NOTICE is hereby given that the Minister for Urban Development and Planning has, pursuant to sections 24 and 26 of the Development Act 1993, prepared a draft Plan Amendment Report (PAR) to amend the Adelaide Hills Council, Alexandrina Council, The Barossa Council, Mount Barker (DC), Onkaparinga (City), Playford (City), Tea Tree Gully (City), Victor Harbor (DC) and Yankalilla (DC) Development Plans. The draft PAR proposes to amend those Development Plans by revising the objectives and principles of development control in affected rural and primary production zones within the Mount Lofty Ranges Watershed area, in order to guide future winery, cellar door sales and ancillary restaurant uses. Two Community Information Forums have been arranged to provide background information and other details regarding the PAR. These forums have been scheduled for: • Wednesday, 30 November 2005 at 7.30 p.m. at the

Hahndorf Resort (Heidelberg Room), 145 Main Street, Hahndorf; and

• Tuesday, 6 December 2005 at 7.30 p.m. at McLarens on the Lake (Coach Room), Kangarilla Road, McLaren Vale.

The draft PAR will be on public consultation from Thursday, 27 October 2005 to 5 p.m. on Friday, 13 January 2006. Copies of the draft PAR are available during normal office hours at the Department for Primary Industries and Resources SA (Planning SA), Level 5, 136 North Terrace, Adelaide, or can be viewed on the Internet at www.planning.sa.gov.au/wineriesPAR. Alternatively the draft PAR can be viewed during normal office hours at the offices of the Council’s listed above. Written submissions regarding the draft PAR should be submitted no later than 5 p.m on Wednesday, 13 January 2006. I, STEPHEN RICHARD SMITH, Senior Adviser, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 69 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Vary the Approval of Category B Containers Vary the approval of Category B Containers, subject to the conditions in subclauses (i) and (ii) below, each of the classes of containers identified by reference to the following matters described in the first four columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; (d) the name of the holders of these approvals. (i) Subsection 69 (3) Arrangements: The holders of these approvals must ensure that the empty containers which belong to their respective class of containers

hereby approved as Category B Containers are collected from collection depots approved under section 69 of the Act by the party named in column 5 of Schedule 1 of this Notice; and

(ii) Approved Refund Markings: (a) The holders of these approvals must ensure that each container which belongs to their respective class of containers hereby

approved as Category B Containers bears the refund marking approved by the Authority in respect of that class of containers.

(b) The refund marking that appears on each container that belongs to the class of containers hereby approved, must be a minimum 1.5 mm for the smallest letter in the statement and a minimum 3 mm for the numeric (‘5’) in the statement.

(c) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

FISHERIES ACT 1982: SECTION 59 TAKE notice that pursuant to section 59 of the Fisheries Act 1982, the Spencer Gulf and West Coast Fishermen’s Association (the ‘exemption holder’) or a person authorised by the Association to act as their agent and undertake fishing activity pursuant to this exemption (‘authorised licence holder’), is exempt from the notice made under section 43 of the Fisheries Act 1982 in June 2005 prohibiting fishing pursuant to a Spencer Gulf Prawn Fishery Licence insofar as the exemption holder or an authorised licence holder shall not be guilty of an offence when using prawn trawl nets pursuant to their fishery licence for the purpose of undertaking prawn surveys (the ‘exempted activity’), subject to the conditions contained in Schedule 1.

SCHEDULE 1 1. The exempted activity may only be undertaken from 1 November 2005 until 30 June 2006. 2. The exemption holder may authorise the holder of a Spencer Gulf Prawn Fishery Licence to act as their agent and undertake the exempted activity pursuant to this notice. 3. The exemption holder must contact the PIRSA Fisheries Compliance Unit on 1800 065 522 not less than one hour prior to departure from port and provide the following information for each survey period: • A list of the licence numbers of the authorised licence

holders who will be conducting fishing activity pursuant to this notice.

• The date of departure from port for each boat. • The general area in which the surveys are to be conducted. • The time of return to port for each boat. • The registered master who will be in charge of each

registered boat during the exempted activity. 4. If a registered boat will return to port more than 30 minutes before or after the time reported in accordance with condition 3, then the exemption holder must make a new report at least one hour before the registered boat returns to port. 5. Authorised licence holders may only engage in the exempted activity in the waters of the Spencer Gulf Prawn Fishery that are greater than 10 m in depth. 6. All fish other than prawns, calamary (Sepioteuthis australis) and slipper lobster (Ibacus spp.) taken during the exempted activity must be returned to the water immediately after capture. 7. The exemption holder or an authorised licence holder must not contravene or fail to comply with Fisheries Act 1982, or any other regulations made under that Act, except whereby specifically exempted by this notice. NATURAL RESOURCES MANAGEMENT ACT 2004 Notice of Restriction on Water Use in the Padthaway Prescribed

Wells Area PURSUANT to section 132 (1) of the Natural Resources Management Act 2004 (the Act), I, John David Hill, Minister for Environment and Conservation, being of the opinion that the rate at which water is being taken from wells in the Padthaway Prescribed Wells Area, being the area gazetted on 13 May 1976 as the Padthaway Proclaimed Region under the provisions of the Water Resources Act 1976 and now known as the Padthaway

Prescribed Wells Area, is likely to affect the quality of the underground water in the Padthaway Prescribed Wells Area, hereby prohibit the taking of water from wells, subject to the exceptions specified in Schedule 1.

SCHEDULE 1 1. A person may take water in accordance with the terms of a written authorisation: (a) granted under the Notice of Restriction published in the

Government Gazette on 13 December 2001 (page 5377), in accordance with the Guidelines for Authorisations for the Taking of Water Under the Notice of Restriction in the Padthaway Prescribed Wells Area dated 12 December 2001; or

(b) granted under the Notice of Restriction published in the Government Gazette on 16 October 2003 (page 3814), in accordance with the Revised Guidelines for Authorisations for the Taking of Water Under the Notice of Restriction in the Padthaway Prescribed Wells Area dated 8 October 2003; or

(c) granted by me or any person authorised in writing by me under this Notice and in accordance with the Revised Guidelines for Authorisations for the Taking of Water Under the Notice of Restriction in the Padthaway Prescribed Wells Area dated 8 October 2003.

2. This prohibition does not apply to: (a) the taking of water pursuant to section 124 (4) of the Act

for domestic purposes or watering stock (other than stock subject to intensive farming); or

(b) taking of water for fire-fighting, road making or reticulating supplies of potable water for townships in the area.

This Notice will remain in effect for two years unless earlier varied or revoked. Dated 18 October 2005.

South Australia—Gulf St Vincent—Port Giles—New Berth and Approach Declared

MARINERS are advised that the dredging operations at Port Giles referred to in the previous notice have now been completed. A swath hydrographic survey was carried out on 12 October 2005. This technology provides ‘total bottom coverage’ and indicated a minimum depth of 14.7 m referred to Lowest Astronomical Tide (LAT) over the full width of the new berth and a minimum depth of 13.5 m in the northern approaches. The size of the new berth box is now 340 m long and 40 m wide. 1—Short title This notice may be cited as the Motor Vehicles (Approved Foreign Licences) Notice 2005.

2—Commencement This notice will come into operation on 31 October 2005.

For the purposes of section 72A(1)(b)(ii) and 79(1)(b)(ii) of the Motor Vehicles Act 1959 foreign licences issued by any of the countries listed in Schedule 1 are approved.

4—Approved foreign licences – section 79A(1)(b)(i)(B)

For the purposes of section 79A(1)(b)(i)(B) of the Motor Vehicles Act 1959—

(a) a foreign licence of a country listed in Schedule 1 is approved if the applicant is applying for a licence of class “C”, “R” or “R-D”; and

(b) a foreign licence of New Zealand authorising the holder to drive a vehicle other than a car or motorcycle is approved if the applicant is applying for any class of licence.

Preamble 1 A proclamation was made pursuant to section 41 of the Water Resources Act 1976 (the 1976

Act) declaring an area of the State to be the Mallee Proclaimed Region for the purposes of that Act (see Gazette 28.07.1983 p205).

2 The proclamation was varied on 9 January 1986 (see Gazette 09.01.1986 p19).

3 Schedule 3, clause 2 of the Water Resources Act 1997 (the 1997 Act) provides that a proclamation under section 41 of the 1976 Act in force immediately before the commencement of the 1997 Act continues in force as if it were a regulation under section 8(1) of the 1997 Act.

4 Schedule 4, clause 54(2) of the Natural Resources Management Act 2004 (the current Act) provides that a regulation in force under section 8 of the 1997 Act (including such a regulation in force by virtue of the operation of Schedule 3 of the 1997 Act) will continue in force and effect as if it were a regulation made under section 125 of the current Act.

5 It is now appropriate to make a regulation under section 125 of the current Act declaring a number of wells situated in a part of the State that is adjacent to the Mallee Proclaimed Region to be prescribed wells.

6 The regulations to be made under the current Act will (among other things) have the effect—

(a) of varying the area of the Mallee Proclaimed Region; and

(b) of re-naming the whole of that area as the Mallee Prescribed Wells Area in keeping with current practices.

These regulations may be cited as the Natural Resources Management (Mallee Prescribed Wells Area) Regulations 2005.

2—Commencement These regulations come into operation on the day on which they are made.

3—Interpretation In these regulations—

Act means the Natural Resources Management Act 2004;

Mallee Prescribed Wells Area means—

(a) the Mallee Proclaimed Area; and

(b) the New Area;

Mallee Proclaimed Area means the Mallee Proclaimed Region under the proclamations referred to in clauses 1 and 2 of the preamble;

New Area means—

(a) the area comprising the Hundreds of Bandon, Wilson, Marmon Jabuk, Vincent and Hooper; and

(b) the area designated as Area A in GRO Plan No 217/2004.

4—Declaration of prescribed wells Wells situated in the Mallee Prescribed Wells Area and wells drilled in that Area after the commencement of these regulations are declared to be prescribed wells.

5—Establishment and prescribed periods (1) The establishment period in relation to the area comprising the Hundreds of Bandon,

Wilson, Marmon Jabuk, Vincent and Hooper commenced on 1 July 2001 and ended at the commencement of the prescribed period in relation to those Hundreds (11 March 2004).

(2) The establishment period in relation to the area designated as Area A in GRO Plan No 217/2004 commenced on 1 July 2001 and ended at the commencement of the prescribed period in relation to that area (22 July 2004).

(3) The prescribed period in relation to the area comprising the Hundreds referred to in subregulation (1) commenced on 11 March 2004 and will end on the day that coincides with the third anniversary of the commencement of this regulation.

(4) The prescribed period in relation to the area designated as Area A referred to in subregulation (2) commenced on 22 July 2004 and will end on the day that coincides with the third anniversary of the commencement of this regulation.

6—Operation of section 124(4) Pursuant to section 124(5) of the Act, the operation of section 124(4) of the Act is not excluded in relation to the prescribed wells declared under regulation 4.

Note—

Section 155 of the Act has no purpose in respect of that part of the Mallee Prescribed Wells Area that is in the Mallee Proclaimed Area.

6—Operation of section 124(4) Pursuant to section 124(5) of the Act, the operation of section 124(4) of the Act is not excluded in relation to the prescribed wells declared under regulation 4.

• introducing the Mixed Use Historic (Conservation) Zone and the Portrush Road Policy Area along Portrush Road, between Harcourt Road and Victoria Street;

• incorporating Desired Character Statements into each of the Policy Areas, as an important development assessment tool;

• replacing Table NPSP/6 with a revised list of Local Heritage Places including an additional 66 proposed Local Heritage Places, that meet the criteria for a Local Heritage Place under the Development Act 1993;

• replacing Table NPSP/7 with a revised list of Contributory Items including an additional 308 that fall within the boundaries of the extended Residential Historic (Conservation) Zone and the Mixed Use Historic (Conservation) Zone;

• including revised Zone Maps, Policy Area Maps and new Figures that define the boundaries of the proposed Historic (Conservation) Zones, Policy Areas and the location of all Local Heritage Places and Contributory Items.
