JUDICIAL AFFIDAVIT(For the Prosecution)

The petitioner and her attorney-in-fact Juan Dela Cruz, through the undersigned counsel most respectfully submits this judicial affidavit of witness Aparecio Bator (Thereinafter referred to as witness) and in support thereof states the following:1. This Judicial Affidavit was taken before Jimoncito Santos who conducted and supervised the examination of witness in his office located at Bakakeng Baguio City.

2. The herein affiant is a Filipino Citizen, single and a resident of Atok Trial Baguio City.

3. The witness is answering the questions asked of in the TAGALOG, a language he fully speaks and understands and is giving is fully aware that she will face criminal liability for false testimony or perjury.

The witness offers the testimony to prove the following:

1. That based on his examination of the cadaver of the victim, the latter died through severe head injury; and

2. That this head injury was caused by a severe blow using a hard object on the victims head.The questions and answers are as follows:Q:Ano ang iyong profession?

A:

Ako po ay isang medico-legal officer ng NBI dito sa baguio.

Q:Saan ang iyong opisina dito sa baguio?

A:

Sa Regional Laboratory Office-Baguio City po ng NBI ditto sa baguio.

Q:Ilang taon ka ng medico-legal officer?

A:

Twenty years na po akong medico-legal officer.

Q:Saan ka mo kinuha ang iyong kurso?

A:Sa SLU college of medicine po.

Q:Anong taon ka naggraduate?

A:1987.

Q:Matapos mong matapos ang iyong kurso sa medisina, kumuha k aba ng Licensure exam para sa mga doctor?

A:Opo. Kinuha ko po yun isang taon matapos kong matapos ang aking kurso

Q:Naipasa mo ba ang yung pagsusulit na iyon?

A:Opo.

Q:Matapos kang makapasa sa pagsusulit na iyon, kaagad ka bang nag apply bilang Medico-Legal officer?

A:Hindi po. Nag private practice po muna ako ng tatlong taon.

Q:Sa tatlong taon na nagpublic practice ka, ano yung mga iyong ginagawa bilang doctor.

A:Ginagamot ko po yung mga pasyente na may ibat-ibang sakit. Isa po kasi akong General Surgeon.

Q:Matapos ang tatlong taong nag private practice ka, ano ginawa mo?

A:Nag special training po ako para maging medico-legal tapos nagapply po ako sa Regional Crime Laboratory Office-Baguio ng National Police.

Q:Naging medico-legal ka matapos ang training?

A:Opo.

Q:Bilang Medico-Legal Officer, ano ang iyong mga tungkulin o gampanin?

A:Kami po ang nag o-autopsy sa mga bangkay para malaman kung ano yung sanhi ng kanilang pagkamatay.

Q:Ilang beses ka ng nag autopsy ng bangkay?

A:Maraming beses na po.

Q:Masasabi ba nating sanay kana mag autopsy ng bangkay?

A:Opo

Q:Sinasabi dito sa Medico Legal Report No. M-125-97 na ikaw ang nag autopsy sa mga labi ng biktimang si Marijoy Chiong. Tama ba?

A:

Opo

Q:Ito ba yung Medico Legal Report na iyong nilagdaan?

A:

Opo

Q:Maarai mo bang sabihin kung ano yung iyong nalaman matapos mong i-autopsy ang mga nasabing labi ni Marijoy Chiong?

A:

Meron pong mga contusions sa may noo, anit at kanang baba ng Biktima. Meron din pong lacerated wound sa superior aspect of the forehead sa kaliwa. Meron din pong mga abrasions sa baba ng biktima.

Q:Bukod ditto, may iba ka pa bang nakitang mga injuries ng biktima?

A:Opo

Q:Ano yung mga iyon?

A:Meron din pong fructures sa magkabilang floor ng bungo ng biktima.

Q:Ano ibig sabihin ng mga ganitong sugat?

A:Ang ibig sabihin lang po nito eh maaring natamo po ito ng biktima dahil sa pagpukpok ng mabigat na bagay sa kanyang ulo.

Q:Ano ang sanhi ng pagkamatay ng biktima?

A:Meron pong Shock at hemorrhage sanhi po ng mga grabeng sugat na natamo nito sa kanyang ulo

I, Jimoncito Santos, of legal age, married, Filipino Citizen with office address at Bakakeng Baguio City and the lawyer who conducted or supervised the examination of herein witness, hereby attest that :I. I faithfully recorded or caused to be recorded the questions I asked and the corresponding answers that the said witness gave in Tagalog, a dialect known and understood by the witness; and

II. Neither I nor any other person then present or assisting the said witness coached the witness regarding the latters answer
