Sir, I / We hereby accept the terms and conditions mentioned in the Tender for supply and installation/commissioning of tendered items/equipments in the Fireworks Research & Development Centre, Office of the Dy. Chief Controller of Explosives, 261, Sivakasi – Virudunagar Road, Thiruthangal 626130 I / We agree that the offer shall remain open for the acceptance for a minimum period of 60 days from the date fixed for notice in writing duly addressed to the authority opening the render and sent by registered post AD or otherwise delivered at the office of such authority. Demand Draft No:_______________ dated : ____________ for Rs. __________________ in favour of Jt.Chief Controller of Explosives, payable at Chennai in respect to the earnest money is herewith forwarded. TERMS AND CONDITIONS OF TENDER NOTICE FOR THE SUPPLY, INSTALLATION/ COMMISSIONING OF TENDERED ITEMS/ EQUIPMENTS AT FIREWORKS RESEARRCH AND DEVELOPMENT CENTRE, SIVAKASI.

The Bidder should quote technical and commercial bids in two separate envelopes mentioning on the top of the one of the envelop as “Technical bid” and another as “Commercial Bid”. Both the sealed envelopes shall be put in one big envelope and again sealed. Details such as Bidder’s name and Address date and time of Tender Opening should be clearly mentioned on the big envelope. This big envelope shall be marked with “tender for supply and installation/commissioning (wherever applicable) of equipments/instruments/Office modernization set up. Only those tenders received alongwith necessary documents submitted on or before 13/02/2008 upto 1500hrs. in the office of Dy. Chief Controller of Explosives Sivakasi will be considered. No postal delays will be entertained. The tenders without demand draft on EMD will be rejected. Parties registered with DGS & D/NSIC forsuppy of these items, are exempted from payment of EMD. The Technical Bid will be opened on 13/02/2008 at 1600hrs and Price Bid will be opened on 15/02/2008 at 1100hrs in the Office of the Dy Chief Controller of Explosives , Sivakasi , Bidders who downloaded the tender form from departmental website should submit tender form fee along with technical bid failing which their tender will be rejecte. 1. The Dy. Chief Controller of Explosives, Sivakasi will issue the tender form

after receiving the Tender Fee in the Form of DD in favour of Jt Chief Controller of Explosives payable at Chennai

2. EMD (Earnest Money Deposit)

Every Bidder will have to deposit earnest money deposit as mentioned in Tender Notice against each item by D.D. drawn in favour of the Jt Chief Controller of Explosives, payable at Chennai. The demand draft in the original should be enclosed along with the tender form. Parties registered with DGS & D/NSIC for supply of these items should submit their valid DGS&D registration certificate in technical bid failing which their tender will be rejected.

3. The earnest money will be forfeited if the Bidders fails to complete the contract according to his tender if accepted.

4. The earnest money deposit of the unsuccessful Bidder will be refunded

without any interest after the contract is awarded to successful Bidder .

5. The rate for Comprehensive Annual Maintenance wherever it is applicable should be quoted separately and cost should be in words as well as in figures.

6. The rate for comprehensive AMC (indicating no. of visits in a year) for a

period of 5 years after expiry of warranty shall be quoted in Price Bid separately. Such AMC shall be binding on the bidder if accepted by the Bidder. However, acceptance of AMC shall not be binding on the purchaser. Comprehensive AMC includes repairing or replacement of spare parts free of cost.

7. Tender will be accepted or rejected on recommendation of the committee appointed for this purpose

8. The Chief Controller of Explosives, Nagpur reserves the rights to reject the

tender without assigning any reason. 9. The Bidder should specifically mention separately Taxes / Octroi etc. on each

item and exemption certificate needed from Government Department.

10. Following documents should be submitted with Tender.

(a) Two copies of certificate from the manufacturer regarding Authorized Distributorship / Dealership / Agents.

(b) Detail specification of the equipment quoted should be substantiated by

data sheet in original.

11. In case of every offer whether indigenous or imported; the name of the manufacturer, address together with Brand should be indicated in the tender and two sets of original leaflets catalogues and literature also should be enclosed. Tenders for unbranded equipments / machines shall not be entertained.

12. In case of equipment with I.S.O. or I.S.I. mark relevant certificate from

I.S.O. or I.S.I. should be attached.

13. List of atleast three customers in and around Sivakasi of the tenderer to whom the Machinery / Services has been supplied / provided in Government / Autonomous / Laboratories / Research Institute, during last 3 years should be furnished.

14. Organization profile of your firm should be given in Annexure.

15. The successful bidder will have to give bank guarantee of 10% of the

respective amount till the delivery and installation of the item supplied issued by any Nationalized Bank located at Sivakasi

16. The bidder must do paging for the documents attached in the same manner

as given here

17. All the copies of the certificate attached by the Bidder should be duly attested by Gazetted Officer / Public Notary

18. The price quoted should be inclusive of Installation, Transit Insurance etc.

19. The bidder should quote the exact and firm delivery period.

20. Offer of the Bidder must be firm. Conditional offer, will not be considered.

21. Failure or delay to supply the items within stipulated time frame after issue of work order will be liable to cut of 2% per week of the prices quoted.

22. The items specified should be supplied / installed within 60 days from the

date of issue of work order or as per directions given by the Dy Chief Controller of Explosives, Sivakasi.

23. Information regarding any current litigation in which the Bidder is involved,

should be given.

24. Payment of the contract value will be made after the delivery of item at site

and its successful installation duly and commissioning, duly approved by Purchase Committee.

25. Only manufactures or authorized dealers / distributors / agents of

manufactures should quote the tender along with authorization letter.

26. Material will be delivered at O/o. Fireworks Research & Development Centre Dy. Chief Controller Of Explosives, Sivakasi which is out of octroi limit. Therefore no octroi is applicable.

(A) TECHNICAL ENVELOPE COMPULSORY DOCUMENTS Each tender must be accompanied by Earnest Money Deposit (EMD) of value as shown in tender notice against each item payable to the Jt Chief Controller of Explosives, Chennai along with the tender in the shape of Demand Draft of any Nationalized Bank payable at Chennai without which the tender will be rejected outright. The parties registered with DGS&D/NSIC for supply of these items , are exempted from payment of EMD. THE TECHNICAL ENVELOPE SHOULD CONTAIN ALL THE UNDER MENTIONED DOCUMENTS AND ALSO TENDER APPLICATION FORM (TECHNICAL BID) IN THE FORMAT SPECIFIED.

I. List of Government Department, Public Sector Undertaking, Private corporate Firms, etc. where such equipments and instruments have been supplied and installed by Bidder during last 3 years and should be attached.

II. ONLY MANUFACTURERS OR AUTHORISED DEALERS / DISTRIBUTORS /

AGENTS SHOULD APPLY

Authorized dealers / distributors / agents should submit a True copy of their dealership contract. Manufacturers should submit location and infrastructure details (Address of manufacturing plant and testing facilities) of factory premises.

III. Income Tax clearance certificate of previous two years and PAN No. should be attached.

IV. Details of Test / Calibration Certificate for Equipments / Instruments should

be given.

V. Company’s financial statement for last two years.

VI. All technical documents pertaining to the Equipments / Instruments as given in Tender Document should be submitted.

VII. List of at least three customers in and around Sivakasi of the Bidder to whom

the machinery / Equipment / Services has been supplied / provided in Government / Autonomous / Laboratories / Research Institute, during last 3 years should be furnished where the total amount of supplies/work should not be less than Rs.20 lakhs in each contract.

VIII. Soft copy of power point presentation of tendered items with colour scheme and execution methodology etc with presentation of similar work executed in

past should be submitted along with technical bid. Power point presentation should be given during technical bid opening.

IX The CST/TNGST Registration numbers allotted by the sales tax authorities

should be mentioned in the tender. In the absence of sales tax number, sales tax certificate (true copy) given by the Competent authority with the period of validity should be attached.

X Comparative statement of technical specification of vendor vis-à-vis Technical Specification of Bidder (Item Wise) should be submitted along with

Original Technical Literature / Brochures, etc. (Xerox copy will be not be entertained).

IX. The certificate of performance and successful execution should be submitted

from the clients where such supplies and installation has been executed.

X. Purchase Committee may decide to see the demonstration of the tendered item of bidder who qualified in Technical Bid, before opening of Price Bid, wherever required. Demonstration may be seen at Testing Station, Sivakasi.

XI. The tender committee will assess the performance/workmanship by visiting such places. The bidder will have taken in consideration while qualifying the technical bid of the bidder.

XII. The certificate issued by client stating good behaviour and relations during execution of such contract should be submitted.

(B) COMMERCIAL ENVELOPE 1. In this envelope Bidder should submit “Price Bid Tender Form” (Purchased for

himself and duly signed) showing all inclusive rates etc . IN THE FORMAT SPECIFIED. (SCHEDULE – B)

N.B. BOTH the sealed envelopes shall be put in one big envelope and again sealed.

Details such as Bidder’s Name and Address date and time of Tender Opening should be clearly mentioned on the big envelope. This big envelope shall be marked with “Tender for supply and installation commissioning (Wherever applicable) of equipments / instruments/furniture”.

2. The Dy Chief Controller of Explosives. Sivakasi will not be responsible for any

delay in obtaining details of tender or in the delivery of tender document by post. 3. The offer submitted by telex / telegram or any similar manner will not be

considered. No correspondence of any kind will be entertained in this regard. 4. The items offered should be as per specification given in the Tender Form. 5. The rate should be quoted in Indian Rupees on FOR basis delivery at

office of the Dy. Chief Controller of Explosives, Sivakasi. The basic price should be quoted separately and other charges such as excise duty / custom duty break up, sales tax, insurance, freight, forwarding, octroi, if any applicable must be clearly indicated. The sales tax @ 4% against “D” / “H” Form may only be included as the supplies belong to the Central Government.

N.B. Payment through LC is not accepted. 6. The Prices should be quoted item – wise for a single unit. The amount should be

mentioned in figures as well as in words without any correction(s).

7. The tender document is not transferable. Only party to whom the Tender Form is issued shall be entitled to quote. Every Tender page should be duly signed and any alterations should be attested by the authorized signatory.

8. You shall provide Original Operational Manual, Maintenance Manuals, documents,

Engineering Manuals, with the Tendered item. You will also provide necessary drives (Programs) and firmware to run standard software. Also a free of cost training on operation and Maintenance should be given to the staff of Dy. Chief Controller of Explosives, Sivakasi office atleast to the extent of two days.

9. The delivery of the items should be made strictly as per the delivery

schedule, failing which a penalty of not less than 2% of tender cost per week, subject to a maximum of 3 weeks will be levied. After expiry of 3 weeks, the order is liable to be cancelled.

10. The supplier should supply specified items, install and commission successfully

within 60 days from the date of placing a firm order. 11. No advance payment shall be made at any time. 12. The rate for comprehensive A.M.C. (Indicating No. of Visits in a Year) for a

period of 5 years after expiry of warranty shall be quoted in price bid separately. Such AMC shall be binding on the bidder if accepted by the purchaser. However, acceptance of AMC shall not be binding on the purchaser. Comprehensive AMC includes repairing or replacement of spare parts free of cost.

13. Vendor will have to install the equipments / instruments at concerned office on

suitable dates to conduct Bench Marking / other tests for two working days after the placement of firm order. The cost involved in this will have to be borne b the vendor.

14. Warranty certificate for minimum 1 year should be submitted along

with Invoice. 15. Performance of Equipments / Instruments/tendered items will be monitored

closely during the warranty period. All faults should be rectified within a maximum period of forty eight hours including replacements of parts. Failing to do this warranty period will be extended by 1 month for every 72 (Seventy two) hours down time.

16. If any item does not match with the approved specifications or is found inferior

in quality, the entire order is liable to be rejected. No payment will be made for such rejected supply and such items will be taken back by the supplier on his own cost.

17. If the bidderr fails to supply the items of the good quality within specified period

of delivery, the Dy Chief Controller of Explosives, Sivakasi has the right to cancel the order. In such as case (Purchase Committee) can place the order on any other party at the cost and risk of the supplier and difference in cost will be deducted from the security deposit of the supplier.

18. The Dy Chief Controller of Explosives, Sivakasi reserves all the right for

discontinuance of further supply at any time if the ordered items are found inferior at any stage of supply or delivery schedules are not properly maintained.

19. The equipments / instruments will be accepted subject to standard acceptance

tests ( as mentioned in (15) to be carried out at Dy. Chief Controller of Explosives, Testing Station, Sivakasi office, any item failing in the test will be summarily rejected.

20. The equipments / instruments should be under one year free maintenance

service (warranty) including free provision of spare parts from commencement and certification by the Dy. Chief Controller of Explosives, Sivakasi. This condition also applies for all software, if any to be delivered with the system.

21. Printed conditions mentioned in the tender will not be binding on the purchase

committee. Purchase committee reserves right to alter, to modify or to amend the existing tender conditions.

22. In the case of Bidders whose tenders are not considered for placing order, the

earnest money deposit (EMD) will be returned within 1 month of the decision along with necessary endorsement for payment to the Bidder. In the case of Bidder whose tender is accepted for placing the order, if the Bidder is not able to supply the items within specified period, the security money will be forfeited in full.

23. If there is any reduction in duties etc. after placing the order, the supplier will

pass on the benefits to the office of the Dy Chief Controller of Explosives, Sivakasi.

24. The Bidder should supply all necessary accessories or peripherals such as cables,

ports etc. and any other attachment which will be required to run the instruments efficiently and smoothly.

25. Conditional tender will not be accepted WHATSOEVER IT MAY BE. 26. The Bidder shall attach a copy of the power of attorney in respect of the

person(s) who attend(s) the Purchase Committee meeting, for tender opening further follow – up work and also who is authorize to sign tenders, agreements and other relevant documents.

27. The tenders will be accepted by the PC (Purchase Committee) functioning under

the over all supervision of the Dy Chief Controller of Explosives, Chennai, the final decision of acceptance / rejection will be taken by the committee under the Chairmanship of the Dy Chief Controller of Explosives, Chennai and decision of the committee will be final and binding on the Bidder

28. Purchase Committee reserves the right to accept or reject any or all tenders

without assigning any reason. 29. The Purchase Committee functioning under the over all supervision of the Dy

Chief Controller of Explosives, Chennai reserves the right to distribute the orders at the acceptable rates amongst two or more Bidders

30. The Bidder should remain present at the time of opening of Tender in person or

through authorized signatory. 31. Cost of consumables (if any) should also be quoted in the tender. 32. The design drawings, data sheet, specification submitted by the Bidder of plant

and machinery will be checked for correctness, compatibility and conformity by the Purchase Committee during the evaluation of technical bid and changes if any, originated from the feedbacks received from clients and other sources shall be made accordingly.

33. Infrastructure facilities such as electricity and water supplies, space for fabricated

parts for erection of a plant and machinery shall be provided by the purchaser at

site but no manpower will be provided for commissioning installation of plant machinery / equipment.

34. Stage wise inspection at various intervals shall be carried out by the

representative of purchaser and if any reasonable changes are required that will be made in consultation with manufacturer / supplier.

35. The Bider shall be submit the details of their technical competence, manpower

available and workshop facilities in the technical bid. TERMS OF DELIVERY AND PAYMENT A) Bidders whose bid is accepted shall have to deliver the tendered equipment’s and

install it within a period of 60 days or delivery period mentioned in purchase order from the date of issue of supply order.

B) No amount shall be paid as advance C) After installation of the tendered items/instruments / equipments / fabricated

items at the site and successful commissioning and performance workmanship is satisfactory or not satisfactory, assessment of performance by Purchase committee will be decided by Dy Chief Controller of Explosives, Chennai. The decision of the Dy Chief Controller of Explosives, Chennai shall be final.

D) The total cost of instruments / equipments / fabricated items shall be paid to the

supplied after their successful commissioning as mentioned in Para ‘C’ E) Any further concessionaire credit terms advantageous to this Department shall

be duly weighted during purchase / execution.
