Widely held as one of Southern Nevada’s most admired attorneys, Joseph L. Benson is the President and Senior Partner of Benson, Bertoldo, Baker & Carter, Chtd. Regardless of his position, Mr. Benson is universally known as “Joe.”

Joe, a high school All-American quarterback from Paducah, KY, attended the University of Nebraska-Omaha on a football scholarship. Upon graduating with a Bachelor of Arts Degree, Joe entered the United States Air Force.

After serving in Vietnam in 1970, Joe was assigned to Nellis Air Force Base as commander of the Office of Special Investigations (OSI) detachment. Joe was later selected to attend law school on a highly competitive Air Force program and attended the California Western School of Law in San Diego, CA. Upon graduation from law school, Joe was assigned to the JAG office at Nellis Air Force Base where he served both as a criminal prosecutor and defense counsel. After serving 12 years in the Air Force, Joe resigned his regular commission in 1978 and began private practice as a civilian attorney in Las Vegas, NV. He remained in the United States Air Force Reserves and ultimately retired after serving eight additional years.

A respected resident of Nevada, Joe served as President of the Nevada Federal Credit Union and was on the Board of Directors for 14 years.

In 1979, Joe founded the law office that eventually evolved into Benson, Bertoldo, Baker & Carter, Chtd. Since 1979, he has practiced law with an emphasis in the areas of personal injury, aviation accidents, medical malpractice and wrongful death. A skilled negotiator, Joe is a certified Eighth Judicial District Court Arbitrator.

Joe is a member of the Million Dollar Advocates Forum, a prestigious group of attorneys nation-wide who have obtained a verdict or settlement in excess of a million dollars. Early in his legal career, he obtained a structured settlement in the amount of nine million dollars for two children who lost their mother and father in a Pan Am crash in New Orleans. Since this time, Joe has amassed settlements in excess of a million dollars on numerous occasions. He is a recipient of the NTA Lifetime Achievement Award for 2012.

John Bertoldo has been a practicing attorney in the State of Nevada since 1985 and has been an effective managing partner at Benson, Bertoldo, Baker & Carter since becoming a partner in 1992. After high school, John served a volunteer two-year mission in Italy for the Church of Jesus Christ of Latter Day Saints and remains fluent in Italian. John received a Bachelor of Arts Degree in English from Brigham Young University followed by a joint Juris Doctor and Master of Business Administration, also from Brigham Young University. John practices exclusively in the area of plaintiff ’s personal injury, with special emphasis in the handling of medical malpractice, brain injury and wrongful death cases. In 1997, he became a member of the Million Dollar Advocate Forum, a prestigious group of attorneys nationwide who have obtained a verdict or settlement in excess of a million dollars. John’s most notable case was a $19.5 million verdict in 2001, where he teamed with partner Steve Baker on behalf of a lovely young lady who suffered a catastrophic brain injury after being hit by a Republic Silver State garbage truck.

John has served as a member of the Medical Dental Legal Screening Panel of Southern Nevada, and the Southern Nevada Disciplinary Panel of the State Bar of Nevada. He is also a member of the following organizations: Clark County Bar Association, Nevada Justice Association, American Association for Justice, Nevada Society of Italian American Lawyers, The Western Trial Lawyers Association, and The Nevada Law Foundation. Steven Baker is a highly experienced civil attorney who has spent his entire career representing injury victims. Steve received his Bachelor of Arts degree in Literature from the University of California, San Diego. While obtaining his undergraduate degree, he worked as a field representative for the “Voter Revolt”, a grass-roots movement that opposed insurance industry backed legislation. He went on to study law at Pepperdine University, where he earned his Juris Doctorate.

After being admitted to the Nevada State Bar, Steve joined Benson & Bertoldo as an associate attorney, where he practiced with an emphasis in plaintiff ’s personal injury law. He has appeared in the Federal, Supreme, District, and Justice Courts of the State of Nevada, in addition to several local courts of special jurisdiction. Steve has also appeared in the Ninth Circuit Court of Appeals, Trial and Bankruptcy Courts in the State of Arizona, as well as, Trial Courts in both California and Oregon.

In 1997, he became a partner with Benson, Bertoldo & Baker. Steve was the 2010 President of the Nevada Justice Association. He also serves on the Board of Citizens for Justice, the Nevada Foundation for Consumer Education, and Young Isreal Aish of Las Vegas. He is a past member of the Clark County Bar Association Legal Education Board, a past Co-Chair of the CCBA Community Service Division, a past Senior Attorney for the Trial by Peers Program and a Big Brother in the Big/Little Brothers Program. He also served on the Southern Nevada Medical Legal Screening Panel and has been selected as a Colleague of the Nevada Law Foundation. Like all partners of Benson, Bertoldo, Baker & Carter, Steve is a member of the Million Dollar Advocates Forum. In 2009 and 2010, he was selected as a Mountain States Super Lawyer. Brett Carter is a partner at Benson, Bertoldo, Baker & Carter, having joined the firm in 1996. He received a degree in Business Administration from the University of Nevada, Las Vegas, and then graduated with his Juris Doctorate from the Willamette University School of Law. During his studies at Willamette, Brett also attended William and Mary Law School’s inter-national studies through the University of London-Exeter.

Brett has chosen to devote himself solely to the practice of personal injury law, particularly vehicular negligence, premises liability, medical malpractice, nursing home negligence, products liability and negligent security. His practice ranges from those individuals who have suffered relatively minor injuries to those who have had their lives permanently and catastrophically altered as a result of another’s negligence. Lawrence J. Smith is a Partner at the firm. He was born in Urbana, OH. He served in the United States Air Force for three years, stationed at Nellis Air Force Base, Las Vegas, NV.

Larry received his B.A. from University of Nevada, where he graduated Summa Cum Laude. He then went on to achieve his J.D. with an emphasis in civil litigation from Baylor School of Law.

Larry has specialized in the area of product liability, an area of law wherein individuals are injured as the result of a defectively designed or manufactured product, and has numerous multi-million dollar settlements and verdicts as a result of product liability cases. Larry also concentrates on jury trials and works with the other attorneys in the Firm when, and if, it becomes necessary to present a case before a jury.

Larry is a member of the Million Dollar Advocates Forum, the College of Advocacy Hastings College of the Law, and the Nevada Trial Lawyers Association. He is licensed to practice in the U.S. District Court and all courts in the State of Nevada. His practice involves personal injury.

Worker’s compensation laws are designed to protect employees who have suffered from work related injuries. Before worker’s compensation was available, employees injured on the job were only able to pursue their employer through civil or torts law. Under Nevada worker’s compensation laws, employees injured or disabled are provided with fixed monetary awards, eliminating the necessity for expensive litigation.

An employer is required by law to carry worker’s compensation insurance. Should a Las Vegas or Nevada employee become injured or ill due to circumstances surrounding their working conditions, the employee might be entitled to benefits. These benefits could include medical expenses, lost wages, vocational rehabilitation, and death benefits for the surviving family members. Sudden physical damage to the brain is referred to as traumatic brain injury. Car accidents are a leading cause of head and brain injuries. Javier A. Arguello is a graduate of the University of Southern California. He received his J.D. from the Santa Clara University. Javier worked in both private practice and for the State Industrial Insurance System/Employer’s Insurance Company of Nevada during which he also served as chief counsel for EICN. During his six years with the State Industrial Insur-ance System/Employee Insurance Company, Javier argued numerous successful cases before the Nevada Supreme Court.

Javier formerly represented insurers, employers and self-insured employers in worker’s com-pensation and related issues. Among the clients he represented are all areas of the construc-tion industry, municipalities, manufacturers, grocery stores, department stores, hotels, casi-nos, transportation companies and health care organizations. Javier is currently a member of the State Bar of Nevada and the Clark County Bar Association, as well as a member of the State Bar of California. He is also admitted to practice in the Federal District Courts for Nevada. Since joining Benson, Bertoldo, Baker & Carter in 2006, Mr. Arguello has been leading the Worker’s Compensation Department. In February of 2013, he again argued suc-cessfully before the Nevada Supreme Court in the Case of Williams v. United Parcel Services. His background and expertise to handle difficult cases makes Javier one of the top profession-als to represent the injured worker.

Autumn was born and raised in Las Vegas, and is a three time graduate of the University of Nevada Las Vegas. She first graduated from UNLV in 1993 with a Bachelor’s in Communication Studies. In 1995, Autumn returned to UNLV to pursue her Master’s Degree, and in 1996 began teaching for the Fine Arts and English Departments at the Community College of Southern Nevada. She received her Master’s Degree in Organizational Communications in 1997.

Autumn received early acceptance into the Charter Class of the William S. Boyd School of Law. While at Boyd, Autumn served on the Editorial Board for the Nevada Law Journal, was a founding member of the Honor Code Committee, received the CALI award in Torts, and assisted in researching, writing and developing a new course of study in the field of Products Liability including the changes made by the Third Restatement of Torts (1998) dealing with strict liability. Autumn was also fortunate to be selected to serve as an extern for U.S. District Court Judge Roger L. Hunt. Autumn was one of five students to graduate early in December 2000.

Upon graduation, Autumn went to work for the Civil Division of the Clark County District Attorney’s office, followed by a career in complex litigation including insurance, employment, products liability, wrongful death and construction defect law. Autumn then had her own practice where she focused exclusively on plaintiff ’s personal injury law including car accidents, premises liability, and injuries caused by defective products. She now joins Benson, Bertoldo, Baker & Carter where she continues her work as a personal injury attorney. She is also an Adjunct Professor at CSN where she teaches public speaking.

Autumn is a member of the Nevada Bar Association, the Clark County Bar Association, the American Bar Association, the Nevada Justice Association, and the Southern Nevada Association of Women Attorneys. Autumn is licensed to practice in the State Court of Nevada and the District Court of Nevada.

Autumn continues to reside in Las Vegas and enjoys spending time with her family. She is actively involved in the lives of her nieces and nephew and donates her time to St. Fancis De Sales as well as several local charitable organizations including Safe Nest, Habitat for Humanity, and Three Square. In her free time, Autumn enjoys international travel, sailing and live music.

Robert S. Cardenas received his Bachelor of Arts Degree from the University of Memphis, graduating Magna Cum Laude, in 1997. Rob received his J.D. from the University of Memphis in 2000.

Rob hails from a strong defense background, having defended attorneys in legal malpractice actions, insurers in extra-contractual (“bad faith”) matters and insureds in third-party matters. Rob has successfully completed several jury trials and has represented both Plaintiffs and Defendants in negotiations, settlement conferences, mediations and arbitrations.

Rob is currently a member of the State Bar of Nevada, American Bar Association, Clark County Bar Association, and Sustaining Member of the Nevada Justice Association He is admitted to practice in State and Federal Courts in Nevada, as well as the United States Court of Appeals for the Ninth Circuit.

Rob became a member of the Million Dollar Advocates Forum in 2007, was named a Mountain States Rising Star by SuperLawyers.com in 2010, and in 2012 was named “Top 40 Under 40” by The National Trial Lawyers. In 2013, Rob was named Top 100 Trial Lawyers by The National Trial Lawyers, and in 2014 he received a BV Distinguished rating from Martidale-Hubbell.

Rob lives in the Las Vegas area with his wife, Lisa, and their two children Riley Simone and Cameron Chase.

Lindsay is a graduate of the University of Nevada, Reno, where she earned a B.A. in Criminal Justice with Highest Distinction Honors. Prior to law school, Lindsay worked for the Founder of E-Bay, providing risk management and executive protection services. She also worked for former Governor of Nevada, the late Kenny Guinn, in the Homeland Security Division.

Lindsay attended Golden Gate University, School of Law in San Francisco, California. She was a faculty merit scholar and named to the Dean’s List in consecutive semesters. In addition to her Doctor of Jurisprudence, she earned a Specialization in Business Law with Distinction.

Lindsay is dedicated and committed to helping those who have experienced injury or loss by the carelessness of another. Through tireless advocacy, she has successfully represented individuals and their families in serious personal injury, medical malpractice, wrongful death, premise liability and product defect cases. Prior to joining Benson, Bertoldo, Baker & Carter in 2013, she was an associate with White and Wetherall, LLP, a plaintiff ’s personal injury law firm. She is currently licensed to practice law in Nevada and California.

Concurrent to her law practice, Lindsay serves on the Golden Gate University Alumni Association Board of Directors. Lindsay was named Golden Gate University Volunteer of the Year, 2011, for her extensive work with an alumni program, Griffin Connect. She is also an active member in numerous legal organizations, including the Nevada Justice Association, where she serves on several committees and co-chairs Club X, the Young Lawyer Division of the organization. She is active in the National Trial Lawyers Association, American Association of Justice, where she serves as the Southern Delegate for the State of Nevada and participates in the Women Trial Lawyers’ Caucus.

In her spare time Lindsay enjoys running, hiking, traveling, volunteering and spending time with her family, especially her husband Paul and their Siberian Husky, Bella.
