1. SCARBOROUGH – MALVERN LRT PROJECT OVERVIEW

TTC provided an overview of the overall Transit City program, including description of the proposed technology, transit corridors, and a brief description of the Scarborough-Malvern LRT project.

Presently the Scarborough-Malvern LRT project is in the EA phase, with completion expected later this year. Given present Transit City project priorities, the Scarborough Malvern LRT is slated to be operational for 2018.

The first round of Public Open Houses for the Scarborough-Malvern LRT project is planned for July 23rd and 24th.

2. PRELIMINARY ALIGNMENTS AND TYPICAL SECTIONS

IBI Group outlined the following:

�� recommended corridor in the vicinity of the Highland Creek valley, specifically, Morningside Avenue and easterly along Ellesmere Road, in order to reach UTSC;

�� crossing of Highland Creek to consist either of an existing bridge widening to the east, or a new bridge structure on the east side;

�� proposed typical cross-sections at key points (i.e. mid-block along Morningside, near Ellesmere intersection along Morningside, mid-block along Ellesmere) that will be

o an at-grade alignment in the centre of the existing roadway, with widening of the existing roadway platform on both sides;

o an at-grade alignment in the centre of the roadway, maintaining the existing west edge of pavement, with widening of the existing roadway platform on the east side only;

o an at-grade alignment in the centre of the roadway, maintaining the existing east edge of pavement, with widening of the existing roadway platform on the west side only;

�� advantages and disadvantages associated with each alternative alignment.

IBI Group indicated that a key factor in the evaluation of the alternative alignments is the significance and sensitivity of the roadway platform widening on the natural environment (i.e. is impact to one side preferable to both sides, if one side was preferable). IBI Group to forward a copy of the alternative typical sections to TRCA for review and comment.

3. IDENTIFY KEY ISSUES AND OPPORTUNITIES

In general, TRCA did not offer any major concerns at this time, subject to the subsequent fieldwork / inventory to be completed by LGL and the TRCA staff.

Key points from general discussion included:

�� Highland Creek has been subject to major flooding / erosion / scour, and these issues (including meander belt) will have to be addressed eventually (TRCA indicated that detailed fluvial geomorphological studies for this section of Highland Creek has been completed by Parrish, and a copy will be provided);

�� IBI Group noted that the floodplain mapping provided by TRCA presented a discrepancy in elevations and boundaries between the Ellesmere Ravine and Highland Creek (TRCA to look into);

�� wildlife crossing impacts and potential mitigation will need to be reviewed for the final alignment (i.e. barrier effect, as deer crossing warning signs are present, and the extent of wildlife movement in the urban areas has increased).

4. CONFIRM TRCA REQUIREMENTS FOR EA STUDY

Following the reporting of the existing conditions (including fieldwork and site visits) and definition of the recommended alignment / crossing details, TRCA will be in a better position to identify any detailed study requirements. TRCA understood that these detailed studies may be commitments to do further work, and not necessarily be part of this study.

As agreed upon, the TRCA / TTC protocol is to hold a site visit before the first round of open houses. TRCA to provide TTC / IBI a list of dates in the next 2 weeks to hold a site visit, giving TRCA some time to do some desktop investigation / assessment. IBI / LGL to forward existing conditions / inventory to TRCA as soon as possible.

Toronto and Region Conservation Authority (TRCA) staff received the Draft Natural Heritage Report- Existing Conditions prepared by LGL Limited for the above-noted Environmental Assessment (EA)on September 10, 2008. TRCA staff also met on site with Greg Neill of LGL Limited on July 15, 2008.It is our understanding that the Toronto Transit Commission (TIC) is assessing ways to significantlyimprove transit service from the Kennedy Station (Bloor-Danforth subway line) to the Malvern TownCentre.

TRCA staff has completed its review of the draft Natural Heritage Report - Existing Conditions and issatisfied with the report findings. During detailed design, the following comments will have to beaddressed. Please ensure that a copy of this letter is included in the EA report.

1. The proposed LRT will run along Morningside Avenue and traverse several TRCA Programand Policy Areas including the Morningside Park Forest, Highland Creek Forest, and theHighland Creek Swamp. As explained on Page 5 of the draft report, the vegetationcommunities found in this area of Morningside Avenue form the largest remaining forestarea within the Highland Creek watershed. Thus, impacts to these sensitive features shouldbe minimized to the extent possible. Where impacts are inevitable, TRCA will require TIC tocompensate for losses through restoration/compensation activities to provide a no-net lossto the areas affected. Details of protection and restoration/compensation plans will beaddressed during detailed design.

2. Sections of the study area are located within TRCA's Terrestrial Natural Habitat System.During detailed design, staff will identify opportunities for incorporating TRCA restorationprojects into the overall natural heritage improvement activities for the study area.

3. A crossing of the Highland Creek is proposed along Morningside Avenue. Historic recordsfrom the Ontario Ministry of Natural Resource (MNR) and the TRCA indicate that Red SideDace (a species at risk) has been found in the Highland Creek and its tributaries. Thus, thefisheries timing window of July 1st to September 15th will apply to this project which meansthat all in- or near-water construction activities must be completed during this period.

Additionally, please note that Highland Creek is exceptionally flashy and prone to significantflows during relatively minor rainfall events which could have significant safety, constructionand ecological impacts. Please ensure that these issues are incorporated into the designand construction of the proposed project.

4. An erosion and sediment control plan for the entire area of disturbance will be required atdetailed design. Details of the TRCA guidelines for erosion and sediment control can befound in the GTA CA's Erosion & Sediment Control Guideline for Urban Construction(2006)". This document can be downloaded for free from TRCA's Sustainable TechnologiesEvaluation Program website - www.sustainabletechnologies.ca.

5. During previous meetings with TIC, potential wildlife impacts associated with the operationof the proposed LRT were discussed. In particular, TRCA expressed concerns aboutpotential deer crossings and road kills along Morningside Avenue. Please ensure that thisissue is incorporated into the proposed project.

6. A TRCA permit under Ontario Regulation 166/06 will be required for the proposed project.Please consult TRCA at detailed design to confirm permit requirements.

Please ensure that the TRCA receives project updates including the Notice of Study Completion,copies of the Draft EA Document (four hard copies); and, One hard copy and one digital copy of theFinal EA Document. The draft EA document should be accompanied by a covering letter whichuses the numbering scheme provided in this letter and identifies how these comments have beenaddressed.

1 Introduction

TTC/IBI provided an update of the project as follows:

� SMLRT is one of the TTC Transit City projects and is being undertaken under the new Transit Project Assessment Process.

� The second round of Open Houses is scheduled for mid-May 2009, with the Notice of Study Commencement under the new transit regulations being submitted shortly thereafter.

An updated draft Natural Heritage Report with the assessment of potential environmental impacts and the associated mitigation measures has been submitted to TRCA on March 26, 2009 for review. The report has addressed the comments that were previously received from the TRCA regarding the existing conditions report (October 2008), preliminary draft natural heritage report, site meeting, and progress meetings.

The purpose of the meeting was to present the preferred design concept and address any comments and concerns that TRCA may have, and obtain general consensus and approval for the project prior

to the final Open House and submitting the Notice of Study Commencement.

A 1:1000 scale preferred conceptual design plan on Morningside Avenue between Kingston Road intersection and Highway 401 was presented at the meeting.

2 Scarborough – Malvern LRT Project Overview

IBI Group outlined the following:

� Eglinton Avenue and Kingston Road are urbanized. The proposed LRT with the associated road improvements are within the existing right-of-ways, therefore no significant environmental impacts are anticipated.

� A new Highland Creek structure is proposed on the east side of Morningside Avenue to accommodate the LRT facility.

� The LRT alignment is located on the east side of Morningside Avenue and on the south side of Ellesmere Road outside the existing roadway. A separate alignment is proposed due to the grades of Morningside Avenue and Ellesmere Road and the provision of LRT stop in the area.

� The grading limits (due to the alignment and the new structure abutments) of the LRT are presented on the plan. IBI noted that footprints could be minimized further by constructing a retaining wall. However, this option will be investigated further and to be addressed during the detailed design.

� A meander belt analysis was undertaken by Parish Geomorphic. IBI will provide the meander belt report to TRCA for review.

3 Key Issues and Opportunities

TRCA indicated that a stormwater outfall is located at the SE quadrant of Ellesmere Road and Morningside Avenue. IBI noted that the existing outfall will be extended and the opportunity to improve the water quality will be investigated during the design stage.

IBI/TTC noted that meetings have been held with University of Toronto Scarborough Campus (UTSC) to discuss the proposed LRT plan. In general, UTSC supports the provision of LRT facilities. UTSC is currently undertaking a Master Plan study for future development in the area including a world-class aquatic facility if the City wins the Pan Am Games.

TRCA noted there is a flooding issue on UTSC campus within in the Highland Creek valley. UTSC is planning to relocate the tennis court. There are no anticipated impacts to the LRT facility.

TRCA noted that the City of Toronto is undertaking a watermain study to determine the routing of a 2250 mm Watermain from F.J. Horgan Water Filtration Plant to Ellesmere Reservoir and Pumping Station. Additional information may be obtained from the City’s Project Manager, Cliff Chu. [Post-Meeting Note: The City of Toronto is updating the Project File in compliance with the conditions imposed by the Minister of the Environment for the previous watermain EA study. The preferred route will run across Highland Creek Ravine from Kingston Road/Military Road intersection and along east side of Morningside Avenue. The details of the watermain study can be found on the City’s web site at: http://www.toronto.ca/wes/techservices/involved/wws/fj_horgan_watermain/index.htm. A meeting has been planned to review the potential conflicts.]

Wildlife crossing was discussed at the meeting. TTC indicated that fencing along Morningside Avenue between Highland Creek and Ellesmere Road is preferred due to ensure the safety of LRT operations. LGL noted that the major wildlife crossing movement will be adjacent to Highland Creek structure. TRCA noted that the preference is to provide a free flow wilding crossing along the LRT corridor. However, given the above noted reasons, the justification of having fencing along the Morningside Avenue with the associated mitigation measures should be documented in the Environmental Project Report.

Following the review of the report, TRCA will be able to identify any future commitments to the future work to the later stage of the project. A formal response will be provided to TTC.

5. With respect to the effectiveness of reducing deer-vehicle accidents along Morningside Avenue,staff notes that there is some evidence that properly installed fencing can be effective in reducingthe frequency of deer-vehicle accidents. In this instance, there is a possibility that fencing couldbe effective by further encouraging local deer to use the already established pathway within theHighland Creek valley as a migratory route across Morningside Avenue. Thus, TRCA has noobjection to the use of fencing to control and protect deer populations in this area. Nonetheless,please be advised that deer may behave unpredictably in some circumstances. Thus, if possible,we recommend further monitoring be undertaken during the operation of the LRT to confirm theeffectiveness of fencing in protecting human life and wildlife in this area. Such information willlikely be beneficial for other similar transportation projects located close to urban-deer migrationroutes.

Toronto and Region Conservation Authority (TRCA) staff received the Highland Creek - MeanderBelt Analysis Report (Draft) prepared by Parish Geomorphic on behalf of IBI Group for the TorontoTransit Commission (dated November 28, 2008) on July 14, 2009.

Staff understands that the Toronto Transit Commission (TTC) is assessing ways to significantlyimprove transit service from the Kennedy Station (Bloor-Danforth subway line) to the Malvern TownCentre. TRCA staff has completed its review of the draft Highland Creek - Meander Belt AnalysisReport and are satisfied with the report findings. Staff is providing the following comments thatshould be included in the EA and project:

1. Overall, the meander belt analysis undertaken and the results provided in the "Highland CreekMeander Belt Width Assessment Report" are satisfactory to TRCA Water Resources Staff, andare in compliance with TRCA's approach for Meander Belt and 100 year Erosion Rateassessments.

2. Staff notes that the Meander Belt assessment recommends placement of piers a distance of40m to 45m apart within the flood plain. Staff recommends that given the dynamic nature of theHighland Creek, pre-emptive pier protection should be provided by TIC to provide additionalprotection of the piers against channel migration.

3. Please note that TRAC has completed minor revisions to the flood plain mapping for the areaand for the existing Morningside Avenue Bridge based on discussions with Harold Sich of IBIGroup. Please ensure that all further hydraulic assessments and flood plain managementdiscussions are based on the revised mapping and model. Attached is the updated flood plainmapping and associated modeling.

4. As the study progresses, please complete and provide for TRCA review, a hydraulic assessmentof the proposed structures. Although no major impacts associated with the structure areanticipated, the analysis is required to confirm flood plain elevations, and to help keep TRCA'sflood plain mapping and model up to date. The analysis may be deferred to the detailed designstage of the project, when more information regarding the crossing is made available, orcompleted as part of the EA to confirm the preferred concept. Should TIC deferred the analysisto the detailed design phase of the project, details of the required 'analysis should be discussedwith TRCA.

Also, TRCA will require that TIC provide a commitment in the EA document to complete theanalysis based on the results of the TRCA discussions.

5. With regards to the modeling methodology (simplified) and documentation to be provided toTRCA, please note the following:

• Any additional piers associated with the proposed TIC structure should be coded into theexisting rendition of the Morningside Bridge. Given the sensitivity of the HEC-RAS model,the addition of cross-sections (for bridge bounding conditions) will create a localized"unstable" condition within the model (due to the extremely close proximity of theMorningside Bridge), which will produce un-realistic results.

• TIC should review the modeling results and provide confirmation of flood plain delineation,and bubble information through the area. In addition, please revise flood lines and bubbleinformation, where necessary.

• Please provide TRCA with a Hydraulic Analysis Design Brief, signed and stamped by aprofessional engineer. Please note that the Hydraulic Assessment Design Brief may be partof, and appended to the Storm Water Management Report.

• Also include digital copies of the revised flood plain mapping and associated HEC-RASmodel in your submission to TRCA. Please note that TIC's mapping product and model willbecome TRCA's regulation mapping for the area.

Please ensure that the TRCA receives project updates including the Notices of Public meetings,Notice of Study Completion, copies of the Draft EA Document (four hard copies); and, One hardcopy and one digital copy of the Final EA Document. The draft EA document should beaccompanied by a covering letter which uses the numbering scheme provided in this letter andidentifies how these comments have been addressed.

SCARBOROUGH-MALVERN LRT TRANSIT PROJECT ASSESSMENT STUDY

Further to your letter dated May 28, 2009 regarding the above noted study, we are pleased to submit four (4) copies of the Draft Environmental Project Report (EPR) for your review. Your comments that were noted in the letter have been fully addressed in both the EPR and the revised Natural Heritage Report (July 2009) as included in the Appendix C1 of the EPR. Our responses to your comments are shown as follows:

1. Regarding the installation of the retaining walls, TTC is committed to provide the details and design drawings of the proposed retaining walls during the design stage. This commitment has been documented in the draft EPR under Section 9.6 “Future Environmental Work”.

2. Regarding the compensation ratio for the impacted vegetation, LGL has revised the Natural Heritage Report Section 4.1.2 to note that “Compensation for vegetation loss, at a 3:1 ratio, will be required to meet TRCA objectives”. This compensation ratio commitment is also shown in the draft EPR Section 7.3.2 and in the Exhibit 7-4 – Summary of Scarborough-Malvern LRT Potential Impacts, Mitigation Measures, Monitoring and Future Work Contingencies.

3. For the City of Toronto Urban Forestry Invasive species control strategy. The revised Natural Heritage Report has included the following paragraph under Section 4.1.3 and indicates that “

“The City of Toronto’s Urban Forestry division has initiated invasive species control in other areas within their jurisdiction. It is recommended that discussions with Toronto Urban Forestry be included during the detailed design phase of this project to develop an invasive species control program for the Morningside ANSI/Highland Forest ESA area.”

This commitment has also been documented in the draft EPR under Exhibit 7-4 and Section 9.6.

4. With respect to the redside dace within the Highland Creek watershed, the Natural Heritage Report has been included the following paragraph as follows under Section 2.2.2 to address your comment.

“It is likely that the species is not found within the Highland Creek watershed at present. Notwithstanding, one of the long-term goals of a recovery strategy for Red Side Dace in Ontario is to restore viable populations by ‘re-introducing Red

5. Future monitoring for the effectiveness of the deer crossing fencing in the Highland Creek area will be undertaken during LRT operation. This commitment has been documented in Natural Heritage Report Section 5.0 as well as in the draft EPR under Exhibit 7-4 and Section 9.6.

TTC presented an overview of the overall program, including description of the proposed technology, transit corridors, project priorities, and organizational structure. It was noted that there will be several proposed TTC line crossings of MTO highways, and each will be addressed on an individual basis.

IBI outlined the Scarborough Malvern LRT project as follows:

�� The typical cross-section will consist of an at-grade alignment with the tracks in the middle of the roadway and with stops at major intersections;

�� Proposed route is from the existing Kennedy Subway Station, easterly along Eglinton Avenue to Kingston Road, easterly along Kingston Road to the Morningside Road intersection, and then northerly along Morningside Road to the Ellesmere Road intersection.;

�� From the Morningside / Ellesmere intersection, there are a number of northerly routes to reach the proposed terminus of Malvern Town Centre, including crossing Highway 401 at Neilson Road or at Morningside Road;

�� Presently the project just started the EA phase, with completion expected later this year. Given present Transit City project priorities, the Scarborough Malvern LRT is slated to be operational for 2018.

2. ALTERNATIVE ALIGNMENTS IN THE VICINITY OF HIGHWAY 401

Two main routes are available to link UTSC and the Malvern Town Centre, and that would cross Highway 401:

�� Along Neilson Road, where the existing bridge is not wide enough, requiring either widening the existing structure or providing a new structure (given the superstructure type, a new structure is likely required);

�� Along Morningside Road, where there is potential to remove a lane in each direction on the existing structure (as per the intent of Transit City and other City structures). If the traffic analysis indicates that taking away lanes would cause unacceptable traffic impacts, widening of the structure or a new structure will be investigated.

3. POTENTIAL KEY ISSUES

A preliminary assessment identified these potential key issues:

�� Property / Operations / Maintenance – roles and responsibilities, including associated financial implications, need to be identified and documented in a legal agreement. Further, impacts on highway infrastructure operations and maintenance needs to be assessed;

�� Traffic / Ramp Operations – MTO will not accept major traffic impacts (i.e. LOS degradation), and in particular increased queuing that might affect the overall safety of their users;

�� Structural – impact on the existing structure’s performance, and the associated impact on the flexibility / compatibility for any future rehab needs to be assessed.

4. GENERAL DISCUSSION / MTO REQUIREMENTS

General discussion ensued with the following major points:

�� In principle, MTO would not see any reason why LRT crossing their infrastructure would not be allowed (but to be confirmed by senior management), as long as it does not affect their ability to operate the highways safely and efficiently;

�� Eventually, an agreement between MTO and the TTC/City would be required to delineate costs, roles and responsibilities;

�� MTO indicated that traffic signals in the vicinity of the ramp terminus is likely operated and maintained by the City (to be confirmed), however with MTO approval.

�� MTO would not permit full transit signal priority in the vicinity of their structures;

�� MTO noted that the recently construction interchange modifications in the NW quadrant of Highway 401 and Morningside Road was a City / developer initiative (City contact is Penelope Palmer).

5. ACTION ITEMS / NEXT STEPS

The initial step is to determine the potential traffic impacts and the feasibility of taking away lanes, and / or placing a LRT alignment in the centre of the roadway. IBI is to undertake traffic analysis to investigate the potential impacts of a centre LRT alignment with and without taking a lane each direction along Morningside Road. It was understood that along Neilson Road the roadway would need to be widened.

The following is a list of data collection items and questions that is requested of MTO:

�� To confirm the feasibility, in principle, of using MTO infrastructure for proposed TTC LRT crossings;

�� To confirm the ownership / operation / maintenance of traffic signals in the vicinity of Neilson Road and Morningside Road crossings;

�� To provide any subsequent rehabilitation drawings, including likely future rehab program (MTO has provided the original construction General Arrangement drawings);

�� To forward a digital copy of MTO Guidelines for Traffic Impact Studies (a hard copy was provided);

�� To provide, if available, the MTO approved traffic impact study for the new roadway / interchange modifications in the NW quadrant of Highway 401 and Morningside Road (i.e. extension of Cinemart Road);

�� To provide traffic count data along the ramps and at the ramp terminus for both the Neilson and Morningside interchanges. In addition, provide access to other relevant data and background reports, such as Compass-related video in order to inspect existing queuing.

1 Introduction TTC/IBI provided an update of the project as follows:

� SMLRT is one of the TTC-Transit City Projects and is being undertaken under the new Transit Project Assessment Process.

� The second round of Open Houses is scheduled for May 2009, with EA approval expected later this year. At present construction of this project is not expected until 2015, with design commencing a couple of years in advance.

� A Traffic Impact Study and a Structural Report have been provided to MTO for review on February 18, 2009, which addressed MTO’s major concerns as outlined in the initial MTO meeting.

� A new separate structure crossing Hwy 401 is not being recommended for this project due to the existing land use / property issues, connectivity to Sheppard East LRT (and associated yard) requirements, and cost implications.

The purpose of the meeting was to discuss and address any comments and concerns that the MTO may have in regards to this project. In addition, the TTC want to obtain MTO’s general approval to the project in principal, with identified commitments to work together on specific issues and conditions in subsequent project phases.

A 1:1000 recommended SMLRT functional design plan in the Highway 401 area was presented at the meeting.

2 Traffic Operations MTO noted that there may be a potential safety concern for the EB Off-Ramp (i.e. Ramp E(401)-N/S(Morningside)) vehicles going across the intersection at a high speed (i.e. 80km/h), specifically that the vehicles may slip and lose control due to the embedded LRT tracks. IBI noted that this situation is not an uncommon situation and such safety concerns have not been previously noted. However, there are potential mitigative measures, such as rubberized / textured treatments with the track approaches among other possible treatments, which may reduce the slipperiness that will be investigated during the preliminary engineering phases. The TTC will commit to reviewing the potential issue to the MTO’s satisfaction, and if necessary, investigate and incorporate measures to address the concern.

IBI / TTC – Future Commitment

MTO noted there are two EB left turn lanes at the Ramp E-N/S terminal and the southbound receiving throat should be widen to ensure all vehicle turning movements can be accommodated and can turn simultaneously. TTC indicated that this will be investigated and the pavement area will be widen in this area. In addition, during the preliminary engineering phase, other options could be examined such as having the LRT stopping location further south (i.e. have the top of rail match the top of roadway pavement sooner) and provide positive guidance pavement markings in order to provide additional space for vehicle turnings.

IBI / TTC – EA Study

MTO noted that the elimination of the right-turn lane, specifically at Milner Avenue, may cause a backup on Morningside Avenue at the intersection and the ramp terminal may potentially be blocked. TTC noted that right-turn lanes are not being proposed within the study corridor in accordance to the TTC’s guidelines. Exceptions have been made where the traffic analysis has shown the elimination of right turn lane may cause significant traffic queuing. IBI’s traffic analysis has shown that a designated northbound right turn lane is not required at the Milner Road intersection.

IBI noted that a more detailed traffic analysis by using a more sophisticated micro-simulation model (i.e. VISSIM) will be undertaken during the preliminary design to finalize the traffic operation requirements. A pro-active traffic management approach will be also undertaken by TTC and the City to manage traffic operations along the entire LRT corridor.

MTO questioned about the urban design / landscaping opportunity in the north ramp terminal area as shown on the plan. IBI responded that the elements at the interchange area will be “hard” urban design features (i.e. textured and/or coloured treatments), rather than landscaped / vegetative treatments. The details will be determined during the design phase.

IBI / TTC – Future Commitment

TTC noted that the maximum headway of the LRV will be 3.5 min during the peak hour. Transit signal priority will be provided at the intersection. The future traffic signals will be operated and maintained by the City of Toronto.

MTO noted that the temporary and permanent traffic signal design drawings (PHM-125), the associated signal timing plan, and the revised sign inventory and pavement marking plans will require MTO review during the design phase.

IBI / TTC – Future Commitment

Bike lanes are not being proposed through the interchange ramp as the width of the existing structure cannot accommodate the LRT alignment and bike lanes. IBI noted that provision of bike lanes at the ramp terminals may raise the liability and safety concerns. [PostMeeting Notes: TTC will discuss with the City of Toronto to determine whether the bike lanes should be proposed at this location given the constrained width of structure and the liability issues. The results will be provided to MTO for further considerations]

3 Structural The structural report noted that the girders will require strengthening due to the construction of LRT facilities. MTO questioned how many girders will be impacted. IBI noted that two to four girders will require strengthening due to the different skew angles of the structure’s girders. The details of the impacts and the associated improvements will be assessed during the design phase.

IBI / TTC – Future Commitment

MTO questioned whether the maintenance frequency will be increased if a light weight material is used for the trackbed to avoid the strengthening of the superstructure and substructure. MTO indicated that the LRT maintenance works will impact the ramp terminal traffic operations and therefore the frequency of maintenance work should be minimized. TTC will address this concern during the selection of the track bed material during the design phase.

It is s agreed that TTC/MTO will investigate the opportunity of providing a full structural rehabilitation before the LRT construction in order to minimize the traffic operation impact and the disturbance of the future LRT operations. [Post-Meeting Note: Although the report noted that temporary closure of the LRT ROW may be required during major rehabilitation works on the bridge, TTC would expect a LRT track will remain open for operations during the rehabilitation work]. A more detailed rehabilitation plan will be discussed with MTO during the preliminary design plan.

There was a discussion about the maintenance of the expansion joints on the structures. IBI noted that different treatments will be investigated during the design phase, including replacing the expansion joints with a semi-integral abutment arrangement, or employing a sliding rail expansion connection. MTO inquired the TTC to provide examples of similar situations and treatments where there are TTC streetcar tracks on structures.

TTC/IBI noted the LRT right-of-way curb would be mountable for emergency vehicles. The width of the curb as shown in the report could be widened inside from 300 mm to 500 mm without affecting the LRT right-of-way.

4 Other Business MTO questioned about the timing of the LRT construction. TTC noted that the earliest construction may begin in 2010 and the latest in 2014, depending on the results of the bidding of the PanAm Games, available funding, and the TTC’s priorities.

In addition to the action items noted in this meeting, a formal response will be provided by MTO to the submitted reports and the meeting’s discussion.

TTC noted that the design drawings will be provided to MTO for reviewing during the detail design phase. A future discussion on the agreement on the future maintenance, traffic operations and bridge rehabilitation requirements will also be undertaken during the detail design phase.

Based on the information submitted to date, we have no objection in principle to the proposed SMLRT subject tothe following comments:

- MTO Encroachment Permit(s) are required prior to any construction taking place. Encroachment Permits are also required for any Pre-Construction work (i.e. Survey, Bore Holes, etc.) taking place within the Highway R.O.W.

- Prior to the issuance of MTO Permit(s), all MTO concerns must be addressed to the satisfaction of MTO. These concerns may include, but not be limited to the following:

o All required engineering drawings (construction, electrical, structural, staging, etc.) and reports (Traffic,Foundation, etc.) must be submitted to MTO for review and approval. (Applicable MTO Standards where required).

o A legal agreement between TTC and MTO must in place addressing the construction, financial, and maintenance responsibilities of TTC, with no cost to MTO.

- Review of the Report(s) submitted in February 2009 (TIS Feb 09, Structural Assessment Dec 08, IBI Group) had been completed and MTO comments/concerns were discussed at the Meeting of April 8, 2008 (seeminutes). MTO has no further comments beyond those voiced at the meeting, at this time. Please ensure that commitments referred to in the minutes, regarding the operations study and other items “to be addressed“ during preliminary design, are met.

- Other issues to be addressed during preliminary and detail design are:

o Double left and double right receiving lanes must be 2 ½ lanes wide to accommodate turning paths, and divisional islands may need to be pulled back.

o The issue with the through traffic crossing the tracks had to do with the crown along the middle of the track bed. It should be flatter.

o The TTC will be operating transit signals through the ramp terminal intersections. The signal Maintenance Agreement may require modification to accommodate the transit signals.

o Will separate power supplies be needed for the TTC infrastructure, vs. the MTO lighting and signal infrastructure?

o Include the development in the S/E quadrant in the Traffic Study.

o Ensure emergency vehicles can mount / cross, and drive along the “transitway” if required.

o Check left turn lane capacity for the 5-10 year horizon after project completion.

UTSC indicated that Urban Strategies have been invited as they are preparing a Master Plan for UTSC.

2. TRANSIT CITY PROGRAM

TTC provided a handout and presented an overview of the overall program, including description of the proposed technology, transit corridors and organizational structure.

3. SCARBOROUGH MALVERN LRT PROJECT

TTC outlined the Scarborough Malvern LRT project as follows:

�� The typical cross-section will consist of an at-grade alignment with the tracks in the middle of the roadway and with stops at major intersections;

�� Proposed route is from the existing Kennedy Subway Station, easterly along Eglinton Avenue to Kingston Road, easterly along Kingston Road to the Morningside Road intersection. From the Kingston / Morningside intersection there are a number of alternatives to reach the vicinity of the UTSC. From the UTSC, there are 2 alternative northerly routes to reach the proposed terminus of Malvern Town Centre;

�� Presently the project is in the EA phase, with completion expected later this year. Given present Transit City project priorities, the Scarborough Malvern LRT is slated to be operational for 2018.

4. UTSC CURRENT AND FUTURE FACILITIES / OPERATIONS

The following were key points presented about UTSC existing and future facilities / operations:

�� UTSC started a Master Plan exercise in January 2008 (Urban Strategies); �� Master Plan is currently in the visioning / consultation phase (PIC is planned for late

June / early July at the campus), with this phase planned for finalization by September 2008;

�� Objectives include looking at more than academic functions, as the site presents an unique opportunity for a "hub" in eastern GTA;

�� UT governing body looking to build a profile for this site, to integrate with the local community, and potentially including hotels and restaurants (to support conference events);

�� UTSC site is 300 acres, with 125 acres available on the north side of Ellesmere Road, although the available site to the north has challenges (i.e. western parking lots generally based on fill, northern portions is an former pit / landfill site requiring methane gas testing throughout the UTSC property)

�� Continuous growth in Ontario universities expected beyond the next 30 years, and of the 3 UT campus sites, Scarborough has the most land available to meet future needs (and is presently below the standard building ratio per student);

�� Presently there about 10,000 UTSC students, 3-4,000 Centennial students, and 800-1000 employees, for a total of about 15,000 people accessing this location (hospital hub mentioned, but relationship with health centres at Ellesmere / Neilson is uncertain). This is expected to grow to 20,000 people in 10 years, and to be doubled in the longer term;

�� A major sports facility is being proposed, in conjunction with the City (to straddle City / UT properties along Morningside Road, north of Military Trail), with Ron Moeser, the local councillor leading the initiative. Facility is looking for a "creative partnership", providing high performance athletics, including potentially as part of the PanAm games submission (being submitted in October 2008). Preliminary plans are for a $150-200 M facility that includes a 5500 seat aquatics centre and a 6500 seat hockey / multi-purpose arena (total of 462,000 sq. ft.);

�� Intent is that the PanAm (for 2015) games are to leave "legacy" sites, including addressing brownfield sites, and potential exist for tie-in with available government funds for development of brownfield sites;

�� Regardless of PanAm games success, a scaled down version of the facility will go ahead.

�� In conjunction with the above Master Plan exercise, UT is undertaking a long term strategic plan for the next 30-40 years, where doubled growth at UTSC is expected.

5. GENERAL DISCUSSION

General discussion ensued with a consensus that a campus development with transit as a primary consideration was important to UTSC and the surrounding community. TTC indicated that significant routing decisions were still required to clearly identify potential alignments in the vicinity of UTSC, but the potential opportunities of the UTSC development is an important consideration. Supporting documentation of the proposed development was requested to update land use and employment projections in the area.

Transit Project Assessment Study for the Scarborough Malvern Light Rail Transit Project

The Toronto Transit Commission (TTC) is undertaking a Transit Project Assessment Study following the “Transit Projects and Greater Toronto Transportation Authority Undertakings Regulation” (Ontario Regulation 231/08) under the Ontario Environmental Assessment Act (RSO 1990, Chapter E.18).

The Scarborough Malvern Light Rail Transit (SMLRT) project, is one of the seven proposed LRT lines of the Toronto Transit City – Light Rail Plan, which was endorsed by the TTC Commission in March 2007, and supported by the Province of Ontario in June 2007 as part of Move Ontario 2020, a strategic transit plan across the GTA and Hamilton.

The SMLRT is approximately a 15 km long corridor that would link Kennedy Station, including the Bloor-Danforth Subway, the Scarborough RT and the proposed Eglinton Crosstown LRT, with northern Scarborough communities, utilizing the following corridors:

� from Kennedy Subway Station, east along Eglinton Avenue to Kingston Road, in the centre of the roadway (existing 6 lane cross-section will be reduced to 4 lanes);

� from the Kingston / Morningside Intersection, northeast on Kingston Road to Morningside Avenue, in the centre of the roadway (existing 6 lane cross-section will be reduced to 4 lanes);

� from the Kingston / Morningside Intersection, north on Morningside Avenue to Sheppard Avenue, via Ellesmere Road and Military Trail in order to provide transit service to the University of Toronto Scarborough Campus

o the alignment will be in the centre of the roadway between Kingston Road and Highland Creek, maintaining 2 lanes in each direction thereby requiring road widening on both sides;

o alternative alignments on the east and west side of the roadway will also be investigated along Morningside Avenue between Highland Creek and Ellesmere Road;

o alternative alignments on the north and south side of the roadway will also be investigated along Ellesmere Road between Morningside Avenue and Military Trail;

o alternative alignments on the east and west side of the roadway will also be investigated along Military Trail between Ellesmere Road and Morningside Avenue;

� from the Sheppard / Neilson Intersection, north along Neilson Road to the Malvern Town Centre area, in the centre of the roadway, maintaining 2 lanes in each direction thereby requiring road widening on both sides.

Attached are Drawing SK-U-01, Key Map, which illustrates the recommended corridors for the SMLRT line, and Drawing SK-U-02, Typical Cross-Sections. As you can see from the latter drawing, the intent is to relocate all existing utilities within the proposed LRT right-of-way (shown in red on typical cross-section drawing).

We are requesting your assistance to kindly provide existing and proposed utility plant information along the above noted SMLRT corridors. This information will assist us to identify potential utility impacts of the proposed construction, and to identify utility relocation / protection requirements.

Please indicate if you require base mapping or more detailed drawings to provide the above information.

Presently we are identifying and evaluating alternative alignment details, in order to select the preferred alignment for the SMLRT. The selected alignment will be presented at a number of Open Houses, which is scheduled for November 2008. An Environmental Project Report will then be prepared and submitted this winter for approval. Construction is presently planned for 2014.

As such, we would appreciate a response from your agency by November 14, 2008.

Any work beyond 3 [m] of the markings must be separately located by Enwave. 3) The sole responsibility of avoiding damage to Enwave’s Infrastructure lies with the person digging. Nothing that Enwave does in connection with stakeout (including incorrectly marking its lines) shall relieve, in whole or in part, the person digging of that Responsibility.
