TERMS & CONDITIONS

1. General:

1.1 Any offer not received as per terms & conditions of the tender enquiry is liable to be

ignored and also no offer shall be considered if:

a. received without earnest money

b. It is received after the time and date fixed for its receipt

c. Not signed & stamped by authorized person on each page of tender documents

d. The offer is ambiguous

e. The offer is received by fax or e-mail

f. The offer is from a black listed firm

g. Offer received with shorter validity than required

h. The offer is for store not conforming to specifications indicated in the tender

enquiry.

i. Offered rate is received other than original tender documents

j. Any conditional offer

k. Not meeting technical evaluation criteria as mentioned at Clause: 13 of tender

documents

1.2 Offered rates (in Pak Rupees) will remain valid for a period of 90 days after bid

opening. No change in price will be made in case of Pak rupees depreciation against

US$ or any other currency.

1.3 The cover envelop should indicate particulars of tender, date of opening and the

envelope must be properly sealed.

1.4 The purchaser reserves the right to issue order in full / partial quantity or as per

requirement

1.5 The bid money / security shall be forfeited if:

a. The acceptance of purchase order is not received within ten days of issuance of

order

b. The offer is withdrawn, amended or revised.

c. If equipment/services not supplied

1.6 The bidder should indicate their National Income Tax No. / Sales Tax No. and circular

of Income Tax Department.

1.7 The contractor will be responsible for the free replacement of furniture / Equipment (s)

if the same is found to be substandard and or at variance with the specifications given

in the supply order within 07 days. Items offered of specifications superior to the one

specified in the tender enquiry may be accepted subject to the approval of competent

authority.

1.8 Items should be brand new and A grade quality.

1.9 One-year free service and supply of spare parts must be guaranteed by the bidder.

1.10 The bidder / supplier will produce documents if required by purchaser to ensure that

store supplied is brand new and in original packing of manufacturer.

1.11 Offered rates will be on basis of free delivery at VTI Data Darbar and shall include all

applicable taxes.

1.12 All tenders can be cancelled by the competent authority before acceptance of the bid

(s) as per PPRA Rules 2014, Clause 35.

1.13 Purchase order(s) will be issued by the Principal VTI Data Darbar.

1.14 The bidder can quote for any of the Lot (s) as mentioned above and decision will be

taken on Lot Wise lowest rates.

2. Delivery Period:

2.1. Delivery period is 20 days for “Delivery of Items” and 40 days for “Civil Work” after

issuance of Purchase Order(s) / Work Order(s) for the procurement required. The Furniture /

Equipment (s) to be provided should be of the same as offered in the bid documents.

2.2. The contractor will be responsible for the free replacement of furniture / Equipment (s) if the

same is found to be substandard and or at variance with the specifications given in the supply

order within 07 days. Items offered of specifications superior to the one specified in the

tender enquiry may be accepted subject to the approval of competent authority

3. Extension of Delivery Period:

In special circumstances, request for extension of delivery period may be considered by the

approving authority (President District Board of Management Lahore VTIs) on the written

request of the firm before the target date of supply.

4. Cancellation & Penalty of Delay:

4.1. If the acceptance of the tender issued during the validity period of the tender is not acceptable

by the bidder, the bid security will be forfeited and the stores can be purchased at his risk and

cost.

4.2. In case the offer is withdrawn, amended or revised during the validity period of the tender,

the bid security shall be forfeited.

4.3. In case bidder fails to execute the contract in accordance with the terms & conditions laid

down in the contract, the bank guarantee/performance guarantee will be en-cashed and the

store will be purchased at his risk and cost.

4.4.In case of delayed supply / non-supply/partial supply, the purchaser may cancel the supply

order or impose appropriate penalty. The penalty may be up to @2% per week

4.5.In case, the bidder fails to execute the contract in accordance with the terms and conditions

laid down in the contract, bid money will be forfeited and required job/services can be hired

from other company at risk and cost of the bidder.

5. Payment to The Contractor:

5.1. Payment will be made through crossed cheque to the supplier against invoice after 100%

completion of delivery, satisfactory performance against each purchase order from

Vocational Training Institute Data Darbar within 30 days after issuance of satisfactory report

by the VTI.

5.2. Payment against partial supply will not be made.

6. Bid Money:

6.1. Fix Bid money of 5% which is Rs. 43,545 for the estimated price of the tender will have to be

deposited along with the tender. It should be in the form of Pay Order / Demand Draft in

favor of “Vocational Training Institute Data Darbar”.

6.2. Bid money of successful bidder shall be refunded on successful completion of the contract

and provision of performance guarantee. Whereas bid money of unsuccessful bidders will be

refunded on the approval of the tender by the Competent Authority.

7. Inspection

The Furniture / Equipment (s) will be inspected by “Inspection Committee VTI Data Darbar”

through authorized personnel who will coordinate with the contractor in lieu of required job

as per tender requirements, specification, quality and terms of the contract

8. Deduction of Taxes:

Any taxes (if applicable) will be deducted while making payment as per Government instructions

/ notifications.

9. Payment of Sales & Other Taxes, Duties, Levies:

All taxes and any other duties if applicable will be liability of the firm. Purchases & Services

shall be made from the firm registered with income tax and sales tax under Punjab Revenue

Authority if applicable

10. Performance Bond:

One-year performance bond / bank security equivalent to10% of the total contract price will have

to be furnished after issuance of purchase orders and before the time of delivery of the equipment.

11. Termination of Contract:

11.1. The procuring agency may reject all bids or proposals at any time prior to the acceptance of

a bid or proposal.

11.2. The procuring agency shall upon request communicate to any bidder, the grounds for its

rejection of all bids or proposals, but shall not be required to justify those grounds.

11.3. The procuring agency shall incur no liability, solely by virtue of involving sub-rule (1)

towards the bidders.

11.4. The bidders shall be promptly informed about the rejection of the bids, if any.

12. Dispute Resolution:

In case of any dispute before or after the execution of contract, matter will be resolved as per

PPRA Rules 2014’ Clause 67 & 68

The dispute arising after the contract shall be resolved in the following manner/mechanics

12.1. The arbitrator will be Area Manager (Lahore VTIs) PVTC Lahore.

12.2. The contractor shall provide his grievances in writing within 15 days after the dispute

12.3. The arbitrator shall decide the matter after hearing both parties within 30 days after

receiving the written complaints from the contractors.

12.4. The decision of the arbitrator shall be final and binding for both the parties.

13. Information about firms (Company Profile):

The firms shall supply information along with tender about the following:

13.1. List of customers

13.2. Company profile mentioning at least one year.

13.3. Copy of NTN and GST certificate.

14. Technical Evaluation:

14.1. Company should be supplier of same products from the last one year.

14.2. Annual turnover of Company for the last three years.

14.3. Response / rectification time for complaints handling will be 36 hours. After 36 hrs, VTI

will arrange to rectify the problem at risk and cost of Bidder.

15. Bid / Tender opening procedure:

15.1. The bid shall comprise a single package containing two separate envelopes. Each

envelope shall contain separately the financial proposal and the technical proposal;

15.2. The envelopes shall be marked as “FINANCIAL PROPOSAL” and “TECHNICAL

PROPOSAL” in bold and legible letters;

15.3. Initially, only the envelope marked “TECHNICAL PROPOSAL” shall be opened;

15.4. The envelope marked as “FINANCIAL PROPOSAL” shall be retained in the custody of

the procuring agency without being opened;

15.5. The technical proposal shall be evaluated in a manner prescribed in advance as mentioned

in the tender documents, without reference to the price and any proposal may be rejected

which does not conform to the specified requirements / specifications;

15.6. During the technical evaluation, no amendments in the technical proposal shall be

permitted;

15.7. The financial proposals of bids meeting the technical specifications after technical

evaluation shall be opened publicly at a time date and venue announced and

communicated to the bidders in advance. The financial bids of unsuccessful bidders will

be returned unopened after technical evaluation

Note: Above mentioned Technical criteria documents must be attached, failing which will lead towards

disqualification of the bid.
