As you know, while being debriefed by agents and prosecutors in connection with a bribery scheme originating in the District of Oregon, Levey admitted that he also had been involved in a bribery scheme pertaining to Levey's efforts to supply parking meter equipment to the company implementing the City of Chicago's parking meter privatization project. In short, Levey admitted that he had paid $90,000 to Philip Oropesa, a former executive with LAZ Parking, to ensure that Levey's company would win the contract. Levey thereafter met with agents and prosecutors on several occasions in both New York and Chicago to fully describe the bribery scheme with Oropesa and, at the government's request, testified in the grand jury. Both the agents and prosecutors found Levey cooperative and determined that the information he provided was truthful and accurate. We were able to corroborate much of the information - he provided both with documents and other records as well as Oropesa's eventual admissions. As a result of Levey's cooperation, Oropesa was charged in the Northern District of Illinois with honest services wire fraud, in violation of 18 U.S.C. §§ 1343 and 1346. Oropesa has asked that the case be transferred to the Northern District of Georgia where he intends to enter a guilty plea. We likely would have been unable to charge Oropesa without Levey's cooperation. The cooperation provided by Levey was significant enough that if Levey had been charged in the Northern District of Illinois, we would have made a motion for a substantial assistance departure, pursuant to Guideline § 5Kl.l.
