2.00 – 2.40: Right to Manage – the opportunities for leaseholders and their professional advisers – by Professor James Driscoll

Those involved in advising on enfranchisement and new lease claims often find it useful to consider alternative approaches when helping leaseholders achieve their goals. The statutory right to manage is one such alternative as it can provide the control of the management of the building they desire without having to fund a freehold purchase. As a no-fault based right it can be very straightforward but, as seemingly endless court and tribunal decisions show, great care must be taken at the preliminary stages. This talk will demonstrate how important it is for practitioners to be familiar with what the RTM can bring and how it can be achieved.

Jennifer Ellis’ talk will cover the importance, role and standing of those owning intermediate leases and how they are compensated when their interests are diminished.

Anna Favre will present relevant case law on the meaning of common parts and occupation for residential purposes together with practical examples on the application of section 4(1) of the 1993 Act to mixed-use buildings.

Anthony Radevsky will provide an overview of the most important decisions of recent months and assess their impact on the enfranchisement sector.

The Association prides itself on delivering conferences twice a year that are specific and relevant to the leasehold enfranchisement sector. It is this focus that has led to the last two conferences selling out, so please take the time to book your place at the event to avoid disappointment.

We will be returning to the Royal Institution, in the heart of London’s Mayfair. The main conference will be held in the renowned Faraday Theatre, home to the famous televised Christmas lectures. Lunch and afternoon refreshments will be served on the first floor and we will round off the event with a drinks reception.

We are delighted to welcome ALEP’s Honorary President, Damian Greenish, as host of ALEP’s 16th Conference

Damian Greenish is Chairman of Pemberton Greenish LLP and ALEP’s Honorary President. He has been a solicitor for over 40 years and is a leading authority on leasehold reform, advising both landlords and tenants on all aspects of leasehold enfranchisement.He has been involved in many of the landmark leasehold reform cases in the Supreme Court, House of Lords, Court of Appeal, High Court and the valuation tribunals, including: Hosebay; Shalson; Sportelli; Aggio; Magnohard, Dolphin Square and many others.He has been the joint editor of Hague on Leasehold Enfranchisement since 1998; the 6th Edition of the book has recently been published. He is well known both as a speaker and chairman at the leading conferences and seminars in this specialised sector of the law.

Professor James Driscoll, Judge at the First-tier Tribunal

Professor James Driscoll is a solicitor, author and Judge (part-time) at the First-tier Tribunal (Property Chamber). For 20 years he was a consultant solicitor with Trowers & Hamlins specialising in housing law. A prolific author of books and articles, he is the Consultant Editor to the Butterworths Residential Landlord and Tenant Handbook, to Halsbury’s Laws (volume 56, ‘Housing’) and volumes 62, 63 and 64 (‘Landlord and Tenant) and several other books and loose-leaf works. James is a consultant editor to the Landlord and Tenant Reports, regularly contributes articles to the Estates Gazette, the New Law Journal and other publications, and is a visiting professor at the University of Essex.

Anna Favre, Partner, Residential Real Estate, Pemberton Greenish

Anna Favre is a partner in the Residential Real Estate team at Pemberton Greenish LLP. She is a recognised and leading expert in the complex field of leasehold enfranchisement, acting for major London landed estates including Cadogan, Sloane Stanley and the Day Estate as well as a large number of tenants. Equally, she advises companies and high net worth individuals on all aspects of landlord and tenant law. Anna regularly presents at conferences and seminars and has written for both the legal and general press on these specialist areas. In both 2013 and 2014 she won Solicitor of the Year at the Enfranchisement and Right to Manage Awards.

Anthony Radevsky, Barrister, Falcon Chambers

Tony Radevsky practises in the law of commercial and residential landlord and tenant and real property, including property-related professional negligence. His main specialism is leasehold enfranchisement (including the right of first refusal). He is co-author of the leading textbooks, including the 6th edition of Hague on Leasehold Enfranchisement. Recently reported cases include: Wiggins v Regent Wealth (2014), Westbrook Dolphin Square v Friends Life (2014), Helman v John Lyon (2014), Albion Residential v Albion Riverside Residents RTM Ltd (2014) and Howard de Walden v Accordway (2014).

Jennifer Ellis FRICS, Senior Partner, Langley Taylor

Jennifer Ellis has been involved with the leasehold reform acts since the 1967 Act was introduced. She is a valuer whose clients are freeholders, intermediate landlords and claimants. She acted for Westbrook from about 2006, advising on their claims which led to the recent purchase of the freehold of Dolphin Square. Jennifer gives expert valuation evidence, both on claims themselves and on the ‘side issues’ that arise. She also acts as an arbitrator. She is the author of the chapters on leasehold reform in ‘Statutory Valuations’ and regularly speaks at conferences.
