    APPLICATION OF

    SURVEY LAW DATE: 12 February 2007 TIME ALLOWED: Part 1: Questions 1-7: 3 Hours Part 2: Question 8: 1 Hour INSTRUCTIONS TO CANDIDATES:

    All Questions should be attempted. To obtain a pass in this examination a candidate must pass BOTH parts 1 & 2

    Candidates may make reference to any relevant Acts, Regulations, Guidelines, Directions and Practice Manuals (on line) during the exam.

    Candidates may take a short break between questions 1-7 and question 8

    and this break period is not included in the examination time, however candidates are reminded of the obligations set out in the declaration.

  • QUESTION 1 (a) What are the duties and responsibilities of a surveyor in carrying out surveys

    under the Licensed Surveyors' Act ? (5 marks)

    (b) What rights of entry onto land do surveyors have when carrying out authorised

    surveys? In which Acts are the rights conferred and what obligations and limitations are imposed on the licensed surveyor?

    (6 marks) (c) What Acts of Parliament and regulations provide for the imposition of

    penalties for the destruction of survey marks? (4 marks)

    QUESTION 2 Explain what is meant by the term "hierarchy of evidence" in respect of land boundaries. What weight would you place on the following?

    (i) an unreferenced peg (ii) occupation (iii) a monument (iv) a co-ordinate value obtained from Landgate

    (v) co-ordinate value calculated from original dimensions - provide reasons for your answers.

    (10 marks) QUESTION 3 (a) When is a surveyor obliged to place additional reference marks during a

    survey involving; (i) urban land (ii) rural land.

    (4 marks) (b) How are excesses and deficiencies within a section of freehold land distributed

    when the land is? (i) unimproved (ii) improved

    When does this apply and how can these new more accurate dimensions be reflected in the title?

    (a) What constitutes a "search" of information for use on an authorised survey ?

    Explain why it is important to obtain a full and accurate search before commencing a survey.

    (5 marks) (b) What additional information should be included in a search for a survey of a

    remote location that abuts the coast (ie. one boundary is mean high water mark) and an unsurveyed pastoral lease boundary ?

    (3 marks) (c) What annotation(s) are required to be placed on a new deposited plan that

    depicts the survey of an original boundary that was previously unsurveyed?

    (2 marks) QUESTION 5 (a) Under what circumstances must fieldbooks be lodged for authorised surveys?

    (4 marks) (b) Describe the fieldbook recording requirements for observations made on

    original alignments. (2 marks)

    (c) Outline the fieldbook presentation requirements for authorised surveys using

    Global Positioning System (GPS) equipment. (4 marks)

    (d) What are the limitations in using GPS for survey control within Special

    Survey Areas? (3 marks)

    (e) What are the requirements for lodging digital data on surveys for Special

    Survey Areas? (2 marks)

    the options available for eliminating Common Property in a strata scheme. What are the roles and responsibilities of a licensed surveyor in this situation?

    (10 marks) (b) When are fieldbooks to be lodged for a survey on a strata development ?

    (2 marks) (c) Describe the method of numbering lots on a Survey Strata Plan.

    (3 marks) QUESTION 8 Examine the attached print of Deposited Plan 49414 to identify any mistakes and/or omissions. A relevant search is attached to the print. It is to be assumed that the dimensions on the plan are correct so NO mathematical checks are required. Mark the mistakes and/or omissions on the plan print supplied and return it, together with the search, to the supervisor at the end of the exam.
