DESIGN OVERVIEW

The vibrant character of great shopping are comprised of exceptional storefronts. Texture, color, lighting, graphics, andmerchandising are the key elements to the Tenant identity and storefront.

Tenant design professionals are encouraged to view these renderings as the inspiration to create storefronts thatenhance the shopping experience at King of Prussia. Tenants are encouraged to exceed and not simply replicate mallprototype storefronts. High quality materials, trend setting design and balanced composition shall be a high priority of theTenant design professional and will be carefully reviewed, encouraged, and enforced by the Tenant Coordinator.

GENERAL DESIGN CRITERIA

The general design philosophy is to conceive newstores and new storefrontswith maximumheightandtransparency,usinga refreshingly new designapproach, resulting in innovative, state of the artstorefront and signagedesign.Tenantsareencouraged toexpress their individualityand theirbrand identity through their originality in store designand merchandisingas well as utilizeavariety ofplanes and material treatments,both horizontalandvertical in their designto createa three dimensionalfeel and to give dimensionalarticulation to theirstorefront.

This design criteria is intended to be used as a guide duringyour process and creation of your space. Intheevent of adiscrepancy between this criteria, mall criteria, leaseand/or lease exhibits, the most stringent shall takeprecedence.Tenant’sdesign professional, and/orTenant’sgeneralcontractorshall confirmthecriteria in questionwith theTenantCoordinator before execution of work (orsuchwork shall be corrected by Tenantat Tenant’sexpense). All componentsof theTenant InformationPackage can be found at www.simon.com.

The TenantStorefront Design Control Zone is theareaof the storeextending from thestorefront lease line intothestore aminimumof five feet (5’-0”)across the entirewidth of the store.Since theappearanceof this zone iscritical to the overall storeappearance, designsolutions, andmaterials are expected to be of thehighestquality. Thedesignzonewill be closelyreviewedbyLandlord for designanduse.Ceiling materials shall consist of gypsumboard,wood, metal,or other types ofhard surface materials.Acoustical ceilings andopen ceilings will not bepermitted in thiszone.

Sprinkler heads shall be fully recessed with coverplates at entry vestibule andstorefront showwindows.Any speakerswithin 5’-0”of the entry shall haveaseparatevolumecontrol thatcanbe set to theMall Managers’specifiedlevel.The backs of EmergencyExit signage/lights (overtheentry doors)mustnot bevisible from the exteriorcommonarea.Security systemsshall be fully concealed. Gate style orstanchion security systemsare not permitted if visiblefrom the common mall area.Security cameras, trafficcounters, vision panels,or “bubbles”shall not beexposed to public view in theDesignControlZone.

storefront that is recessed behind the Landlord’sbulkhead. All finishes shall match the bottom of theLandlord’s bulkhead.

Tenant shall construct a “roof’ or finished top onall storefront projections beyond the Landlord’sbulkhead. In locations where the “roof” top is visiblefrom an upper level floor, then the closure shall besloped and constructed using approved glazingsystems unless otherwise approved, in writing, byLandlord. The closures’ finishes and construction shallbe consistent with the Tenant’s storefront design.

STOREFRONT DESIGN CONTROL ZONEAll walls within this zone shall be provided with high qualityfinish material–plain painted surfaces are not permitted.Materials such as stone, tile, wood panels, the use of trimand other decorative treatments shall be utilized. Slat walland grid wall are not permitted.

No previous tenant storefront, or storefront materials,fixtures or finishes shall be reused.

Tenant shall extend the bottom of Landlord’s bulkheadto the point of closure for any portion of the Tenant’s

Extending 5’-0’back from the storefront glazing, thesidewalls andshowwindows shallbe dedicatedfor useasahigh-quality show window display.A creativedisplay is required for standard merchandiseracks,and wall finishingmaterials such asslat wall andprepackagedwall mounted grid systemsareprohibited.

Distinctive, high-quality and appropriate displaytechniques which best showcase theTenant’smerchandisemustbeused.At thestorefront entry,display fixtures andmerchandisemustbe placed at least 3’-0” behind theTenant’sentrydoor.Merchandise rack and display features mustnotblock customer traffic flow in andout of thestore.

LOW CEILINGS OR SOFFITS WITHINTHE CONTROL ZONEThere are occurrences within someof theTenantspaces inwhich there is adrop in ceiling heightwithin theTenantDesign Control Zone. Inthis case,Tenants areencouraged to minimize this transitionasmuch as possible.Theuseof similaror sameceiling orControl Zone materials is recommendedand anything that would bring attention to thiscondition such ascolor or lighting isdiscouraged.

STORE DISPLAY & MERCHANDISING ENTRIES & WINDOWSEntries are tobe inviting andmakeastatementabout themood andstyle of the store.Likewise, displaywindowsare more than frames;they mustbe interactive with themerchandise, customer,and interior designof thestore.Inorder to improve the general shopping experience, alltenants must place an emphasis on powerfulstorefronts and increase their levels ofpresentation.This shall be accomplished through the integration ofgraphicsand thecreationof enclosedportalentrancesto build up the experience forcustomers.All storefronts should provideanattractive andunmistakable invitation to enter.Entry involves more thanthedoor alone andshould entice customers to enterand browse.

TRANSPARENCYRetail ground floors shall havebetween 60%and80%transparency, as measuredfrom grade to theundersideof theslababove.Colored or mirroredglazing andglass block areinappropriate.

STOREFRONT LIGHTINGDisplay window lighting shall be incandescent, HID, orsimilar color light source, as approved by the Landlord.Light sources and track lighting must not be visible fromthe exterior common area. Sodium lamps are prohibited instorefront areas.

Show windows and display areas should be adequatelylighted and ventilated. Exposed fixture lamps areprohibited without prior Landlord approval; no lamp shallextend below the ceiling or below the display windowheads in the Design Control Zone. Displays, showwindows and entrances shall be illuminated duringShopping Center’s hours of operation, and shall becontrolled by an automatic time-clock or control systemconnected to the Tenant’s power supply.

Rear egress lighting to match other base building servicefixtures. All emergency and exit lighting for the Tenantpremises, both interior and exterior, shall be by theTenant, and shall be provided with emergency batterypower back-up.

The Tenant is prohibited from providing any sign, light orother building feature, extension or attachment that willinterfere with the Landlord’s building lighting, common areaor landscape lighting. All lighting power penetrationsthrough building piers or Landlord walls are not allowed.Strobe, spinner, chase or moving type of lighting will notbe allowed.

L.E.D. SCREENSL.E.D. screens proposed to be installed at the storefront orwithin the Design Control Zone require specific approval bythe Landlord, and will be reviewed on a case by case basis. Ifapproved, L.E.D. screens shall be incorporated into theoverall storefront design and are to be encased withinattractive display fixtures to conceal all surfaces except forthe screen surface.

They must be mounted a minimum of 3’-0” behind thestorefront glass and must incorporate slow fade typegraphics with no sound, animation, fast movement, strobing,or flashing. Maximum screen size is 42” measureddiagonally. All cables and wiring must be concealed fromview.

• All storefront materials shall be high quality, durablefinishes with minimal maintenance requirements.

• All materials are to be installed over a durablesubstrate and must be long lasting with minimalmaintenance required.

• All Tenants shall comply with all governing andapplicable building and fire code requirements.

• The Landlord reserves the right to reject orrequest substitutions or adjustments to theproposed finishes.

TEMPORARY BARRICADE

• If a construction barricade does not exist in front of theTenant space, the Tenant is required to install a 5/8” gyp.board enclosure. The barricade may be placed 3 feet infront of the Lease Line as long as a ten foot minimumclearance is maintained between the barricade and thenearest obstruction. It is the Tenant contractor’sresponsibility to ensure barricade placement meets egress,life safety and building code requirements.

• Barricades should be finish painted 5/8” gyp. board with3 5/8” metal studs at 16” on center. 1/2” plywood or gyp.board cap is to be installed over the top of the barricadeto prevent dust transmission. A 3’-2” x 6’-8” hollow coreaccess door with an “in” swing is permitted only whenthe premises does not have a rear service entrance.

• Barricades should be braced to maintain stability. Bracingshould be made to Tenant materials inside the Lease Line.Do not attach any framing to Landlord finishes. Precautionsshould be taken to protect Landlord finishes.

• Full color graphics are required and must cover the entiresurface of the enclosure. Prior to printing and installation, theTenant shall submit full color graphic content to the Landlordfor approval. Contractor signs are not permitted.

HVACHeating, Ventilating, Air-Conditioning and VAV All Retail TenantSpaces (Except in “C” Building Excluding C222,C223, C269)

Tenant shall install a heating, ventilating and Air-Conditioning (HVAC) system as designed by Tenant'sEngineer in strict accordance with the American Society ofHeating, Refrigerating and Air-Conditioning Engineers,Inc. (ASHRAE), Building Officials and Code AdministratorsInternational, Inc. (BOCA), National Fire ProtectionAssociation (NFPA) recommended practice and thiscriteria. Tenant shall submit, for Landlord's review andacceptance, design documents and design loadcalculations including cooling and electrical tabulationforms prepared and sealed by a registered ProfessionalEngineer.

Landlord's HVAC system is based upon the followingparameters:

1. Landlord will supply medium pressure, variable volumeand constant temperature air for cooling during Mallscheduled business hours. Under normal operatingconditions, cooling will not be provided during Mallscheduled non-business hours.

2. Landlord will provide heat to Tenant spaces during non-business hours to prevent freezing when necessary.Under normal operating conditions, heating will not besupplied during Mall scheduled business hours.

3. During Mall scheduled business hours, Landlord willsupply minimum ventilation air in accordance withBOCA Code.

4. Landlord will install Variable Air Volume (VAV) terminal(s) tomodulate supply air quantity from 20% to 100% of maximumrequired air volume. Landlord shall furnish and install, atTenant’s expense, a thermostat for control of VAV terminal.

5. Cooling Design Conditions:a.) Primary Air Supply: Summer Cooling - 58 °F nominalb.) Space Conditions: Business Hours - 76 °F nominal

6. Return Air: Tenant shall provide a means for return air toLandlord’s HVAC system during all occupied and unoccupiedhours. Return air openings shall have free area sized formaximum velocity of 400 FPM of Tenant’s maximum air supplyduring occupied hours, including door openings, and 800 FPMduring unoccupied hours. Return openings shall meetArchitectural design criteria. Tenant shall return supply air toMall unless otherwise required by Landlord. Tenant shall notallow the return of objectionable odors to Mall and shall providemeans of exhausting same in a required manner.

7. Tenant HVAC Construction:a.) Construction: Tenant’s HVAC ductwork shall be galvanized

sheet steel, black steel, or aluminum. Tenant’s toilet exhaustductwork shall be fabricated from galvanized sheet metal, and allvapor removal ductwork shall be fabricated from stainless steel orblack steel in accordance with ASHRAE standards and SheetMetal and Air-Conditioning contractors National Association, Inc.(SMACNA) manuals. Fiberglass ductwork will not be permitted.

b) Maximum allowable pressure drop through Tenant’sductwork and equipment downstream of Landlord’sVav terminal shall not exceed 0.4-inch water column.

c.) Air Distribution Devices: Air distribution devices shall becommercial grade registers or ceiling diffusers with individualmanual volume control.

d) Flexible Ductwork: If used, flexible ductwork shall be equalto “Flexmaster Triple Lock” aluminum insulated ductwork witha maximum length not to exceed six (6) feet.

e) Duct Insulation: All supply air ductwork shall be insulatedwith one (1) inch thickness glass fiber insulation with foil vaporbarrier, internally lined ductwork will not be permitted.

f) Penetrations: Penetrations in any partitions having a firerating of one hour or more must be fire stopped with approvedmaterials and methods to prevent the migration of smoke andto maintain the fire rating of the partition.

g) Variable Air Volume (VAV) Terminals: VAV terminals, withDDC control, are manufactured by the Price Corporation, andexisting. Any and all Tenant requested revision to the existingVAV terminals shall be performed by the Landlord at theTenant’s expense.

h) Access Panels: Access panels of suitable size to enablesafe entry shall be provided for all fire dampers, air balancingcontrols, valves, VAV terminals and other equipment ifrendered inaccessible by Tenant’s construction

i) Air Balancing: Tenant shall engage the services of acertified independent air balance contractor. Tenant’s airbalance report must be submitted to and accepted byLandlord before the Premises will be allowed to open forbusiness.

j) Electrical Heating Coil: If heating to the Premises isrequired during occupied hours, Tenant’s Engineer shallprovide for the installation of an electrical duct heating coildownstream of the VAV terminal. Tenant shall install a 24-volt control wiring interlock so that heating elements can beenergized only when VAV terminal is in 30% supply airposition. In the event the Tenant elects to install an electricduct heating coil, Tenant shall 1) provide air flow safetyswitch and thermal overload device and 2) design the electricheat capacity to minimum VAV terminal setting. Landlord, atTennant’s expense, shall adjust VAV terminal minimum stopto 30% supply air position.

k) Toilet Exhaust: Tenant shall provide a toilet exhaust fan.Where available, Tenant shall interconnect toilet exhaust fandischarge to the Landlord toilet exhaust duct. Where toiletexhaust duct is not accessible or available the Tenant shallbe required to exhaust at the roof level. Roof membranecutting and flashing shall be performed by the Landlord’sRoofing contractor at the Tenant’s expense. Tenant’scontractor must contact Mall Management Office prior tocommencement of work.

8. Hot Work Permit: Tenant’s contractor shall beresponsible to obtain and secure a Hot Work Permit(s)from the Landlord. A Hot Work Permit is required forany and all open flame welding or cutting such as butnot limited to welding, soldering and brazing.

9. Odor, Thermal & Process Equipment Exhaust:Odor producers (pets. hairstyling, manicures) mustmaintain a minimum of (15%) negative air pressurebetween their space and the Mall. Non-Odorproducing Tenants: Shall design ventilation system tomaintain a positive (15%) pressure in relation toCommon Area Mall.

10.Temperature Controls: Tenant must utilize LLapproved EMS contractor to connect to Mall EMSSystem.

11. Test & Balance: Tenant shall employ a TAB,NEBB or AABC Certified Air Balance Contractor toperform final testing and balancing.

Landlord provides a four (4) pipe hydronic loop chilled/hot watersystem with 3” chilled water and 1-1/2” heating water supply andreturn taps for most Tenants. Landlord also provides a commongravity outside air duct and relief ducted sized for Tenants fulleconomizer requirements. Tenant’s Engineer is required toaccommodate conditions that may affect the performance of theHVAC system for their store.

• Equipment: Tenant to provide air handler unit (AHU) designedwith CW coil-EWT/LWT of 46/56 °, minimum 6 row coil with 2-way valve. HW coil with EWT 140-180 ° and 40 Delta-T, 2-wayvalves. Heating coils to precede the cooling coils. Tenant toinclude freeze stat in design. AHU design must include mixingbox for return and outside air with modulating damper on OA.

• Condensate Drain: Condensate to be piped to a Landlordapproved termination location within Tenant space.

• HVAC Load Calculation: Tenant’s Engineer is to submit adetailed computer generated load calculation to justify requestfor CW/HW, and submit documentation to Landlord depictingTenant mechanical system design complies with local energycodes.

• Return: Plenum (Ducted return is for odor production Tenantsonly and subject to Landlord approval). Tenant with open ceilingdesign will be required to provide jumper ducts between transferair openings.

• Outside Air: Landlord provides common gravity outside air ductfor Tenants full economizer requirements. Tenant to connectfrom Landlord OA duct to Tenant AHU mixing box

• Relief Air: The Landlord has gravity relief vents in roof withductwork air intakes above ceiling.

• Transfer Air: Tenant to provide transfer air openings in thedemising wall to transfer relief air to Landlord designated gravityrelief vent. Tenant to size openings to obtain 400fpm air flow fromTenant space to designated relief vent.

• Toilet Exhaust: Landlord has provided a central toilet exhaustsystem; 200 CFM per Tenant typical. Tenant to provide fan andductwork from their toilet room to the Landlord provided centralduct. All make-up air for Tenant toilet exhaust shall be fromTenant AHU.

• Odor, Thermal & Process Equipment Exhaust: Odorproducers, (pets, hairstyling, manicures), must maintain aminimum of (15%) negative air pressure between their space andthe mall.

• Non-Odor producing Tenants: Shall design ventilation systemto maintain a positive (15%) pressure in relation to Common AreaMall.

Vapor removal system materials shall be new and designedfor the intended application in accordance with engineeringdata. Vapor system shall conform to all applicable laws, codes,ordinances and governing regulations, including but notlimited to the following:

TYPICAL ROOF OPENING, CURBINGAND SPECIFICATIION1. Roof membrane cutting, flashing and cutting roof deck must beperformed by Landlord approved Roofing contractor at Tenantexpense. Tenant’s contractor must contact Mall managementoffice prior to commencement of work. All other work, such as,miscellaneous steel, welding must be performed by Tenant’scontractor. Wood block-type supports set directly on the roofmembrane will not be permitted.

2. Submittals shall include three (3) installation drawings ofstructural support steel prepared by a Licensed Engineer andforwarded to the Landlord’s Tenant Coordinator prior to workcommencement.

3. Abandoned equipment located over the Premise must beremoved by Tenant. Existing roof curbs not scheduled for re-useby the Tenant shall be removed by Landlord approved Roofingcontractor at Tenant expense.

4. Tenant’s Engineer shall submit dimensioned sketch of allsurrounding existing roof-top equipment for Landlord review andacceptance. Submittals shall include details of roof supports for allexterior piping including a roof plan of proposed routing forLandlord’s review and acceptance.

5. The top of roof curb must be a minimum of 18” above theexisting roof. Refer to Appendix Drawing for requirements ontypical roof mounted exhaust fans.

6. Tenant’s contractor shall be responsible to obtain and secure aHot Work Permit(s) from Landlord. A Hot Work Permit is requiredfor any and all open flame welding or cutting such as but notlimited to welding, soldering, and brazing.

1. Typical water and sewer connections provided by Landlord to thePremise are as follows: Cold water supply @ 3/4”, Sanitary stub @4”, Sanitary vent @ 3”. If Tenant’s requirement(s) exceed theexisting connections provided by Landlord, the Tenant’s plans shallreflect such modifications for review and approval by Landlord. Anyand all such modifications shall be performed by Landlord’scontractor at Tenant’s expense.

2. All saw cutting of the floor slab shall be by Tenant’s contractor,after advance written notification is submitted to Landlord’s Engineerfor approval.

3. Tenant shall furnish and install an electric water heater. Waterheater shall be UL listed and approved. The relief valve shall bepiped to an open drain.

4. Food Preparation Tenants shall provide at least one floor sink withintegral sediment bucket in each kitchen and/or food preparationarea with accessible cleanouts as required by applicable codes.Cleanouts shall terminate flush with the finished floor or wall. Tenantshall install an accessible cleanout prior to the entry to Landlord’ssanitary main within the Premise.

5. All waste piping designed and installed for the drainage of greaseproducing fixtures as defined by the Plumbing Inspector and/orLandlord’s Engineer, such as pot sinks, dishwashers and kitchenhood grease drains, shall discharge through an approved Tenantprovided, mechanical grease recovery unit(s) with sediment strainerprior to connection to the Landlord’s sanitary system. The Tenantmust comply with all local codes and Landlord requirements forinstallation and maintenance of grease recovery units. Greaserecovery units must be installed within Tenant's Premises and abovethe finished floor.

7. All Tenant applications using chemical processes, such as photofinishing, dental facilities, or as otherwise determined by theLandlord, must pre-treat. All wastewater to meet the requiredstandards and regulations before discharge to Landlord’s sanitarysystem.

8. All piping systems must be compatible with the type of materialsused by Landlord and shall comply with the following requirements:

a) Drainage, Vent Pipe and Fittings: Below grade service shallbe bell and spigot, cast iron pipe and fittings with rubber gaskets.Above grade service shall be hubless cast iron pipe and fittings.Joints shall be rubber sealing sleeve and stainless steel couplingwith stainless steel clamps and bolts as manufactured by Tyler Pipeor equal. Pipe and joining couplings must be produced by the samemanufacturer. Copper drain, waste and vent piping is acceptableabove Tenant's floor elevation. Plastic pipe will not be permitted.

b) Domestic Water Piping: All water piping shall be Type Lcopper tube, seamless drawn, hard temper with plain endscompatible with plastic pipe will be permitted. Fittings shall bewrought copper with socket ends with lead- free ASTM 95/5 tin-antimony. Tenant's plumbing contractor will be required to certify toLandlord that all equipment and installation is lead-free incompliance with Federal Drinking Water Standards. All valves fordomestic water use must be rated at 125-psi test.

c) Tenant shall install air chambers or shock absorbers in pipingsystem to prevent noise and damage due to water hammer. Branchpiping shall include accessible service valves and shut off valves toall fixtures.

d) Tenant shall provide dielectric fittings at all junctions ofdissimilar metal.

9. Pipe must be supported securely from hangers asfollows:

a) Where required, and with Landlord’s approval,Tenant's plumbing contractor is responsible to installadditional intermediate structural supports for hangers.

b) Hangers must not pierce insulation vapor barrier.c) Cast iron pipe must be supported at least every

five (5) feet and at every joint and fitting. Cast iron pipebranches without support must have hangers installeda maximum of four (4) feet on center.

d) Non-insulated copper pipe must be installedwith either copper or plastic coated steel hangers.

10. Tenant shall furnish and install a water meterincluding remote readout, of size and type approved byLandlord and at a location designated by theLandlord’s Engineer.

11. All Tenants are required to install, test and maintainbackflow prevention devices in series after the watermeter. No bypass is permitted. Tenant applicationssuch as, but not limited to, food service, hair styling,photographic reproduction, pet shop; must install aWatts 009 Series reduced pressure zone (RPZ)backflow pressure device. All other Tenants shallinstall a Watts 007 Series double check valveassembly.

12. Pipe Insulation:a) All hot water piping and piping subject to condensation,

including cold water and condensate drain piping, must beinsulated.

b) All insulation shall be fire and smoke hazard rated astested by procedure ASTM E-84, NFP 225 and UL 723 andmust not exceed a flame spread rating of 25 and smokedeveloped rating of 50. Glass fiber insulation shall be of thetype having a 4.0 pound density and a k-factor of 0.25, oneinch minimum.

c) Insulation hangers shall be protected by a section ofcompressed glass fiber insulation with a metal saddle on theoutside of the insulation.

d) All exposed and concealed insulated piping is to havean all service jacket similar to Owens-Corning FiberglassASJ25 with self-sealing lap and joint sealing strips.

e) Pre-molded insulated fittings shall be of the samematerial and thickness as the pipe insulation. ProvideZeston PVC jackets or equivalent and must not exceed aflame spread rating of 25 and smoke developed rating of 50.

f) All vapor barriers are to be continuous and completelysealed against moisture penetration.

13. Tenant applications such as, but not limited to, foodservice, hair styling, pet shop, or as otherwise determined bythe Landlord, shall be required to install waterproof floormembrane system(s).

PLUMBING – Retail – CON’T14. Hot Work Permit: Tenant’s contractor shall beresponsible to obtain and secure a Hot Work Permit(s) fromLandlord. A Hot Work Permit is required for any and allopen flame welding or cutting such as but not limited towelding, soldering and brazing.

15. For all new installations of bathrooms, water closetsmust be wall-mounted per Upper Merion Township effective5/5/2006.

ELECTRICAL – Retail

1) Voltage: 277/480 volt, 3ph, 4-wire, plus full size ground,60 Hertz for all Tenants.

2) Landlord Equipment: Landlord provided electrical bus-ductor electric room distribution system with conduit sized byLandlord and pull wire to Tenant space. Feeder cables areby the Tenant. Tenant to provide bus-plug in designated busduct or circuit breaker in Tenant distribution switchboard.Tenant o use Landlord designate electrician to land Tenant’sfeeders into Landlord panels.

3) Power Redistribution by Landlord.

4) Metering: Tenant shall furnish and install a Landlordapproved electric meter in Landlord provided meter socket.

5) Capacity: Tenant maximum connection is 20 watts per squarefoot. Submit connected and demand electrical load calculations tosupport electric service size requested.

6) Telephone/Data: Landlord provides a 1” conduit sleeve only thrurear demising wall into Landlord Service Corridor and a designatedpath of travel to a central connection point. Tenant provides allwiring.

7) Fire Alarm: Landlord will provide a junction box within Tenantspace connected to mall integrated fire alarm circuit. Tenants arerequired to provide system appliances within their premises andconnect them to the Building Fire Detection / Emergency voicecommunication system within their premises at Tenant expense.The Fire Detection/Emergency voice communication system designmust comply with the current enforced Pennsylvania State BuildingCode and NFPA-72, Americans with Disabilities Act, and the NationElectrical Code.

8) The final connection of Tenant appliance wiring to the BuildingFire Detection/Emergency voice communication system includingprogramming and testing: This connection must be performed bythe Landlord approved Building Alarm System Contractor at TenantExpense. All appliances must be compatible with Landlord system.

9) All tenant sound systems must be interlocked with the BuildingEmergency voice communication system so that the Emergencysystem can override the Tenant System.

10) Nameplates: Tenant’s equipment such as, but not limited to,main service disconnect, meter, if applicable distribution panel,boards, motor starters and roof mounted equipment shall be identifiedwith individual permanent nameplates.

NATURAL GAS

1. Natural gas service will be available only to restaurantTenants, at Landlord’s discretion. The installation thereof, ifapproved by Landlord, shall be subject to such conditionsof use as Landlord may impose. Gas service, if approved,my be used for food preparation only. Flues will not bepermitted. Installation of pressure-reducing station, ifrequired, and piping from point of service on Landlord’sroof shall be by Tenant at Tenant expense. Installationshall meet all AGA and PECO energy standards. Any andall roof penetrations shall be performed by Landlordapproved roofing contractor at Tenant expense.

2. At the Landlord’s discretion, natural gas service, will bemade available from either the Gas Main installed on theroof or to the utility gas distribution manifold. Distributionpiping from the discharge side of the Tenant provided gasmeter, regulators, and related miscellaneous equipmentrequired to make for a complete approved system will bethe sole responsibility of the Tenant who will bear allassociated installation costs and fees (including all permitsand inspection fees related to said installation). Tenantshall perform gas test as required by the gas utility andhave witnessed by Landlord Representative.

3. The Tenant will be responsible for obtaining all necessaryapprovals prior to the installation of any piping, includingapproval of the utility company, Landlord InsuranceUnderwriter and Landlord Engineer.

4.The gas piping installation shall be installed inaccordance with NFPA Standard No. 54 “National FuelGas Code”, and the rules and regulation of the utilitycompany and any other local and state agency involvedin the regulation of this type of installation.

5. Exterior gas piping shall be either galvanizedSchedule 40-with galvanized malleable iron 150 PSIGfittings or Schedule 40 with black steel pipe with high-density polycoat with welded fittings. Field appliedpolycoat must be applied to any bare metal.

6. Tenant’s Engineer is required to confirm the location ofLandlord designate gas service, available capacity, anddelivery pressure.

7. Provide Micro Industries (Midvale, Utah 1-801-566-3680) Model # 02 pillow block pipe stand for gas pipingon roof. Supports shall consist of a nylon roller situatedin a PVC scat with a self-lubricating Teflon base and athree (3) pipe support of rigid PVC.

8. Automatic gas shut-offs are required.

ENTRANCE DOORSSwinging doors shall not project beyond the face of theentry construction or into the Mall common area. Doorsmust lock in the open position during business hours withdust proof strikes and recessed floor locks for both openand closed positions. If incorporating a glass pivot doorsystem, a minimum of ½” thick, tempered glazing shall beutilized and shall be in compliance with manufacturer andstructural recommendations.

Overhead rolling grilles and sliding glass door systems withfloor tracks are not permitted. Sliding grilles (if approved bythe Landlord) may be considered only for special use suchas jewelry stores on a corner location with storefrontopenings greater than 20’-0” wide.

STOREFRONT BASESThe storefront base shall be a minimum of six inches(6”) in height. The base shall be constructed fromhighly durable non-porous material such as stone, tile,substantial gauge metal with a powder-coated finish,stainless steel, or other material that can withstandcontact with cleaning equipment and solutions. Tenantmay extend glazing to floor utilizing a fully recessedglazing channel where trenching of the floor slab ispermitted by Landlord.

STOREFRONT STRUCTURAL SUPPORTDo not weld, drill, screw, or shoot into Landlord structure.Use clamps or compression techniques. All storefront workrequiring structural support shall be supported at the headsections by a welded structural steel framework provided byTenant. All storefront framing shall be structurallyindependent of Landlord bulkhead and self-supporting fromthe Tenant floor slab. Tenant may connect to Landlordbulkhead for finish purposes only, and to Landlord structuralmembers for lateral bracing only (refer to “StructuralRequirements”).

ENTRY FLOORUnless otherwise approved by Landlord, the Mall floorfinish material shall be extended into Tenant entranceopening to the rear of the most prominent storefrontdesign element (usually, beyond the door to the rear of theentrance ceiling).

If Landlord permits the use of an entry floor materialother than the Mall floor finish, said material shall behard surface, high quality, and durable such as stone,marble, or ceramic tile. It will be closely reviewed forapplication, durability and visual impact with respect toquality of appearance. Wood flooring directly in the entryis discouraged. Faux wood products are not permitted asan entry floor. All wood flooring shall have a minimum of1/8” thick wear layer. The finished floor elevations at theentrance must be level with the finished floor elevation ofthe Mall.

Tenant shall provide a metal embedded transition stripflush with the hard surface flooring at all transitionsbetween different floor finishes. No trip hazards such asreducer strips, thresholds, or other noticeable transitiondevices shall be permitted between different floor finishes.

Vinyl and/or rubber resilient flooring or sealed/stainedconcrete systems are not permitted as entry flooring or inthe Design Control Zone.

TENANT SERVICE DOORUnless existing, Tenant shall be responsible toinstall, finish, and maintain in good repair a servicedoor. The door and surrounding wall surface shallbe finished and sized to match Mall standards.

When the service door is to be installed in a CMUwall, the opening shall have a steel angle lintelheader and metal corner guards at the jambs.

The existing exterior door location shall not bealtered by Tenant without prior written approvalfrom the Landlord.

The Landlord has established standard servicedoor signage for each Tenant service door. Noadditional signage shall be permitted unlessapproved by Landlord.

SHOW WINDOW SAFETY LOGOSRepetitive safety symbols (graphically designed)or lettering may be applied to the inside face ofstorefront glazing as approved by Landlord foridentifying transparent surfaces for customersafety purposes. Emblems, logos, and letteringmust not exceed 4” in height.

Typical interior wall construction is to be composed of non-combustible metal stud framing sized per structuralrecommendations, with 5/8” type ‘x’ gypsum board, taped,spackled, sanded, and finished.

Metal stud framing shall extend up to the structure aboveas required so the wall is adequately braced andsupported. Entire perimeter and penetrationsthrough demising walls shall be fire sealed per UL ratingrequirements. Do not attach directly to Landlord’s roof deck(refer to “Structural Requirements”).

Prohibited Wall Construction:

Asbestos containing materials, fiberglass,formaldehydes or any other known hazardousmaterials are prohibited.

Tenant/Tenant’s contractor shall provide 5/8” Type “X”gypsum board on Tenant’s side of Landlord’s bulkheadto structure above. Closure shall be smoke tight.

• Single-color, low-profile, all-loop carpeting in the SalesArea.

• Vinyl tile or any other sheet goods flooring (such asrubber flooring) in the Sales Area.

• Simulated materials, such as simulated wood, of anykind.

• Slick or slippery finishes that may lead to falling.• Painted, stained, or exposed concrete (unless

otherwise expressly approved by Landlord in Tenant’slease)

• No rubber/vinyl wall base is permitted in the sales area.

All transitions between floor finishes of unequalthickness shall be accomplished by a gradualtransition with floor leveling compound to create asmooth and level walking surface. Trippinghazards such as carpet trim strips and reducertrim strips are not permitted.

Carpeting, if used in the sales areas, shall be of thehighest quality. Commercial grade high quality cutpile or loop/cut pile combination is required.The reuse of any existing floor finish is strictlyprohibited.

Prohibited Floor Finishes:

TENANT DISPLAY FIXTURES, RACK/SHELVING/STORAGE UNITREQUIREMENTSTenant display fixtures in the retail space and rack/storage units in the stockroom must be designed toprovide adequate clearance for the automatic (fire)sprinkler system. No displays or storage shall exceed12 ft. and ceilings must be installed to provide at least18 in. of clearance between the top of the storage andsprinkler deflectors.

Tenant displays or storage higher than 12 ft. areclassified as “high piled storage”, which requires highhazard automatic (fire) sprinkler protection designedper FM Global Loss Prevention Data Sheet 8-9 andNFPA-13-Chapter 12 for the storage of “Group APlastic” commodities. High piled storage also requiresat least 36 in. of clearance between the top of storageand sprinkler deflectors.

Tenant mobile (compact) storage systems shallbe constructed of wire mesh shelves. However, ifconstructed with solid (steel, wood), the units must beequipped with 3 in. spacers to provide flue spaces at 4ft. to 5 ft. maximum intervals.

WATERPROOFING MEMBRANEIf the premises concrete slab is not on grade, Tenantshall install a waterproofing barrier membrane, inaccordance with Landlords specifications, in all areasthat may be exposed to fluids or liquids including, butnot limited to, restrooms, food preparation andservice areas, laundry and dry cleaning areas, andphoto processing areas. Waterproof membrane shallextend 6” up all adjacent walls. All drains must beaccessible and have cleanouts.

The Tenant shall sleeve, fire-stop, flash and caulk allpenetrations so as to provide an adequate seal. Referto the required waterproofing specifications includedas part of the Tenant Information Package.

Each Tenant space wet area will be required to undergoan on-site, four-hour flood test to be performed by theTenant contractor while witnessed and documented byLandlord Representative.

If Tenant currently occupies any portion of the premises,or, if any portion of the premises was previouslyoccupied by a former Tenant, Tenant shall remove allprevious floor penetrations not intended to be re-used,patch & repair the floor to original condition and re-sealall remaining floor penetrations to be re-used utilizingLandlord waterproofing specifications.

INTERIOR CEILING CRITERIAPainted gypsum drywall ceilings or other hardpanceilings are required. Open to deck type sales areaceilings and acoustical tile ceilings are not permitted.Other ceiling treatments or finishes (such as woodor metal) will be reviewed by Landlord and may bepermitted if they are an integral part of Tenant’s overalldesign concept.

Hard surface ceilings shall have individual accesspanels to allow access to Landlord’s and Tenant’ssystems.

All ceilings and associated framing, furring, and blockingshall be non-combustible UL approved materials.Absolutely no wood of any kind shall be used above anyceiling or soffit, including fire retardant treated woodblocking.

Ceiling heights within the Premises may be restricteddepending upon field conditions. Tenants are encouragedto use a variety of ceiling heights throughout their space.

All ceiling construction is to be properly supported tostructural members only (refer to “StructuralRequirements”).

Soffits are to be supported solely by a wire suspensionsystem and must be properly braced to the structure (referto “Structural Requirements”).

GENERAL CONSTRUCTION & STRUCTURALREQUIREMENTS SUPPLEMENTALSTRUCTURAL FRAMING

Supplemental structural support framing shall bedesigned by a licensed structural engineer employed byTenant to adequately support the Tenant’s suspendedequipment within the Premises.The Landlord may require that engineering analysis,review, or design be performed by Landlord’s engineerat Tenant’s expense.

STRUCTURAL ALTERATIONSNo alterations, additions, reinforcements, ormodifica- tions to Landlord’s structure toaccommodate Tenant’s work shall beperformed, without obtaining Landlord’s priorwritten approval.

The Landlord may require that approvedstructural or mechanical/electricalmodifications be performed by theLandlord’s contractor and/or engineer undercontract to Tenant at Tenant’s expense.

MEZZANINE STRUCTURES (IFAPPROVED BY LANDLORD INTENANT’S LEASE)

Mezzanine structures within any Tenant spaceshall require review and approval in writing bythe Landlord’s structural engineer at theTenant’s expense. All mezzanines shall bedesigned to be self-supporting and meet allapplicable design standards, requirementsand codes.

Prior to the preparation of Tenant plans, Tenant shall visitthe premises to verify existing conditions andconstruction and to ensure that none of the Tenant workwill be in conflict with any existing Landlord or adjacentTenant improvements and construction.

Tenant shall schedule and sequence all drawingsand construction activity to allow the premises to beopen for business as required in Tenant Lease. Thefollowing timelines are minimum requirements and donot alter or waive Tenant obligation to open thepremises as provided in the Tenant Lease.

PRELIMINARY DRAWINGSif Tenant is to submit Preliminary Drawings showing theintended design of the store the submission should include,but not be limited to, the following:a) Floor plan and fixture planb) Storefront elevation and interior elevation.c) Section drawing through storefrontd) Reflected ceiling plane) Color rendering of storefront or photos of Tenant

Tenant’s final Plan submission shall be prepared in strictcompliance with this Landlord Design Criteria as set forth inthe Tenant Information Package and shall adhere to theTenant “Approved” or “Approved as Noted” Preliminarydrawings.

Working drawings shall include, but not be limited to, thefollowing:a) Floor plan, fully dimensionedb) Item and fixture layoutc) Section drawingsd) Reflected ceiling and lighting plane) Elevations and sections of storefront, storefront signs, and any

special conditionsf) Sections and details of types of partitions usedg) Door schedule with jamb detail to include a list of hardware

Sigange shop drawings shall also be submitted for Landlordreview in accordance with the requirements outlined onpage 41 of this criteria entitled “General Sigange Criteria”.

All Tenant work shall comply with authorities,agencies, or entities having jurisdiction over thepremises, including the Building Department, FireDepartment, local utility company, HealthDepartment, Fire Insurance Underwriter, and theLandlord. All construction shall comply with therequirements of application codes and laws,including accessibility requirements.The Landlord does not review the Tenantdrawings for compliance with Building code oraccessibility requirements. It is solely the Tenantresponsibility to ensure compliance with thesecodes and the requirements of jurisdictionalauthorities. Tenant shall have sole responsibilityfor compliance with all applicable statutes,codes, ordinances, and other regulations for allwork. In those instances where multiplestandards and requirements apply, the strictestof such standards and/or requirements shallcontrol unless prohibited by applicable code.

Landlord approval of Tenant drawings iscontingent upon Tenant compliance withLandlord comments and shall not be construedso as to hold Landlord liable for either theArchitectural or the Engineering design of thepremises or the accuracy of the informationcontained in Tenant drawings. Should anyconflict arise between the Tenant drawings andthe Tenant Lease, the applicable portion of theTenant Lease shall be determinative. Landlordapproval of Tenant drawings will in no way alter,amend, or waive the requirements or criteria ofthe Tenant Lease. The Tenant shall beresponsible to conduct a site visit of thepremises for the purpose of verifying the existingconditions and construction of the premises.Landlord review or approval of Tenant drawingsdoes not represent a confirmation or verificationof any existing condition at the premises. Theexistence of a particular condition on otherspaces or improvement at the Mall does notimply acceptance by the Landlord. Newimprovements are expected to comply with thecurrent design criteria and the Mall standard.
