DOG FENCE ACT 1946 Declaration of Rate

PURSUANT to the provision of section 25 of the Dog Fence Act 1946, the Dog Fence Board, with the approval of the Minister for Environment and Conservation, hereby declares that for the financial year ending 30 June 2009 the dog fence rate shall be 104 cents per km2 and the minimum amount payable $73 for all separate holdings of more than 10 km2 of land situated inside the dog fence. DEVELOPMENT ACT 1993: SECTION 46 (4)

Preamble 1. On 5 June 2003, the Minister for Urban Development and Planning, by notice in the Gazette (see Gazette 5 June 2003 pp. 2380) declared that section 46 of the Development Act 1993, applied to a development of a kind specified in Schedule 1 of that notice. FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Miles Wise of Clean Seas Tuna Pty Ltd, 7 North Quay Boulevard, Port Lincoln, S.A. 5606 (the ‘exemption holder’), or a person acting as his agent, is exempt from section 54 of the Fisheries Management Act 2007 and Clause 99 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder may engage in the collection of up to 20 Yellowtail Kingfish (Seriola lalandi) using a hauling net for the purpose of aquaculture broodstock, in the waters described in Schedule 1 (the ‘exempted activity’), subject to the conditions set out in Schedule 2, from 1 August 2008 until 1 November 2008, unless varied or revoked earlier.

SCHEDULE 1 The waters of Port Patterson east of a line from Point Patterson to Snapper Point in Spencer Gulf.

SCHEDULE 2 1. The Yellowtail Kingfish collected by the exemption holder must only be used for aquaculture broodstock; all other species must be released immediately. 2. The exemption holder may collect a maximum of 10 Yellowtail Kingfish per trip and must allow a minimum of seven days between collections. 3. All Yellowtail Kingfish collected pursuant to this notice must not be sold or transferred to another party. 4. The exempted activity may be undertaken on behalf of the exemption holder by Craig Edwards, Marine Scalefish Fishery Licence No. M128.

A hauling net used pursuant to this notice must have a maximum length of 600 m, a maximum depth of 10 m and a minimum mesh size of 30 mm. 7. All Yellowtail Kingfish taken pursuant to this notice must be delivered to and retained on the registered aquaculture site of landbased Aquaculture Licence Nos FT00287 or FT00560. 8. The exemption holder must notify PIRSA Fisheries on 1800 065 522 at least 12 hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption with them at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. 9902126. 9. The exemption holder shall also provide written details to the Director of Fisheries of any interactions with threatened, endangered or protected species. 10. The exemption holder must provide a written report to the Director of Fisheries, (G.P.O. Box 1625, Adelaide, S.A. 5001) within 14 days of any collection. The report is to provide details of the time, date, location and number of fish collected, including details of any mortalities. 11. The exemption holder must notify the Director of Fisheries in writing (G.P.O. Box 1625, Adelaide, S.A. 5001 or Facsimile 8226 0434) when 20 Yellowtail Kingfish have been collected pursuant to this exemption, to allow for the this exemption to be revoked. 12. The exemption holder shall record the number of wild broodstock held pursuant to this notice in a register to be maintained at the registered aquaculture site, which must be made available for inspection by a PIRSA Fisheries Officer if requested. 13. The exemption holder must allow a Fisheries Officer or another nominated person to be on board the boat during the exempted activity if requested by PIRSA Fisheries. 14. While engaging in the exempted activity, the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested. 15. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice. TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Julia Murrie of Ceduna Area School, May Terrace, Ceduna, S.A. 5690 (the ‘exemption holder’), or a person acting as her agent, is exempt from Clauses 41 and 72 of Schedule 6 of the Fisheries Management (General) Regulations 2007 but only insofar as the exemption holder shall not be guilty of an offence when engaging in the taking of aquatic organisms (excluding species protected pursuant to section 71 of the Fisheries Management Act 2007) using a fish trap for education purposes at the Ceduna Area School (the ‘exempted activity’), from the waters specified in Schedule 1, subject to the conditions specified in Schedule 2, from 14 March 2008 until 31 December 2008, unless varied or revoked earlier.

SCHEDULE 1 South Australian marine coastal waters of Denial Bay (excluding intertidal ‘rocky’ reef areas).

SCHEDULE 2 1. All organisms taken by the exemption holder are for display purposes only and must not be sold. 2. An employee of the Ceduna Area School must be present at all times whilst conducting the exempted activity. 3. The fish trap must be marked with a white buoy of a volume of at least four litres and marked with a tag with the name and address of the exemption holder.

4. No more than five of any species may be taken or possessed at any one time. 5. Within 14 days of the collection of organisms, pursuant to this notice, the exemption holder must provide a report in writing to the Director of Fisheries, (G.P.O. Box 1625, Adelaide, S.A. 5001), giving the following details: • the date and time of collection; • the location of the collection; • the name and number of each species taken, including any

mortalities resulting from collecting. 6. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. 9902125. 7. Whilst engaged in the exempted activity, the exemption holder must have in their possession a copy of this notice and produce a copy of the notice if required by a PIRSA Fisheries Compliance Officer. 8. The exemption holder shall not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by the notice. TAKE note that the notice made under section 79 of the Fisheries Management Act 2007, published in the South Australian Government Gazette, dated 4 March 2008, referring to the West Coast Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a West Coast Prawn Fishery Licence to use prawn trawl nets in the waters specified in Schedule 1, under the conditions specified in Schedule 2, during the period specified in Schedule 3.

SCHEDULE 1 The waters of the West Coast Prawn Fishery within Venus Bay and Coffin Bay.

SCHEDULE 2 1. Each licence holder must ensure that a representative sample of the catch (a ‘bucket count’) is taken for each trawl shot carried out during the fishing activity. 2. Each ‘bucket count’ sample must be accurately weighed to 7 kg where possible and the total number of prawns contained in the bucket must be recorded on the attached data sheet, marked ‘West Coast Prawn Fishery Bucket Count Data Sheet’. 3. The information recorded on the ‘WCPF Bucket Count Data Sheet’ must be returned to SARDI Aquatic Sciences within 15 days of the fishing activity being completed. 4. Fishing must cease if one or both of the following limits are reached: (a) The average catch per vessel, per night (for all three

vessels) drops below 300 kg for two consecutive nights. (b) The average prawn ‘bucket count’ for all three vessels

exceeds 240 prawns per bucket on any single fishing night.

5. The fleet must nominate a licence holder to provide a daily update by telephone or SMS message to the PIRSA Fisheries Manager, to report the total prawn catch per night and the average prawn ‘bucket count’ information.

By notice published on 9 November 2006 (Gazette 9 November 2006 page 3918), a declaration under section 43 of the Fisheries Act 1982 made it unlawful for persons to engage in certain fishing activities for a specified period. 2. THE following determination is made by the State Crewing Committee pursuant to part 6, section 45 of the Harbors and Navigation Act 1993 in respect of the Ungarra whilst operating pilot boat work only: Minimum Complement Two persons—Master and one GP (General Purpose Persons) The Master or GP can be the holder of the Marine Engine

Driver Grade 3 the GP needs to hold a Coxswain Certificate if the Master holds the MED3.

Minimum Qualifications of Crew Master—Certificate of Competency as Master Class 5. Engineer—Certificate of Competency as Marine Engine

Driver Grade 3. The Master or GP can be the holder of the Marine Engine

Driver Grade 3 the GP needs to hold a Coxswain Certificate if the Master holds the MED3.

WORKERS REHABILITATION AND COMPENSATION ACT 1986 THE WORKCOVER CORPORATION OF SOUTH AUSTRALIA (‘the Corporation’) in accordance with those provisions of the WORKERS REHABILITATION AND COMPENSATION ACT 1986, as amended (‘the Act’) identified in Item 1 of the Schedule hereto (‘the Schedule’) makes its determination in the terms set out in Item 2 of the Schedule upon the grounds set out in Item 3 of the Schedule, if any, to come into effect on the date set out in Item 4 of the Schedule and determines further that notice of this determination shall be provided in the manner set out in Item 5 of the Schedule. 2.1 Amendment to Levy Rates That the Determinations of the Corporation as to the percentage of aggregate remuneration paid to an employer’s workers payable as the levy made prior to the making of this Determination be and are hereby varied so that the percentage of aggregate remuneration paid to an employer’s workers in each class of industry, referred to in Column No. 2 of the Appendix hereto, payable as the levy, shall be the corresponding percentage set out in Column No. 3 of the Appendix hereto plus 10% to allow for any GST additionally payable by an employer.

Item 3 Grounds of Determination

3.1 In respect of the levy applicable to the classes of industry that the percentages applicable take into account:

(a) the extent to which work carried on in a relevant class is likely to contribute to the cost of

compensable disability; and

(b) the need to establish and maintain sufficient funds:

(i) to satisfy the Corporation’s future liabilities in respect of compensable disabilities attributable to traumas occurring from the date of commencement of this Determination until the 30th day of June 2009 from the levy raised from remuneration in that period; and

(ii) to make proper provision for administrative and other expenditure of the

Corporation; and

(iii) to make up any insufficiency in the Compensation Fund resulting from previous liabilities or expenditures or from a reassessment of future liabilities.

3.2 That the percentages so determined in accordance with Section 66 (7) of the Act (not exceeding 7.5 per

cent) are as follows:

Schedule 1—Revocation of Construction Industry Training Fund Regulations 1993

1—Short title These regulations may be cited as the Construction Industry Training Fund Regulations 2008.

2—Commencement These regulations will come into operation on 1 September 2008.

3—Interpretation In these regulations—

Act means the Construction Industry Training Fund Act 1993;

GST means the tax payable under the GST law;

GST law means—

(a) A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth; and

(b) the related legislation of the Commonwealth dealing with the imposition of a tax on the supply of goods, services and other things.

Pursuant to section 3(3) of the Act, the sectors of the building and construction industry are constituted as follows:

(a) The housing sector

That part of the building and construction industry which carries out building or construction work on, or resulting in, a building that is a residential dwelling unit, or a number of residential dwelling units, each of which contains cooking and bathing facilities and is intended to be used predominantly for long term residential purposes. A building that is a dwelling unit which is part of an educational institution, a hospital or other building offering institutional care or temporary accommodation (such as a motel, hostel or holiday apartment) is not included in the housing sector;

(b) The commercial sector

That part of the building and construction industry, other than the housing sector, which carries out building or construction work on, or resulting in, a rigid, fixed and permanent structure with a roof, the intended purpose of which is for the shelter, or the use, of people, plants, machinery, goods or livestock;

(c) The civil sector

The remainder of the building and construction industry.

5—Composition of Board (1) For the purposes of section 5(1)(c) of the Act—

(a) the method of selecting the persons to represent the interests of employers in the building and construction industry will be determined by majority agreement between the employer associations referred to in Schedule 2 of the Act (as amended by regulation); and

(b) when the appropriate number of persons have been selected, the nominations under that section must be made by notice in writing to the Minister.

(2) For the purposes of section 5(1)(d) of the Act—

(a) the method of selecting the persons to represent the interests of employees in the building and construction industry will be determined by majority agreement between the employee associations referred to in Schedule 3 of the Act (as amended by regulation); and

(b) when the appropriate number of persons have been selected, the nominations under that section must be made by notice in writing to the Minister.

6—Forms (1) A levy paid for the purposes of the Act must be accompanied by information determined by

the Board and that information must be given in a manner and form determined by the Board.

(2) For the purposes of section 23(4)(c) of the Act, an application for the benefit of section 24(4) of the Act must be made to the Board.

(3) An application or notification to the Board for the purposes of the Act must be accompanied by information determined by the Board and be made or given in a manner and form determined by the Board.

declaration under Part 3 of the Oaths Act 1936.

7—Penalties Pursuant to section 25(1)(b) of the Act, the following amounts are prescribed as maximum amounts that may be imposed by the Board under that section if a project owner fails to pay a levy due under the Act in accordance with the requirements of the Act:

(a) if the value of the unpaid levy does not exceed $500 $ 500

(b) if the value of the unpaid levy exceeds $500 but does not exceed $10 000 $2 500

(c) if the value of the unpaid levy exceeds $10 000 $5 000

8—Prosecutions Pursuant to section 36(1)(b) of the Act, an offence under Part 4 of the Act is an offence of a prescribed kind.

9—Records (1) Pursuant to section 37(2)(d) of the Act, a person must keep the following records in relation

to building or construction work for which he or she is the project owner and which gives rise to a liability to pay a levy under the Act for a period of 5 years from the commencement of that work:

(a) a copy of all forms submitted to or received from the Board or a collection agency relating to the payment or refund of the levy;

(b) the date on which the building or construction work commenced;

(c) the value of the building or construction work;

(d) the site address of the building or construction work;

(e) brief details describing the type of building or construction work.

(2) The Board may, in writing, exempt a person from keeping any of the records referred to in subregulation (1), either in general or in relation to specified work or work of a specified kind, for a period of time specified in the exemption.

10—Offence A person who breaches, or fails to comply with, a provision of these regulations is guilty of an offence. Maximum penalty: $2 500.

11—Items not subject to levy (1) Pursuant to section 37(2)(g) of the Act (but subject to subregulation (2)), plant or equipment

directly associated with mineral, oil or natural gas exploration, production or processing constitute a class of items the cost of which will not be taken into account for the purposes of the calculation or imposition of the levy under the Act.

(2) Subregulation (1) does not apply in respect of plant or equipment constructed, erected or installed as part of the housing sector or the commercial sector of the building and construction industry (as defined by these regulations).

12 June 2008] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 2335 (3) Pursuant to section 37(2)(g) of the Act, main or core turbines or generators to be installed at

power stations involved in the generation of electricity for the State's power system constitute a class of items the cost of which will not be taken into account for the purposes of the calculation or imposition of the levy under the Act.

12—Building or construction work—Schedule 1—Maintenance Pursuant to clause 1(r) of Schedule 1 of the Act (but not so as to affect the operation of regulation 13), maintenance work carried out on a building or structure, or on any place, machinery, plant, system, equipment, facility or operation referred to in Schedule 1 of the Act, constitutes building or construction work for the purposes of the Act.

13—Exclusions—Schedule 1—Mining and Petroleum (1) Pursuant to clause 2(d) of Schedule 1 of the Act, the following work associated with any

operation under the Petroleum Act 2000, the Petroleum (Submerged Lands) Act 1982, the Mining Act 1971 or the Opal Mining Act 1995 does not constitute building or construction work for the purposes of the Act, provided that it is not carried out in the housing sector or the commercial sector of the building and construction industry (as defined by these regulations):

(a) earthworks associated with the construction or maintenance of a temporary water supply or temporary access track for a purpose associated with mineral or petroleum exploration activity, and other earthworks associated with such exploration activity;

(b) excavation work associated with exploration for, or the extraction of, any mineral or petroleum;

(c) work directly related to the fabrication of a pipeline system used in mineral or petroleum production or processing (but not including associated work such as earthworks, excavation work or the construction of culverts, bridges, drains or structural supports), and subsequent repair work that involves welding or coating a pipeline system (or part of a pipeline system) used in mineral or petroleum production or processing;

(d) the construction or maintenance of a haul road or track which is—

(i) in or around a mine or other mineral or petroleum production facility; and

(ii) directly used in a mineral or petroleum production operation;

(e) the maintenance of an airstrip or landing pad used in conjunction with a mineral or petroleum production operation;

(f) work associated with an environmental clean-up or environmental restoration;

(g) work associated with a mine back-filling operation;

(h) repair or maintenance work carried out on plant or equipment directly associated with mineral or petroleum exploration, production or processing, or for piloting.

(2) In subregulation (1)—

petroleum has the same meaning as in the Petroleum Act 2000 and includes any other regulated resource within the meaning of that Act.

14—Estimated value of building or construction work—Schedule 1A Pursuant to clause 1(b)(vi) of Schedule 1A of the Act, the value of any GST payable in respect of the components referred to in clause 1(b) of Schedule 1A is to be regarded as a component of the estimated value of the building or construction work.
