    NATIONAL COMMISSION ON TERRORIST ATTACKS UPON THE UNITED STATESSUBJECT: REQUEST FOR DOCUMENTS -- NUMBER SIX (U)

    (SBU) This is in response to the National Commission onTerrorist Attacks Upon the United States' request forDepartment of State documents dated October 3, 2003.

    (SBU) Attached are forty-three documents meeting yourrequest. They include five documents (nos. thirty-fivethrough thirty-nine on the list) that commission staffrequested following a briefing by TIPOFF Director John Arrizaon September 30.

    (SBU) Under Executive Order 12958, the Department ofState may not disseminate classified information outside theExecutive Branch except under conditions that ensure that theinformation will be given protection equivalent to thatafforded to such information within the Executive Branch. Weask that only appropriately cleared members of staff begranted access to the materials and that it be protected byapplying standards at least as stringent as E.O. 12958 on thehandling of classified information.

    United States Request for Documents (Request forDocuments No. 6)

    This is in response to the National Commission on TerroristAttacks Upon the United States' October 3, 2003 Request Number 6 forDepartment of State documents.

    This installment has four documents consisting of classified andunclassified documents. Under Executive Order 12958, the Departmentof State may not disseminate classified information outside theExecutive Branch except under conditions that ensure that theinformation will be given protection equivalent to that afforded tosuch information within the Executive Branch. We ask only thatappropriately cleared members of your staff be granted access to thematerial and that it be protected by applying standards at least asstringent as E.O. 12958 on the handling of classified information.

    Although some of the material is not classified in and of itself,its designation as "Sensitive But Unclassified" requires specialhandling. Therefore we request that all of these documents beprotected from unauthorized disclosure.

    [f any requested documents are withheld from production, even temporarily,based on an alleged claim of privilege or for any other reason, theCommission requests that the respondent, as soon as possible and in no eventlater than the produ ction date, identify and describe each such document orclass of do cumen ts, as well as the alleged basis for not pro ducing it, withiufficient specificity to allow a meaningful challenge to any suchwithholding.

    If the respondent does no t have possession, custody or control of anyrequested documents but has information about where such docum ents maybe located, the Commission requests that the respondent provide suchinformation as soon as possible and in no event later than the production date.If the respondent has any questions or concerns about the interpretation orscope of these document requests, the C omm ission requests that any suchquestions o r concerns be raised with the Commission as soon as possible sothat any such issues can be addressed and resolved prior to the productiondate.October 3, 2003 Daniel Marcus, General Counsel
