In exercise of the powers conferred and as per the provisions under Section 65 of the Wakf Act, 1995, the TamilNadu Wakf Board in its order in item No. 23/08 in Rc. 4193/C2/06/Chennai, dated 28th February 2008 resolved totake over the Management of Nanbai Makkan Wakf, George Town, Chennai-600 001 and Shaik Hussain Malick ShaDargha Wakf, George Town, Chennai-600 001 under direct control of the Tamil Nadu Wakf Board for a period of sixmonths from the date of the pronouncement of the Board’s order on 29th May 2008 and appointed the Wakf InspectorChennai (North) as Executive Officer.

As the period of the direct management was lapsed on 28th November 2008 and due to the administrative reasonthe Tamil Nadu Wakf Board in its resolution in item. No. 254/08 in Rc. 4193/06/B1/Chennai, dated 26th February 2009has resolved to recognize the period of the direct management from 29th November 2008 to 25th February 2009 andextended the period of the direct management for a further period of one year from 26th February 2009 to 25th February2010.

CONDITIONS OF SALE

1. Lots are to be examined by the intending purchasers before bidding and to be taken with faults and errorsto description.

2. The highest bidder to be the purchaser and in the event of any dispute arising between two or more biddersthe lots so disputed should be put up again and resold.

3. The bid amount shall be paid in full immediately after the bid is knocked down. If this not possible a depositof 25 per cent of bidded amount should be paid on the spot to the auctioneers and a receipt shall be obtained forthe amount paid in case only a deposit of 25 per cent is paid the balance amount should be paid to the Trust FinancialAdviser and Chief Accounts Officer on or before 4.00 p.m. on the third day calculating from the date of confirmationof sale, failing which the EMD paid will be forfeited and the Trust will resell the lot either in sale by tender or byPublic Auction at the risk and responsibility of the defaulters.

4. Goods advertised for sale will not be withdrawn by the Trust except on payment of sufficient deposit to coverthe Harbour dues, demurrage charges and other charges due thereon.

5. The goods sold in Auction will not be delivered to the purchaser thereof or his authorized agent unless thepurchaser produced delivery order from the Auctioneers for having paid the amount in full.

6. Goods sold in Auction shall be allowed three free days excluding Sundays and Board’s holidays from the dateof confirmation of sale and thereafter shall be charged at daily rated as per Scale of Rates up to and including thedate of clearance.

7. The lots sold will be lying at the risk of the purchaser and must be removed within the free period of threedays from the date of confirmation of sale at the purchaser’s expenses.

8. The purchasers are distinctly warned that if the goods are not cleared within eight days from the date of expiryof free period they have no claim whatsoever over the materials and the same will be sold whether in sale by Tenderor Public Auction. The first purchaser to be held liable for any loss arising from such resale and to forfeit any advancestogether with auctioned commission.

9. The Trust shall reserve the rights to withdraw any of the items notified for sale without assigning any reasonfor such withdrawal.

10. Bidders shall gain admission into the Harbour on the days of Inspection and as the passes can be obtainedon payment from the Programmer, Computer Pass Section near Main Gate opposite to Customs House, Chennai-600 001. The successful bidder should also obtain pass on payment for clearing the goods.

11. Terms Cash or Demand Draft, Pay Order of any Nationalized Bank.

12. All the Lots sold in the auction are subject to confirmation.

13. If any packages are not sold in the auction for which they are listed they will be included for sale on thesucceeding sale by Tender or in Public Auction.
