This Agreement between _________________________(the “Owner”) and Adirondack Animal Services LLC (a/k/a Upstate Canine Academy) (the “Company”) sets forth the terms and conditions pertaining to the training services

provided by the Company to the Owner and the Owner’s dog.

1. Liability. Neither the Company nor any authorized representative of the Company is responsible for any injury, sickness or illness Owner or, his or her dog, may encounter while engaging the services of the Company at any time. Owner hereby releases the Company, its employees, owners, successors or assigns from any and all liabilities, financial and otherwise, for injuries to myself, my dog, or any other property of mine, which arise in any way at any time directly or indirectly from services and/or products provided by the Company.

2. Social Media/Advertising. By acknowledging below, Owner agrees to allow use of his or her dog’s name and any images or video taken of his or her dog, in any form or format, for use, at any time, in any form of media, marketing, print or advertising.

3. Services. Owner agrees to pay the total sum of $__________ for ________ private training sessions and ________ group sessions. This amount must be paid in full within 30 days of purchase. A. No Refunds. Owner understands that the Company does not give refunds for services rendered, or services purchased and not used. B. 24-Hour Notice of Cancellation. Owner also understands that if he or she fails to give at least 24 hours cancellation notice or is not present at time of the scheduled training session, the Owner’s session will be considered used. For a package deal, the missed session will still be counted as one session and a private session will be deducted from the Owner’s training package. C. Expiration of Package. Since successful training of dogs requires constant routine and consistency, it is recommended that the training package be completed within one year of the date of this Agreement. However, the Company agrees to keep the package open for 2 years calculated from the date of this Agreement. If all of the training sessions have not been used within 2 years from the date signed below, the Owner agrees that all remaining sessions shall be forfeited and that there will be no return of money to the Owner.

4. Owner’s Obligation/Responsibility. As stated above, the Company does not issue refunds or guarantees as to the training provided since there are so many factors that contribute to the success of any dog training. The Company agrees to provide training lessons for the Owner and dog on a lesson-by-lesson basis, the goal being to teach the Owner how to train and work with his or her dog. The Company will make every reasonable effort to help Owner achieve training and behavior modification goals but makes no guarantee of dog’s performance or behavior. Owner understands that he/she and members of the household must follow the Company’s instructions without modification, work with dog daily as recommended, use the tools and training methods specifically recommended by the Company and constantly reinforce training being given to dog. The Owner understands that the Company does not contact the Owner to inquire as to the progress of training. Instead, it is the sole responsibility of the Owner to contact the Company for follow up training sessions or to voice concerns about training issues.

5. Complete Agreement. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties and expresses the entire agreement between Owner and Company regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to dog or anything else. This Agreement may be amended only by a written instrument signed by both Owner and Company.
