1. EXECUTIVE SUMMARY
Through funding from the U.S. Agency for International Development (USAID), the American Bar
Association Rule of Law Initiative (ABA ROLI) initiated its three-year, $1,599,100 program titled
Support to the Kyrgyzstani Legal Defence Community in February 2012. To improve access to an
impartial justice system, build public confidence in the legal system and promote stability in Kyrgyzstan,
ABA ROLI uses a three-pronged approach focused on enhancing the capacity, skills, and knowledge of
practicing attorneys and the next generation of Kyrgyzstani lawyers. The primary objectives of the
program are:
1. To support the development and growth of a unified bar association and enhance the qualifications
of attorneys to serve the needs of the public; and,
2. To equip the next generation of lawyers with the advocacy skills and knowledge to provide quality
legal representation to citizens in need.
During Year One ABA ROLI anticipated two scenarios (or alternatives) based on parliamentary action on
the draft Law on Advocatora, including performing activities that support the creation of an independent
bar if the Law on Advocatura passes, (Alternative A), or an alternate means to accomplish similar goals if
the law is delayed or rejected (Alternative B). For the reporting period, ABA ROLI continued to support
passage of the draft Law, Alternative A, as the draft Law remains in committee.
Pursuant to the work plan, in Year Two there will be continued emphasis on passage of the Law on
Advocatura with the hope that a unified criminal defence bar can be established. In addition to the
legislative reform efforts, ABA ROLI will support legal education and continued training for current
advocates by providing financial and technical support to the Advocates Training Center (ATC) and six
legal clinics through long-term sub-grant agreements. Building on the progress of the Inter-University

Working Group, three new practical skills courses will be presented to the participating universities with
the objective of having the courses incorporated into the university curricula in April and May of 2013.
In February 2013, USAID and the Ministry of Justice signed a memorandum of understanding to create
an electronic version of a bar exam with updated exam questions. ABA ROLI is working with a software
developer to produce a computer-based exam program and has established, with the Ministry of Justice, a
working group to review and update 1,000 multiple choice questions for the computerized evaluation.
This report summarizes ABA ROLI's progress for the period of January 1, 2013 through March 31,
2013.The following programmatic developments over the quarter merit individual mention:
ABA ROLI, through its partnership with the Advocates Training Centre (ATC), conducted a
series of trainings on domestic violence, professional skills of advocates, and commercial
law;
ABA ROLI, in cooperation with the ATC, started training notaries on professional skills and
effective implementation of notary activities.
ABAROLI held an international conference entitled: "Advocacy in contemporary society:
approaches and its role and place in the system of law" in conjunction with the Kyrgyz
Ministry of Justice, the ATC, senior members of Parliament, and the German Society for
International Cooperation (GIZ);
Three practical skills courses have been developed, in draft form, and are in the process of
introduction into law school curriculums.
ABA ROLI held a Client Consulting and Interviewing Competition for the legal Clinics of
Bishkek city. The winning team is now interning in the local ABAROLI office;
USAID signed a memorandum of understanding with the Ministry of Justice of the Kyrgyz
Republic on cooperation in implementation of project activities, under which;
ABA ROLI began developing a computer-based qualification examination for advocates;
ABA ROLI and the Ministry of Justice formed a working group on reviewing and developing
questions for the qualification examination for advocates.
II. PROGRAM ACTIVITIES
Objective One: Supporting Development and Growth of a Unified Bar Association and Well-
Qualified Attorneys Able to Service the Needs of the Public
ALTERNATIVE (A)
Activity One: Support Passage of the Law on Advocatura and Inform Advocates about the Law
The draft Law on Advocatura, which is intended to improve regulation and supervision of the legal
profession in Kyrgyzstan, has been under various levels of consideration for well over a decade. ABA
ROLI has been actively supportive of the law by providing technical support and guidance to the relevant
government bodies working on the drafts, encouraging public support for the law, and involving the
defence advocate community in the process.
In August 2012, a Presidential decree on judicial reform established several commissions to review and
suggest changes to the draft law, and invigorated discussion of the law. Among the various suggestions
was a proposal to create a European-standard single professional bar association of lawyers that mirrored
several provisions of the draft Law on Advocatura. The association would be based on the existing
professional bodies of lawyers with a gradual transfer of rights to advocates. The hope is that the force of
the decree will supplement the combined pressure from the Ministry of Justice, ABA ROLI, and various
local partners and that the law will pass. ABA ROLI understands that passage of the Law is going to take
time and requires many varied efforts, and has held discussion with the ATC, defence advocates,
parliament, and the President’s staff to identify why the law is stalled, and propose active solutions to
these problems.

International scientific/practical conference entitled: "Advocacy in contemporary society:
approaches and its role and place in the system of law"
ABA ROLI has noted the need for consistent
regulations for bar admission and attorney
regulation for years. The current situation of
attorney regulation is inconsistent, arbitrary and
fraught with corruption. Having a single entity
regulate advocates would be a positive step forward.
Following the August 2012 Presidential decree on
judicial reform, ABA ROLI organized a conference
for local stakeholders and international experts on
advocacy, in an effort to further the public discourse
on the matter and increase pressure on Parliament to
take action on a long-standing draft law. On March
12, 2013 ABA ROLI in partnership with the Kyrgyz
State Law Academy, members of parliament, the Ministry of Justice, the Advocates’ Training Center
(ATC), and the German Society for International Cooperation (GIZ), hosted members of Parliament,
representatives of the Offices of the President, the Prime Minister, the Prosecutor General's Office, the
Supreme Court, the Ministry of Justice, members of the academic community, and representatives of the
legal community from all regions of the country in Bishkek.
This conference was designed to raise awareness of the benefits of a unified bar, by providing examples
from the United States, Germany, and Kazakhstan on how their unified Bars work, and showcasing the
benefits of each. By taking this comparative approach, the organisers hoped to build support in the legal
community for the concept, and pressure parliament
to move the law forward.
Following a history of bar reform, current trends in
bar development, and a comparative view of the
role of continuing legal education, conference
participants discussed the draft Law "On the Bar of
the Kyrgyz Republic and advocates’ activity," and
the impact its passage could have strengthening the
administration of justice in modern Kyrgyzstan.
Key discussion points covered bar unification, the
decision between voluntary or mandatory
membership, CLE requirements, and licensing of
advocates.
The participants expressed their vision and proposals on various subjects, including:
- Trends in the development of advocacy in Kyrgyzstan;
- The level of professionalism of lawyers in the country; and
- Opportunities for and benefits of professional development for lawyers and the legal profession, and
whether it was necessary.
Parliamentary member Alymbekov noted that the draft law is pending before parliament, and likely will
be revised before it will be introduced for a second reading.
Activity One Expected Deliverables – Alternative A:
A series of three (3) roundtables held to increase advocate participation in the legislative process,
and one (1) subsequent to the passage of the law.
Completed. Three (3) roundtables were held in March 2012 in Osh and Jalalabad for 63
advocates and representatives from the MOJ and one (1) roundtable was held in April in Issyk-

Kul for 23 participants. A fourth roundtable will be scheduled should the Law on Advocatura
pass.
Adoption of the Law on Advocatura.
On Hold. The Law is still under consideration in Parliament, though the Presidential decree has
renewed momentum on the issue of legal professional and bar reform.
Activity Two: Provide Institutional Support to the National Bar
ABA ROLI will support the Ministry of Justice to host the first Congress of Advocates, at which
members will approve the governing bodies and founding documents, including rules of professional
ethics for advocates, if the Law on Advocatura passes.
No progress was made under this activity during the reporting period due to the Law on Advocatura not
passing.
Activity Two Expected Deliverables – Alternative A
All activities to be completed contingent on the passage of the Law on Advocatura.
ALTERNATIVE (B)
Activity Three: Instituting an Ethics Council to Regulate the Defense Bar
In the event that the Law on Advocatura does not pass, ABA ROLI will support the development of an
independent Ethics Council for defence attorneys; which will be charged with establishing professional
conduct standards for the legal defence community. ABA ROLI’s financial and technical support would
be in lieu of the support budgeted for the bar, which is tasked with enforcing ethics standards under the
Law on Advocatura.
No activities were pursued as part of this activity during the reporting period in order to devote energy to
the passage of the Law itself as described in Alternative A. ABA ROLI will reassess its approach during
the Spring of 2013 pursuant to its work-plan.
Activity Three Expected Deliverables – Alternative B:
All activities to be completed contingent on the Law on Advocatura not passing
Activity Four: ATC CLE Curriculum Development and Trainings
CLE trainings at the ATC are core activities for ABA
ROLI. These practical seminars are aimed at
practicing attorneys, and are designed to enhance skills
and abilities for lawyers, and encourage learning
throughout a lawyer’s career. The trainings cover a
broad range of topics from practical skills and
technical knowledge on specific regulations to
trainings aimed at raising awareness of social
problems like domestic violence.
To ensure that ABA ROLI and ATC can reach the
largest sample of the population, trainings are held not
only in Bishkek, but also Issyk-Kul and other regional locations as possible. The trainings are well
received and well attended. This is in part due to the strong reputation of ABA ROLI, ATC, and the CLE
program.
ATC relies on advanced teaching methodologies, by combining lecture, discussion, group work and
individual assignments into their curriculums to keep participants engaged and ensure the course material

is internalized. This style is a sharp contrast to the traditional, theoretical model employed by most of the
universities.
As a result of these trainings, lawyers are better prepared to positively manage their cases, and clients
receive better and more effective representation. In a country where the reputation of lawyers remains
low, the increased capability of lawyers and the positive experience of clients will contribute to a
changing public mind-set, and increased respect and responsibility for advocates. This, in turn, increases
the prestige and importance of the judicial system and strengthens Rule of Law more broadly.
Domestic Violence
On January 12, 2013, ATC in cooperation with ABA ROLI conducted training on Domestic violence for
eighteen (18) defence attorneys in Bishkek. ABA ROLI and the ATC have provided this training four
previous times in Bishkek and the regions – in an attempt to broaden the role of the legal community in
the fight against domestic violence. Domestic Violence is rampant in Kyrgyzstan, and traditional values
often limit a victim’s ability (or perceived ability) to find a remedy to their issues. Trainings such as this
do more than further the skills of the legal community; they also encourages the public discussion of
Domestic Violence, which can contribute to a social shift and public acknowledgement of this hidden and
taboo social issue. Involuntary bride kidnappings are an example of domestic violence, and still quite
common in Kyrgyzstan. In these trainings, attorneys learned how to annul a forced wedding. This also
helps remove the stigma associated with forced marriages, and supports the notion that it is “OK” to run
away from a forced marriage. The social stigma still exists, and it will take time to change thinking,
however trainings such as this are a solid step to societal change.
This training educated the participants on the basics of
domestic, family, and gender based violence, as well as
the technicalities and implications of the existing law on
domestic violence and how it can be used to a client’s
benefit. The participating attorneys were trained on how
to best represent the interests of their clients and how to
use the current codes to benefit the victims of domestic
violence. Many of the participants of these trainings
have had no experience with domestic violence cases.
This training gave these lawyers the basic information
necessary to identify and pursue remedies for the
victims, and encourage the judicial community to do so
as well.
One of the most important aspects of the training is that the participating lawyers learn the “nuts and
bolts” of getting a protection order – a traditional first step as a victim protects themselves (and often their
children) from further abuse. These orders make it a crime for the perpetrator to contact the victim for six
months, and carry the consequence of immediate arrest for violation of the terms. Since the start of these
trainings, participants are reporting that the police are increasingly enforcing the orders and arresting
perpetrators for violations. Although not currently quantifiable, this change in behaviour and increased
support for victims of domestic violence is evidence of the value of these trainings and the impact they
have on a community.

Attorney’s Fees On January 18, 2013, ATC in cooperation with ABA ROLI conducted training on "Attorney's fees" for 10
advocates from Bishkek.
Setting a fee is always a difficult task for lawyers. There are issues surrounding ability to pay, fairness of
the fee to both parties, and the costs associated with providing legal services. This training addressed that

by giving a definition of attorney’s fee and relevant terms, varieties and recommendations for determining
the amount of fee, and providing examples of agreements
that take into account the amount and complexity of work,
length of time needed to accomplish it, the experience and
qualifications of a lawyer, the degree of urgency of the
work, and other applicable circumstances. Participants
practiced this new skill in individual and group exercises, to
ensure that the new knowledge and skills could be applied
in their own practices.

Invalid Transactions As Kyrgyzstan develops, civil and business law are increasingly important to the economic development
of the country. Both the World Bank and USAID have identified improving the legal commercial climate
as goals for the next five years, highlighting the nascent stage of the current legal climate for investment
and business practices. Knowledgeable commercial lawyers are a key necessity for this development.
However, civil practice is a complicated branch of law, with difficult rules and procedures. While taught
in law schools in Kyrgyzstan, the instruction available is not enough for practitioners to adequately
represent the interests of their clients. On January 26, 2013 ATC, in cooperation with ABA ROLI,
conducted training on "Recognition of void transactions" for 7 advocates of Issyk-Kul.
The training, led by experienced civil lawyers with
significant commercial experience, taught practitioners
how to identify void and voidable transactions, and
remedies available in such situations. Understanding
the flaws in a contract or transaction that could make it
voidable prior to execution is a key skill for ensuring
that transactions go as intended, and contribute greatly
to stability and development in the business sectors. In
turn, strong and clear business standards can increase
the business prospects of a country, and lead to further
development.
The training also covered the standards for multilateral
and bilateral transactions. Please see Attachment C for the Agenda.
Professionalism and the image of an attorney On February 17, 2013, ATC in cooperation with ABA ROLI conducted training on the “Image for
attorneys” for fourteen (14) defence attorneys in Bishkek.
The training was led by the Head of the Inter district Court
of Bishkek, who presented the many factors that contribute
to how a person is perceived, and how that can make for a
successful or unsuccessful lawyer. An interactive discussion
allowed participants to evaluate the factors that contribute to
an attorney’s professional reputation such as professional
competence, personal reputations, and appearance. They
discussed how a positive image influences the relationship
between the attorney and the client by developing trust and
confidence in the capability of the attorney. The training
stressed that the impression an attorney makes on individual
clients and society in whole is a fundamental element of
his/her success and plays into the greater reputation of the
legal profession.

Trainings for notaries
As Kyrgyzstan continues to modify and update their legisilation, Parliament has made significant changes
to the Law on Notaries. The revised Law decreases the authority
of notaries in certain areas and updated common forms in others.
There are 117 licensed state notaries in Kyrgyzstan, many of
whom are unaware of these changes and continue to use old
forms and act beyond their new scope of authority. While other
branches of law enforcement are provided technical assistance
(the judiciary and prosecutors have substantial training
opportunities from the government and ABA ROLI provides
regular training to advocates), little training has been given to
notaries. At the express request of the MOJ, ABA ROLI in
cooperation with ATC is providing trainings to notaries in order
to improve their performance.
On March 13, 2013 ATC in cooperation with ABA ROLI and
Ministry of Justice conducted its first training on “Notaries
practice and professional development skills” for 20 notaries of Bishkek city (8 notaries) and Chui region
(12 notaries). The Head of the Department of Notaries and Advocates, the Chairmen of The Chamber of
Notaries (an NGO), and a Legal Specialist from the Department of Notaries and Advocates were guest
trainers for this event. Participants were provided with hand-outs, including reports, memos, and copies of
the proper certificates and forms they will need to use.
The structure of the training workshop was consistent with most ATC trainings. Participants were
engaged in a lecture on notarial acts, and a discussion of routine notarial acts such as land transactions,
inheritance, and division of property. This was paired with a practical skills discussion on Toktom
software, and uses of the Internet for notaries.
By the end of the training, participants had acquired theoretical and practical skills needed for effective
notary practice, were informed of new laws regulating the field, and were able to work with other notaries
to share skills and information.

Training on Civil Trials
In response to the demonstrated need and the advocates’
request, on March 23, 2013 the ATC, in cooperation with ABA
ROLI, conducted training for 13 defence attorneys - 11 from
Bishkek and 2 from Chui - on civil law cases.
Training objectives were to increase professional competence
and abilities in civil matters, and the trainer, Judge
Asanbekovna of the Leninsky district court in Bishkek, led 13
participants through an introduction to civil procedure. The
course provided explanations of terms commonly used in civil
proceedings and types of cases that could be tried as civil trials
(such as forced civil commitments, electoral rights, and pre-
trial preparation). There was also an instructor led discussion
of trials, including trial procedure, the use and proper
procedure for evidence, and the roles and responsibilities of the
parties. The participants left the training more confident civil
litigators, with increased skills to assist their clients.

Training on the Acquisition of Inheritance
On March 30, 2013, ATC in cooperation with ABA ROLI, conducted training for 17 defence attorneys
from Bishkek on “The acquisition of inheritance”. Inheritance law in Kyrgyzstan is complicated and
practitioners often lack of training and education in the subject. Additionally, and unfortunately, many
inheritance decisions are made by courts based on corrupt practices. To combat this, attorneys need to
have a solid understanding of the law, and be able to argue well when disputes arise. This is another
example of the theoretical training received in school needing to be augmented with practical training
from experts in the field.
Participants received instruction on opening an inheritance claim, distinctions in inheritance law, and
issues that frequently occur in inheritance cases. The course emphasised practical skills for lawyers who
do not usually handle these types of cases, and included a section on economics, and how to set attorney
costs.
In all of these trainings, the attendees gained theoretical and practical knowledge of the subject matter and
were awarded certificates of participation. The demographic breakdown of the trainings is as follows:

ATC Strategic Planning Training
ABA ROLI conducted institutional sustainability training for staff, stakeholders and members of the
Supervisory Board of the ATC from February 13-15, 2013.
To promote sustainable CLE for defense attorneys,
ABA ROLI has previously assisted the ATC in
developing its Strategic and Fundraising Plan for 2010-
2013. ABA ROLI also reviewed the ATC’s budgetary
information to identify sources of support for the
implementation of this plan. As part of this process,
ABA ROLI and the ATC are exploring the
establishment of a revenue base within the
organization. As a first step, ATC prepared cost
estimates for both half-day and full-day CLE courses,
including a portion of overhead expenditures into this
fee. It may take some time for attorneys to get used to
the idea if paying for CLE, however if the Advocatura
bill passes, and mandatory CLE is enacted, this will
provide more incentive for attorneys to pay, and adjust
their fees to account for this cost of doing business.

During the training, ATC developed:
1. A presentation of ATC’s Plans and achievements for 2013.
2. A list of Paid Trainings for 2013.
3. A list of up-coming trainings.
4. An Organizational Chart.
5. Implementation Plan for 2013.
These tools will be used to further develop the sustainability and strength of the ATC.
ATC identified a key programmatic goal for 2013: providing training to 200 lawyers that will increase
their practical skills and enhance their ability to serve the people of Kyrgyzstan. Of the 200 trained, 30
will be new clients, and 30% will be from regions other than Bishkek. Further, they plan to develop at
least 4 new training topics, increase the use of technology in their courses, increase their monitoring and
evaluation system by incorporating new procedures into their standard operating procedures, and to work
with the Ministry of Education and Science to acquire a license for implementing educational programs.
A license would be greater evidence of the high quality educational programs provided, and the
government support for CLE.

Activity Four Expected Deliverables:
Financial support provided to ATC
In Progress. ABA ROLI continues to provide financial support to the ATC under a multi-year
sub-grant agreement. These funds will be used to significantly improve the organizational
capacity of the ATC, develop the training curricula of the organization, and move towards
sustainability.
Twelve (12) topical trainings conducted (four regions, three one-day training each)
Completed and Exceeded. Topical trainings are ongoing and ATC regularly plans for additional
trainings. This quarter, between January and March 2013, ABA ROLI and the ATC provided
eight (8) trainings for 110 participants.
Activity Five: Improving the Qualification Examination Process
Computer-Based Qualification Examination for Defense Attorneys
Currently, Kyrgyzstan employs a paper-based bar exam for testing prospective advocates that consists of
100 questions, focused largely on theoretical knowledge. Administration of the paper-based exam is
difficult to control in a fair and unbiased manner. Computer-based exams, if properly designed, have
several advantages over traditional paper exams, including the
ability to provide randomly generated questions. Exams are
graded upon completion of the exam by the computer. With the
computer system’s electronic security measures answers are
confidential, and results cannot be manipulated.
The Ministry of Justice has been very receptive to ABA ROLI’s
work on this issue, and previously requested ABA ROLI draft a
memorandum of understanding (MOU) between USAID and
the Ministry of Justice to commission such a computer based
bar exam. The MOU identifies ABA ROLI as the implementing
partner, and was signed February 7, 2013 by the Minister of
Justice, Almambet Shykmamatov, and USAID Country
Representative Carey Gordon.
The qualification exam will be conducted by electronic testing

ROLI and the MOJ), 100 of which will be randomly assigned to test takers. With USAID support, ABA
ROLI will provide computer equipment to the Ministry of Justice to conduct the qualification exam, with
the ability to limit access to the equipment and exam content to specific personnel.
In addition to improving the exam itself, ABA ROLI and the ATC, will provide pre-qualification exam
trainings for prospective advocates and separate trainings for notaries to help them prepare for the exam.
Bar Reform Working Group
On March 14, 2013, the working group charged with implementation of the MOU held their first meeting.
The Working Group that was established to develop and implement software for electronic testing for
individuals applying for a license to practice law and notary. It is composed of legal scholars, practicing
lawyers, representatives of ABA ROLI and the Ministry of Justice. The Working group is headed Deputy
Attorney Jyldyz Mambetalieva.
Off-site meeting
ABA ROLI conducted an off-site meeting of the working group on March 29-31 in Issyk-kul.
ABA ROLI facilitated the meeting to revise the content of examination questions and to improve
procedures. The working group added questions on legal ethics based on research materials prepared by
ABA ROLI staff. During this meeting, members of the working group revised and developed a first draft
of the 1000 questions needed for the exam.

Activity Five Expected Deliverables:
Software for computerized exam is configured and adopted
In Progress. ABA ROLI has identified technical experts to develop the necessary software, and
outlined safety and function requirements for the program. Progress will continue on this activity
following USAID and the Ministry of Justice of the Kyrgyz Republic entering into a memorandum
of understanding.
Exam questions are developed
In Progress. The working group conducted their first meetings in March 2013 and developed
draft questions of the qualification examination. Expected completion in June 2013.
Objective Two: Equipping the Next Generation of Lawyers with the Practical Legal Skills and
Knowledge to Provide Quality Legal Representation to Citizens in Need
Activity One: Inter-University Working Group on Practical Skills Curriculum Development
During Year One of this program ABA ROLI established an Inter-University Working Group with
representatives from six universities. The Working Group has developed three new practical skills
courses, which will support the legal clinics (described further in Activity Three below) in meeting a
strategic need for practical skills training for students and new advocates. They will cover the issues of
interviews and counselling, the roles of each party to a case, and the role of a lawyer in the pre-trial stage
of criminal proceedings. These are important skills for lawyers to develop, especially new lawyers, and
are rarely taught in the current law school system. These courses will be made widely available through
the universities, so as to have a greater reach than the natural limit of 30-45 students of the legal clinics.
On February 19 АВА ROLI organized a meeting of the inter-university working group developing the
above courses. As a result of the meeting the working group set timeframes to accomplish the following
activities:
• Develop the Educational Methodological Complex by March 15, 2013, and deliver an
electronic version of the material to ABA ROLI (according to amended schedule of the working
group). Completed in draft form.

• To organize trainings for the professors who will teach the courses (2 professors from each

• To prepare the innovative Educational Methodological Complex and to pilot and publish,
“test versions” in June 2013.
• To organize a pilot space in KNU, KSLA, Academy of MIA, KRSU, OSU, JSU to work
with the Educational Methodological Complex of the courses in the first half of the 2013-14
academic year.
• To conduct monitoring of the pilot Educational Methodological Complex on the courses
with the purpose of advancing and improving the material – September- December 2013.
• To conduct a round table for the professors and the authors of the courses to discuss
methodological and substantial aspects – December 2013.
• To publish the Educational Methodological Complex after possible corrections and review -
end of 2013- beginning of 2014.
On March 10, 15 and 18, 2013 the working group met to finalize the content and related issues of the
courses, and to prepare for the introduction of these courses into the university systems. The courses are
expected to be introduced by May 20, 2013.
Activity One Expected Deliverables:
Approval from universities for new courses to be part of their curricula during the following
academic year.
In Progress. Since universities typically make decisions in April and May on the following year’s
curricula, this activity is expected to be completed later in the year.
Three (3) practical skills courses developed and ready for presentation to universities in
April/May 2013 for approval to incorporate into their curricula.
Completed. The initial drafts of three (3) practical skills courses were completed this quarter by
the Inter-University Working Group.
Activity Two: Support of Practical Skills Through Client Counselling Competitions
Client Consulting Competition for Legal Clinic Students
On February 1-2, ABA ROLI hosted its first Client
Counseling Competition. Thirteen teams representing five
law schools, comprised of 11 males and 15 females,
showcased their interviewing techniques and counseling
skills during the two-day competition. The competition
gave the students from these universities the opportunity to
practice their legal skills, exchange knowledge, and
network with each other.

The competition was held in Bishkek for students from
universities based in the capital: Kyrgyz Russian Slavic
University (who sponsored three teams), Kyrgyz National
University (who sponsored three teams), International
University of Kyrgyzstan (who sponsored three teams),

1st place was given to the Students of the Legal Clinic
of the American University of the Central Asia. In
addition to their trophy and certificates, the winning
pair was invited to join ABA ROLI’s Bishkek office as
Summer Interns to gain further experience and skills.
American University of Central Asia (who sponsored three teams), and the Kyrgyz State Law Academy
(who sponsored one team). Leading up to the competition, students were coached by their supervisors in
practical skills, case studies, legal literature, and technical rules in order to hone their interviewing
techniques and mediation skills. Representatives of the legal clinics in Jalalabad and Osh attended the
competition as observers, in order to prepare their students to compete in future competitions that will
take place other regions of the country.
The highest marks were awarded to a team from the American
University of Central Asia while a team from the Kyrgyz National
University earned second place and third place was awarded to two
teams, both from the American University of Central Asia.
While this was a highly competitive event, all students expressed
their interest to conduct this kind of activity regularly in order to
practice their skills in real-life situations. Students emphasized that
the public element of the competition serves as motivation to
improve their legal knowledge and practical skills to better “show
off” for their peers. While being able to apply their studies through
competing, students also learned from their peers’ experiences how
lawyers can work to succeed in their professional career.
Competing teams were first tasked with
conducting an interview with a client. The
contestants had to respond in a competent, caring,
and appropriate manner while using the
appropriate procedures (stages of interviewing,
ethical and psychological considerations,
identification of a clients’ needs etc.), to gain
necessary information and insight into the root of
the problem. The student lawyer then formed an
opinion, and had to explain it to the client in terms
they could understand. Plain language was
rewarded, as many clients these young lawyers
will encounter in their future careers will have
minimal familiarity with the legal terms and
principles. The contestants discussed the
information and established plans of action. The
student-lawyers were allowed to use any necessary
legislation and legal texts. The teams were
evaluated on their empathy, knowledge of the law, listening skills and demeanour by three judges: two
lawyers and a psychologist.
The second stage of the competition was focused on consulting a client and providing appropriate
solution alternatives that reflected the competition guidelines - following the proper stages of consulting,
being sensitive to ethical and psychological aspects of the case, finding optimal solutions, and clearly and
simply explaining relevant legal information. The students’ work in this stage was evaluated by five
judges.
After the competition the teams and judges met with ABA ROLI staff to reflect on the competition. They
discussed what worked, what did not, and ways to improve the contest for next year. This competition is
anticipated to be conducted annually and reach other regions of the country outside of Bishkek, including
Osh and Jalalabad.

Activity Three: Support and Expansion of Clinical Legal Education
On October 23, 2012 ABA ROLI signed a memorandum of understanding with the legal clinics of six
Kyrgyz university law faculties designed to provide financial and technical assistance to four existing
Bishkek-based legal clinics and two new clinics in Osh and Jalalabad. The memorandum was intended to
facilitate cooperation between ABA ROLI and six legal clinics to develop practical, hands-on legal skills
in law students and to provide quality legal assistance to citizens of the Kyrgyz Republic.
Osh and Jalalabad are areas in which ABA ROLI is
working hard to raise the competency and ability of the
legal community. The ethnic strife that has plagued the
region makes quality legal assistance, especially to
marginalised peoples extremely important. To this end,
efforts are underway to include these regions in as much
of our work as possible. On March 15, the Office
Director for ABA ROLI in Osh, and two staff of the Osh
legal clinic visited the Jalalabad legal clinic. They
attended training conducted by an advocate of the clinic.
Sixteen students discussed two of the clinic’s cases. Both
were divorce and alimony. The students presented
information gained while interviewing the clients
followed by discussion of the cases. The members of the
Osh clinic also met with students from Jalalabad, and
reviewed the case files of other pending matters. At the
time of the visit, the Jalalabad clinic had 15 open cases.
On March 20, the Director of the ABA ROLI Osh office participated in a meeting with students and staff
of the Osh legal clinic. The meeting was devoted to discussion of, and adoption of, an Ethical Code of the
clinic, and an Agreement between the Students and the Clinic. During the two-hour discussion,
amendments were made to both, and the staff and students of the clinic unanimously adopted the Code
and the Agreement. Following a code of ethics will help prepare the students for the ethics portion of the
upcoming electronic bar examination, and is significant in that presently there is no developed ethical
code for lawyers. The code of conduct and contract are similar to the codes already adopted by other
legal clinics.
ABA ROLI is also making an effort to meet regularly with the clinics and clinic staff in Bishkek. On
March 27, ABA ROLI visited the Legal Clinic of the National University of Kyrgyzstan and on the 28th
the Kyrgyz Russian Slavic University. The representatives met students participating in the clinics and
the lawyers/professors supervising them. Topics of discussion included the history of each clinic, the
types of cases handled, and case load. During the meetings the ABA ROLI’s Legal Specialist made a
presentation on the American system of Clinical Education for comparative purposes.
Activity Three Expected Deliverables:
Two (2) Training-of-Trainer sessions for clinic professors are conducted.
In Progress. A second Training-of-Trainers session is scheduled for late summer 2013.
Financial Support to legal clinics is provided.
In Progress. Six clinics signed sub grant agreements, ensuring financial support for continued
programming.
III. UPCOMING ACTIVITIES
The progress of this past quarter has laid the groundwork for great progress in the upcoming quarter.

ATCPriorities:
1. Increasing the number of participants of ATC trainings on 25%
2. Contribution to development of the Continued Legal Education System
3. Introduction of paid-services (commercial trainings)
4. Strengthening the executive body of the ATC
5. Formation of favorable image of ATC among legal community
Expected programmatic results:
DIRECTION: EDUCATION
1. The professional level of at least 200 lawyers in the provision of quality legal aid to the
population of the Kyrgyz Republic is increased, including 30 new participants and 30%
participants from regions of the Kyrgyz Republic;
2. At least four new training courses are introduced;
3. The team of trainers of four new training courses is established;
4. Thirty-five trainings conducted, at least eight out of thirty five are paid trainings. Topics of paid-
trainings are determined in accordance with the needs of lawyers;
5. The license of the Ministry of Education and Science for educational programs is granted;
6. The database of trainers and participants is improved;
7. A system of assessment the impact of the services rendered is introduced;
8. Handbook on trainings materials is developed and posted at the ATC website;
9. Technical parameters of the website is improved to increase the number of visitors among legal
community (the counter of users, maintenance, convenience and quality of the customer, open the
ATC page on Facebook, Classmates, DieselForum etc.)
DIRECTION: ADVOCACY COMPAIGN 1. Background statement on implementation of Continuing Legal Education System is prepared;
2. The Regional/National Conference on Bar reforms is conducted in close cooperation with ATC
partners;
3. Two events to expand the base of support of Continuing Legal Education are conducted (talk
show “Open Kyrgyzstan” , publications in the Internet);
4. The draft law on Advocatura of the Kyrgyz Republic and advocates activities is passed the
second reading.
Organizational development, expected results:
1. The activity of the Supervisory Board of the ATC is enhanced;
2. Executive team, committed to the mission and goals of organization is established
3. Internal Policies of the organization is developed;
4. The capacity of Director on a project management is improved;
5. PR-strategy is implemented;
6. ATC is a member of at least two international networks or associations;
7. ATC received the Ministry of Education and Science License for educational programs;
8. ATC has improved facilities (Xerox, furniture is purchased, Wi-Fi is set, library is expanded and
etc.);
9. PR-strategy is implemented:

• Proposed ATC Structure:
New program ideas:
• Statistics concerning the population and convicted and sentenced prisoners is accessable, with
information on the quality of legal services they received;
• A School for future defense attorneys;
• Conducting conferences with the interactive format in close cooperation with partners
• Expansion of services to enhance the capacity of legal community through the use of new media
(online video tutorials, animation, etc.)
• Popularization of the legal profession: Championship judicial Casey students with the Ministry of
Education, Law of Academy and more.
