Welcome to ‘The Collection’On behalf of Channel Island Plants (UK) Ltd, I would like to welcome you tothis special collection of many of the world’s leading selling basket, bedding,patio and perennial plants, grown from elite material, supplied direct to thegrower both in the UK and throughout Europe as unrooted cuttings, using nextday delivery.
We are proud to be associated and are UK licence holders for many of theworld’s leading breeders who work tirelessly to bring new products to themarket place. I am pleased to announce the continuation of our agreementwith Breier Genetics, enabling us to exclusively supply their huge portfolio ofproducts please see the back page of this brochure for more details.
Every year we test and trial many new lines here in the UK ensuring thatbefore we launch them, we have a real feel for the product and itsperformance. Many lines are shown annually by us that have not been seenbefore. We exhibit at many of the major European shows, so please come andsee what new and exciting varieties we have available to help you capture themarket.

Why choose Elite Cuttings fromChannel Island Plants (UK) Ltd?
Plant HealthFollowing recent changes in Plant Health Legislation, it isnow more important than ever that production sitessupplying unrooted/rooted cuttings are free from pestsand diseases that are endemic. Bemisia Tabaci, LiriomyzaHuidobrensis. Thrip Palmii and others are now found inmany countries where mother stock production is held.The UK is still ‘free’ from these pests and we ensure thatwe operate within the EU Plant Health Directive toensure that these pests are kept off our stock.
Mother Stock StatusAll our mother stock is derived from Elite materialsproduced by a laboratory and supplied in agar. This stockis replaced annually to ensure the best quality cuttings areavailable at all times. Working closely with AdvisoryServices, all our mother stock is monitored and checkedon a regular basis for viruses and other potentiallyharmful pathogens.
ShippingCuttings are taken on a daily basis by highly skilled andexperienced staff. After harvesting the cuttings arepre-cooled before despatch to take out any heat that maybe in the material to enable it to be transported in thebest condition possible.
Cuttings for orders are picked and packed 100 or 200 perbag, dependant on variety, and placed in insulated boxeswith a variable count of 2000 to 6000 cuttings per box,again dependant on species.
Throughout the UK, we use guaranteed next day, specialdelivery and throughout Europe, we use an excellent 1-2day delivery service.
LicensesChannel Island Plants (UK) Ltd is the UK license holderfor many of the world’s leading varieties and plantbreeders rights are applicable, propagation without alicense agreement is forbidden.

Terms & Conditions 1, General1.1 Orders are accepted subject to the contract andconditional upon availability at the time of dispatch.Confirmation of orders does not constitute guaranteeof delivery.1.2 These conditions are to apply in conjunction withthe term of financial settlement mentioned in thiscatalogue and the purchaser is strongly advised to readand consider both these conditions and the terms offinancial settlement before placing any order with theCompany.1.3 No contract shall arise between the partiesaccepted and order in writing from the purchaser.1.4 The giving or sending to the company of an orderconstitutes acceptance of all these conditions by thepurchaser.1.5 Any typographical, clerical error or omission inany document of information issued by the Companyshall be subject to correction without any liability onthe part of the Company.1.6 All descriptions, illustrations or colours in respectof the goods, specified in any of the Company’s salesliterature or brochures are so stated or shown as ageneral guise or description only and the company doesnot contract or represent that the goods will complywith any particular detail contained in such salesliterature or brochures. Whilst any advise given by thecompany is proffered in good faith the growth of plantsand seeds is affected by many matters beyond theCompany’s control and the Company shall not be liablefor any consequences for any technical information,recommendations, statements or advice furnished bythe Company or it’s servants or agents related to thevarietal description.
2, Price & Payment2.1 All goods are sold at prices current on date ofcontract2.2 Unless otherwise stated, all processes are net ex-works and exclusive of VAT2.3 The Company reserves the right by giving noticeto the purchaser at any time before delivery, to increasethe price of the goods to reflect any increase in the costto the Company which is due to any factor beyond thecontrol of the company including any foreign exchangefluctuation, currency regulations, alteration of duties, anychange in delivery dates, quantities or specifications forthe goods which is requested by the purchaser, or anydelay caused by any instructions of the purchaser orfailure of the purchaser to give the Company adequateinformation or instructions.2.4 Unless otherwise agreed in writing the purchasershall pay all amounts due within 30 days of the date ofdelivery.2.5 If the purchaser fails to make any payment within30 days of the due date of payment, then, withoutprejudice to any other right or remedy available to theCompany, the Company shall be entitled to:2.6 Cancel the contract or suspend any furtherdeliveries to the purchase under this or any othercontract.2.7 Appropriate any payment made by the purchaserto such of the goods (or the goods supplied under anyother contract between the purchaser and thecompany) as the company may think fit (notwithstandingany purported appropriation by the purchaser) and;2.8 Charge the purchaser interest (both before andafter any judgement) on the amount unpaid, at the rateof 5% per calendar month above Barclays Bank PLC’sbase rate until the payment in full is made, such interestbeing deemed to accrue on a daily basis.2.9 The purchaser shall have no right of set-offstatuary or otherwise.
2.10 The Company reserves the right at any time at itsdiscretion to demand security for payment beforecontinuing with the contract or delivering goods.
3, Insolvency3.1 If the purchaser commits to or if the Companyreasonably apprehends, that it is about to commit anyact of insolvency or bankruptcy and notifies thepurchaser accordingly, then without prejudice to anyother right or remedy available to the Company, theCompany shall be entitled to cancel the contract orsuspend any further deliveries under the contractwithout any liability to the purchaser and if the goodshave been delivered but not paid for, the price shallbecome immediately due and payable notwithstandingany previous agreement or arrangement to thecontrary.
4, Title and Risk4.1 Risk in the goods shall post to the purchaserwhen the goods are delivered to the purchaser or itsagents.4.2 Notwithstanding risk in the goods passing inaccordance with 4.1 hereof title in the goods shallremain with the Company and shall not pass to thepurchaser until payment is received by the Company forthe goods and all other amounts outstanding from thepurchaser to the company in respect of any goodssupplied by the company under any contract.4.3 Until such time as the property in and legal titlepasses to the purchaser (and provided the goods arestill in existence and have not been resold) theCompany shall be entitled at any time to require thepurchaser to deliver up the goods to the company and ifthe purchaser fails to do so forthwith, to enter upon anypremises of the purchaser (or any third party where thegoods are stored) and repossess the goods, and ifnecessary to sever the goods provided always thatnothing in sub-clause 4.3 shall confer any right upon thepurchaser to return the goods or to refuse or delaypayment thereof.
5, Force Majure5.1 The company shall not be responsible for delay indelivery or none delivery of the goods or any partthereof occasioned by any act of god, action by anygovernment strike, lock-out, other industrial action, riotor civil commotion, breakdown of machinery, powerfailure, fire, transportation, failure of crop grown by thecompany or omits behalf, loss and/or detention at seaor any other contingency beyond its control. Should anyof the goods be rendered unfit for delivery by reason ofany of the above acts or events, the contract shall bedeemed to be discharged.
6, Warranty & Complaints6.1 No complaint can be considered unless clearproof can be given that the goods alleged to haveperformed unsatisfactorily, were in fact goods suppliedby the company and that they were grown carefully andcorrectly throughout and subject only to suchconditions as were likely to produce a favourable crop.6.2 Every effort is made to ensure that the company’sstock is of the highest quality but the company shall notbe responsible for the effects of natural causes that arebeyond the control of the company and therefore theplants are sold without warranty, express or implied, asto productivity or freedom from pest or disease.
7, Notification of Claims7.1 Any claim for none delivery must be notified inwriting by the purchaser to the company within sevendays of despatch as to which the purchaser will beseparately notified.7.2 Any claim that the goods have been delivereddamaged or are not of the correct quantity or do notcomply with their description shall be notified to the
company by telephone or fax within twenty four hoursof their delivery and confirmed in writing within sevendays of notification.7.3 Any alleged defect in the goods shall be notifiedby the purchaser to the company within seven days ofdelivery of the goods or in the case of any defect in thegoods which is not reasonably apparent on inspectionwithin seven days of the date upon which the defectmight reasonably have been expected to come oractually did come to the notice of the purchaserwhichever be the sooner.7.4 Any claim made under this condition must be inwriting and must contain full details of the claim.
8, Extent of liability8.1 Except in accordance with this condition 8 theCompany shall have no liability to the purchaser or anythird party for any loss or damage of any nature(including consequential loss) arising from any breach ofany express or implied warranty or condition of anynegligence or breach of statutory duty on the part ofthe company or arising in any other way out of or inconnection with the performance or purportedperformance or of failure to perform any part of thecontract.8.2 Where any valid claim in respect of the goods isnotified to the company in accordance with theirconditions, the company at its option replace withsimilar goods to treat defective goods or goods whichdo not comply with the contract, allow the purchaser tocredit for their invoice value or to the extent that suchgoods are not of the company’s processing or growth,assign to the purchase (so far as the Company is able todo) any warranties given by the grower or processor ofthe goods to the Company.8.3 In no circumstances shall the liability of thecompany to the purchaser exceed the invoice value ofthe goods.
9, Law and Construction9.1 The contract shall be governed by English law.
10, Plant Breeders Rights10.1 Customers purchasing any plant material which iscovered by plant Breeders rights or a registered trademark agree to attach the official label, provided byChannel Island Plants (UK) Limited to the finished plantsof the point of sale and therefore more that the plantsare sold using this specific trademark and official plantname only.10.2 Purchasers must be advised that the use of plantmaterial for propagation for further sales is prohibited.10.3 The company or a representative authorised byhim shall be entitled to verify the observance of theplant breeder’s rights, including inspection of the plantsstocks and plant material covered by these rights.10.4 Customers agree to after reasonable andnecessary assistance and to give all relieving informationfor the performance of the inspection which shall notbe more exhaustive than is necessary to verify theobservance of the terms of the sale.10.5 Violations of the plants breeder’s rights will resultin an immediate penalty per illegally propagated cutting.This penalty does not affect the rights of the supplier toclaim real damages form the transgressor.
11, Trade Mark Registration11.1 Channel Island Plants (UK) Limited and CIP(Guernsey) Limited own the rights to their companylogo and no use is permitted by any person, unlessauthorised by the said company.
