As the FCC has taken on the regulation of cable, Reed Hundt had his hand out to Congress last week for an extra $50 million to cover the added costs. According to Inside Radio, the House was ready to approve only $21 million. Hundt has been a proponent of user fees, which are being looked at as a way to make the Commission fiscally self- sufficient. The NAB has vowed to fight this type of funding. ARBITRON MAY DROP TWO BIG ONES... Nobody at Arbitron has confirmed this, but it seems that the San Diego North County and Anaheim -Santa Ana markets may be history as soon as the Spring '94 book is out. Most of the subscribers of those books are in the San Diego and Los Angeles markets, respectively, anyway. Look for an official announcement from Arbitron soon. WASHINGTON THIS WEEK

If you're looking for a new set of call letters, you're going to have about 1,250 fewer sets to choose from. The Commission has amended the rules to allow low power television stations to be issued actual call letters, rather than the alphanumeric scheme they've used in the past. Previously, LPTV's were issued identifiers similar to the way translators are (for example, W67BC). LPTV's will be issued the four letter calls, followed by the suffix "LP" (e.g. KKKK -LP). According to the NAB's TV Tech Check, the Commission will later issue a schedule by which broadcasters can apply for new call letters. As with other call signs, only call signs not in use may be requested, unless the stations are commonly owned or the LPTV station has gotten written permission from the broadcaster that holds the desired calls.

With the appointment of Susan Ness and Rachelle Chong as the two new Commissioners, several staff appointments have also been made this week. Ness has appointed Gregory Vogt, Chief of the FCC's Common Carrier Bureau Tarriff Division, and Rosalind Allen, Chief of the Private Radio Bureau's Rules Branch, as interim advisors until she finalizes her permanent staff. Donna Stapleton will become Ness's Confidential Assistant.

Rachelle Chong has made several appointments. Richard Welch will be her legal advisor. Welch was most recently an attorney in the Administrative Law Division of the FCC's Office of General Counsel. Angela Wu will be her Confidential Assistant. Wu comes from Mead Data Central, where she was an Account Representative. Jill Luckett, who served as Legislative Director to Oregon Senator Bob Packwood, will be a Special Advisor. Jane Mago, will become Senior Advisor. Mago has been with the FCC in several capacities over the last 16 years.

The FCC has provided some guidance on how to report employees on the 395 -B Annual Employment Report. Questions were being raised as to which company should report employees in an LMA. The guideline states, "Employees hired in concert with time brokerages and LMAs should be reported on the Form 395 -B submitted by the licensee that employs them." If you aren't a licensee, you don't have to file the form.

ELSEWHERE

Scam me once and scam me twice and scam me once again. The theme song to the latest ordeal from a company called Promopax, a.k.a. Promo West, a.k.a. Island Promotion West, a.k.a. Island Promotions.

It seems that several stations were promised two general admission tickets to the Indy 500, accommodations at a hotel, transportation, two grandstand seat tickets to the Parade and two tickets to the Promopax Party. The night before winners were to leave, a fax addressed to the General Manager of the participating stations stated, "Unfortunately, (Promopax) not having sufficient funds to cover the hotel rooms...The hotel...has agreed to accept your credit card via phone from you for

the payment." The fax went on to say "We...promise you repayment...no later than June 7th ".

One station, smartly fearing greater loss, contacted the "winners ", explained the situation, and gave them alternative prizes. Some other stations were not that lucky. We heard reports of "winners" flying down and having no hotel, no "welcome crew" to tell them what's happened, and no tickets.

So, first offense, live and learn right? Nope. There are similar reports about Promopax's Superbowl Promotion and NCAA Promotion (see Inside Radio April 6th

issue). The lawyer for Promopax states "financial problems" as reason for why the promotions never panned out. He said that Promopax has no money to pay anyone and is consequently urging the company to file Chapter 7.

On a "positive" note, Promopax is still around, and will be doing three more promotions in the following months: The Playboy Jazz Festival in June, The Baseball Allstars in July and The Brickyard 400 in August. So what can you do if you've been burned? The lawyer for Promopax says stations can contact him.

Some suggestions from one of the stations burned in the Indy 500: Request Competitive Bids on any event promotion, Don't send advance money and thoroughly check all references.

Van Halen is out of the radio business, as they've sold the stations they owned in Portland, OR --hot AC KXYQ (AM) Milwaukie & KXYQ -FM Salem --to Jeff Trumper for $5.6 million. The profit from the sale could certainly ease up their tour schedule: they paid the Daytona Group around $1.3 million for the combo two years ago. The purchase will give Trumper a duopoly as the two stations will combo with AC KKCW Beaverton.

Christopher Dahl's Children's Broadcasting Corp. reported a net loss of just over $937,000 for the first quarter of 1994 compared to a loss of $590,681 for the same period last year. Revenues for Q1 '94 were $756,232, up from $102,028 for Ql '93.

Emmis Broadcasting has received final approval to start the first national commercial talk radio station. Talk Radio U.K. is expected to debut in February, 1995. Talk Radio U.K. will be the country's third commercial station, on the heels of classical Classic FM and rocker Virgin 1215. According to the press release, Emmis Chairman Jeff Smulyan said the new station will feature a high level of controversy and humor.

Don Geronimo and Mike O'Meara, better known as WJFK's syndicated morning team Don & Mike, have settled the Dawn Tritaik defamation suit out -of- court, but the terms of the settlement weren't disclosed. In a broadcast last year, Don & Mike revealed that Tritaik, a WWMX Baltimore staffer, was gay. This on -air revelation triggered a $50 million lawsuit, which was set to go to trial August 29.

People's Radio Network has a new 24- hour -a -day affiliate --much to their surprise. WXOL Oshkosh WI apparently flipped to the PRN channel, locked the doors, and walked away. No ID's, no spots, just PRN. Nobody is answering the phone at the station. Nearby PRN affiliate WCWC Ripon WI is miffed because they have the exclusive rights to PRN in that area. WXOL's agreement allows them to carry only what WCWC didn't.

The Radio Advertising Bureau reports Radio revenue jumped 9% in combined national spot and local revenue for April. Local revenue is up 11% from January to April 1994 and is up 13% for the same period on the national level.

Arbitron has introduced a "First Preference" report, which lists the percentage of a station's cume audience that's "core listenership " -- listeners who report listening to that station for more quarter -hours than for any other single station. Maximiser subscriber's can get additional demos and formats, as well.

After the completion of the "Family Radio Study," Arbitron is looking for takers for the measurement of children's radio listening. The just -completed study, done in conjunction with the Children's Satellite Network, was the first co- sponsored venture measuring listening for children under age 12.

The just - launched AP All News Radio has 30 new affiliates so far, according to Associated Press. Three of them --WKIN Kingsport TN, KDES Palm Springs, and KNUU Paradise NV (Las Vegas), have already begun the format. The rest will start soon. WASHINGTON THIS WEEK The Commission has approved the assignment of the license of KGAL -FM Brownsville, Oregon from Eads Broadcasting Corp. to C &C Broadcasting, Inc, after two competing broadcasters filed a petition to deny the sale. C &C already owns KUGN -AM & FM Eugene, OR. KGAL -FM's coverage overlapa tho3E two, making it subject to duopoly regulations. KGAL -FM also has a construction permit to upgrade from a class A facility to a class Cl. The two petitioners, McKenzie River Broadcasting and McCoy Broadcasting Company, unsuccessfully argued that even though the transfer was filed during the Spring 1992 book (and therefore used those numbers), the application was still pending during the Fall 1992 book --which would have put the duopoly over the 25 percent share cap. The Commission stated that since the Fall 1992 ratings hadn't been published at the time the application was filed, the Spring numbers must be used.

Lauren J. (Pete) Belvin has been appointed to serve as Commissioner Jim Quello's Senior Legal Advisor. Belvin was Chief of the Field Operations Bureau's Enforcement Division.

The NAB's Radio Board has a new Chairman. He's J. Douglas Williams, owner and general manager of KWOX -FM, Woodward, OK. Dick Ferguson, chairman of Bridgeport, Conn. based NewCity Communications, was elected vice chairman. Williams is a

former FBI special agent.

ELSEWHERE It's official: Capital Cities /ABC will be picking up KSFO San Francisco to combo with KGO. The LMA will begin September 1. Although nothing about the purchase price is official, Inside Radio tags it at $10 million. The combo will give ABC talker combos in the two largest California markets.

Benchmark Communications has announced it will buy WVOC Columbia, SC for $2.5 million from Clayton Radio. They'll combo the AM talker with their country trombo of WCOS -AM & FM, Columbia and WHKZ Cayce, SC. At the same time, Benchmark will sell adult contemp. WZNY Augusta, GA to Savannah Valley Broadcasting Co. for $3.9

million. Savannah Valley already owns CHR combo WBBQ -AM & FM there. In the press release, Benchmark promises more acquisitions in the next 90 days.

Dowdy Broadcasting is doubling up in Lubbock as it will purchase country KONE for

$700,000. Dowdy already owns AC KMMX, Lamesa, TX.

According to Public Broadcasting Report, NPR's All Things Considered fans may have a chance to double their pleasure soon as the show may expand to three hours with

a 4:00 p.m. ET start. The show is currently ninety minutes. NPR hopes to

announce the move at the Public Radio PD's meeting in Seattle in September.

American Public Radio may introduce an internationally focused weekday news

program called "A New World" which would also start at 4:00 p.m. ET. Both of

these programs may have an impact on lower -end demos of commercial news /talk

stations.

Arbitron has announced the winner of its Great Radio Promotion #3. KZFX, Lake

Jackson (Houston), TX will walk away with the honors when given at the Radio Mercury Awards next week in New York. The station was selected from 41 entries for the best "Why is Radio Such a Powerful and Effective Medium for Advertisers" commercial. Three runners -up were also chosen: WKMF -FM /WCRZ /WFNT, Flint, MI;

KNIX -FM /KCWW, Tempe, AZ; and WUSL, Philadelphia and WIOQ, Bala Cynwyd, PA.

Walt Love has extended his contact with Westwood One to continue tc host The Countdown, which counts the Urban Top 25 hits as tabulated by Radio and Records Magazine. This will be the start of Love's twelfth year with the show.

M Street: What is in a Arbitron average quarter hour share?

From what we have seen (even in our own M Street products) there is far too much talk of share and not nearly enough talk of audience. Newspapers quote circulation not share and the large papers could claim a 90% plus share of daily newspaper reading 12 +. Radio can deliver real people to real business and yet they talk share not people.

Here in New York the press is constantly referring to classical formatted WQXR as "low rated" at 2.2% and in Washington, DC the press praises "highly rated" urban formatted WPGC with a 9.1% share. Yet few people seem to realize that WQXR's 2.2% represents 59,500 people and that beats WPGC's 53,500 average quarter hour listeners.

Tribune Broadcasting's full service WGN with its 6.2 showing in Chicago is often talked about in glowing terms, yet in truth WGN is the #2 Tribune station in terms of listeners as WQCD New York with its Jazz format talks to on average 95,100 people or 3.6% to WGN's 75,800.

Jones -Eastern's new urban combo in Augusta --WYFZ Evans and WAGW Waynesboro GA --have been on the air under their new ownership for a few months now, but apparently using the wrong call letters. When Jones -Eastern bought the stations, the plans were for a simulcast, so they applied for the call letters WAEG in Evans and WAEJ in Waynesboro, which were to be granted as soon as they notified the FCC's call letter desk when the sale closed. According to the Commission, no one called them. C.J. Jones, President of Jones -Eastern, responded by telling M Street, "Our attorneys are looking into it."

Radio & Records reports the FCC has begun a program that will allow broadcasters to pay user fees (and other fees) by credit card, bank wire, and other forms of

electronic payment using FCC Form 159. The new user fees, which are set to go

into effect this summer, are outlined in the chart on page 8. Fees must be paid by August 10 for FM's, September 2 for AM's.

Women and Minorities are well- represented in the broadcast industry workplace. So says the National Association of Broadcasters to the FCC. According to data supplied by the FCC, the broadcast industry employs women at 87% of the available labor -force (ALF) overall; 75% of the available labor -force in decision making positions and managers' jobs. Minorities are employed at 80% of ALF overall and 50% of ALF in decision making positions. The FCC requires 50% labor -force level. Given the employment levels, the NAB said there is no need for expanding the broadcast EEO requirements such as additional reporting efforts and record - keeping. The NAB also argued to the FCC for greater relief in record- keeping for small market broadcasters (15 full -time employees or less) and total relief of detailed record- keeping requirements if a small station has no history of discrimination.

And if $68 million wasn't enough for one day, Summit is selling off the rest of the group to Herb McCord's Granum Communications for approximately $130 million. The purchase will give Granum a duopoly in Dallas, and new combos in Atlanta and Baltimore to go along with his holdings in Boston and Orlando. For those of you keeping score at home, Summit h& F:IVN Fort l:orth/ KJMZ n9'''s, WACK/WVEE Atlanta, and WCAO /WXYV Baltimore. All of Summit's AM's are Black Gospel while the FM's are urban. Granum already owns New Age KOAI Fort Worth and Spanish KMRT Dallas, Progressive WBOS Brookline MA and AC WSSH -FM Lowell MA (Boston), and Progressive WMMO Orlando.

The second big duopoly prize of the week goes to Broadcasting Partners, who has picked up a sister in Chicago for soft urban WVAZ Oak Park IL by buying rapper WJPC -AM Chicago & urban oldies WJPC -FM Lansing IL. BP will pay $8 million to

Johnson Publishing for the combo.

Bud Paxson is selling his sports AM in Orlando, WWZN Winter Park FL, for $300,000 to J & V Communications. The sale will create a duopoly for J & V, which already owns oldies /talk WTRR Sanford FL.

Bengal Communications is rounding out its Albuquerque duopoly by picking up easy listening KKJY for $1.75 million on the heels of its recently announced purchase of CHR KAMX -AM and FM from Coastal Communications for $750,000.

Barnstable's WYKL Memphis has management at Dayton- Hudson Corp.'s Target Stores all, uh, "a quiver." When the station migrated to 70's oldies last month, it's slogan was changed to "Target 98 FM" and the logo was changed to a blue and orange bulls -eye. Target Stores management says that they've gotten negative calls, thinking their stores and the station are related, and have asked the station to

quit using the new slogan and logo, which resembles Target Stores' logo but uses different colors. In a story last week, the Memphis Commercial Appeal quotes Barnstable President David Gingold, "We hope we can resolve their concerns in a

nonlitigious manner, but we don't see any reason to change."

The Radio Corporation, owned by Ed Levine, has announced it will buy oldies WTLB and CHR WRCK, Utica NY from Joel Hartstone & Barry Dickstein's H & D Media for $1

million. Levine already owns rocker WKLL Frankfort NY (Utica /Rome) which simulcasts on nearby WKRL -AM & FM North Syracuse, and has a purchase pending for

classic rocker WTKW Bridgeport NY (Syracuse). An immediate LMA will take WRCK to

classic rock.

Major Broadcasting, the parent company of Chris Devine's Major Networks, has

purchased the Continental Basketball Association's Chicago Rockers, a new semi -pro NBA farm club. No word yet on whether Major will carry any of the games of the Rockers or the CBA.

Bruce Williams has been named 1994 Talk Show Host of the Year and will be presented with the honor at the sixth annual NARTSH convention in Los Angeles this Saturday June 25th. Bruce can add this honor to his earlier nomination into the Museum of Broadcast Communication's Radio Hall of Fame.

Morningstar Radio Network announced that Dick Marsh, founder of the Marsh Broadcasting Company and former COO of the Children's Radio Group, will join them as Director in the new Network Syndication department. Michael S. Miller will head a second new department as Director of Affiliate Services.

Sports Byline USA went back to school. Elementary, my dear. Sports Byline spent a

day, by invitation, with a fourth grade class in Pottsville, PA that uses the show for Creative Writing, Math and Geography lessons. Teacher John Spleen would tape the show, play it for the class and use the show's topics such as athletes as role models and players' salaries for creative writing projects, sports statistics for math lessons and home town of callers for geography lessons. Instead of just sending a "Thank You" letter, host Ron Barr packed up the show and took it to Pottsville where they broadcast from the classroom with special guests Ronnie Lott and a few pupils from the class.

Its a Talk Network! Your Talk Authority Radio Network, an extension of WYTA Largo, FL (Tampa), will "Open to the Public" on July 4th. The network will feature programs including: Sleepless on the Bay, 12 Midnight -3 AM, Fax and Sax, 3 AM to 6

Douglas Broadcasting, Inc. has announced the formation of AsiaOne, the first radio network in the country to provide Asian language programming on a nationwide scale. Initial network programming will focus on the Chinese -American population, and will later expand to include national broadcasts in Tagalog, Vietnamese, Korean, Japanese and Hindi. The Interep Radio Store announces a new three -pronged strategy to grow farm radio advertising 25% by 1996. The new strategy centers upon creating a meaningful dialogue among farm -oriented client stations, advertising agencies, and advertisers to allow station executives to hear advertiser objections and respond to them. Part of the strategy includes Interep and client stations to be represented at all National Agricultural Marketing Associations (MAMA) and National Association of Farm Broadcasters (NAFB) events. The Radio Advertising Bureau's 1994 Radio Mercury Awards heralded the Levis 501 "Cover Me" radio commercial by LANY Music and Foote Cone Belding /San Francisco as the $100,000 winner. The black -tie event, hosted by Gary Owens of Laugh -In fame, brought out radio and advertising stars including Charles Osgood, Wolfman Jack, ABC's "Fly Jock" Tom Joyner, Therese Crowley and Brigette Quinn of WCBS Radio, Ad Age's Jim Brady and radio legend Dick Purtan. AND THE WINNER IS. . . Two companies were bidding on Pacific Quadracasting's rocker KKDJ --Ralph Guild's EBE Communications and Charlton Henry's Henry Broadcasting. The winner was Henry, who will combo the station with his news -talk KMJ and country KSKS. Price for KKDJ was $1.725 million. Guild, who owns country combo KFRE and KNAX, immediately entered into an LMA -to -buy with Headliner Communications KSXY, which has become Fresno's sixth country station. WASHINGTON THIS WEEK

On the heels of new FCC Chairman Reed Hundt's pledge to keep a close eye on broadcast stations' EEO compliance, the Office of Management and Budget is wrestling with the current ethnic categories to try to make them better fit today's racial and ethnic classifications. The Washington Post reports that many of the standard categories, such as white, black, and Asian, will be broadened, but to what extent is unclear.

The FCC issued a public notice this week outlining some of the finer points of the new regulatory fees we listed in last week's Journal. The notice points out that fees for FM translators and boosters don't kick in until next year. Payments can be made by check, money order, Visa or Mastercard. Those that owe fees for more than one type of service can consolidate payments into one check. For those that own more than 100 fees, and are consolidating them all can pay in two installments --the first half due Sept. 2, the second half due Sept. 30, 1994. To avoid filing hundreds of forms, automated data submissions can also be made. AM Radio fees are due by Sept. 2, FM by August 10. If you pay late, you'll be assessed a 25% penalty, and any pending actions may be dismissed. You may also face a revocation hearing. The Commission will consider fee waivers in exceptional instances. ELSEWHERE

Topping off a flurry of buying, Liberty Broadcasting announced this week it will merge with Mery Griffin's Griffin Group, bringing Liberty's station count to 17. Liberty already has a merger pending with Beck -Ross Communications which, when combined with Griffin's stations, will yield duopolies in Providence, Hartford, and Albany NY. In Providence, Griffin's news -talk WHJJ and rocker WHJY will combo with AC WSNE Taunton MA, which is currently owned by Beck -Ross. In Hartford, Griffin's news -talk WPOP and hot AC WYSR Waterbury CT goes with rocker WHCN. In Albany, Griffin owns rocker WPYX and oldies WTRY Troy NY, which will combine with country combo WGNA -AM & FM. There's no word yet on what will happen to oldies WTRY -FM Rotterdam NY.

Jacksonville will get another duopoly as J.J. Taylor Companies announced they will sell AC /jazz WIVY -FM to Prism Radio Partners. Price was not disclosed. Prism already owns oldies WKQL, standards WOKV and talker WPDQ there.

SESAC has announced the first music licensing system based on actual airplay, rather than the approximations of the past. The system uses Broadcast Data System's (BDS) tracking system to actually sample stations' airplay and compute the license fees on -line. This system will first be used for Spanish radio and television stations. SESAC plans a similar system for country stations soon.

BDS has also announced it is investing $5 million to allow its station monitoring system to track oldies, in addition to the current and recurrent records currently monitored by the system. The new system, which digitally records airplay at approx. 750 radio stations and 515 television stations, will check each song heard against the main computer's library of recognized songs. Any songs the computer can't recognize will be verified by BDS staff and added to the system. BDS currently monitors stations at 125 sites across the U.S..

Inside Radio reports that it only cost CBS $1 million, but the defamation claim filed by Joan Esposito against Joe Bohannon, one -half of the former WBBM -FM's morning team of he and Ed Volkman, has been settled. The morning team suggested Esposito's child was the product of a Chicago Bulls player, and asked listeners if she should have an abortion.

Arbitron has announced it will consolidate its four processing facilities into a

two building campus in Columbia, MD. Now that the television division is gone, it will be reducing its square footage from 287,000 to 127,000. Arbitron says the relocation will not affect its 700 employees.

Kudos for live coverage of a breaking news event go to CBS. Technically speaking, did you catch the CBS coverage of O.J. Simpson's ordeal? CBS provided affiliates with full coverage of the pursuit and press conferences throughout the entire event. The Gil Gross show, which usually runs from 8 pm to 11 pm, was extended live until 2 AM with interviews with former teammates, colleagues, friends and national calls. The whole thing was put together quickly but was not lacking in

quality.

National Public Radio, Denon, and RE- America will team up to test the latest RBDS technology by placing encoders at 26 NPR stations across the country, with 10

other sites pending. Denon had originally planned to provide the encoders to commercial stations, but ran into coordination problems among different stations. NPR's participation allows Denon to test the technology under a coordinated effort. The stations will be allowed to keep the encoders and radios in exchange for on -air promotion of the technology and Denon.

Ross "Graph -Man" Perot comes to radio. Starting October 1st, Ross will be heard on Tribune's WGN 720 AM doing a one -hour weekly call -in talk show that may expand if all goes well. The show will also be offered on a barter basis. Besides the show, Tribune will also syndicate a 90- second Perot feature covering politics, social and family topics.

"Noticias CBS Americas ", the Spanish news service set up by CBS Americas and UPI,

will debut Monday June 27th. The service will feature hourly newscasts in Spanish to listeners in the US and Latin America. For more information contact CBS Radio Division at 212 -975 -3771 or UPI at 202 -898 -8200.

The House of Blues Radio Hour, heard on CBS, was awarded a Gold Medal for Best Regularly Scheduled Music Program at the New York Festival 1994 Radio Awards Luncheon on International Radio Day, June 16th.

Cal Thomas, Los Angeles Times columnist and "Far- Right" conservative will be launching a three -hour Saturday night call -in talk show on the Salem Radio Network, starting August 13th. The show will air live from 9 pm to Midnight Eastern time. Interested stations can contact the Salem Radio Network at

The Independent Broadcasters Network introduces their latest show titled "Timeless Voyager Radio" hosted by Bruce Stephen Holmes. Cullum Communications, Inc. announces the syndication of Blanquita "BQ" Cullum Radio Talk Show. The show, originating from Richmond, VA will be available on a

WLS SIGNS ILLINOIS LT. GOVERNOR. Howard Stern may want to be governor, and now there's a governor that apparently wants to be Howard. In a move that has shocked many locals, Illinois Lt. Governor Bob Kustra resigned from his position and will resign from the GOP ticket to co -host afternoons on WLS AM by August 1st. Kustra will be teamed with Ty Wansley. True or False. A duopoly involving four stations combining for a 28.6% share in one market is legal. If you said "false ", guess again. The Commission has upheld a Mass Media Bureau ruling one of the first cases to test the duopoly rules when proposed contours straddle more than one market. According to Radio & Records, WOMP AM and FM Bellaire will be able to combine with WSTV and WRKY Steubenville OH because less than 50% of the proposed signal overlap falls within the Steubenville -Wierton metro, as defined by Arbitron. Therefore, the Arbitron county -by- county data for the entire area must be used. (P.S. Since this hearing, Arbitron no longer measures Steubenville -Wierton as a market.)

In another important ruling, the Commission has upheld the practice of assigning a zero share to a construction permit, thus allowing KUGN AM and FM Eugene OR to combo with KGAL Brownsville OR.

KMAL, Malden, MO was lucky enough to be only admonished by the Commission after airing a commentary by a mayoral candidate while not following the Commission's rules allowing opposing candidates to respond. Back in April, 1993, KMAL endorsed Clark Duckett for mayor of Malden, and sent tapes of the commentary in advance to the other candidates. The problem was he didn't enclose a letter with the tape notifying the other candidates how to respond, even though he made brief comments on the end of the tapes.

The Commission dismissed a request by KVCX, Gregory, SD to change to non- commercial status. The station is being operated as if it were non -commercial by the Wisconsin Voice of Christian Youth.

The Commission is asking for public comment on the modification of the criteria used in comparative hearings to award construction permits for new broadcast facilities. Specifically, it's asking commenters to address several issues raised in a recent court decision.

On December 17, 1993, the U.S. Circuit Court of Appeals for the D.C. Circuit issued a ruling (Bechtel v. FCC) that the Commission's integration criterion was arbitrary and capricious and therefore invalid. (The Commission had given credit to applicants who proposed integrating their owners into theday -to -day management of the station.)

When the Commission initiated this rulemaking in 1992, it noted that the comparative criteria had not been comprehensively examined for 27 years and that changes in the broadcast marketplace, in broadcast technology, and in the Commission's regulatory policies for broadcasting warranted another look at the criteria.

In the Bechtel decision, the court directed the Commission to evaluate applications before it, under standards free of the integration criterion. Because integration and factors deemed to enhance integration have been decisionally significant in many recent comparative proceedings, the Commission stayed pending cases while it considered appropriate actions responsive to the court's opinion.

The Commission is asking commenters to address what objective and rational criteria could be used to evaluate the applicants' comparative qualifications in light of Bechtel. In particular, its looking for comments on:

1. The impact of Bechtel on the factors previously considered to enhance integration: local residence and civic participation, minority status, and broadcast experience.

2. The relative weight that should be given to the various comparative criteria in an analysis that does not rely on integration.

3. The procedural ramifications of applying a revised comparative analysis to pending cases. For example, commenters may wish to consider under what circumstances it would be appropriate to permit applicants in pending cases to amend their proposals in light of newly- adopted standards and when further evidentiary proceedings would be warranted.

4. The ways any proposed revision of the comparative analysis could be structured to satisfy the kind of concerns which, in Bechtel, resulted in a

determination that integration was arbitrary and capricious.

Harry Buck's KFBQ, Cheyenne, WY signed off the air last Saturday night about 11 p.m. telling listeners they'd be off for a short time for repairs - -but they might be off for a bit longer than that. The IRS is attempting to seize the STL, the station has filed for protection under Chapter 11 bankruptcy protection, and the station's studios will be moving, but no one's told the station's employees where yet. According to the Wyoming Tribune -Eagle and KFBC, Buck moved everything out of its offices it leases from KFBC. Buck claims the station will be back sometime this week. As to where the station will be located, Buck said "The only reason I'm being kinda cagey about (the new studio's location) is because we might make a contest out of finding it."

David Gingold's Barnstable Broadcasting has decided to throw in the towel on a potential copyright battle over the use of the slogan "Target 98 FM" for WYKL Memphis. Dayton- Hudson Corp., who owns the Target discount chain, threatened to sue the station if it continued to use the slogan and a similar logo.

Only months after it bought the stations, HMW Communications is spinning off urban oldies WOIC and CHR WNOC Columbia SC for $5 million to Emerald City Radio Partners. The sale will give Emerald City a duopoly with classic rocker WMFX, St. Andrews.

The Fabulous Sports Babe, ESPN Sports Radio's talk show launched last month, will move to mid -days from 10 am to 2 pm ET beginning July 4. The show claims over 30 affiliates including WWKB Buffalo, KJR Seattle, KFXX Portland, and WDFN Detroit.

The Radio Advertising Bureau announced that according to its calculations, May marked the first month ever that radio advertising revenues have exceeded $1 billion. RAB's monthly radio revenue index indicates that combined national spot and local radio revenue grew at a rate of 12% in May over May 1993 levels. In 1970 radio revenue was "$1.26 billion for the entire year" said RAB President Gary Fries. "We continue to grow at a pace that other media simply can't match." The breakouts are included below.

A new study released by The Interep Radio Store reveals that the multi -billion dollar non -prescription drug market is missing a major opportunity to reach their prime consumers because of severe overspending in TV and underspending in radio. "Reaching the Non -Prescription Drug Consumer" offers a side -by -side comparison of heavy users of radio, broadcast TV and cable TV within each top 10 ailment category, and finds that radio outdelivers broadcast and cable television in all ten instances. The report's findings include the following: The Top 3 ailments for both Men and Women were colds or headaches and sinus problems. For cold and sinus remedies, radio received only 4.5% of 1993 advertising dollars spent. TV received 84.9% and cable 6.4 %. As for headache medication, radio received 3.4% of 1993 ad dollars while TV and cable raked in 81.9% and 8.2% respectively. 8% more men who used a cold remedy during the past year were heavy radio listeners than were frequent TV viewers. 53% more were heavy radio listeners than were frequent cable viewers. With women, 13% more were heavy radio listeners than were frequent TV views. 60% more were radio listeners than were frequent cable viewers. Radio outreached TV with men most dramatically with heartburn medication and cough medicine: 22% more and 14% more, respectively. Arbitron announces the appointment of Jay Guyther to the newly created position of VP of Radio Development. His new position will have him directing a number of business initiatives designed to deliver new products and services for radio stations. Another position, General Manager, Arbitron Radio, will be created to handle Arbitron's current radio audience measurement business.

Westwood One Entertainment has announced the appointment of Larry Kahn to Director of Talk Programming. Kahn will oversee and manage the division's current line -up of talk hosts as well as develop new personality driven programming. Prior to his appointment Kahn was Exec. Producer /Asst. Program Dir. at WOR Radio in New York.

ABC Radio Networks has promoted Jane Shapiro to Senior Director of Research. Shapiro will be responsible for managing ABC Radio's Dallas and New York Research Departments including the installation and operation of ABC's new network radio research system RADPRO, development and updating of AREAS, ABC's research system for using Arbitron's County Coverage Study. Shapiro previously worked for the RAB, Arbitron and Blair Radio.
