b) Rajaram Krishnaji Ingawale' died in the year 1948 leaving behindhiin widow Tarabai and two sons namely Vasant and Shashikant.The names of these legal heirs were duly ,entered in the' revenuerecords by mutation entry No. 979 dated 20/12/1951.

c) Mr. Vasant Rajaram Ingawale died on 26/9/1978 leaving behind'him his widow Sindhu, two sons namely Sharad and Vilas and a,daughter namely Surekha. The names of thebe legal heirs were dulyrecbrdedby mutation entry No. 2028 dated Q4/10/1980.

d)Mr; Sharad Vasant Ingawale died at Jamnagar (Gujrat) on4/2/1987. As he had no first class legal hei~sto succeed, the namesof the other legal heirs of Mr. Vasant R~jaram Ingawale whichwere entered on the,reyenuerecord by Mudltion Entry No. 2028 asthe legal heirs of late Mr. Sharad Ingawale also and Mutation EntryNo. 3146 was passed to that effect on 4/1/1988.

e) Mr. Sadhu Dharmaji Ingawale diedin the y~ar 1970 leaving behindhim his two wives (widows) namely Cha,bdrabai and Gangubai.The names of Chaildrabai and Gangubai were duly t:.ecordedin therevenue', records.by Mutation Entry No. 1754. SubsequentlyGangubai Sadhu Ingavale also died in the year 1975 and as she wasnot having any issues, Chandrabai.became entitled to her share inthe said Survey NO.l01 as per Mutation Entry No. 1955.

t) Subsequently Smt. Chandrabai Sadhu Ingawale died on 7/8/1985.She had no legal heirs of Class - I degree. Khandu DharmaIngawale washer real nephew who predeceased her in the year1977 and as such Chandrabai' s share in the property merged intothe share of legal heirs of Late Khandu Dharma Ingawale.Accordingly mutation No. 3076 dated 24/3/1986 was carried outand the following names were entered on the revenue record.

h)Mr • Shankar Dharma Ingawale died on' 1717/1962 leavingbehind him his only sot). Le. Mr. Khandu Sl1ankarlngawalewhose name was rec()rdedin revenue records by MutationEntry No. 1638 dated 17/1/1964.

i} Mr. KhanduShankar-Ingawale died in the year 1978 leaving.behindhim-hiswido,¥smt. Sitabai, three sonS Dagadu, Arun,.Manik and Mother DagadabaiShankar In.gawale. The namesof the legal heirs were ' recorded in the revenue records hyMutation Entry No. 1792 dated 6/4/1979.'

j) Smt.:Dagadabai,shaIikar Ingawale died somewhere in the year1979 leaving behind her grand sons i.e. Dagadu Khandu.Inga~ale, Arun Khandu Ingawale and Manik ~anduIngawale. And their names were entered on the revenue recordby Mutation Entry No. 2061 dated 28/5/1981. .

k)Mr.DattuDhondiba Ingawaledied at Mumbai leaving behindhis only son Narendra alias NathuDattu Ingawale as legalheir. The name of Mr. Narendra alias Nathu Dattu Ingawale isduly recorded in the revenue records vide Mutation Entry No.2096 dated 3/12/1981.

1) Mr. Narendra alias NathuDattu Ingawale died at Mumbai on11/4/1989 leaving behind him his widow Sheela NarendraIngawale, Son Mr. Nandan Natendra Ingawale and marrieddaughter Mrs. Sadhana Nandkumar Pathare. b) Bhimab~i Rawaji Ingawale died on 19/9/1964. She had nolegal heirs of Class I degree. Hence her nephews i.e. AbujiNamdeo Ingawale and Pandharinath Bhivaji Ingawale,TukaramBhivaji Ingawale carried out the Mutation and byMutation Entry No. 1660 dated 23/9/1964 the names of AbujiNamdeo Ingawale, Pandharinath Bhivaji. Ingawale andTukaram BhivajiTngawale were recorded in revenue records.

c) Abuji Namdeo Ingawaledied on 6/11/1973 leaving behindhim two sons namely Ramchandra. Aburao Ingawale,Genubhai Aburao. Ltd. has paid the entireagreed consideration to Mr.' Sanjay Ramchandra Kulkarniand 11 others in respect of the said lands and by executing aPossession Receipt dated 5/4/2008, they!have handed overpeaceful and vacant possession of the said lands to MatrixDevelopers Private Limited, which Poss~ssion Receipt hasbeen duly registered in the office of Suq-Registrar, Mulshi(Paud)at Sr. No. 2767/2008 dated 7/4/2008.

e) In pursuance of the said Agreement lfor Sale (withoutpossession) dated 20/3/2008, by a Sale D~ed dated 5/4/2008,Mr. Sanjay Ramchandra Kulkarni and 11 others have sold,conveyed and transferred the said jlands, to MatrixDevelopers Private Limited, which Sale IDeedhas been dulyregistered in the office of Sub-Registrar, Mulshi (Paud) at Sr.No. 2766/2008 dated 7/4/2008. '

f) Thus, Matrix Developers Private Limited became theabsolute owner of the land adm. 0 Hectare 20 Ares out of thesaid Survey No; 101/1 and landadm. o Hectare 20 Ares outof Survey No. 102/3/2,' Bhugaon, Taluka Mulshi, DistrictPune.

7. Maharashtra Gunthewari Act and Urban Land (Ceiling andRegulation) Act:

The said lands are situated at village Bhugaon,Taluka Mulshi, DistrictPune within the jurisdiction of Zilla Parishad Pune, PanchayatSamitee, Taluka Mulshi, Dis~rict Pune. The Regional Plan for PuneDistrict has been sanctioned w.e.f. 10/02/1998. and the villageBhugaon is covered under the said Regional Plan. On perusal ofvarious Zone Certificates issued by Assistant Director, TownPlanning, Pune Division Pune issued in the year 2006-2007 it isobserved that; the zoning of the said lands is Agricultural and nodevelopment as per the aforesaid sanctioned Regional Plan.

However, all the. lands out of the said lands haye been regularisedunder the provisions of Maharashtra Gunthewari (Regularization,Upgni~ation .and Control) Act, 2001 (hereinafter referred to as the"GunthewariAct") by.the Collector, Revenue Branch, Pune by theafor~sdid Preliminary order dated 16/02/2006 and fidal .order dated28/06/2006. The demarcation of the said lands is also iearried out byTILR, MulshiPune as per the provisionso'f the Gunthe!wari Act and alayout in respect of the said lands has also been sanbtioned by theColleetor,Revenue Branch, Pune vide aforesaid Order dated09/1 0/~006. Consequently, as per the provisions of section 5 of theGunthewari Act, the" said lands shall be deemed to have beenexempted U/S 20 of the Urban Land (Ceiling and R~gulation) Act,

- 1976 ahd converted to non-agricultural Use for all tne purposes ofMaharashtra Land 'Revenue Code, 1966 subje9t to payment of non-agricultural. asseSsment etc. As. per the order dated 28/6/2006 passedby the Collector, Revenue Branch, P~ne bearingPMAlNAISR/I:31/2005, it is seen that all the-required amounts ofdevelopment charges,N.A. assessment, Zilla Parishad taxes, Grall,lPanchayat taxes, etc. in respect of the said lands have been paid.

8. I~itigations :

From the enquiry and. investigation of title, I did not come across anypending litigation in respect of the said lands. .

9. Encumbrances and charges:

From the perusal of various documents and the Search carried out byus in respect of the said lands, I did not come across any encumbranceor charge upon the said lands.

10. Custody of title deeds and important documents:

All the available original title deeds and /.or certified copies thereof inrespect of the said lands are handed over by S. R. Kulkarni & 11others to Matrix Developers Pvt..Ltd. and now, all such documents arein the custody of Matrix Developers Pvt. Ltd. :

11. Public notice:

..,For investigation of title, I had issued public notices in daily news-paper "Sakal" on 05/12/2007 in respect of the said lands, for inviting; objections from public at large if anybody having any right, title andinterest or claim therein. However, till date Ihave not received anyobjection in response to the .said public notices from any person,claiming any right, title and interest of whatsoever nature in the saidlands.
