1.Basic Introduction about Wayanad Dairy The Wayanad Dairy of Malabar Regional Cooperative Milk Producers’ Union Ltd,(milma) is located at Chuzhali, Kalpetta, 1.6 KMs away from National Highway 212. The handling capacity of this Dairy is 1,00,000 Litres per day. The Dairy carries out pasteurization of milk as well as manufacturing of various Dairy products. Wayanad Dairy has implemented the Food safety Management System & certified under ISO 22000:2005 by DNV. Wayanad Dairy is also having Export Approval from Export Inspection Agency, Govt. of India, with all international hygienic standards and Food safety measures. 2.Invitation of Tender

Sealed tenders are invited for carrying out the following skilled (Technicians) & unskilled (workmen) jobs related to production activities under Wayanad Dairy on “Principal to Principal Piece-rate Independent Labour Contract basis.

4.Details of work

4.1.Job No: 1-Tray Washing

The milk trays are used for dispatching packet milk, curd, Buttermilk and other products to the Milma dealers in the market through the distribution vehicles. After completing the distribution, the empty containers are brought to the Dairy in the same vehicles. These trays are to be washed by passing through the Tray Washing Machines at the Tray washing Block of the Dairy. The specified jobs are: 4.1.1.Cleaning of the Tray Washing Dock 4.1.2.Receiving and accounting the “returns” from the distribution vehicles such as

empty trays, cans, full (unsold) packets, leak packets etc. 4.1.3.Issuing acknowledgements to the vehicle crew for the items received, indicating

the shortages and /or excesses. 4.1.4.Recording the “returns” details in the dispatch sheet of the concerned vehicle and

subsequently entering the data in the computer. Milma shall provide the software.

4.1.5.At the end of the shift dispatch sheets shall be handed over to the Technical Superintendent (Production) on duty.

4.1.6.Preparing the Tray Washers for operation by ensuring the prescribed chemical strength, temperature and pressure and recording in the Tray Washer Log Book/Production software during every 30 minutes interval.

4.1.7.Cleaning of the trays (Pre rinse and sterilization of Trays using hot water & Steam) by passing through the Tray Washing Machine.

4.1.8.Getting quality clearance from the Dairy Laboratory through the Good Packets Return Retrieving Register/Production software regarding acceptability of the full (unsold) packets received.

4.1.9.Cut opening of the full packets if it is of acceptable quality and retrieving the milk in clean cans.

4.1.10.Handing over the retrieved milk to the Technical Superintendent (Production) on duty and getting acknowledgement in the Good Packets Return Retrieving Register/Production software.

4.1.11.Taking the count of leak packets returned, cut opening them and discarding the milk.

4.1.12.Washing the plastic film of the leaky packets as well as cut-opened packets in hot water.

4.1.13.Filling the above washed waste film in polythene bags and depositing in the Film Waste Yard.

4.1.14.Shifting the sterile washed trays to the Main Production Block of the Dairy using a vehicle arranged by the contractor.

4.1.15.Getting acknowledgements from the Technical Superintendent (Production) on duty in the Pre-Washed Tray Acknowledgement Register/Production software for the total washed trays brought to the dock.

4.1.16.After completion of the tray washing operation, draining the Tray Washer tanks and washing the machine both inside and outside. Cleaning the floor of Tray Washing Block using the pressure jet

4.1.17. Dismantling and cleaning the spray nozzles once in a week and recording in the Tray Washer Log Book/Production software.

4.1.18.Ensuring that the total number of trays received at the Tray Washing Dock and total number of Washed trays acknowledged by the Technical Superintendent (Production) at the Main Production Block are the same. (If there is any shortage in the trays, the cost of the trays shall be recovered from the contractor @166.00 per tray).

4.1.19.The payment of this work shall be based on the total number of Trays acknowledged by the Technical Superintendent (Production) at the Main Production Block, after deducting the cost of shortages indicated in the above clause.

4.1.20.The minimum required workmen for this job would be 10 numbers at the current level of operations

4.2.Job No: 2-Milk Sachet Filling

Based on the sales volumes, milk filling will be planned. The material used for filling the milk in packets is LDPE Film supplied in rolls. These rolls are to be loaded to the Filling Machines. The machines will be operated with a minimum speed of 40 packets of 500 ml per minute. The filling performance shall be evaluated based on the minimization of film wastage at Dairy level as well as minimization of sales returns due to leakage at the distribution route level. There will be a permissible wastage of film @ 1% at the dairy level during the time of filling and the losses above 1% shall be charged to the contractor (Film Cost). For calculating the leakage, the permissible route leakage (leak returns from the Wayanad market& Depots market including the transit leakage through Taurus vehicles) level will be taken as, 0.2% of the dispatched quantity and the losses above 0.2% shall be charged (both the cost of film of leaked pouches and cost of milk) to the contractor. The wastage and leakage loss will be calculated on daily basis. The wastage and losses shall be calculated based on the parameters detailed in the following table:

4.2.1.Washing the overhead bowl of the Filling Machine. Cleaning the inner and outer areas of the Machine.

4.2.2.Giving Cleaning-in-Place (CIP) to the Machine. 4.2.3.Deciding the number of heads (each Machine is having two heads) and type of

Milk to be operated/filled, by getting the direction of Technical Superintendent (Production) on duty.

4.2.4.Taking the weight of the required LDPE Film in the presence of Technical Superintendent (Production) and loading it to the Machine.

4.2.5.Recording the weight, type of Film, supplier name, yield condition as per purchase order etc in the Log Book/Production software.

4.2.6.Consulting the Plant Technician for the type of milk available, opening the valve of the tank and starting the Machine for filling the packets.

4.2.7.Operate the Filling Machine. See that there is no leakage of packets and wastage of film during the filling process.

4.2.8.Putting the packets in the trays (20 packets per tray) and sending to the Cold Store through the conveyor.

4.2.9.Check the weight of the milk packets for correctness during every 30 minutes in the electronic balance and recording it in the concerned register.

4.2.10.Stacking the filled trays inside the Cold Store as per direction of the Technical Superintendent (Production), without mixing the stacks of different varieties of milk. (Each variety of milk shall be stacked separately)

4.2.11.When the required quantities of packets are filled, closing the tank valve and stopping the Filling Machine.

4.2.12.Draining the balance milk in the pipelines and bowl to the cleaned steel cans and handing over to the Plant Technician.

4.2.13.Leak packets generated during the filling process shall be cut open and milk collected in cans then and there and handed over to the Plant Technician.

4.2.14.Washing the plastic film of the leaky packets as well as cut-opened packets in hot water.

4.2.15.Filling the above washed waste film in polythene bags and discarding in the Film Waste Yard.

4.2.16.Doing CIP (automatic cleaning) of the Machine and pipelines. 4.2.17.Cleaning and housekeeping of the work spot. 4.2.18.Handing over the details of filled packets, quantity of film used, quantity of film

wasted etc to the Technical Superintendent. 4.2.19.The minimum required workmen for this job would be 27 including the

Technicians (4 numbers). 4.2.20.Taking the weight of the left over LDPE Film in the machine in the presence of

Technical Superintendent (Production) recording it.

4.3.Job No: 3- Ghee Filling

Ghee shall be filled into Bottles/PP Jars of 100 ml, 200ml, 500ml& 1 L or Tins of 15 Kg, 5 L, 2 L & 1 L.

The details of the job are as follows: 4.3.1.Select the Ghee Tank for filling ghee as per the advice of Technical Superintendent (Production) on duty. 4.3.2.Confirm from the Technical Superintendent (Production) the type packing

required to be filled. 4.3.3.Collect all the requirements like PP Jars & Tins, replicas & caps from the Store

through indents raised by the Technical Superintendent (Production). The Replicas/Wads shall be inserted in to the empty caps

4.3.4.The Technician engaged in the Ghee Filling Section shall ensure the proper functioning of all the required parameters of Ghee Filling Machine &Set the Ghee Filling Machine for the volume required.

4.3.5.Switch on the Machine. 4.3.6.Ensure that the empty packing containers are free from any extraneous matter. 4.3.7.Start feeding the empty PP Jars/Tins to the machine 4.3.8.Checking the weight of each filled Ghee PP Jar/Tin during filling, using the

electronic balance for ensuring the correct weight. 4.3.9. Print the shrink label PP Jars/tins with AGMARK/EXPORT Batch No., Date of

Manufacturing/Expiry & MRP as per the direction of duty Technical Superintendent (Production)

4.3.10.Stick the printed AGMARK serial number on the filled PP Jar/Tin & put the Filled Ghee PPJars/Tins in to the cartons having partitions as per the variety filled. Put the correct number of bottles/tins in the cartons.

4.3.11.Seal the carton with Tape. 4.3.12.Seal the packing date on the carton in the case of local sales and belt with

plastic rope in the case of Export sales 4.3.13.Stack in the godown. 4.3.14.Clean and do the house keeping of the work spot& Machine. 4.3.15.Record the names of employees along with replica numbers in the Ghee Filling

log book/Production software, so as to spot out the persons who filled the ghee, in case there are any market complaints.

4.3.16.Hand over the log book to the Technical Superintendent (Production) on duty and get it acknowledged

4.3.17.If there is any shortage or spillage of Ghee, the cost of the concerned loss (as per S/T price of Ghee per Kg) will be recovered from the total wages.

4.3.18.The minimum workmen required is 6nos including 1 Technician 4.4.Job No: 4-Curd Manufacturing & Filling

Based on the sales volumes, Curd filling will be planned. The material used for filling the Curd in packets is LDPE Film supplied in rolls. These rolls are to be loaded to the Filling Machines. The machines will be operated with a minimum speed of 40 packets per minute. The details of the work are as follows:

4.4.1. The Plant Technician shall deliver required quantity of milk to the

Reconstitution tank. In the case of reconstitution, the Contractor’s Technician has to brought the SMP from the go down and mix it with water to make the required volumes of Skimmed Milk as directed by the duty TS(P)

4.4.2. The Contractor’s Technician has to adjust the SNF to the required level by using the Skimmed Milk Powder brought from the godown.

4.4.3. Milk shall be given required processing in the Plate Heater/Cooler, added with culture obtained from Quality Control Laboratory at the prescribed temperature and the milk so prepared shall be fully packed within 60 minutes by the above Technician.

4.4.4.Washing the overhead bowl of the Filling Machine. Cleaning the inner and outer areas of the Machine.

4.4.5.Giving Cleaning-in-Place (CIP) to the Filling Machine & Curd Pasteurizer 4.4.6. Taking the weight of the required LDPE Film in the presence of Technical

Superintendent (Production) and loading it to the Machine. 4.4.7. Recording the weight and type of Film in the Log Book or in the software given. 4.4.8.Operate the Filling Machine by draining a minimum one can of cultured milk.

See that there is minimum leakage of packets and wastage of film during the filling process.

4.4.9.Leak packets generated during the filling process shall be cut open and cultured milk shall be collected in cans then and there.

4.4.10.Washing the plastic film of the leaky packets as well as cut-opened packets in hot water.

4.4.11.Filling the above washed waste film in polythene bags and discarding in the Film Waste Yard.

4.4.12.Putting the packets in the trays (20 packets per tray) and sending to the Incubation area manually.

4.4.13.Allow setting time till the Quality Control Department clears the set curd for cold storing.

4.4.14.Shifting the curd trays to the Cold Store without disturbing the set curd and also without mixing with the stacks with different varieties of milk in the cold store.

4.4.15.Draining the balance cultured milk in the cans after keeping the required quantity of cultured milk in the curd tank for setting for Buttermilk preparation.

4.4.16.Doing CIP (automatic cleaning) of the Curd Filling Machine, Plate Heater/Cooler and related pipelines.

4.4.17.Cleaning and house keeping of the work spot. 4.4.18.Record the details of filled packets, quantity of film used, quantity of film

wasted etc in the Curd Log Book and Pouch filling log book and get it acknowledged by the Technical Superintendent (P).

4.4.19.The required workmen for filling the curd shall be taken from the Milk Filling pool& 1 Technician is required for processing & packing of Curd.

4.4.20.Taking the weight of the left over LDPE Film in the machine in the presence of Technical Superintendent (Production) recording it.

4.5. Job No: 5-Buttermilk Manufacturing & Filling

Based on the sales volumes, Buttermilk, filling will be planned. The material used for filling the Buttermilk in packets is LDPE Film supplied in rolls. These rolls are to be loaded to the Filling Machines. The machines will be operated with a minimum speed of 40 packets per minute. The filling performance shall be evaluated based on the minimization of film wastage at Dairy level as well as minimization of sales returns due to leakage at the distribution route level. There will be a permissible wastage of film @ 1% at the dairy level during the time of filling and the losses above 1% shall be charged to the contractor. For calculating the leakage, the permissible route leakage (leak returns from the Wayanad market, Depots market & Transit leakage through Taurus vehicles) level will be taken as, 0.2% of the dispatched quantity and the losses above 0.2% shall be charged (both the cost of film of leaked pouches and retail cost of Buttermilk prevailing during the time of starting the contract shall be applied) to the contractor. The wastage and leakage loss will be calculated on daily basis. The wastage and losses shall be calculated based on the parameters detailed in the following table:

The details of the work are as follows:

4.5.1.Get the requirement of Buttermilk to be manufactured from the Technical Superintendent (Production) on duty

4.5.2.Get the details of required volumes of Curd, processed water and other natural ingredients like Ginger, Green Chilly & Curry Leaves from the Technical Superintendent (Production) on duty. Prepare the Buttermilk mix by grinding the Chilies (after removing the studs) & Ginger (after washing in the hot water to remove the soil). Curry Leaves should be dipped in the previous day’s Curd for extracting the essence. Process the extract to a minimum of 70 Deg C through the plate heat exchanger. Mix the contents with Salt and ensure the required taste.

4.5.3.Cool the Buttermilk to the required temperature (4 Deg C). 4.5.4.Take it for filling after getting the clearance from the Quality Control

Department. 4.5.5.Filling and storage of the product will be same as the case in Milk. 4.5.6. Record the details of filled packets, quantity of film used, quantity of film waste

in the Buttermilk Log Book and Pouch filling log book/Production software and get it acknowledged by the Technical Superintendent (Production)

4.5.7.Clean and do housekeeping of the work spot. 4.5.8.Minimum requirement of workmen for preparing the essence will be 2 nos.

Workmen from the Milk Filling pool can be utilized for Buttermilk filling & the

service of Technician meant for curd can be used for operating the Buttermilk filling machine.

4.6.Job No: 6- Ghee manufacturing The details of the work are as follows: 4.6.1.Cream/Butter shall be made available in the Cream Tank/Trolleys to the

Contractor’s cream melting person. In case of Biriyani special Ghee, the Cream has to be chilled, cultured and incubated for 48 hrs as per the advice of QCO, if needed.

4.6.2.The cream melting person shall pump/take the specified quantity of Cream/Butter (normal/cultured) to the Ghee Vat/s. In case if Bulk Ghee is received from other units, it shall be taken for re melting & clarification for which wages shall be paid @ 40% of the quoted rate for Cream/Butter to Ghee. It should be recorded separately in the log book & shall be duly certified by the duty Technical Superintendent (Production)

4.6.3.Ghee Vat shall be operated by allowing steam flow till Ghee of right quality is produced (preferably up to 114 Deg C).

4.6.4.Molten Ghee shall be pumped to the settling tanks for cooling and settling. 4.6.5.Clarify the Ghee after cooling (at min. 45 Deg C). 4.6.6.Pump the Ghee to the Ghee storage tanks& seed it properly with old ghee. 4.6.7.Treat the Ghee residue to recover the maximum quantity of Ghee from it. 4.6.8.Dismantle and clean the clarifier, cleaning of the cream tanks, settling tanks,

ghee storage tanks, chemical cleaning of Ghee Vat etc will be the responsibly of the contractor’s person.

4.6.9.Record the details of Cream/Butter used, Ghee remelted, Ghee produced etc in the Ghee Making Log Book/Production software. Record the Ghee processing Temp in the register provided for the same/Production software.

4.6.10.The person should also keep the Ghee Block neat and tidy always by following best housekeeping practices. If the yield of Ghee is found less than the expected yield from the given Cream/Butter& the loss/Spillage of Ghee if any shall be recovered from the contractor based on the S/T price of Bulk Ghee prevailed during the time of starting the contract.

4.6.11.Number of skilled workmen required will be two and the payment shall be based on per kilogram of ghee produced.

4.7.Job No: 7-Sip Up /Lolly Manufacturing & Filling

Based on the sales volumes, Sip up/Lolly filling will be planned. The material used for filling the Sip up/Lolly in packets is LDPE Film supplied in rolls. These rolls are to be loaded to the Filling Machines. The filling performance shall be evaluated based on the minimization of film wastage at Dairy level as well as minimization of sales returns due to leakage at the distribution route level. There will be a permissible wastage of film @ 1% at the dairy level during the time of filling and the losses above 1% shall be charged to the contractor. For calculating the leakage, the permissible

route leakage (leak returns from the Wayanad market, Depots Market & Transit leakage through Taurus vehicles) level will be taken as, 0.2% of the dispatched quantity and the losses above 0.2% shall be charged (both the cost of film of leaked pouches and retail cost of DTM milk prevailing during the time of starting the contract shall be applied) to the contractor. The wastage and leakage loss will be calculated on daily basis. The wastage and losses shall be calculated based on the parameters detailed in the following table:

The details of the work are as follows:

4.7.1.Get the requirement of Sip up/Lolly to be manufactured from the Technical Superintendent (Production) on duty.

4.7.2.Get the details of required volumes of Milk/Processed Water, Sugar, Colour & Flavour from the Technical Superintendent (Production) on duty. Prepare the Sip up/Lolly mix by mixing the ingredients to the suitable taste. Filter the mix through Muslin cloth to avoid the presence of foreign bodies.

4.7.3.Take it for filling after getting the clearance from the Quality Control Department. Pack each 25 numbers of Sip up/Lolly tubes in polythene bags printed with Date of Manufacturing & MRP. Seal the bags using hand sealing machines.

4.7.4.Harden the Sip up/Lolly using perforated trays in the Hardening Chamber. 4.7.5.Record the details of filled packets, quantity of film used, quantity of film waste

etc in the Sip up/Lolly Log Book/Production software and get it acknowledged by the Technical Superintendent (Dairy).

4.7.6.Clean and do housekeeping of the work spot. Workmen for this work can be drawn from the Milk Filling Pool & the Technician of Curd filling can be used for operating the sip up/Lolly packing machine.

4.8.Job No: 8-Tray Loading to the Taurus Vehicles

The milk trays are stacked in the cold store meant for dispatch to the local market & Depots. The contractor’s persons are required to load the Taurus vehicles with 13 numbers of stacks as per the advice of the duty Technical Superintendent (P) as and when the Taurus vehicle reports at the dispatch dock. A Taurus should be loaded

within a maximum span of 2 hours. Before starting the loading, the chilled water should be sprayed inside the puff body and while loading each and every tray should be checked for replacing the leakage/shortage if any. If not, the cost of the shortage of sachets reported at the Depots shall be recovered from the Contractor. The specified jobs are: 4.8.1.Collect the loading figures from the duty Technical Superintendent (P). 4.8.2.Start leading the stacks from the cold store to the Ante Room using trolleys 4.8.3.Load the trays to the Taurus by checking each tray as per the loading pattern

given by the duty Technical Superintendent (P). 4.8.4.Replace the leak sachets in the trays during the loading time itself 4.8.5.Stacks of each 13 numbers of trays should be placed in side the Taurus vehicle 4.8.6.If there is any change in the loading pattern, the same should be informed to the

duty Technical Superintendent(Production) 4.8.7.At the end of the Taurus loading, the loading persons should take the closing

4.9.Job No: 9-LDPE Film Rewinding for Date Coding

4.9.2.Collecting the Indent for LDPE film from the duty Technical Superintendent (P) as per the requirement from the filling operators and supervisor of the piece-rate contract.

4.9.3.Receiving the LDPE Film from the Stores after proper weighment in the presence of Asst. Stores Officer (ASO) / Stores-in –charge.

4.9.4.Shifting the LDPE Film to the Rewinding room in a covered Vehicle arranged by the Contractor 4.9.5.Loading the LDPE Film rolls to the rewinding machine for printing the Date

Coding on the Film. The Date of printing should be collected from the duty Technical Superintendent (P).

4.9.6.Operation and daily/routine Maintenance of the Rewinding Machine is vested with the contractor.

4.9.7.As part of food safety, utmost care should be taken to prevent the entry of flies and dust in to the rewinding room during the time of rewinding.

4.9.8.Stacking the date-printed rolls of film in the labelled racks. The contractor has to ensure for the non-mixing of printed and unprinted film rolls in the rewinding room.

4.9.9.Shifting of the date-printed rolls to the site in the production block as per the direction of duty Technical Superintendent (P).

4.9.10.Collecting the balance unused film if any of previous day from the filling section and taking to the rewinding room for blocking the existing date on the film and printing the new date assigned by the duty Technical Superintendent (P). Return the printed film to the filling section with immediate effect on the same day.

4.9.11.The Film should be hygienically handled with proper care for not exposing to the dust, sunlight, chemicals, extraneous matters, flies and water during its handling.

4.9.12.Rewinding room should be kept clean and tidy always 4.9.13.In case of price revisions, the film received from the other units should be rate

coded within the specified time given by the duty TSP/TO with additional effort.

4.9.14.A register with all relevant details should be maintained as per the instruction of duty TSP/TO/AM(P)

4.9.15.Minimum manpower required is one Technician

4.10.Job No: 10- Butter manufacturing & Packing

The details of the work are as follows: 4.10.2.Cream shall be made available in the Cream Tank/Trolleys to the Contractor’s

Butter manufacturing person. The Cream has to be diluted to the required level of fat % making it suitable for processing as per the advice of QCO

4.10.3.The Butter manufacturing person shall pump the specified quantity of diluted Cream to the Cream Pasteurizer.

4.10.4.The processed Cream shall be pumped to the Butter Churn for churning in to Butter with the advice of duty TSP/TO

4.10.5.The process of butter churn operation by the butter manufacturing person shall be guided by the DE/TO

4.10.6.After loading the butter to the trolleys, it will be shifted to the hardening chamber as per the advice of QCO

4.10.7.Record all the details of Butter manufacturing in the log book & submit o the duty TSP

4.10.8.As per the requirement & with the advice of duty TSP, the Butter will be taken to the filling room(Air Conditioned) without any contamination & shall be packed in to 50 gm, 100 gm, 200 gm & 500 gm cartons. The MRP & Use By date shall be printed on the cartons as advised by the duty TSP

4.10.9.The weight of the bulk butter before starting the packing shall be verified & the packing yield should be synchronized with it, which otherwise, the cost of the shortage of butter shall be recovered from the contractor as per the S/T price of bulk Butter prevailed during the time of starting the contract.

4.10.10.The packed butter shall be shifted to the Freezers/Hardening room as per the direction of duty TSD

4.10.11.The lapses happens if any in butter packing like correction in date coding, MRP etc, shall be reworked by the contractor at free of cost

4.10.12.The packing staff should wear the hand glosses during the packing of butter & should maintain the personal hygiene to prevent the contamination of butter. Best housekeeping shall be maintained in the packing room of butter

4.10.13.Dismantling and cleaning the Cream pasteurizer, cleaning of the cream tanks, Butter Trolleys, Butter Churn, SS pipe lines& housekeeping of the Butter manufacturing Block will be the responsibility of the contractor’s person.

4.10.14.The person should also keep the Butter Block neat and tidy always by following best housekeeping practices.

4.10.15.Numbers of workmen required are 6 attenders & 1 Technician (for manufacturing).

4.11.Job No: 11- Paneer manufacturing & Packing

The details of the work are as follows: 4.11.2.Required quantity of milk shall be taken for processing as per the advice of QCO/TO/TSD 4.11.3.The Paneer manufacturing person shall pump the specified quantity of Milk to

the Paneer manufacturing vat 4.11.4.The Paneer shall be manufactured as per the procedure advised by the duty

TSD/TO/QCO. The manufactured Paneer as per the required specifications, shall be filled in to the moulds

4.11.5.The Paneer moulds shall be shifted to the hardening chamber as per the advice of QCO

4.11.6.Record all the details of Paneer manufacturing in the log book & submit o the duty TSD

4.11.7.As per the requirement & with the advice of duty TSD, the hardened Paneer will be taken out to the filling room(Air Conditioned) without any contamination & shall be packed in to 200 g, 500 g & 1 Kg cartons. The MRP & Use By date shall be printed on the cartons as advised by the duty TSD

following best housekeeping practices. 4.11.14.Required workmen for packing the Paneer can be drawn from the Butter Pool.

4.12.The tenderer has to supply manpower to perform additional jobs like Manufacturing and Packing of Palada mix, Peda etc as and when required during the contract period. The rates for the same on piece rate basis shall be fixed on mutual discussion between the contractor & MRCMPU as and when required.

5.How to offer the Tender

5.1.Tender Notice along with “Form of Submitting Tender for Piece-Rate Operations under Wayanad Dairy” can be obtained by remitting Rs.1000.00 (inclusive of taxes) from the following Unit during working hours.

5.2.The Tender has to be submitted in sealed envelopes by filling in the abovementioned

form. 5.3.Tenderers who have work experience in the field of supplying manpower for any

commercial organization for at least one year during the last 3 year period should enclose an experience certificate in the prescribed format which is attached to the tender notice as Annexure 1. They should also enclose a copy of their PF/ESI registration certificates. Tender submitted by tenderers with work experience who do not submit Annexure 1 /copy of their PF/ESI certificates along with their tenders as above ,will be rejected . Tenderers without work experience are permitted to participate in the tender process without submission of copies of their PF/ESI registration certificates on condition that they shall submit the copies of the registration certificates within one month of the date of awarding the contract. In areas where ESI scheme is not notified he should provide statutory WCCP coverage to his employees.

5.4.The tenderer has to quote the rates for all the contract jobs in a single form. If anybody quotes for less than 11 jobs, the quotation shall be invalid.

5.5.Each Tender form submitted should be accompanied by Earnest Money Deposit (EMD) of Rs.25, 000.00 (Rupees Twenty Five Thousand) as Demand Draft in favour of Managing Director, MRCMPU Ltd payable at Kozhikode or as Receipt of Cash remitted at Wayanad Dairy.

5.6.Tender applications shall be available from Wayanad Dairy up to 12 PM of 05/10/2015 & the filled Tenders in the prescribed form shall be accepted till 1 PM of 05-10-2015, Monday in sealed envelope, along with the EMD. The envelope should carry superscription “Tender for Piece-Rate Operations.”

5.7.While submitting the Tender, the Tenderer has to sign in all the pages of Tender Notice.

5.8.Tenders will be opened on 05-10-2015 at 2:00 PM at the Wayanad Dairy. 5.9.Tenders, which contain false statements by the tenderer are liable to be rejected. 5.10.Negotiation, if any, will be with the lowest quoted party only. 5.11.The Senior Manager, Wayanad Dairy reserves the right to accept or reject any Tender

without assigning any reason thereof.

6.General Terms and Conditions

6.1.The Independent Labour Contractor should have the necessary license from the competent authority (District Labour Officer-Enforcement) under the Contract

Labour (Regulation and Abolition) Act 1970 to provide services of workmen for carrying out labour contract on piece rate basis. A copy of the same shall be submitted along with the tender application. If he does not have the license, he should obtain the same at his own cost within one month of starting the piece rate work & he shall comply with all statutory requirements within the above period of one month.

6.2.The Independent Labour Contractor should have valid PF registration, ESI registration, Professional Tax registration, PAN number of Income Tax Department, independent code number under ESI and EPF Act etc. If the tenderer does not have the registrations cited above during the time of submitting the tender application, he is also permitted to participate in the tender on a condition that he should submit the copies of registrations within one month from the date of awarding the contract.

6.3.The wages paid by the Independent Labour Contractor to his employees should be in accordance with the Agricultural Operations and Dairy Farming notification made under the Minimum Wages Act (Notification GO/MS/No.106/2009/LBR dated 10/8/2009) and each employee should be paid a wage amount for an eight hour duty which should not be less than the amounts shown in the table below: If any employee is engaged for more than 8 hours in a day, over time wages shall be paid to him for the number of hours worked over & above the 8 hrs normal duty as per the Factories Act.

MRCMPU Ltd shall not be bound to bear any additional expenditure by the contractor on account of wage revision in excess of the declared minimum wages.

6.4.The Contractor shall also remit employer’s contributions of PF and ESI as shown in the above table. The Contractor shall make remittance of employees’ contribution of

PF and ESI by deducting the same from the employees’ wages. The contractor shall submit the photocopy of the wage register& proof of PF & ESI remittance to the Senior Manager every month.

6.5.Necessary enough time is required to tally the production/dispatch data with Depots. Hence, the processing of contractor’s bill may take time. In order to avoid the delay in disbursement of salaries to the employees, the contractor shall submit a request for the advance payment (80% of the total bill amount) on 2nd of every month. The advance shall be released based on the recommendation of section head of Production Dept.

6.6.The Independent Labour Contractor has to use the Employee Management Software developed by MRCMPU for the preparation of Daily attendance report, Monthly salary report and Contractor’s Monthly bill.

6.7.Average number of manpower engaged by the contractor in a day shall be restricted to 68 in the Employee Management Software. The contractor can engage more manpower if needed as “Special Duty” with the permission of Unit Head through the software.

6.8.The Independent Labour Contractor shall submit his final bill obtained from the Software, for the month to the Senior Manager on or before the 10th day of the succeeding month along with copies of wage register and remittance challans with bank seal to prove remittance of PF and ESI contributions. Payment of eligible amount (after deducting the advance released) will be made by the Dairy Manager on or before the 20th day of the succeeding month after deduction of penalties if any for unsatisfactory performance. Statutory deductions like Income Tax etc as applicable will be recovered from the bills as per Government instructions from time-to-time. Collection and payment of Service Tax will be the responsibility of the Contractor. Permanent Account Number (PAN) of Income Tax is essential to effect the payment. The Service Tax shall be reimbursed to the contractor from the Dairy based on the submission of the proof of remittance. The contractor shall pay the Service Tax & claim the same from the Dairy by submitting the proof of remittance.

6.9.The Independent Labour Contractor’s employees shall wear prescribed uniforms within the Dairy campus and they shall follow all prescribed hygienic practices in the Dairy. The Contractor shall provide his employees (within one month from the Date of commencement of the contract) two sets of uniforms at his own expense per year with the prescribed material (33% cotton and 67% polyester) and design approved by the Unit Head. The name of the employees shall be stitched on the pants, shirts, coats &Chudidar for differentiating the uniforms. The employees should also wear mask, gloves, head caps and boots. Disposable type gloves Moth Gags & head caps daily, two sets of sweaters (for those working inside the cold store) and one set of boots every year shall be provided to the employees by the Contractor at his own expense. If the Contractor does not provide the Uniforms as prescribed, the Dairy shall provide the Uniforms & recover the cost including the stitching charges from the contractor. Daily washing of uniforms and all the above articles (except boots) will be done by the Dairy at free of cost. If the contractor fails to comply the above, within 40 days from the date of commencement of the contract, the Dairy has the right to provide them to the Employees & recover the cost from the bill of the Contractor with an annual penalty of Rs.5000.00 per year.

6.10.The Independent Labour Contractor’s employees working in the Dairy shall perform their duties in a disciplined manner and should not behave in any manner detrimental to the smooth functioning of the routine Dairy operations.

6.11.In case any of the Independent Labour Contractor’s employees meet with any accident in the Dairy, the Contractor shall be solely liable to provide the employee with necessary treatment and compensation. MRCMPU Ltd shall not be liable for any disability claims/compensation due to injury/death on account of such accidents. The Contractor shall obtain ESI registration to meet such eventualities. Whenever new employees are engaged by the Contractor such employees shall also be included in the ESI coverage and evidence of inclusion shall be submitted to the Dairy Manager immediately.

6.12.The Independent Labour Contractor shall not be eligible for any payment other than the amount calculated as per the piece rate fixed under the contract and service tax, and the Contractor shall meet all his statutory liabilities as well as liabilities of wages from this amount.

6.13.The employees of the Independent Labour Contractor shall have no right for regular employment in MRCMPU Ltd and there shall be no employer-employee relationship been the Union and the Contractor’s employees.

6.14.The Independent Labour Contractor shall post a Supervisor in each shift in the Dairy to supervise the work carried out by his employees under this contract and the salary of the supervisors shall be borne by the Contractor. If the Contractor gets any other contract work in the Dairy, such work shall be supervised by a separate Supervisor. The service of the Supervisor under this contract shall not be used for any other contract.

6.15.The Independent Labour Contractor shall provide a night shelter facility outside the Dairy campus and in its vicinity, for the benefit of his lady employees engaged in the night shift (up to 8 pm). Otherwise he has to provide transport facilities for such lady employees to reach their residences after night shift (up to 8 pm). If engaged for duty after 8 pm, eligible Night Allowance shall be paid to the Employees as per the Factories Act.

6.16.The Independent Labour Contractor should hold meetings with his employees every month to sort out and settle grievances as well as complaints of unsatisfactory performance.

6.17.The Independent Labour Contractor shall follow instructions issued by Dairy authorities in conformity with the provisions of the ISO/HACCP specifications regarding the hygiene, punctuality and performance of his employees and documentation procedures connected to ISO/HACCP implementation. As part of personal hygiene in FSMS, medical checkup of the entire piece rate employees shall be conducted once in a year by the Dairy & the expenditure incurred (approximately Rs.400 per head) for the same shall be recovered from the contractor.

6.18.The personnel employed by the Independent Labour Contractor shall be above 18 years and below 58 years of age and must be well disciplined and medically fit and technically skilled to carry out the specified jobs. These personnel shall be engaged for a maximum of 26 days in a month.

6.19.The Independent Labour Contractor shall on request by the Dairy Manager immediately replace any person employed by the contractor, who may, in the opinion of the Dairy Manager be unsuitable or incompetent to carry out the allotted work or is found guilty of misconduct/indiscipline.

6.20.The Independent Labour Contractor shall make periodical and/or surprise checks to supervise the performance and turn out of the contract personnel provided by him.

6.21.The Independent Labour Contractor shall arrange for the maintenance of registers and forms as are found necessary for efficient performance of the work assigned to him. A duty register indicating the names of the contract personnel on duty should be made available to the Dairy Manager at all times.

6.22.The Independent Labour Contractor shall not assign or sublet the work in full or part to any other sub contractor.

6.23.The Dairy Manager deserves the right to require Police verification to be done by the Independent Labour Contractor of the persons engaged by him before assigning duties inside the Dairy.

6.24.Independent Contractor Relationship and Status 6.24.1.The Independent Contractor shall perform the Services under this Contract

solely as an Independent Contractor and shall recognize that this Contract does not create any actual or apparent agency, partnership, franchise, or relationship of employer and employee between the Contractor and Wayanad Dairy or MRCMPU Ltd. The Independent Contractor is not authorized to enter into or commit MRCMPU Ltd to any agreement, and the Independent Contractor shall not represent itself as the agent or legal representative of MRCMPU Ltd.

6.24.2.The Independent Contractor shall have the right to control and supervise the performance of the services provided under this contract.

6.24.3.The Independent Contractor shall not be entitled to participate in any of the benefits provided by MRCMPU Ltd, including without limitation any health or retirement plans. The Independent Contractor shall not be entitled to any remuneration, benefits, or expenses other than as specifically provided for under the terms of this Contract.

6.24.4.MRCMPU Ltd shall not be liable for taxes, Worker's Compensation, ESI, EPF etc for the services provided by the Independent Contractor or for withholding for or on behalf of the Independent Contractor any amount payable to any other person consulted or employed by the Independent Contractor in performing Services under this Contract. All such costs shall be the Independent Contractor's responsibility.

6.24.5.The Independent contractor shall indemnify MRCMPU Ltd/Wayanad Dairy against all claims which may arise under the under noted Acts:

6.24.5.1.The Minimum Wages Act, 1948. 6.24.5.2.The Workman's Compensation Act, 1923. 6.24.5.3.The Payment of wages Act, 1963. 6.24.5.4.The Payment of Bonus Act, 1965. 6.24.5.5.The Contract Labour (Regulation & Abolition) Act, 1970 and the rules

framed there under. 6.24.5.6.E.S.I Act 1948 6.24.5.7.Inter-State Migrant (Regulation of Employment and Condition of

Service) Act. 1979. 6.24.5.8.The Employees Provident Fund and Miscellaneous Provisions Act,

1952.

6.25.Any other Acts or Statute not here in above specifically mentioned having bearing over engagement of workers directly or indirectly for execution of work.

6.26.Any amount payable to MRCMPU Ltd arising out of this contract will be recoverable from the amounts payable to the contractor by MRCMPU Ltd.

6.27.The successful Independent Labour Contractor shall execute an agreement in non judicial stamp paper worth `500.00 and remit a security deposit of `10, 00,000.00 (Rupees Ten Lakhs only ) as cash/DD in the name of Senior Manager, Wayanad Dairy or a bank guarantee for the equivalent amount, which will be released after successful completion of the contract without interest. Either party can terminate the agreement during the operative period by giving three month advance notice in writing.

6.28.If the contractor is found violating the terms of agreement or if the contractor is involved in the activities which are against the interest of the Dairy, the contract shall be terminated either immediately or with a three months notice and the contractor shall be black listed if required.

6.29.The rate quoted by the Independent Labour Contractor shall include all expenses mentioned in the Tender Document as well as any other statutory payment not specifically mentioned therein. The rates should be quoted in the attached format. The total daily average manpower requirement will be maximum 68 persons including the Supervisors & Technicians.

6.30.The Grand Total Amount per day for all the jobs will be considered as criteria for determining who has quoted the lowest rate.
