I am directed to invite attention to the reference cited wherein instructionshave been issued to ensure that while initiating disciplinary action, the charges/showcause notices are carefully drafted in such a way that they are not vague and noirrelevant or incorrect rule or section of an Act is quoted therein and also to ensurethat the final orders should be in self contained ‘speaking orders’.
2. It has been brought to the notice of the Government that in the final ordersissued in most of the disciplinary cases while imposing penalties, the disciplinaryauthorities, after reproducing the charges, defence statement of the delinquent officer,the findings of the Inquiry Officer and the further representation of the delinquentofficer on the findings of the Inquiry Officer, are simply concluding that “after examination,that the charges are held as proved against the delinquent officer” without indicatingthe specific reasons as to how the charges are held proved. Such kind of final orderscertainly will not stand before the judicial scrutiny for which the recent Case Laws arelisted below:-

i) The Hon’ble High Court, Madras in its order dated 26.03.2014 inW.P.No.29479/2007 in Padmini Sundarajan Vs. State of Tamilnadurepresented by Secretary, School Education Department and anotherhas quashed the final order issued by the disciplinary authority for thereason that the disciplinary authority has not independently appliedhis mind into the charges and the explanation of the petitioner andother materials if any available. The disciplinary authority has afterreproducing the charges and explanation of the delinquent officer, thefindings of the Inquiry Officer and the explanation offered by thedelinquent officer therein, in para 2 of the order, stated that on perusalof the records, the charges 2, 3 and 4 are proved and other charge isnot proved. Hence, the order of the disciplinary authority which isimpugned herein is the out come of non-application of mind and ishence per se, arbitrary and contrary to law and stands vitiated.
ii) The Hon’ble High Court, Madras in its order dt. 24.06.2014 in W.P.Nos.6768 to 6770 of 2007 in S.Santhanakrishnan Vs. Secretary toGovernment, Health and Family Welfare Department and another, hasquashed the final order issued in the disciplinary proceedings byobserving that the disciplinary authority, ought to have consideredthe explanation offered by the petitioner and thereafter, ought to havegiven reasoning for rejecting his explanation before confirming thefinding of the Inquiry Officer and that failure to do so, the impugnedorder is not in accordance with the procedure, and is in violation ofprinciples of natural justice and is the out come of non application ofmind of the disciplinary authority.
3. Further, in cases, where the Tamil Nadu Public Service Commission is consultedfor its views, the disciplinary/appellate/revision/reviewing authority should record itsindependent views while imposing penalties and rejecting the appeals in addition tothe views offered by the Tamil Nadu Public Service Commission. The Madurai Benchof Madras High Court in its order dated 19.06.2014 in W.P. (MD) No. 9785/2014 inN. Mahalakshmi Vs. The State of Tamil Nadu represented by its Principle Secretary,Labour and Employment Department and another, has observed as follows:
“The role of the appellate authority cannot be confined only to seekthe view of the recruiting agency namely, Tamil Nadu Public ServiceCommission and to follow the same to confirm the order of the originalauthority. On the other hand, the appellate authority has to apply hismind independently to the facts and circumstances of the case andgive reasoning either to confirm the order or to deviate from thesame. Here, in this case, a perusal of the order passed by the appellateauthority would show that except extracting the view expressed bythe Tamil Nadu Public Service Commission, the said authority has notshown his independent application of mind in the impugned order. Hehas not given any independent reasoning for rejecting the appeal”.
4. As such, the competent authority while imposing the penalty, should examinethe evidence and satisfy himself that the evidence does prove the guilt and record hisindependent observations or reasoning regarding how the charges are held provedagainst the delinquent officer with due justification for imposing the penalty. Further,In cases, where the Tamil Nadu Public Service Commission is consulted, thedisciplinary/appellate/revision/reviewing authorities as the case may be,

should record their independent views in the order, in addition to the viewsoffered by the Tamil Nadu Public Service Commission and the orders shouldbe self contained and speaking order.
5) The above instructions should be followed scrupulously.

Auxilium Jayamary, Director (Operation)TANTRANSCO has requested to accord sanction towards claiming of rental chargeand rental advance for her private accommodation, at No.G-3, Amrutha CrescentApartments, Old No. 25, New No. 39, Dr. P.V. Cheriyan Crescent Road (Near EthirajCollege), Egmore, Chennai - 8, from 30.12.2015.
3. Sanction is hereby accorded to Tmty A. In the letter second read above, the Secretary, Tamil Nadu Generation andDistribution Corporation Limited has stated that in G.O. (Ms.) No. 1025, CommercialTaxes and Religious Endowment Department, dated 07.09.1983, a notification wasissued under clause (d) of sub-section (1) of section 88 of the Registration Act, 1908in which it has been ordered that it shall not be necessary for the holders of the PublicOffice in the Tamil Nadu Electricity Board to appear in person or by agent at anyRegistration Office in any proceeding connected with the registration of any instrumentexecuted by them or in their favour, in their official capacity or to sign as provided insection 58 of the said Act and that in G.O. (Ms.) No. 100, Energy Department, dated19.10.2010, the Tamil Nadu Electricity Board has been trifurcated into three entities,namely the Tamil Nadu Electricity Board, Tamil Nadu Generation and DistributionCorporation Ltd., (TANGEDCO) and Tamil Nadu Transmission Corporation Limited(TANTRANSCO) and that the personnel of the Tamil Nadu Electricity Board shall standassigned to the services of the relevant Transferee. On deputation basis, on “as-is-where-is” basis, (i.e) they will continue to serve in the place where they are postedon the day of transfer. Hence, the Secretary, Tamil Nadu Generation and DistributionCorporation Limited has requested the Government to issue orders to extend theexemption provided under section 88(1) of the said Registration Act, 1908 in respectof documents executed by the officials of the Tamil Nadu Generation and DistributionCorporation Limited.
2. The Government examined the above said request of the Tamil NaduGeneration and Distribution Corporation Limited and have decided to accept the sameand to issue a fresh notification providing for exemption from appearing in person atRegistration Offices in any proceeding connected with the registration of an instrumentexecuted by the Officials of Tamil Nadu Generation and Distribution Corporation Limitedand Tamil Nadu Transmission Corporation Limited in their official capacity. Accordingly,the Government direct that the Notification appended to this order will be published inthe next issue of the Tamil Nadu Government Gazatte. The Works Manager,Government Central Press is requested to send ten copies to the Government and

Tenure : 13 years including 3 years moratorium for repayment ofprincipal.

I. RESOLVED that the Tamil Nadu Transmission Corporation Limited,(TANTRANSCO) do accept the Term Loan of Rs. 9869.49 Lakhs (RupeesNine thousand eight hundred and sixty nine lakhs and forty nine Thousandonly) For 1 No. Transmission scheme under P:SI (Trans) category sanctionedby Rural Electrification Corporation Ltd., New Delhi and also the terms andconditions as stipulated by the REC Ltd., New Delhi, vide sanction letter dated17.02.2016.

RESOLVED FURTHER that the Chairman/TANTRANSCO be and is herebyauthorized to accept any special conditions that may be stipulated by RECLimited, and that such acceptable terms and conditions may be communicatedto REC Limited, by Chief Financial Controller / TANTRANSCO on behalf of theChairman/TANTRANSCO.
III. RESOLVED FURTHER that the Chief Financial Controller / TANTRANSCO beand is hereby authorized to execute relevant loan documents anyamendments, such certificates and other writings and create security by wayof creation of charges on Future assets on behalf of the TANTRANSCO.
IV. RESOLVED FURTHER that the common seal of the company be affixed onthe security documents and any other related documents as may be requiredby REC in the presence of the Director (Finance) and Managing Director (or)Director/Transmission project and the Company Secretary shall sign the samein token thereof.

Erection of 400 KV Line Reactors & Bus Reactors at various 400 KV Substations inGeneral Construction Circle/Salem & Madurai Region of Tamil Nadu as stipulated bythe REC Ltd., New Delhi, in their letter dt. 10.03.2016 is as follows:
Amount : Rs.4981.89 Lakhs (Rupees Four thousand nine hundredand eighty one lakhs and eighty nine thousand only).
Rate of interest : The interest shall be charged on the loan at the rateprevailing on the date of each disbursement as per REC'slatest loan policy circular.
Tenure : 13 years including 3 years moratorium for repayment ofprincipal.
Repayment : 10 years after the moratorium period of 3 years in tenannual equal instalments.
Validity of sanction : 6 months from the date of sanction.
Security : Mortgage / Hypothecation of future assets so created(TANTRANSCO’S out of loan amount sanctioned for the project subject toOPTION) the value being 110% of the loan amount so sanctioned.
The security by way of creation of charges on FUTUREASSETS ONLY shall be accepted subject to the loanamount being restricted to 90% of the project cost.
3. After careful consideration, The Borrowing Committee of TANTRANSCO haveapproved and accept Rs. 4981.89 Lakhs (Rupees Four thousand nine hundred andeighty one lakhs and eighty nine thousand only) for Erection of 400 KV Line Reactors& Bus Reactors at various 400 KV Substations in General Construction Circle/Salem& Madurai Region of Tamil Nadu sanctioned by the Rural Electrification CorporationLimited, New Delhi, (REC Ltd.) and accepting all terms and conditions as mentioned inREC sanction letter dt. 10.03.2016.
4. The following resolutions are also passed as requested by Rural ElectrificationCorporation Limited, New Delhi.
RESOLUTIONS
I. RESOLVED that the Tamil Nadu Transmission Corporation Limited,(TANTRANSCO) do accept the Term Loan of Rs. 4981.89 Lakhs (Rupees Fourthousand nine hundred and eighty one lakhs and eighty nine thousand only)for 1 No. Transmission scheme under P:SI (Trans) category sanctioned byRural Electrification Corporation Ltd., (REC Ltd.,) New Delhi and also the termsand conditions as stipulated by the REC Ltd., New Delhi, vide sanction letterdated 10.03.2016.
II. RESOLVED FURTHER that the Chairman/TANTRANSCO be and is herebyauthorized to accept any special conditions that may be stipulated by RECLtd., and that such acceptable terms and conditions may be communicatedto REC Limited by Chief Financial Controller / TANTRANSCO on behalf of theChairman/TANTRANSCO.
III. RESOLVED FURTHER that the Chief Financial Controller / TANTRANSCO beand is hereby authorized to execute relevant loan documents anyamendments, such certificates and other writings and create security by wayof creation of charges on future assets on behalf of the TANTRANSCO.
