The Minutes of the 195th Meeting of the NRC held from 13th March, 2012 to 16th March, 2012

The 195th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 13th March, 2012 to 16th March, 2012 at NRC, NCTE, Jaipur.

The following were present:

The Regional Director, NRC apprised the Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission of Chairperson, Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

As per the direction of the Hon’ble High Court, the representation of the institution dated 10th February, 2012 was considered by the NRC and decided that the recognition was granted to the institution dated 4.1.2012 stand the same. There is no need to review to earlier decision and no merit in the case and the representations of the institution have

been rejected. Counter affidavit to be filed before the Hon’ble High Court.

As per the direction of the Hon’ble High Court, the matter be referred to the State Government for necessary action.

3. 195.3.3 RJ-1760 SHRI DAU BABA T.T. COLLEGE, DHORMUI, BHARATPUR, RAJASTHAN.

STC The original file of the institution, reply of the institution along with all other related documents, Act of NCTE, 1993, Regulations and Guidelines of NCTE published from time to time and in the light of Hon’ble High Court Order / Direction, the Committee observed the following:

The recommendation of the State Government is as

“The State Government is of the view that the number of existing 22 colleges in Bharatpur district is quite adequate. Also, the total number of existing 793 in the State of Rajasthan is quite adequate and the number of candidates who are completing their STC course each year from these colleges is far in excess of the total number of new teachers required in the State of Rajasthan.

Therefore, the State Government is of the considered view that no objection certificate should not be granted for the proposal of STC for setting up Shri Dau Baba T.T. College, Dhormui, Bharatpur, Rajasthan.”

Hence, NRC decided that the application of the said course be rejected under section 14/15 (3) (b) of NCTE Act, 1993 on the above points.

Overwriting on building plan shows that the institution has BPE course. It has not been mentioned in the application.

Hence, NRC decided that the application for the said course be rejected under section 14/15 (3) (b) of NCTE Act, 1993 on the above point.

The Committee examined all the documents submitted by the institution to NRC from time to time. It was observed that

(i) Two different affidavits have been submitted by the institution regarding land documents. First was submitted along with application and the second submitted to the Visiting Team (II). The details about land documents stated in two affidavits are different from each other. The mutation

certificate and Khatauni about the transfer of ownership of land is not enclosed along with the second affidavit.

(ii) The Visiting Team had visited the college on 26.3.2010 as well as on 15.1.2012 respectively. There are differences in the maps shown and the size of the constructed area. The size of the classrooms, hall etc. shown to the Visiting Teams were very much different from each other. The first map indicated ground floor built up area of 1436 sq. Meter where as the second map indicated ground floor and first floor construction with built up area of 1846 sq. meter area.

(iii) Whether earlier building shown to the Visiting Team (I) along with map exist in a different part of the plot No. 132/1. If not, whether the earlier building was demolished to accommodate different requirements in the building with new map as shown to the Visiting Team (II) during the second visit i.e. within a gap of one year and nine months.

(iv) The bills and vouchers of books (purchased from different firms with dates) enclosed during Visiting Team (I) visit and Visiting Team (II) were different from each other. Total number of books purchased earlier (VT I) was 3012 and total number of books shown to (VT II) including new purchases afterwards was 3011. What happed to those books which were purchased earlier and shown to VT I? What happened to the previous accession register shown to VT I ?

Hence, NRC decided that Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the above point and direct the Institution to submit the

reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice.

Khasra No. 3429 has been declared non-agricultural land by SDM, Mirjapur on 31.03.2011. The land sale deed dated 31.03.2009 indicates that Khasra No. 3429 is of 0.0800 Hect. The land has been sold by Smt. Sakartiya and others and has been purchased by Vindhaya Sewa Evam Vikas Samiti, Mirjapur. The building plan on Khasra No. 3429 indicates that total covered area on ground floor is 1516.1 sq. Meter and total plot area is 2500 sq. Meter. This is not possible.

The application submitted by the institution on 10.10.2010 shows that the plots in possession of the institution bear numbers 3319, 3358, 59, 60, 61, 62, 74,75, 76 & 77. The page 7 of the application indicates that built up area earmarked for the course is 2250 sq. meters.

One other sale deed dated 2.3.2009 shows that the land has been sold by Smt. Birija Devi and has been purchased by

HSD Shiksha Niken and the plots of this land bear numbers 3319, 3358, 3359, 3360, 3361, 3362, 3374, 3375, 3376, 3377 (total 2.1300 hectares,)

An order dated 25.4.2009 of SDM, Mirjapur indicates that the building of HSD Shiksha Niken stands on plots 3319, 3358, 3359, 3360, 3361, 62, 74, 75, 76 & 77.

On other building plan signed by Pradhan, Gram Panchayat on 05.01.2010 indicates that total covered area is 2633.25 sq. Meter and total plot area is 3600 sq. Meter.

This building plan does not bear any Khasra No.

A third sale deed dated 16.7.2011 shows that the land which contained Khasra No. 3429 (0.0300 hectare) along with others, has been sold by Heeralal and has been purchased by Vindhaya Sewa Evam Vikas Samiti.

Why criminal proceedings be not initiated against you for misleading the NRC with regard to the plot/plots on which HSD Shiksha Niketan Building is situated. The institution should explain the purpose of submission of two sale deeds, other than the one which mentions Khasra No. 3429 on which the building has been claimed to have been constructed.

The institution should explain why the plot number on which the building is supposed to have been constructed has not been mentioned in the plot numbers in the possession of the institution as per the information mentioned in the application submitted by the institution.

Visiting Team inspected the institution on 5-6, February, 2012. VT has made the following observations:

Trust runs a school in the same premises and science lab for B.Ed. is in school building.

Constructed existing building is not according to building plan as per Visiting Team Report.

ICT lab is not as per NCTE norms. Furniture in psychology lab and other

rooms needs improvement. Fire extinguishers needs to be installed. Multipurpose hall is small in size and not

as per NCTE norms. Number of titles of books in library for

B.Ed. is not as per NCTE norms. As the institutuion is running in a school

premises, therefore, he institution is required to submit duly approved building plan exclusively earmarked area for B.Ed./D.El.Ed. course under provisions of clause 8 (7) (ii) of NCTE, Regulations, 2009.

During the discussion it was brought to the notice of the Committee that the HP University has disaffiliated the institution. However, the course is being run inspite of the disaffiliation by the University. However, as the facilities for proposed B.Ed. course are not sufficient.

As per Visiting Team Report, Amity Institute of Education, Amity Campus, M-Block, Saket, New Delhi – 17 was offering B.Ed. for intake of 100 students and got recognition vide Order No. NRC/NCTE/F-3/DH-184/2004/14203 dated 9.3.2005. The institution is housed on the land leased (perpetual lease) to the Society (Ritnand Balved Education Foundation, E-37, Defence Colony, New Delhi-24) by Delhi Development Authority for running school. The B.Ed. programme is being run in the III floor of Amity International School on the built up area of 1749 sq. meter. The institute also runs ETE and ECCE programmes recognised by NCTE during 2005 on different floors with areas 1503 sq. meters and 1006.71 sq. meters respectively.

The recognition was given to the institution to B.Ed. and other programmes of teacher education as per norms of respective courses prevailing in the year of recognition i.e. 2005.

Recognition for B.Ed. course for 100 students vide order No. F.NRC/NCTE/F-3/PB-271/9660-9669 dated 24.08.2005. 1 Principal, 7 teachers, duly approved.

A complaint was lodged against the said institution. This complaint was forwarded to NRC office vide 5299-5300 on 11.7.2011. In response to this complaint a show cause notice was issued to the concerned institution vide letter No. NRC/NCTE/PB-271/191st

meeting/2012/14752 submitted by institution by reference No. 606/TBed/11/02/2012.

The reply was presented before the NRC. The Committee has expressed displeasure about non-fulfilling of sanctioned posts after such a

long time. It reflects that the institute has no intention to stick to the norms of NCTE guidelines and because of paucity of trained teaching and approved staff and a technically qualified Principal, the teacher education is suffering.

Therefore in the light of the above facts, the complaint of non-availability/shortage of trained and approved staff stands correct.

The noncompliance of NRC,NCTE instructions and in clear violation of NCTE norms the NRC Committee has no option but to withdraw the recognition given for B.Ed. course of the concerned institution.

The case deals with the shifting of place of institution and continuance of recognition. The concerned institution has approached the Hon’ble High Court and has filed Writ Petition No. 11460/2010 and Writ Petition No. 11336/2009.

In response to the above Writ, Hon’’ble Court has issued an order on February 08, 2012 and has directed NRC “On considering the representation submission made on 16.02.2012. I am of the considered view that the interest of justice require that the present premises, covered by it, be inspected by the NRC of NCTE, Jaipur and submit its report in the light of the guidelines issued by NCTE. The report after inspection of the premises, be submitted within a period of two months from today. In case the petitioner fulfils the norms as prescribed and required under the guidelines issued by NCTE, the recognition which has been withdrawn be restored.”

Clarification of Manglayatan University dated 05.03.2012 was read and discussed. The following para wise observations have been made:-

1. Read. No comments are required.2(a) There is no provision of initiating a

B.Ed. programme in a project mode in the Rules/Regulations of NCTE.

2(b) This has been done by Manglayatan University. No comments are required.

2(c) NRC does not accept directions from applicant institutions. All teacher training programmes are regulated and screened by NRC as per the NCTE norms.

2(d) There are no concepts like “Implicit approval”, “tantamounting to recognition”. Contents are not accepted.

2(e) It was imperative to refer the application of Manglayatan University to start M.Ed. (Innovative programme) because it is the application through which Manglayatan University informed NRC:-

(i) that B.Ed. Innovative programme has already commenced since 10th

August, 2009.(ii) Recognition order for B.Ed. course is

(iii) The date of recognition of B.Ed course is 8th September, 2009.

(ii) and (iii) above are wrong information.

Hence, astonishment of Manglayatan University is obvious because these very wrong information became the basis of the erroneous observation of NRC which reads “Institution has not completed three years of running B.Ed. course.”

2(f) Read. No comments required.2(g) M.Ed. application is not irrelevant

because it is the only document through which NRC could know that Manglayatan University has started B.Ed. Innovative Programme without grant of recognition from NRC. Not starting the M.Ed. course is the only action which is correct.

2(h) Read. Not accepted. This is wrong allegation.

2(i) Read. Accepted. NRC deals with such cases as determined by NCTE.

2(j) Read. No comments are required. 2(k) Read. Allegation is wrong.

The real issue is this that Manglayatan University has violated the Norms and Regulations by starting B.Ed. (Innovative Programme) without the grant of recognition by NRC.

2 (l) Read. Not accepted. Hon’’ble Supreme Court’s decisions are supreme and it is wrong to question their applicability.

2 (m) Read. Not accepted. These are not unfounded observations. Lapse is on the part of Manglayatan University because it has started B.Ed. (Innovative Programme) without any grant of recognition from NRC.

Hence clarifications are not accepted. Furthermore, the Manglayatan University vide its letter No. MU/RO/letter/10-11/403 dated 02.07.2011 has informed that B.Ed. (Innovative programme) has already been commenced in the session 2009-2010. Manglayatan University also informed that one batch has already successfully completed this course. The Manglayatan University be issued a

show cause notice as to why not its application for B.Ed. (Innovative programme) be rejected on the above mentioned points and also on the basis of the fact that it has admitted students in an unrecognised course.

This LOI clearly mentions that ”Admissions should not be made until formal recognition order under para 7(12) of the Regulations dated 13th January, 2006 is issued by the NRC”. This LOI further maintains that this LOI is “subject to shifting of their own building within one year with the prior permission of NCTE. If it is not shifted then it is deemed to have de-recognised”.

A letter dated 03.03.2011 of the institution reveals that B.Ed. course is being run by the institution for last three years. This is in gross violation of the above mentioned LOI. Furthermore, the application for grant of recognition on 29.11.2011 reveals that this institution has been affiliated with MLS University, Udaipur on 27.01.2009.This affiliation with the University is without the formal recognition from the NRC.

The institution vide its letter dated 29.11.2011 has made a request to get itself shifted in the new building. This request has come after 3 years and seven months. Prior to this, a letter

dated 03.03.2011 of the institution also has sought permission to shift to its own building.

Hence, NRC decided to refuse grant of recognition for B.Ed. course on the grounds mentioned in the Show Cause Notice under Section 14(3)(b) of the NCTE Act, 1993.

The map submitted by the institution indicate the size of Multipurpose hall is 1500 sq.feet. , which is less than the required 2000 sq.feet as per NCTE norms.
