is 58.8 tonnes;
that the parts of the Commercial Dive Fishery from which the maximum live weight of Periwinkles may be taken are:
I) South Eastern Periwinkles Part of the Fishery being that area of State waters on the east coast of Tasmania bounded on the north by the line of longitude 148° 00’ 00”E and on the south by the line of longitude 146° 52’ 15”E (from the southern tip of Tasman Island to Whale Head, this includes Maingon and Norfolk Bays);
II) Central-eastern Periwinkles Part of the Fishery being that area of State waters on the east coast of Tasmania bounded on the north by the line of latitude 42° 20’ 40”S and on the south by the line of longitude 148° 00’ 00”E (from the southern point of Cape Sonnerat to the southern tip of Tasman Island, this includes all waters on the east coast of the Tasman and Forestier Peninsulas and Blackman Bay);
III) North-eastern Periwinkles Part of the Fishery being that area of State waters on the east coast bounded by the line of latitude 42° 20’ 40”S in the south and extending north to the line of latitude 41° 00’ 26”S (from the southern point of Cape Sonnerat to Red Rocks);
IV) Northern Periwinkles Part of the Fishery being that area of State waters in the north bounded by the line of latitude 41° 00’ 26”S in the east and moving anti clockwise around the north coast to the line of latitude 40° 40’ 40”S in the west (from Red Rocks west to Woolnorth – Cape Grim); and,
V) Western Periwinkles Part of the Fishery being that area of State waters along the west coast of the State bounded in the north by the line of latitude 40° 40’ 40”S and in the south by the line of longitude 146° 52’ 15”E (Cape Grim to Whale Head);
that the maximum live weight of Periwinkles which may be taken from each part of the Commercial Dive Fishery is:
I. Central-eastern Periwinkles Part of the Fishery – 5.0 tonnes;
II. South Eastern Periwinkles Part of the Fishery – 10.0 tonnes;
III. North-eastern Periwinkles Part of the Fishery – 14.0 tonnes;
IV. Northern Periwinkles Part of the Fishery – 16.2 tonnes; and,
V. Western Periwinkles Part of the Fishery – 13.6 tonnes.
All coordinates used in this notice are specified in GDA94.

IN ACCORDANCE with the provisions of the Rules Publication Act 1953, notice is given of the making of the following statutory rules:—

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES
(1) Police Offences Amendment Regulations 2016These regulations amend the Police Offences Regulations 2014 by prescribing the infringement notice penalties that apply in relation to certain offences under the Police Offences Act 1935.
(2) Road Amendment Rules 2016
These rules amend the Road Rules 2009 by incorporating a further round of, nationally agreed, changes to the Australian Road Rules. More specifically, the amendments –
(a) provide that the riders of animals, bicycles and postal vehicles may disregard one-way signs, keep left signs and keep right signs in a wider range of circumstances; and
(b) update provisions relating to drivers who are near stopped trams (being provisions that, though irrelevant to Tasmania, keep the State’s Road Rules nationally consistent and inform Tasmanians travelling to jurisdictions that do have trams); and
(c) provide that cyclists are only required to be astride their bicycle seats, not be constantly seated thereon; and(d) provide that, in certain circumstances, the Australian Road Rules prohibition on teenage and adult cyclists riding on
footpaths (not presently upheld in Tasmania) does not apply to cyclists with medical conditions or to their cycling companions, nor does it apply to cyclists who are with cyclists under 12 years old; and
(e) provide that, if faced with a green bicycle crossing light at an intersection or other place on a road, cyclists may proceed against a red or yellow traffic light; and
(f) allow, on conditions, for some flexibility in respect of seatbelt, child restraint and seating position requirements for young children with disabilities and medical conditions; and
(g) make further allowance for young children to travel in the front row of motor vehicles having more than one row of seats; and
(h) provide that vehicle manufacturers’ integrated booster seats and cushions are approved forms of booster seating, child harness and child restraint; and
(i) clarify that, in certain circumstances, young children may be transported in category 2 or 3 seats (known as dickie seats) as defined in the Australian Government’s Standards Bulletin VSB 5A (these being among the few kinds of seats that may be retrospectively fitted to vehicles); and
(j) provide that, in certain circumstances, persons pushing motor bikes need not wear helmets; and(k) provide that, in certain circumstances, riders of moving motor bikes are not required to sit astride their seats or keep
both feet on the footrests; and(l) clarify which vehicles may stop in loading zones; and(m) consequentially insert new definitions; and(n) make other miscellaneous amendments and effect minor statute law revision.
