Bilindi¤i üzere, 1994 öncesi s›nai mülkiyet haklar›n›nkorunmas› ile ilgili ifllemler, Sanayi ve Ticaret Bakanl›¤›bünyesinde yer alan "S›nai Mülkiyet DairesiBaflkanl›¤›"nca yürütülmüfltür. Bu meyanda ülkemizdeetkin bir s›nai mülkiyet korumas› için at›lan en önemliad›m, Türk Patent Enstitüsü'nün (TPE) kurulufluolmufltur. Türkiye’de s›nai mülkiyet haklar›n›nkorunmas› görevini üstlenen TPE, bu görevleri dahaetkin biçimde yerine getirmek ve sanayinin gelifliminekatk› sa¤lamak için bu alanda dünyan›n önde gelenkurumlar›ndan biri olmay› hedeflemifltir.

Bu hedeflere yönelik at›lan her ad›m;• Araflt›rma gelifltirme faaliyetlerinde art›fl, • Yeni üretim usulleri ve ürünlerin sanayiye

uygulanmas›nda art›fl,• Üniversite sanayi iflbirli¤inde geliflme,• Yeni teknolojiler ve yeni bulufllara iliflkin bilginin

yayg›nlaflmas›, • Yabanc› sermaye girifli ve yabanc› yat›r›mlarda art›fl,

sonuçlar›n› do¤uracakt›r.

Bu da tüm sektörler için önemli geliflme ortam›oluflturmak anlam›na gelmektedir.

Serbest piyasa ekonomisini ve rekabetçi bir piyasayap›s›n› benimsemifl olan ve özellikle CumhuriyetDöneminde h›zla sanayileflen Türkiye’de, dünyadakigeliflmelere paralel olarak, TPE taraf›ndan yürütülenfaaliyetler sonucunda toplumda s›nai mülkiyet bilincinindüzenli bir art›fl gösterdi¤i, baflta sanayiciler veifladamlar› olmak üzere toplumun her kesiminde bir ilgiart›fl› oldu¤u gözlenmektedir.

Ülkemizdeki rekabetin geliflmesine önemli katk›larsa¤layan ve buna ba¤l› olarak çok önemli görevleriüstlenmifl olan Türk Patent Enstitüsü Yönetimine, 2003y›l› sonunda atanm›fl bulunmaktay›z. Bu dönem DünyaBankas› projeleri kapsam›nda s›nai mülkiyet kampusuinflaat›n›n ve otomasyon projesi çal›flmalar›n›nyürütüldü¤ü, uluslararas› mevzuatla uyum amaçl› yasahaz›rlama çal›flmalar›n›n devam etti¤i ve kuruluflundanitibaren h›zla geliflen TPE’nin 5000 say›l› Kanununç›kar›lmas›yla yeniden yap›lanmas›nda önemli bir ad›m›nat›ld›¤› bir geçifl dönemi olmufltur.

FROM THE PRESIDENT

The most important step towards achieving an efficient

Industrial Property Rights system in our country has

been the establishment of Turkish Patent Institute (TPE).

Commissioned with the protection of industrial

property rights, TPE assists in industrial development

and aims to become one of the leading offices of the

world to efficiently perform its duties.

Every step towards this aim would result in;

• Increase in research and development facilities,

• Increase in number of new production methods and

applications of the products in the industry,

• Development of cooperation among universities and

industry sector,

• Dissemination of new technologies and information

related to inventions,

• Increase in foreign capital and investment,

This in turn means forming an important development

environment for all the sectors.

In Turkey, who has adopted free trade and competitive

market and has been industrialized rapidly, a steady

increase has been observed in the public awareness

regarding industrial property rights and the overall

interest of public and particularly the industrialists and

businessmen as a result of the facilities performed by

TPE in conjunction with the developments throughout

the world.

The management was appointed to our Institute at the

end of 2003, which provides indispensable support to

the competition in our country and has undertaken very

crucial duties. Taking a look at the picture of the

situation when we overtook the duties, we have

observed a very large accumulation of pending files

particularly in trademarks, long service durations for

procedures that should be concluded within short

periods, problems in the international projects and the

construction of TPE’s New Campus Building under the

Industrial Technology Project. Within this frame, it is

necessary to take immediate measures and objectives.

Yeni yönetim olarak devrald›¤›m›z tabloya göz atacakolursak; di¤er sorunlar›n yan›nda, özellikle markabaflvurular›nda büyük bir birikimin oldu¤u, çok k›sasürede sonuçland›r›lmas› gereken ifllemler için uzun sürebeklenildi¤i, baflta Avrupa Patent Ofisi (EPO) olmaküzere uluslararas› projelerde ve Endüstriyel TeknolojiProjesi kapsam›nda yürütülen TPE yeni kampusinflaat›nda aksakl›klar›n bulundu¤u görülmüfltür. Bukapsamda Enstitümüzde acil önlemlerin al›nmas› veTPE’nin daha etkin ve sa¤l›kl› bir yap›ya kavuflaca¤› yenibir yap›lanma için hedeflerin belirlenmesi gerekmektedir.

Bu nedenle hedeflerimize de¤inmek istiyorum.

• Baflta Markalar Dairesi Baflkanl›¤› olmak üzere TPE’de mevcut ifl ve dosya birikiminin süratle eritilmesi, 5 y›ld›r ifllem görmeyen tan›nm›fl marka baflvurular›n›n sonuçland›r›lmas›,

• Kurumun yeniden yap›land›r›lmas› sa¤lanarak daha etkin bir yap›ya sahip olmas›, bu konuda TPE için yeni bir "vizyon" tan›mlanarak, kurumun misyonu, organizasyon yap›s›, ifllemlerin ak›fl flemas›n›n da etüd edilece¤i kapsaml› bir organizasyon çal›flmas›n›n yap›lmas›,

• Ülkemizdeki s›nai mülkiyet haklar› ile ilgili koruman›nen süratli, fleffaf ve adil bir biçimde yap›larak, üst düzeyde hizmet standard›na ve kalitesine ulafl›lmas›,

• Endüstriyel Teknoloji Projesi çerçevesinde 15 May›s 2002 tarihinde inflas›na bafllan›lan S›nai Mülkiyet Kampusü inflaat›n›n acil eksikliklerinin tamamlanarak Nisan 2004 sonunda, içerisinde ‹htisas Mahkemesi, kütüphane, arfliv salonlar› ve 500 kiflilik konferans salonunun bulundu¤u yeni hizmet binas›na tafl›n›lmas› ve di¤er eksikliklerin süratle tamamlanmas›,

• Baflta Avrupa Patent Ofisi olmak üzere yürütülmekteolan uluslararas› projelere h›z kazand›r›larak, Dünya Fikri Mülkiyet Teflkilat› (WIPO) gibi geçmiflte kullan›lmayan imkanlar›n kullan›l›r hale dönüfltürülmesi,

• Enstitümüzün, yurt içindeki tan›t›m› (e¤itim, bilinçlendirme ve belgelendirme) seferberli¤inin en üst seviyeye ç›kar›lmas› ve TOBB, KOSGEB, TUB‹TAK ve üniversiteler ile iflbirli¤i sa¤lanarak faaliyetlerin ve etkinliklerin yurt genelinde yayg›nlaflt›r›lmas›,

• T.B.M.M. Komisyonlar›nda görüflülmekte olan Kanun Tasar›lar›n›n (Entegre Devre Topografyalar›, TLT, La Hey) yasal sürecinin tamamlanmas› ve TPE’nin mevcut mevzuat›n›n elden geçirilerek, ilgili KHK’lerin kanuna dönüfltürülmesi,

In this regard, I would like to emphasize our objectives.

• Quickly diminishing the accumulated current

workload,

• Making the Institute a more efficient structure by

institutional development; performing an

organizational study to focus on the mission, vision,

organizational structure and workflow of the

procedures.

• Defining a new "vision" for TPE, hence ensuring the

processes for the protection of industrial property

rights to be as transparent, fair and fast as possible;

reaching the highest level of service standards and

quality.

• Completing the construction of New Campus

Building, which has started in May 15, 2002 under

the Industrial Technology Project, and completing the

movement operations in April 2004 to the Campus

that contains the specialized court, library, archives

and the conference hall with 500 persons capacity,

• Increasing the number of national promotion

activities to the highest possible level (training,

awareness and documentation); strengthening

foreign relations,

• Enacting the Decree Laws, which were prepared

between 1994-1995 but could not be revised until

now, through extensive study on the TPE’s current

legislation,

• Adding lectures related to the industrial property

rights in the curricula of the universities.

• Implementing external training activities required by

the staff in accordance with a training program,

• Making the current databases available to the users

via Internet and CD media,

• Establishing a paperless office environment through

complete automation of procedures,

• Concluding the applications for well-known

trademarks that remain unprocessed for the last five

years.

As a start, we have accelerated our studies to increase

the public awareness on Industrial Property Rights,

revise ourselves towards reducing the bureaucracy to

the minimum level and increasing the service quality by

improving our technological infrastructure. In order to

achieve these, we have already started updating our

legislation to meet the today’s criteria. It is planned to


• TPE’nin kalifiye personel ihtiyac›n›n karfl›lanmas› ve

personelinin zaman içinde en aza indirgenmesi için

yeterli say›da kadro ihdas›n›n sa¤lanmas›,

• TPE personelini motive edici ve verimini art›r›c›

tedbirlerin al›nmas›,

• Personelin ihtiyaç duydu¤u kurum içi ve d›fl›

e¤itimlerinin bir program dahilinde gerçeklefltirilmesi,

• Üniversitelerde ve e¤itim kurulufllar›nda s›nai

mülkiyet haklar›na iliflkin konular›n ders

programlar›na dahil edilmesi,

• TPE bültenlerinin CD fleklinde da¤›t›m› ve mevcut

veri tabanlar›n›n internet ve CD üzerinden

kullan›c›lar›n hizmetine sunulmas›,

• Ka¤›ts›z Ofis kavram› do¤rultusunda tam otomasyona

geçilmesi,

• Patent baflvurular›nda tekni¤in bilinen durumuna

iliflkin araflt›rma raporlar›n›n ve patentlenebilirlik

kriterlerine iliflkin inceleme raporlar›n›n Enstitü

bünyesinde düzenlenmesi ve uluslararas› kurumlarla

elektronik veri taban› de¤iflimi sistemlerinin kurulmas›

ile ilgili altyap› çal›flmalar›na bafllan›lmas›,

hedeflenmektedir.

Öncelikle, kamuoyunu S›nai Mülkiyet Haklar›

konusunda bilinçlendirmek, kurumu revize ederek ifllem

süreçlerini asgari düzeye indirmek ve teknolojik alt

yap›m›z› iyilefltirerek hizmet kalitemizi artt›rmak için

çal›flmalar›m›za h›z verdik. Bunlar› yapmak için

mevzuat›m›z›n günümüz flartlar›na uyumlu hale gelmesi

çal›flmalar›na bafllam›fl bulunmaktay›z. Al›nacak idari

önlemler ve Enstitümüz personelinin özverili

çal›flmalar›yla bu dar bo¤az› afl›p kurumumuzu çok daha

ileriye götürece¤imize inan›yorum. Bu alt yap›y›

sa¤layarak hedeflerimize süratle ulaflaca¤›m›za olan

inanc›m›z tamd›r.

a very reduced period; even daily where available. I

strongly believe that we will be able to overcome the

bottleneck areas and carry our Institute to the next

century with these administrative measures and the

willful efforts of our staff. I would like to emphasis that,

Turkish Patent Institute will realize to transform itself

into a quality focused, highly productive, competitive,

responsive organization supporting a market-driven

industrial property system and will and be ranked one

of the highest quality, most efficient industrial property

organization in the world. While expressing my belief to

rapidly achieving our objectives, I would like to also

wish my staff success against the challenges that lie

Türkiye’de s›nai mülkiyet haklar›n›n korunmas›alan›ndaki yasal çal›flmalar›n tarihçesi Osmanl› Devletidöneminde bafllam›flt›r. Marka ve patent haklar›n›nkorunmas› hakk›ndaki ilk yasal düzenlemeler 1871tarihli "Alamet-i Farika Nizamnamesi" ve 1879 tarihli"‹htira Berat› Kanunu"dur. Söz konusu yasaldüzenlemeler, Osmanl› Devleti’ni, dünyada s›naimülkiyet alan›nda mevzuat çal›flmalar› yapan ilkdevletler aras›na sokmufl ve s›nai mülkiyet sistemimizintemellerinin at›lmas›n› sa¤lam›flt›r. Cumhuriyet’in ilky›llar›nda s›nai mülkiyet haklar›n›n korunmas›na yasalanlamda verilen önem, Türkiye’nin 1925 y›l›nda "S›naiMülkiyetin Korunmas› için Uluslararas› bir BirlikOluflturulmas› Hakk›ndaki Paris Sözleflmesi"ne kat›l›m›ile gösterilmifltir. 1965 y›l›nda yürürlü¤e giren 551 say›l›"Marka Kanunu" ve 1976 y›l›nda "Dünya Fikri MülkiyetTeflkilat› (WIPO) Kurulufl Anlaflmas›"na kat›l›m,Türkiye’de s›nai mülkiyet haklar› korumas› alan›ndakiönemli ad›mlar aras›nda yer almaktad›r.

1994 y›l› sonras› dönem ise, Türkiye’de s›nai mülkiyethaklar› korumas› alan›nda bir dönüm noktas› olarakkabul edilebilir. 24 Haziran 1994 y›l›nda Türk PatentEnstitüsü (TPE)’nün 544 say›l› Kanun HükmündeKararname (KHK) ile kuruluflu ve ard›ndan patent,marka, endüstriyel tasar›m ve co¤rafi iflaretler alan›ndaoluflturulan kanun hükmünde kararnameler, Türkiye’ninTPE öncülü¤ünde s›nai mülkiyet reformunu yapmas›n›sa¤lam›flt›r. Söz konusu dönem içerisinde oluflturulanmevzuat, Türkiye’nin, genel anlamda, Dünya TicaretÖrgütü Kurulufl Anlaflmas› ve eki Ticaretle Ba¤lant›l› FikriMülkiyet Haklar› Antlaflmas› (TRIPS)’ndan ve AvrupaBirli¤i ile Gümrük Birli¤i’nden kaynaklananyükümlülüklerini önemli ölçüde yerine getirmesinisa¤lam›flt›r.

Geliflen Türkiye’nin ihtiyaçlar› ve dünyada s›nai mülkiyetalan›ndaki geliflmeler takip eden y›llarda Türkiye’nins›nai mülkiyet altyap›s›n› oluflturan mevzuatlardayenilikleri zorunlu k›lm›flt›r. Yeni mevzuat reformununilk ad›m›, 2003 y›l›nda TPE Kurulufl ve GörevleriHakk›ndaki 5000 say›l› Kanunu’nun kabul edilmesiyleat›lm›flt›r.

ADMINISTRATIVE STRUCTURE

The history of legal process of protecting the Industrial

Property Rights in Turkey started in Ottoman Empire

period. The first legal arrangements on protecting

trademark and patent rights are "Regulations of

Discriminator Sign" dated 1871 and "Invention Patent

Law" dated 1879. By the mentioned legal arrangements

Ottoman Empire was one of the outgoing states

working on industrial property law procedure around

the world and laid the bases of our industrial property

system. It has been revealed the legal importance on

the protection of industrial property rights at the first

years of the Republic period by taking place of Turkey in

Paris Convention on an international integration to

protect industrial property in 1925."The Trademark

Law" numbered 551, which came in to force in 1965

and participating to "Convention Establishing World

Intellectual Property Organization", are one of the

biggest steps about protection of industrial property in

Turkey.

After 1994 it is possible to say that it is a new era in

Turkey for protection of industrial property rights.

Founding Turkish Patent Institute (TPI) on 24 June 1994

with the Decree Law no 544 and afterwards the Decree

Laws about patent, trademark, industrial design and

geographical signs provided Turkey the industrial

property reform in charge of Turkish Patent Institute

leadership. The legislation made in that period provided

Turkey in general to carry out the obligations of

foundation agreement of World Trade Organization

and its annex Trade Related Aspects of Industrial

Property Rights (TRIPS) and European Union as well as

Customs Union.

Following years the request of developing Turkey and

industrial property field made the legislation forming

Turkey’s industrial property substructure renovate. The

first step of the new legislation reformation constituted

by the acceptance of the law no 5000 about the Turkish

Patent Institute’s Establishment and Functions in 2003.

Mevzuat reformu, 2004 y›l› içerisinde s›nai mülkiyetin

tüm alanlar›nda, geliflmifl ülke standartlar›nda ve

Türkiye’nin ihtiyaçlar›n› karfl›layabilecek yeni kanun ve

yönetmeliklerin haz›rlanmas› ve yürürlü¤e girmesiyle

devam edecektir.

S›nai mülkiyet haklar›n›n korunmas› alan›, yaln›zca

ulusal mevzuat›n düzenlenmesi ve yasal koruman›n

sa¤lanmas› ile s›n›rl› olmad›¤›ndan, Türkiye konuyla ilgili

uluslararas› geliflmeleri de etkin biçimde takip etmifltir.

Bu çerçevede, Dünya Fikri Mülkiyet Teflkilat› taraf›ndan

yönetilen birçok uluslararas› antlaflmaya kat›l›m

sa¤lanm›fl, Avrupa Patent Ofisi (EPO)’ne üye ülkeler

aras›na girilmifl, Avrupa Birli¤i’nin ‹ç Pazar’da Uyum

Ofisi’nin (Marka-Endüstriyel Tasar›m) çal›flmalar› etkin

olarak takip edilmifl ve TRIPS yükümlülükleri yerine

getirilmifltir.

Kurulufl

TPE’nin kuruluflu, gerekçeleri ile birlikte, 5000 say›l›

Kanun’da afla¤›daki flekilde düzenlenmifltir:

Türkiye'nin teknolojik ilerlemesine katk›da bulunmak,

ülke içinde serbest rekabet ortam›n› oluflturmak ve

araflt›rma gelifltirme faaliyetlerinin geliflmesini sa¤lamak

üzere, çeflitli kanunlarla düzenlenmifl olan patent ve

markalar ile di¤er kanunlarla düzenlenen s›naî mülkiyet

haklar›n›n tesisi, bu konudaki koruman›n sa¤lanmas› ve

s›naî mülkiyet haklar›na iliflkin yurt içi ve yurt d›fl›nda

varolan bilgi ve dokümantasyonun kamunun

istifadesine sunulabilmesi amac›yla tüzel kiflili¤e sahip,

bu Kanunda belirtilmeyen hallerde özel hukuk

hükümlerine tabi, Sanayi ve Ticaret Bakanl›¤›na ba¤l›,

özel bütçeli Türk Patent Enstitüsü kurulmufltur. Türk

Patent Enstitüsü, bir kamu kuruluflu olup k›sa ad›

"TPE"dir.

Görevler

TPE’nin temel ifllevi Türkiye’nin teknolojik ve ekonomik

geliflimine, afla¤›da belirtilen görevleri yerine getirerek

katk› sa¤lamakt›r:

• Patent, markalar ve endüstriyel tasar›mlar ile di¤er

kanunlarla koruma alt›na al›nm›fl olan s›naî mülkiyet

haklar›n›n ilgili mevzuat hükümleri uyar›nca tescilini

ve bu haklar›n korunmas› ile ilgili ifllemleri yerine

getirmek.

The legislation reformation during 2004 is to carry on inall the areas of industrial property by making new lawson the level of developed countries, which can respondall the needs of Turkey and coming into force.

Turkey followed the protection of Industrial PropertyRights area, not just being determined with arrangingthe national law and providing legal protection,carefully about the issues connected to the internationalimprovements.

In this framework, it has been participated manyagreements administered by World Intellectual PropertyOrganization, joined European Patent Office (EPO),followed actively the Office for Harmonization inInternal Market (OHIM) (Trademark- Industrial Design)works and executed Trade Related Aspects of IndustrialProperty Rights (TRIPS) obligations.

Foundation

The foundation of Turkish Patent Institute and itsreasons to establish came into force as the Law no 5000below:

Turkish Patent Institute has been established, as anindependent legal entity with a special budget beingattached to Ministry of Industry and Trade to be liableunder special judiciary provisions for matters notprovisioned by this Law, with the objective ofsupporting the technological development of Turkeyand of establishing and protecting of industrial propertyrights, as well as providing the public with theworldwide information on industrial property rights,thereby supporting the cultivation of a competitiveenvironment and the development of research&development activities. The Turkish Patent Instituteestablished as a public institution has ‘TPI’ as its initials

Functions

The main aim of the Turkish Patent Institute is tocontribute Turkey’s technologic and economicdevelopment by fulfilling the duties below:

• To implement services for the registration of industrial property rights provisioned by the Patent Trademark and industrial design Laws and the otherrelated Acts and undertake related activities for the protection of such rights thereof.


• Zorunlu lisans ifllemlerinde arabuluculuk faaliyetlerinde bulunmak ve mahkemelerde bilirkiflilik yapmak.

• Lisans ve devir anlaflmalar›n› tescil ve kay›t etmek.

• Bulufllar›n kullan›m›n› takip etmek, yeni teknolojilerinde¤erlendirilmesi ile teknoloji transferinin yönlendirilmesi ve arflivlenmesi ifllemlerini yapmak.

• Yurt d›fl›nda benzer kurulufllar ve uluslararas› kurulufllarla iflbirli¤inde bulunmak.

• Türkiye'yi Bakanl›¤›n onay› ile uluslararas› kurulufllarnezdinde temsil etmek.

• S›naî mülkiyet haklar› ile ilgili uluslararas› anlaflmalar›n haz›rlanmas›na ülke ç›karlar›n› koruyarak katk›da bulunmak ve bu anlaflmalar›n Türkiye'de uygulanmas›n› sa¤lamak.

• Yurt içi ve yurt d›fl›nda teknoloji ve araflt›rma- gelifltirme ile ilgili kurum ve kurulufllarla ve bilgi bankalar›yla iflbirli¤i yapmak, dokümantasyon merkezleri kurmak, bu bilgileri kamunun istifadesine sunmak.

• S›naî mülkiyet haklar› ile ilgili olarak çeflitli yay›nlar yapmak ve S›naî Mülkiyet Bülten ve Gazeteleri’ni periyodik olarak yay›nlamak.

• S›naî mülkiyet haklar› konular›nda yurt içinde kifli ve kurulufllar›n bilgilendirilmesi ve yönlendirilmesi için gerekli çal›flmalar› yapmak.

• Görev alan›na giren konularla ilgili akademik çal›flmalar› desteklemek.

• Publish material on industrial property rights and Industrial Property Bulletins and Official Trademark Gazette periodically.

Söz konusuKanun’un 7 inci maddesine göre, TPE Dan›flma Kurulu Toplant›s› 31 Aral›k 2003 tarihinde yap›lm›flt›r. An›lan toplant›daTPE’nin faaliyet plan›, bütçe ve çal›flma programlar› görüflülmüfltür. Gelecek y›l çal›flma planlar›m›z›n oluflumundaüyelerin düflünce ve tavsiyeleri de göz önünde bulundurulacakt›r.

çerçevede, Avrupa Birli¤i

Mevzuat›na uyum çal›flmalar› da

dikkate al›narak yeni bir kanun

haz›rlanmas› çal›flmalar›na

bafllanm›fl ve söz konusu

çal›flmalar sonucunda haz›rlanan

tasar›, TBMM’nde 06/11/2003

tarihinde kabul edilmifltir.

It has seen that "some main differences from the

Decree Law No: 544 for Establishment and Functions of

the Turkish Patent Institute which was promulgated in

Official Gazette No: 21970, dated June 24, 1994, was

not sufficient for both industry

and trade sides and also its

own needs in the following

years. In this aspect, It has

been started to make a new

law for adaptation to the

European Union Law and the

draft of a proposal prepared

"Endüstriyel Tasar›mlar Dairesi Baflkanl›¤›" oluflturularak,

Main novelties of Law No: 5000 for Establishment

serves as a Department Directorship although it is one

of the main process units of the Turkish Patent

Institute has turned to Industrial Designs Department

and started to serve more effectively.

- Entegre Devre Topografyalar›n›n Korunmas›Hakk›nda Kanun Tasar›s›

Türkiye-AB Ortakl›k Konseyi Karar› ve Dünya TicaretÖrgütü Antlaflmas› eki Ticaretle Ba¤lant›l› Fikri MülkiyetHaklar› Anlaflmas›’ndan (TRIPs) kaynaklananyükümlüklerimiz çerçevesinde haz›rlanan ve ülkemizdeyeni bir s›nai mülkiyet hakk›n›n tesis eden "EntegreDevre Topografyalar›n›n Korunmas› Hakk›nda KanunTasar›s›", TBMM "Sanayi, Ticaret, Enerji, Tabii KaynaklarBilgi ve Teknoloji Komisyonu"na sunulmufltur.

- Baz› Kanun Hükmünde KararnamelerdeDe¤ifliklik Yap›lmas›na Dair Kanun Tasar›s›

Avrupa Birli¤i mevzuat›na uyum çal›flmalar› paralelinde,uygulamada karfl›lafl›lan sorunlar›n afl›lmas› ve mevcutmevzuat›n güncellefltirilmesi amac›na yönelik olarakhaz›rlanan, bu çerçevede s›nai haklar mevzuat›ndade¤ifliklikler içeren "Baz› Kanun HükmündeKararnamelerde De¤ifliklik Yap›lmas›na Dair KanunTasar›s›"na nihai flekli verilmifltir. Tasar›, TPE YönetimKurulu taraf›ndan görüflülmüfl ve Sanayi ve TicaretBakanl›¤›’na gönderilmifltir. Söz konusu tasar›, flu andaBaflbakanl›k Kanunlar ve Kararlar GenelMüdürlü¤ü’ndedir.

- Türkiye Patent ve Marka Vekilleri Birli¤iKuruluflu Hakk›nda Kanun Tasar›s›

Patent ve marka ifllemleri için baflvuru sahiplerini Enstitünezdinde temsil etme, dan›flmanl›k yapma, s›naimülkiyet haklar›n›n korunmas› için Enstitü nezdindegerekli giriflimlerde bulunma ve ifllemleri yürütmeyetkilerini haiz olan patent ve marka vekillerinin de birbirlik alt›nda faaliyetlerini sürdürmeleri amac›ylahaz›rlanan, "Türkiye Patent ve Marka Vekilleri Birli¤iKuruluflu Hakk›nda Kanun Tasla¤›"n›n nihai fleklininverilmesi amac›yla oluflturulan komisyon çal›flmalar›n›tamamlam›flt›r. Taslak hakk›nda ilgili kamu kurum vekurulufllar›n›n görüflleri de al›nm›fl ve gelen önerilerdo¤rultusunda nihai revizyon çal›flmalar›na devamedilmektedir.

The Draft of a Proposal Law on Protection ofTopographies of Integrated Circuits that found a newindustrial property right in our country and preparedaccording to the obligations indicated Turkey-EuropeanUnion Council Decision and World Trade OrganizationTreaty’s annex called Trade Related Aspects ofIntellectual Property Rights (TRIPS) has submitted toNational Assembly of Turkish Republic "Industry, Trade,Energy, Natural Resources Commission".

- The Draft of a Proposal Law on Changes onSome Decree Laws

The Draft of a Proposal Law on Changes on Some ofDecree Laws which includes some changes about thelegislation of industrial rights have finalized after in aharmony with harmonious to European Union Law toovercome the problems putting them into practice andupdate the existing law. The draft of a proposal law hasbeen discussed by Turkish Patent Institute’s themanagement board and send off The Ministry ofIndustry and Trade. The mentioned draft of a proposallaw is at Prime Ministry Decisions and Laws GeneralDirectorship at present.

- The Draft of a Proposal Law on Foundation ofTurkish Patent And Trademark Attornies Union

The commission procedure, which formed for an aim offinalizing the Draft of a Proposal Law About Foundationof Turkish Patent And Trademark Attorneys Union,represent the applicants of the patent and trademarkprocedure, work as an consultative, enterprise for theprotection of industrial property rights an attorney ofthe Institute, maintain the patent and trademarkattorneys who has enabled authorization activities in aunited form has completed its activities. Different viewshave been talked over the Draft of a Proposal Lawfrom the public sector and Institutions and the finalrevision procedure has been going on in the direction ofcoming proposals.


- 551 Say›l› Patent Haklar›n›n Korunmas› Hakk›ndaKanun Hükmünde Kararname ve bu KararnameninUygulama fieklini Gösterir Yönetmelik Revizyonu

Avrupa Birli¤i mevzuat›na uyum çal›flmalar› çerçevesinde,"551 Say›l› Patent Haklar›n›n Korunmas› Hakk›nda KanunHükmünde Kararname" ve ilgili yönetmeli¤ingüncellefltirilmesi çal›flmalar›na TPE bünyesindeoluflturulan "Mevzuat Haz›rlama Komisyonu" taraf›ndandevam edilmektedir. Komisyon çal›flmalar›nda; ilgiliBakanl›klar, kamu kurum ve kurulufllar›, özel kurulufllarile patent vekillerinin de görüflleri al›nm›flt›r.

551 say›l› Patent Haklar›n›n Korunmas› Hakk›nda KanunHükmündeki Kararnamenin Uygulama fieklini GösterirYönetmeli¤in biyoteknolojik bulufllar›n da korunmas›nauyumlu hale getirilmesi için haz›rlanmakta olanyönetmelik revizyonu çal›flmalar›na yabanc› uzmanlar›nda önerileri do¤rultusunda devam edilmektedir.

- Revision of Decree Law No 551 Pertaining to theProtection of Patent Rights and ImplementingRegulation

In accordance with legislation adaptation to theEuropean Union Legislation,’’Preparing Committee inTurkish Patent Institute is carrying on updating TheDecree Law No 551 pertaining to the Protection andrelevant Implementing Regulation work. In committeework, related Ministries’, public sectors and institutes,private sector and patent attorneys ’ view have beentaken.

Also foreign experts’ advices lead our regulationrevision to adapt the Decree Law Law no 551 forpertaining to the Protection of Patent Rights and theRevision of Implementing Regulations in order to addthe protection of biotechnological inventions.

- Endüstriyel Tasar›mlar›n Korunmas› Hakk›ndakiKanun Hükmündeki Kararnamenin Uygulamafieklini Gösterir Yönetmelik Revizyonu

554 say›l› Endüstriyel Tasar›mlar›n Korunmas›Hakk›ndaki Kanun Hükmündeki KararnameninUygulama fieklini Gösterir Yönetmeli¤in, uluslararas›antlaflmalara ve kurumsal ihtiyaçlara uyumlu halegetirilmesi için haz›rlanmakta olan yönetmelik revizyonutamamlanma aflamas›na gelmifltir.

2003 y›l› Patent ve Marka Vekilleri Yeterlilik s›nav› 06Aral›k 2003 tarihinde yap›lm›flt›r. S›nav sonucunda 568kifli marka vekilli¤i; 194 kifli de patent vekilli¤i yapmahakk›n› kazanm›flt›r.

- Correction of Implementing Regulation ofBudapest Treaty on the International Recognitionof the Deposit of Microorganisms for the purposeof Patent Procedure

The text on the Correction in the Implementing on theBudapest Treaty on the International Recognition of theDeposit of Microorganisms for the Purposes of PatentProcedure has transferred to Industry and TradeMinistry. The mentioned text is at Foreign Ministry toresearch.

- Patent Law Treaty (PLT)

The adaptation procedure of the legislation on Patentsaccording to Treaty has been carrying on in order tojoin Patent Law Treaty.

- Patent and Trade Mark Attorneys

The Decree Law no: 544 article 30 related toRepresentative qualifying Exam in each year haschanged with the Law no: 5000 and carried out thedecision to make every other year has made.

Representative qualifying Exam in 2003 carried out on06 December 2003. 568 Trade Mark attorneys and 194Patent attorneys concluded the exam successfully.

Günümüzde s›nai mülkiyet haklar›n›n korunmas›

kavram› ulusal s›n›rlar ötesine tafl›nm›flt›r. Uluslararas›

alanda, birçok farkl› bölgesel ve uluslararas› koruma

mekanizmalar› oluflturularak, s›nai mülkiyet haklar›n›n

etkili korunmas› için yo¤un çal›flmalar devam

etmektedir. Bu durum, s›nai mülkiyet haklar› alan›nda,

farkl› platformlarda ülkeler aras›nda düzenli bir

uluslararas› iflbirli¤i ve koordinasyonu gerekli

k›lmaktad›r.

Bu çerçevede, Enstitü mevcut uluslararas› anlaflmalar›n

reform süreçlerine ve oluflturulmakta olan uluslararas›

anlaflmalar›n mevzuat çal›flma gruplar›na aktif olarak

kat›lmakta ve bu alanda gerekli uluslararas› iflbirli¤ine

büyük önem vermektedir. Ayr›ca uluslararas›

anlaflmalarda gerçeklefltirilen de¤iflikliklere paralel

olarak ulusal mevzuat›m›z da güncellenmektedir.

b) INTERNATIONAL RELATIONS

Nowadays the protection of Industrial Property Rights

concept is below the borders. In the international area,

intense procedure to protect Industrial Property Rights

by forming many regional and international protection

mechanisms is carry on. In these circumstances, an

orderly international cooperation and coordination

among countries in different platforms on Industrial

Property Rights field is certainly essential.

In this aspect, Institute has been joining to reform

process of existing international treaties and the law

study groups that are being formed of the international

treaties actively and consider necessary international

cooperation in this field important. Also our national

law is being updated in a harmony with the changes in

the international treaties.

Bu kapsamda, 2003 y›l›nda konu ileilgili TRIPS Konsey toplant›lar›, DTÖ nezdinde DaimiTemsilcili¤imiz ile iflbirli¤i içinde takip edilmifltir.

2000 y›l›ndan bu yana üyesi oldu¤umuz Avrupa PatentOrganizasyonu’nun tüm idari konsey ve çeflitli komitetoplant›lar› ile çeflitli e¤itim programlar›na kat›l›msa¤lanm›flt›r. Bunlar içinde inflaat, bütçe-finans,

Also, the Patent Specialists of our Institute have beeninformed of Patent Cooperation Agreement, exchangedof views, cooperated by specialists sent by WorldIntellectual Property Organization (WIPO)

Also a visit to take an overview about acceptingapplications by World Intellectual property OrganizationAcceptance Office and archives system has been done.

- The Relations with World Trade Organization(WTO)

In 2002 at the 4th Ministerial meeting the main topicsof final report of the World Trade Organization on thepublic health, the bio technological inventions,geographical signs, industrial property rights discusshave been revealed in Doha and It has been determinedto carry on the negotiations on TRIPS in the mentionedfields. In this regard, TRIPS Council Meetings relatingthe subject was followed in cooperation withPermanent Representative of Turkey by the World TradeOrganization in 2003.

- The Relations with European Patent Organization(EPO)

It has been participated all the Administrative Counciland committee meetings and training programmes ofthe European Patent Organization since theparticipation in 2000. This includes; meetings aboutConstruction, Budget and Finance, EPOLINE,


EPOLINE, Enformasyon Teknolojileri, patent kanunukomite toplant›lar›; PATLIB y›ll›k toplant›s›, AvrupaPatent Ofisi (EPO) Üye Ülkeler Y›ll›k Toplant›s›, TescilSonras› ‹fllemler toplant›lar›; üye ülkeler, veri tabanlar›,ilaçlar, fizik-elektrik-mekanik, bilgisayar teknolojisikonular›nda yap›lan e¤itim çal›flmalar› bulunmaktad›r.Bunlar›n yan› s›ra, 2003 y›l› içerisinde EPO uzmanlar›taraf›ndan ilaç, bilgisayar programlar› ve çal›flmayöntemlerinin patentle korunmas›, patents›n›fland›r›lmas›, biyoteknolojik bulufllar gibikonularda Patent Dairesi uzmanlar›na e¤itimverilmifltir.

2003 y›l›nda, Avrupa Birli¤i mevzuat›na uyumçal›flmalar›n›n düzenli olarak izlenebilmesi içinoluflturulan Ulusal Veri Taban› ile ilgili izlemeformlar›n›n anlat›ld›¤› toplant› ve seminerler ileOrtakl›k Konseyi toplant›lar›na ve AB KomisyonuGeniflleme Genel Müdürlü¤ü TAIEX Ofisi taraf›ndan"AB Mevzuat Haftas›" kapsam›nda düzenlenen e¤itimprogramlar›na Enstitümüzden de kat›l›m sa¤lanm›flt›r.

‹ç Pazarda Uyumlaflt›rma Ofisi’nin (OHIM) markalarlailgili toplant›lar›na, enformasyon teknolojileritoplant›s›na, markalarla ilgili itiraz sistemine iliflkine¤itim program›na, aday ülkeler ofis baflkanlar›toplant›s›na, ayr›ca topluluk markas› ve topluluktasar›mlar› ile ilgili toplant›lara kat›l›m sa¤lanm›flt›r.

OHIM, 2002 y›l›ndan bafllamak üzere Avrupa Birli¤i’neaday ülkelerde, s›nai mülkiyet haklar› konusundatan›t›m ve bilinçlendirme amaçl› çeflitli etkinliklerdüzenlemektedir. Markalar ve tasar›mlarla ilgiliuluslararas› fuar ve sempozyum, EUROFORUM,Macaristan’da gerçeklefltirilmifltir. Topluluk markasistemini tan›t›c› seminer ve çal›flma toplant›lar›n›nyap›ld›¤› bu platformda, Enstitümüz de stand açarakfaaliyetlerini uluslararas› alanda tan›tma imkan›n›bulmufltur.

Information Technologies, Patent Law CommitteeMeetings, PATLIB Annual Meeting, European PatentOrganization member states Annual Meetings, andsome training work in member states, data bases,medicine, physic- electric-mechanic, computertechnologies. Also, training in such as medicine, theprotection of computer programmes and study methods,the patent classification, the biotechnological inventionshave been taught to Patent Department Specialists byEuropean Patent Organization in 2003.

- Relations with the European Union

One of the 8 sub-committees which are under theresponsibility of Turkey EU Association Committee andwhich are relating to the application of the AcquisCommunitaire by Turkey is the 2nd sub-committee titledInternal Market and Competition, which includes thesubjects of intellectual and industrial property rights.Attendance to all of the sub-committee meetings andinner coordination harmonization meetings held withinthe constitution of EU Secretariat General and of theMinistry of Foreign Affairs has been ensured.

In 2003, attendance from our Institute to the meetings inwhich the follow-up forms relating to the NationalDatabase, which has been formed for the purpose offollowing the studies of harmonization of the EuropeanUnion Laws, to the meetings of the Association Counciland the training programs organized by EU CommissionGeneral Directorate of Expansion TAIEX Office under "EULaws Week" has also been ensured.

Attendance to the meetings of Office for Harmonizationin Internal Market (OHIM), meetings of informationtechnologies, to the training program relating to theobjection system as to trademarks, to the meeting of theoffice heads of the candidate countries, and to themeetings relating to the community trademark andcommunity designs.

OHIM, starting from the year 2002, has been organizingvarious activities aiming at promotion of the industrialproperty rights and at giving a conscious as to the matterin the countries that are candidates for membership toEuropean Union. The international fair and symposiumrelating to trademarks and designs, namelyEUROFORUM, was held in Hungary. In this platform inwhich seminars and study meetings for promotion of thecommunity trademark system, our Institute also openeda stand and it found the opportunity of promotion itsactivities in the international field.

toplant›da, Fikri ve S›nai Mülkiyet Haklar› ile ilgili

Avrupa Birli¤i’ndeki son geliflmeler, Korsanc›l›k ve

taklitle mücadele, 12 Akdeniz ülkesinin mevcut

durumlar›n›n tespiti, Rekabet, Do¤rudan Yabanc›

Yat›r›mlar ve Teknoloji Transferi, Avrupa Patent

Sözleflmesi ve Topluluk Patenti, Avrupa Birli¤i’nde S›n›r

Kontrol Sistemleri, Topluluk Markas›, Topluluk

Tasar›m› ve Topluluk Co¤rafi ‹flaret Sistemi

incelenerek, ülkelerin karfl›l›kl› tecrübelerini

paylaflmalar› sa¤lanm›flt›r.

Attendance to the study meeting held in Madridbetween 03rd - 05th February 2003 relating to theintellectual and industrial property rights under EuropeanUnion MEDA project as to the development of theeconomical cooperation between Europe andMediterranean region was ensured. In this meeting, thelatest developments in European Union relating toIntellectual and Industrial Property Rights, struggleagainst piracy, determination of the existing situation inthe 12 Mediterranean countries, Competition, DirectForeign Investments and Technology Transfer, EuropeanPatent Convention and Community Patent, BoundaryControl Systems in European Union, CommunityTrademark, Community Design and CommunityGeographical Indication System was examined and thecountries had find the opportunity to share theirexperiences mutually.

c) INFORMATION TECHNOLOGIES

- Promotion Campaign

The year 2003 was a year in which some activities forthe purpose of enabling Turkish Patent Institute to fulfillits duty of "it carries out the studies required forinforming and directing the persons and organizationsin Turkey on the subjects of industrial property rights",which is also mentioned in the Decree Law Establishing,in a more effective way and for increasing therecognition of Turkish Patent Institute.

In this context, a promotion campaign was started, forcreating a capacity within the institution, after thecampaign is over, for the experts, who have receivedthe required trainings and have formed the requiredinfrastructure to continue this campaign, the requiredsteps were taken.

The industrial property systems are beneficial so long asthey are understood, acknowledged and effectivelyused by the public. For establishment of anaccumulation of knowledge appropriate for Turkishindustry and R & D institutes, the information should bedisseminate. Turkish Patent Institute has carried outseveral activities since its foundations. These activitiesare publication of the informing booklets, seminars,foundation of the Information Centers and face-to-faceconsultancy services. The level of success depends onthe fact that these studies are expanded and continued.

c) B‹LG‹ ‹fiLEM VE ENFORMASYON

- Tan›t›m Kampanyas›

2003 y›l›, Türk Patent Enstitüsü için, Kurulufl Kanun

Hükmünde Kararnamemizde de aç›kça belirtilen "S›nai

mülkiyet haklar› konular›nda yurt içinde kifli ve

kurulufllar›n bilgilendirilmesi ve yönlendirilmesi için

gerekli çal›flmalar› yapar" görevini daha etkin bir

flekilde yerine getirmek ve kamuda s›nai mülkiyet ve

Türk Patent Enstitüsü’nün bilinirli¤ini art›rmak

amac›yla birtak›m faaliyetlerin gerçeklefltirildi¤i bir y›l

olmufltur.

Bu kapsamda bir tan›t›m kampanyas› bafllat›lm›fl,

konuyla ilgili olarak da kurum içi kapasite yarat›lmas›

ve kampanyan›n bitiminin ard›ndan gerekli e¤itimleri

yay›lmas› gereklidir. Türk Patent Enstitüsü kuruluflundan

bu yana çeflitli tan›t›m etkinlikleri gerçeklefltirmifltir. Bu

etkinlikler bilgilendirme broflürlerinin bas›m›, seminerler,

Enformasyon Merkezlerinin kurulmas› ve bire-bir

dan›flmanl›k yap›lmas›d›r. Baflar› seviyesi, bu çal›flmalar›n

S›nai Haklar ile ilgili konularda kamuoyunu

bilgilendirmek üzere 2003 y›l› içinde 8 ayr› ilde

seminer ve sempozyum verilmifl olup, sözkonusu

etkinlikler ile hedef kitlenin do¤rudan bilgilendirilmesi

sa¤lanm›flt›r.

Kamuoyunu bilgilendirmek üzere seminer ve

sempozyumlara devam edilmektedir.

Haklar› ile ilgili ulusal ve uluslararas› veri taban›nda ön

karfl›lamak üzere "Atatürk Üniversitesi Erzincan

Hukuk Fakültesi TPE Bilgi ve Doküman Birimi"

kurulmufltur.

In this context, the Department of Information wasrestructured in 2003, Turkish Patent Institute PromotionGroup" was formed and bound to that unit. Trainingswere given relating to the Promotion Group, andformation of an infrastructure was aimed at.

We can give the following as the examples of theactivities carried out under the Promotion Campaign:

• Formation and publication of news and articles,• Distribution of the relevant materials to journalists

and representatives of media, and follow-up of these,• Regular distribution of the materials of Turkish Patent

Institute (i.e. the last published patent / utility modelapplications / Official Trademark Gazette/bulletins) tothe media,

• Evaluation of the scope of the media mentioning Turkish Patent Institute; informing and promotion ofthe Institute.

The year 2003 was the starting year for promotion, ayear in which studies were carried out for creating acapacity within the institution.

- Seminar and Symposium

In 2003, seminars and symposiums were held in 8different cities in order to inform public opinion as tothe subjects relating to the industrial rights, and withthe activities in question, the target was directlyinformed.

Seminars and symposiums aiming at informing thepublic opinion are continued.

- Information and Documentation Units of TurkishPatent Institute

In accordance with the protocol made between AtatürkUniversity Erzincan Faculty of Law and our Institute, inorder to meet the information and document needs asto the subjects such as the state of art by means of pre-investigations on the national and internationaldatabase relating to the Industrial Property Rights of theuniversity personnel settled in Erzincan, students,persons, organizations and institutions carrying outresearch and development, industrialists, merchants,"Atatürk University Erzincan Faculty of Law TurkishPatent Institute Information and Document Unit" wasfounded.


Bölgesel s›nai mülkiyet kullan›c›lar›na doküman ve bilgideste¤i sunulmas› ve bu hizmetlerin h›z ve kalitesininTPE’ye online eriflim sa¤lanarak art›r›lmas›gerekmektedir. Ayr›ca bilgilendirme merkezi say›s›potansiyel kullan›c›lar›m›z›n bölgesel da¤›l›m›ylakarfl›laflt›r›ld›¤›nda dengeli de¤ildir, bu amaçla yenimerkezler kurulmas› ve merkezlerin gerek teknolojikaltyap›lar›n›n gerekse eleman yetifltirilmesi ifllerininbafllat›lmas› hedeflenmektedir.

Türk Patent Enstitüsü’nün ‹stanbul’da, Adana veErzincan’da birer ve ‹zmir’de iki adet olmak üzeretoplam 5 Bilgi ve Dokümantasyon Birimibulunmaktad›r.

- Patent ve Marka Araflt›rmalar›

Bilindi¤i üzere bir buluflun patentlenebilmesi içingerekli flartlardan biri de bulufl konusunun yeniolmas›d›r. Bu itibarla, Türk Patent Enstitüsü bünyesindeyap›lan patent ön araflt›rmas› ile, baflvuru sahiplerinintekni¤in bilinen durumu hakk›nda bilgi sahibi olmas›sa¤lanmakta ve yeni olmayan konularda baflvuruyaparak para harcamalar› önlenmektedir. Bu kapsamda2003 y›l› içinde patent konusunda 1094 adet araflt›rmayap›lm›flt›r.

Türk marka mevzuat›na göre "markalar›n benzerli¤i",sonradan yap›lan baflvurular için mutlak bir rednedenidir. Baflvuru sahibinin bir marka için baflvuruyapmadan önce ayn› sektörde ön araflt›rma yapmas›vakit kaybedilmesini önlemektedir. 2003 y›l› içerisindemarkalar konusunda 6526 adet kelimenin benzerlikaraflt›rmas› yap›lm›flt›r.

- S›nai Mülkiyet Kütüphanesi

TPE Kütüphanesinde s›nai mülkiyet konular› a¤›rl›kl›olmak üzere ansiklopediler, sözlükler ve y›ll›klar›n yan›s›ra bilimsel nitelikli kitaplar, tezler, ulusal mevzuat,uluslararas› kurulufllar›n yay›nlar› ve periyodik yay›nlarbulunmakta olup, bu yay›nlar›n tamam› araflt›rmac›lar›nhizmetine sunulmufltur.

- Türk Patent Enstitüsü Bülteni Bas›m›

Enstitünün tan›t›m› ve kamuoyunun bilgilendirmesiamac›yla yay›mlanan TPE Bülteninden y›lda 4 say›olmak üzere planlanan 2003 y›l›nda sonbahar-k›fl (özelsay›) say›s›ndan 5000 adet ve ilkbahar say›s›ndan 5000adet bas›lm›fl ve da¤›t›m› yap›lm›flt›r

Regional industrial property users should be givendocument and information support, and the rate andenabling online access to Turkish Patent Institute shouldincrease the quality of such services. Besides, when wecompare the number of the informing center to theregional distribution of our potential users, we see thatthere is not a balance; for this purpose, new centersshould be founded and initiation of the works of boththe technological infrastructures and staff training forthe centers is aimed at.

Turkish Patent Institute has total 5 Information andDocumentation Units one in Istanbul, Adana andErzincan, and two in ‹zmir.

- Patent and Trademark Researches

As known, one of the conditions required for patentingany invention is the invention’s subject being new. Inthis respect, with the patent pre-investigation carriedout within the constitution of Turkish Patent Institute,the applicants are provided knowledge as to the stateof art and they are prevented from spending money byapplying in subjects that are not new. In this context,there was 1094 researches were carried out as topatent in 2003.

According to the Turkish trademark regulations,"similarity of trademarks" is a reason for absoluterejection for the latter applications. That the applicantcarries out a pre-investigation in the sector about atrademark prevents any time waste. In 2003, 6526words were investigated as to similarity.

- Industrial Property Library

In the Library of Turkish Patent Institute besidesencyclopedias, dictionaries and yearbook there arescientific books, thesis, national regulations,publications of the international organizations andperiodicals, and all of these publications are at service ofresearchers.

- Printing of Turkish Patent Institute Bulletin

2003 Autumn-Winter issue (special issue) of TurkishPatent Institute Bulletin, which is published for thepurpose of promotion of the institute and informing thepublic opinion and which is designed to be published 4times a year, was pressed as 5000 pieces, Spring issuewas pressed as 5000 pieces, and their distribution wascompleted.


S›nai mülkiyet alan›nda tek yetkili kurulufl olan TürkPatent Enstitüsü’nün konunun teorik yönünü dedestekleyebilmesi için ilgililerin gerek hukuk, gerekteknik gerekse sosyal anlamda sistemi, yasal zeminleritan›malar›, getirilerini anlamalar› ve tart›flmalar›aç›s›ndan kaliteli bir akademik yay›n oluflturulmas›gerekmektedir. Türk Patent Enstitüsü k›sa dönemdes›nai mülkiyet haklar› için ihtiyaç duyulan bu zeminioluflturmay› hedeflemektedir.

"TPE ÜST DÜZEY STRATEJ‹ BEL‹RLEMETOPLANTISI"

TPE için üst düzey stratejilerin tespit edilmesi, vizyon veamaçlar›n belirlenerek önümüzdeki y›llarda izlenecekpolitikan›n ortaya konulmas› konusundaki "Üst DüzeyStrateji Belirleme" çal›flmas›, 15 – 17 Eylül 2003 tarihleriaras›nda Ankara’da gerçeklefltirilmifltir.

Toplant›ya EPO, OHIM, WIPO gibi uluslararas›kurulufllar›n yan›s›ra, Danimarka, Fransa, ‹ngiltere S›naiMülkiyet Ofisleri de kat›l›m sa¤lam›flt›r.

Çal›flma sonucunda; "Türk ekonomisininfaydalanabilmesi için s›nai mülkiyet haklar›n›nkullan›lmas›n› ve kamunun bilinçlendirilmesiniamaçlayan yüksek kaliteli bir organizasyon olmak"TPE’nin vizyonu olarak belirlenmifltir.

In order for Turkish Patent Institute, which is the soleauthorized organization as to industrial property inTurkey, to be able to support also the theoretical aspectof the subject, there should be a quality academicpublication formed that will enable the relevant personsunderstand the legal, technical and social aspects of thesystem, its yields and discuss these matters. TurkishPatent Institute aims at forming this base, which isneeded for industrial property rights in the short-term.

"TURKISH PATENT INSTITUTE MEETING FORDETERMINATION OF HIGH LEVEL STRATEGIES"

The study of "Determination of the High Level Strategy"for Turkish Patent Institute about determination of thevisions and aims and the policies to be followed in thecoming years was realized between 15th and 17thSeptember 2003 in Ankara.

The meeting was attended by not also suchinternational organizations as EPO, OHIM, WIPO, butalso the Industrial Property Offices of Denmark, Franceand England.

At the end of the study; "To be a high qualityorganization that aims at usage of the industrialproperty rights and at informing the publicopinion for the benefit of Turkish economy" wasdetermined as the vision of Turkish Patent Institute.

Yap›lan çal›flmada, TPE’nin vizyonunun belirlenmesi ve

TPE’nin gelecekte oluflturaca¤› stratejik planlara bir

örnek oluflturmas› hedeflenmifltir. Bu hedefe yönelik

olarak, toplant›da gerek TPE çal›flanlar›ndan ve gerekse

uluslararas› delegasyonlar›ndan aktif kat›l›m sa¤lanm›fl

ve kat›l›mc›lar aras›nda fikir al›flverifli yap›lm›fl, bilgi ve

tecrübelerin paylafl›lmas› gerçeklefltirilmifltir.

In the study carried out, determination of the vision ofTurkish Patent Institute and an example of the strategicplans to be formed by Turkish Patent Institute in thefuture. In line with this aim, active attendance of peoplefrom Turkish Patent Institute employees and frominternational delegations, intellectual relations wereestablished between the attendants, and informationand experiences were shared.

National WIPO Seminar about Madrid System,Patent Cooperation Treaty (PCT), BudapestTreaty

In October 2003, Turkish Patent Institute, in cooperationwith WIPO, acted as the householder of an importantactivity. In this seminar, held between 20th and 22sndOctober 2003, the subjects of Madrid System, PatentCooperation Treaty (PCT), Budapest Treaty was explainedby the experts from WIPO and information was given asto the innovations and practices. The personnel of theInstitute, deputies, academicians, individuals interestedin subject and representatives attended the seminarsfrom private sector.

The Industrial Technology Project, the feasibility studies

of which were initiated in 1996, was signed and put into

force on 01/10/1999. Although there are some delays in

the construction works of the New Industrial Property

Campus Building of Turkish Patent Institute, which is

largely financed by World Bank, these construction

works were continued in 2003 in a rapid way. When the

Industrial Technology Project is completed, Turkish

Patent Institute will have the infrastructure required for it

to be able to give effective service.

TPE hizmetlerinin kaliteli biçimde verilmesi için gerekli Ofis alan›n›n sa¤lanmas› amac›ylainflaat›na 11 fiubat 2002 tarihinde bafllanan ve 2002 y›l› sonuna kadar %80’ni tamamlanYeni S›nai Mülkiyet Kampus Binas›n›n geriye kalan iflleri 2003 y›l› içerisinde tamamlanarak30.10.2003 tarihinde binan›n geçici kabulü yap›lm›fl ve geçici kabul kusurlar› Aral›k ay›sonuna kadar giderilmifltir.

Enstitünün patent, marka ve endüstriyel tasar›mlar›n tescili gibi vermekte oldu¤u anahizmetlerinin tamamen elektronik ortamda verilmesini sa¤lamak ve özellikle Enstitü’nün iflak›fllar› dikkate al›nacak flekilde bir merkezi yaz›l›m›n kurulmas› amac›yla 2002 y›l›ndabafllanan çal›flmalara 2003 y›l›nda da h›zla devam edilmifl ve 2005 y›l›nda tam performanslakullan›ma aç›lmas› planlanlanm›flt›r.

Enstitü ifllemlerinin otomasyona geçirilmesi projesi kapsam›nda Internet üzerinden vekurum içi yap›lan ifllemlerin tamam›nda, bilginin güvenli bir flekilde ifllenildi¤inden eminolunmas›, bilgilerin kötü niyetli kiflilerce kullan›lmas›n›n önüne geçilmesi ve benzeri olumsuzuygulamalardan korunmas› amac›yla 2002 y›l›nda ön haz›rl›klar tamamlanm›fl ve 06 fiubat2003 tarihinde çal›flmalara bafllan›lm›flt›r. 2004 y›l› içerisinde güvenlik yaz›l›m› lisanslar›n›ntedariki sonras›nda güvenlik sisteminin tam olarak hayata geçmesi planlanmaktad›r.

Özel yaz›l›m gelifltirme projesi ile hedeflenen ka¤›ts›z ofis ortam›n›n ikinci aya¤› say›labilecekolan doküman yönetimi sistemi için, Enstitü içi evrak ak›fl›n›n elektronik olaraksa¤lanabilmesi ve ifl flemalar›na göre ilgili düzenlemelerin yap›labilmesi için mevcutdoküman yönetimi yaz›l›mlar›n›n Enstitü ortam›na uyarlanmas›n› ve entegrasyonunusa¤lamak için ön haz›rl›klar 2003 y›l› içinde tamamlanm›fl ve 22 Eylül 2003 tarihindeçal›flmalara bafllanm›flt›r. Bu projenin Ocak 2005 tarihine kadar tamamlanmas›düflünülmektedir.

Enstitünün bilgi iflleme potansiyelinin art›r›lmas›, otomasyon projesi için gerekli fizikselaltyap›n›n oluflturulmas› amac›yla masaüstü bilgisayarlar, sunucular ve bunlara ait çevrebirimleri (yaz›c›lar, taray›c›lar, a¤ ba¤lant›lar›, vs.) gibi ekipmanlar›n mevcut en geliflmiflteknolojiler kapsam›nda temin edilmesi için ön haz›rl›klar 2003 y›l› içinde tamamlanm›fl ve22 Eylül 2003 tarihinde çal›flmalara bafllanm›flt›r. Proje kapsam›nda ekipman ve donan›m›ntamam›n›n 2004 y›l› içinde kurulumlar›n›n tamamlanmas› ve entegrasyonun sa¤lanmas›hedeflenmektedir.

Yeni S›nai Mülkiyet Kampüs Binas›’n›n tamamlanmas› ile yepyeni ve modern bir çehreyekavuflacak olan Enstitümüzün yaln›zca d›fl görünümünün de¤il, ofis içi tefriflat›n›n da eflde¤er modernlikte kullan›ma sunulmas› amac›yla personelin kullan›m›na yönelik ofisekipman› ihtiyac›n›n karfl›lanmas› için ön haz›rl›klar 2003 y›l› içinde tamamlanm›fl vetefriflat›n 2004 y›l› içinde sonuçlanmas› planlanm›flt›r.

S›nai mülkiyet tescil yay›nlar›n›n elektronik ortamda yay›nlanmas›n›n yan› s›ra ka¤›t ortamdabültenlerin Enstitü içerisinde bas›lmas› için ön çal›flmalar› 2002 y›l› içerisinde tamamlanan ve26 Kas›m 2002’de çal›flmalara bafllanan proje kapsam›nda gerekli ekipman Enstitümüzeulaflm›fl ancak sistemin kurulaca¤› bask› odas›n›n teknik altyap›s›n›n henüz tamamlanmam›flolmas› sebebiyle iflletime al›namam›flt›r. Söz konusu sistemin 2005 y›l› içerisinde tamkapasite ile kullan›ma sunulmas› hedeflenmektedir.

Türk Patent Enstitüsünün 1994 y›l›nda kurulmufl oldu¤u ve bilhassa patent baflvurular›olmak üzere yurt içi s›nai mülkiyet baflvurular›n›n arzu edilen seviyede olmamas› sebebiyleEnstitümüzün yurt içinde tan›t›m›n›n yap›labilmesi amac›yla ön haz›rl›klar› 2002 y›l›içerisinde tamamlanm›fl ve 10 Ocak 2003 tarihinden itibaren çal›flmalar›na h›zl› bir flekildebafllanm›flt›r.

Explanation of the Work

In13.10.2003 building temporary acceptance made and the last acceptancerequirement done at the end of December. This step is done to provide the highquality services of TPE.

In 2002 started the software project center and still going in 2003, and planedto give the full performance in 2005. This center will be attention for work flowof institute properties and it will be able to provide all services in electronic space,like institute patent, mark and industrial designing registration.

We planed to get ready using security software licenses in 2004. The preparationwas completed in 2002 and the work started 06.02.2003. The goal of the projectis to protect illegal application entrance, and to stop the using of information byhackers, using the information in secured way and make all procedure throughinternet.

To provide documents managing system which aim to develop projects withoutusing papers. And achieve and make integration we have to redesign the presentdocument managing software of the institute the preparation started andfinished in 2003 and started on 22.9.2003. This project decides to be finished inJanuary 2005.

To achieve the automation projects, increase the potential of informationtechnology; we have to provide foundations like: disk top computers, servers, therelated unites for them (printers, scanners, network connections, etc.). Thepreparation finished at 2003 and the work started in September 2003. The goalis to finish the establishment and the integration of equipment and hardware in2004.

After finishing the new building, we will not change our appearance alone, butwe will have a new and moderated offices and furnishing. And to achieve thisequipments needs preparation finished in 2003. And the furnishing planed to becompleted in 2004.

The preparation of print and press of the Institute beside electronic space onpaper bulletin finished in 2002, and project finished on 26.11.2002. But becausethe printing room technical foundation did not finished, the process did not startyet. The goal is to be work with full capacity in 2005.

Although TPI was founded in 1994, the application to our institute is very low.We decide to make a local advertising campaign. The preparation of thiscampaign and the work started on the 10th of January 2003.

When we take a look at the distribution of patentapplications filed in 2003, there is a decrease observedwith respect to previous years. The main reason for thisdecrease is, Turkey has become the party of EuropeanPatent Convention (EPC) since Nowember 1, 2000.International patent applications particularly , are madethrough the European patents. In recent years, beforethe EPC Turkey was designated for all types of patentapplications, but after the accession to the EPC, thereare only European Patent applications came to thenational phase of Turkey. In o›ther words, EPC hasprevented the designation of Turkey for nonpatentable applications. On the other hand domesticapplications incresed %20 compared to figures of lastyear. When we evaluate this increase we can say thatincrese of patent applications in 2002 are not temporal,as the figure of granted patents are also having sametrend.

When the distribution of the patent applications in2003 according to different systems, there is a greatdecrease in the international patent applications filedunder the Patent Cooperation Treaty (PCT). In return ofthis, there was a great increase in the European patentsthat came to the national stage by means of EuropeanPatent Convention (EPC). It is estimated that this trendwill continue also in the coming years. And the reasonfor this is that we became a party of the EuropeanPatent Convention on November 1st, 2000. When thedistribution of the national patent applications areconsidered, while there is a great increase in thedomestic patent and utility model applications, there isa decrease in the foreign patent applications.

to the cities, it is understood that in our cities which are

richer in terms of industry and population there are

more patent or utility model applications then the other

cities. When the number of patent applications filed in

the cities in 2003, there is a great decrease. While there

was 159 patent applications from ‹stanbul in 2002,

there was 55 patent applications in 2003, and this

situation seems likewise for the other cities. As for the

utility models, this decrease was lesser. While there was

402 utility model applications in ‹stanbul in 2002, this

figure remained in 322 in 2003.

say›larda ülkemizde bilime ve teknolojiye olan ilginin

sürekli artt›¤›n› göstermektedir.

When the first 10 domestic companies that filed themost applications in 2003, it is seen that thesecompanies are the companies that carry out activities inthe sectors of food and medicine in general. That 5 ofthe first ten foreign companies are of German origin isanother point that attracts attention.

As the result of the promotion and spreading studies forthe geographical indications that started in 2001 andhave been intensified increasingly, the number in 2003was increased to 33. Although the number ofapplications does not seem much, this shows that therecognition as to the subject are gradually increasing.

Industrial design applications have entered in a risingtrend starting from 1999, and it is observed that thisrise has been particularly more in the last two years. Thisincrease in the applications clearly shows that theconscious as to design is being spread rapidly in all overthe country.

If the distribution of the applications from foreigncountries is considered, it is seen that there is no greatchange in the applications from U.S.A. and fromEuropean Union Countries, and that the greatestchange is in the applications from Japan.

2003 y›l› baflvurular›n›n firmalar›n yapm›fl olduklar›

baflvurular baz›nda de¤erlendirilmesi sonucunda,

geçti¤imiz y›la göre en çok baflvuru yapan firmalarda

de¤ifliklik oldu¤u, Plastik Sektörü ile Ayakkab›

Sektörünün öne geçti¤i görülmektedir. Yabanc› firmalar

içerisinde ise hemen hemen ayn› firmalar›n bafl› çekti¤i

görülmektedir.

As the result of evaluation of the applications accordingto the the applications filed by companies in 2003, it isseen that there is a change in the companies that filedthe most applications in comparison to the last year,and that the Plastic Sector and the Shoe Sector havebecome the leader. And it is seen that also among theforeign companies almost the same companies are theleader.

Geçmifl y›llarda oldu¤u üzere baflvurular›n yine"Mefruflat" s›n›f›nda yo¤unluk kazand›¤›görülmektedir.

"Tekstil", "Giyim ve Tuhafiye", "Ambalaj" ile "EvEflyalar›" gruplar›nda ise ayn› oranlarda bir yo¤unlukoldu¤u gözlenmektedir.

As with the previous years, it is seen that theapplications are intensified in the "furnishing" class.

And in the groups of "Textile, "Clothing and Sundries"and "Home Furniture", there is seen a intensity at thesame rates.

In relation to the industrial property rights,formation of the Union of Attornies within a legalframework and, in line with the goal ofinstitutionalization of agency, legislation of the"Draft Law of Union of patent and trademarkAttornies" rapidly.

Examination of the existing regulations of TurkishPatent Institute and completion of the points thatare insufficient to meet the contemporaryrequirements thereby, and legislation of the Decreesthat have not been revised so far.

Making Turkey a party of the Trademark Law Treaty(TLT), The Hague Agreement Concerning theInternational Deposit of Industrial Designs andPatent Law Treaty.

Including the subjects relating to industrial propertyrights within the course programs of universities andeducation institutions.

Completion of Turkish Patent Institute specialsoftware development project (may 2004), TurkishPatent Institute information security project (May2004), Turkish Patent Institute networkinfrastructure (new service building, May 2004),Turkish Patent Institute document management andelectronic archive system project (May 2004).

Under these project, re-writing of all theapplications based on web and publication of thereviews of the institute in the electronicenvironment, publication of the databases throughweb and facilities such as application, pre-investigatin and examination, follow-up ofpayments and applications through the Internet.

Preparation of the search and examination reportsrelating to patent applications within theconstitution of the institute.

tak›m ruhuna sahip bir çal›flma anlay›fl›na dayal›

felsefemiz do¤rultusunda, “yenilikte öncü Türkiye”

için TPE hatas›z ve mümkün olan en k›sa sürede

hizmet verilen kifli ve kurulufllar›n ihtiyaçlar›n› en

verimli ve en ekonomik flekilde karfl›lamak amac›yla

çal›flmalar›na devam edecektir.
