Summary

The Title IX Coordinator performs the following roles:

Provides university-wide leadership for all university activities and efforts to build a safe and equitable campus community free from sexual harassment and gender discrimination;

Coordinates Utah State University’s compliance with federal and state statutory and regulatory requirements regarding sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination on the Logan campus, on USU’s regional campuses, and at USU Eastern in Price and Blanding;

Identifies and addresses any systemic problems relating to complaints and collaborates with other departments to ensure policies prohibiting and addressing USU’s response to allegations of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination are communicated to all constituencies; and

Fosters a university-wide culture characterized by equity and inclusion, along with an investigation process rooted in compassion, fairness, and respect.

Reporting and Supervisory Responsibilities

The Title IX Coordinator reports to the Director of the Affirmative Action/Equal Opportunity Office (AA/EO). The position has no direct employee supervisory responsibilities but is responsible for the University’s compliance with Title IX, including the implementation of policies, procedures, protocols, Title IX education and prevention efforts, whether implemented directly by the Title IX Coordinator or by other units on campus.

Typical Functions1. Leads USU’s Title IX efforts and serves as a passionate advocate for equity and inclusion on

campus and in the community.2. Develops, implements and monitors the University’s compliance program for Title IX and Title

VII’s prohibition of discrimination based on sex. 3. Manages the University’s centralized review, safety and risk assessment, investigation and

resolution of reports of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination and addresses any patterns or systemic problems that arise during the review of such complaints.

4. Develops and maintains a case management plan, including investigation procedures, tasks and activities for each investigation.

5. Maintains and updates the case management system and database, ensuring all reports and investigations of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination are accurately recorded and tracked in the database.

6. Leads the evaluation of requests for confidentiality by those who report or complain about sexual misconduct in accordance with the University's confidentiality policy, Title IX regulations, and state and federal law.

7. Takes steps to ensure the parties' equal access to the University's programs and activities and protects the parties as necessary. Such steps may include recommending interim measures during an investigation, providing remedial measures, and making the parties aware of all available resources.

8. Reviews proposed sanctions for sexual misconduct before they are imposed to ensure that they are reasonably calculated to stop the sexual misconduct and prevent its recurrence.

9. Reviews, provides feedback and direction, and approves investigation reports. In some cases, the Title IX Coordinator may draft investigation reports. Reviews findings and recommendations with AA/EO director, as necessary.

10. Collaborates with multi-disciplinary university offices and personnel to provide information, support, resources, interim remedies, and accommodations to university students, faculty and staff.

11. Provides or cooperates with other university offices to provide engaging and effective training, education and prevention programs related to sexual harassment, sexual violence, gender discrimination and other related topics.

12. Provides and/or facilitates ongoing training, consultation and technical assistance for faculty and staff; outlining their rights and obligations under Title IX, reporting options, grievance procedures, applicable disciplinary code, the employees who must report incidents of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination to the Title IX Coordinator, how to report such incidents, and Title IX's protections against retaliation.

13. Coordinates with Student Affairs, including without limitation the Office of Student Conduct and SAAVI, to provide and/or facilitate ongoing training, consultation and technical assistance for all students outlining their rights under Title IX, reporting options, grievance procedures, applicable disciplinary code, the offices or individuals with whom students can speak confidentially and who can provide support services, the employees who must report incidents to the Title IX Coordinator, and Title IX's protections against retaliation.

14. Reviews, updates and maintains university policies and procedures for providing prompt and equitable resolution of student and employee complaints of conduct that violates the University’s prohibition of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination.

15. Reviews for compliance all college, department and unit-level policies, procedures, guidelines, rules, handbooks and other publications that provide information regarding sexual harassment,

sexual misconduct, dating violence, domestic violence, stalking, and gender-based discrimination on the Logan and regional campuses and at USU Eastern in Price and Blanding.

16. Participates in ongoing training and professional development, including self-study, to ensure responsibilities of position are carried out in compliance with Title IX and its implementing regulations, developing case law, and best practices. Also ensures that all members of the AA/EO Office receive adequate training on these matters.

17. Prepares and publishes an annual report summarizing the number, nature, and disposition of reports of sexual harassment, sexual misconduct, dating violence, domestic violence, stalking and gender-based discrimination and describing the University’s education and prevention activities related thereto.

18. Ensures protocols and practices are in place for working with local law enforcement and coordinating with local victim advocacy organizations and service providers.

19. Collaborates with and maintains strong relationships with local law enforcement agencies (e.g. USU Police, Logan City Police) and campus and community resources (e.g. USU’s Sexual Assault and Anti-Violence Information Office, USU’s Counseling and Psychological Services, Citizens Against Physical & Sexual Abuse, known as CAPSA, and the Family Place).

20. Works to strengthen the culture that supports a safe and respectful learning, working, and living environment on campus.

21. Performs miscellaneous job-related duties as assigned.

Minimum Qualifications: Bachelor’s degree in a related field and at least four years of related work experience required.

Solid understanding of federal Title IX regulations, the Violence Against Women Act Reauthorization of 2012 (VAWA), the Clery Act, and other relevant statutes and guidance.

Ability to maintain a high degree of confidentiality.

Ability to use independent judgment and to manage and impart confidential information.

Ability to work under multiple deadlines and sensitive timelines.

Evidence of effective spoken, written, and interpersonal communication skills, including active listening.
