Whether it is the Non Resident Indian (NRI) hotel and motel owners that run the biggest prostitution rackets on the sly in the United States or the insider traders and lobbyists who try to sway foreign public opinion and make inroads into other countries through corrupt business practi- ces, unethical lobbying and manipulation of media or the home grown variety that has a voracious appetite for hoarding wealth by hook or by crook; Indians have the ubiquitous distinction of being some of the most corrupt people in the world. Corruption is one thing that we in India can say we are masters of and this is one field where nobody in the world have more expertise than us except for a few small and inconse- quential countries. Corrupt scams and scandals have been galore in India since independence and have become even more so in the present day and time but there seems to be no political force that is against corruption in normal times except in times before some elections. The Indian middle class knows that it is corruption that has helped them make more money for themselves and the Indian poor know that it is corruption that has made them poorer than they were a few years ago. However it is ironical that the Indian middle class is now supporting anti corruption characters like Anna Hazare and the poor still support all the political characters that are endemically corrupt. Although the Indian middle class won't bat an eyelid when they have to pay or take a bribe to get things done, they are jealous of the ones that are richer and more corrupt than them and find common cause with anti corruption crusaders. The illiterate Indian poor believe that corruption is just normal. This shows that jealousy and the feeling of normalcy about corruption is a feature that is peculiar to the Indian public. This is exactly the reason why corruption is a thriving industry in India. However the paradoxical fact remains that if India leaves corruption as it is and not fight it, then India's economy would continue to grow the same way it is growing now. It is one thing for India to be corrupt and another thing to have knee jerk reactions to exposure of corruption scandals. India is mired so deep in corruption that any policy that would stifle corruption would stifle India's growth story. Take for instance the coal scam that came to light. If coal is being extracted by corrupt and illegal means, it still benefits the country's economic growth. If it is stopped would just hurt India's economy. Birac is providing A$1.2 million (Rs 6.8 crore ) to the University and another A$1.4 million (Rs 8 crore) towards the cost of the Indian component of the programme, which will address a nutrition deficiency in Indian population, said Managing Director Renu Swarup. On Thursady morning while on his way to office on bicycle, following severe chest pain, Sivan Kutty fainted on the road and injured his head. He was taken to the nearby dispensary and from there rushed to the BARC Hospital. The Union alleged that he was kept in the surgical ward where the doctors did not properly attend to him till 1.30 pm. Not a senior doctor examined him till that time and was left in the hands of trainee RMOs. The inexperienced RMOs took the case as a minor problem saying it was only a head injury. It was only when the Union representatives insisted and brought pressure from higher officers that Sivan Kutty was shifted to ICU after 2.00 p.m. The doctor who examined him found that his blood pressure was falling and the ECG was abnormal. West Bengal Chief Minister Mamata Banerjee's arresting of a man who asked her a question at a rally reminds one of Hitler and Nazism which makes one wonder whether why only the RSS and BJP in India should be equated with Nazism. Mamta Banerjee seems to be no better.

A man identified as Siladitya Chowdhury and who was dubbed as a Maoist by Banerjee at a public meeting at the former Maoist stronghold of Belpahari was arres-ted when he asked her what steps she was taking to help farmers. Chowdhury had told the chief minister that the farmers were dying and that 'empty promises were not enough'. The chief minister expressed surprise and dubbed Chowdhury as a Maoist while asking the police to arrest him.

This incident is so abhorrent in independent India that even the BJP was taken aback with such a harsh mercurial decision. The BJP stated that answering questions is the duty of political leaders and that they can't run away. The CPI-M, the arch rival of the Tnnamool Congress supremo, dubbed the arrest as 'unfortunate and horrific.” CPI-M MP Nilotpal Basu said the arrest amounted to autocracy and slammed Banerjee -for not being ready to listen to any criticism or question. “They are using the state institutions to act against - people who ask questions,” he said, regretting that the West Bengal government isn't in a mood to tolerate even a little criticism.

Press Council of India chair-man Markendey Katju was very critical of the incident and was calling her “totally dictatorial, intolerant, and whimsical” in her behavior. Katju said that Baner-jee's action is nothing but “blatant misuse” of state machinery and “flagrant violation' of constitu-tional and human rights. Katju, who is usually known to be a

character who likes to be in the limelight by passing comments about everybody and everything in the world, expressed “shock' at the incident and said that officials in West Bengal should take a lesson from the Nuremburg verdict. At the Nuremburg trials, the Nazi war criminals took the plea that orders were orders and they were only carrying out the orders of Adolf Hitler, their superior, but this plea was rejected and they were hanged. Katju said he has changed his opinion about Banerjee whom he had earlier praised. “Her action is most undemocratic to say the least,” he said, holding that Banenjee is totally undeserving to be a political leader. “I had earlier given a statement in favour of Mamata Banerjee because I thought one should see good points in a person's personality also. But now I have changed my opinion and believe that she is totally undeserving to be a political leader in a democratic country like India since she has no respect for constitutional and civil rights of citizens and is totally dictatorial, intolerant, and whim-sical in her behavior,” he said.

At the political level political parties can't run away when questions are asked and it is the duty of politicians to reply. They have to reply. Taking action on people for just asking uncomfort-able questions is just high hande-dness. Katju however is just the other side of the coin who once wanted to severely clamp down on journalists. At that time he was equated to Hitler and now he is equating Mamata to Hitler. In a way it seems that everybody in power in India turns into Hitler whenever it is convenient and at other times they make it a point to criticize the Hitlerian behaviors of others. A case of those living in glass houses throwing stones at others.

Lack of classification of under trial n India, one of the major Ireasons aggravating the

problem of overcrowding of under trial prisoners in jails is that there are no separate detention centers for accommodating them. As such lunatics, non-lunatic offenders, victims of offences women and children are all lodged together in jail under the general category of under trial prisoners. Under the soviet law, there is a strict rule concerning the separate lodging of prisoners who serve a term of imprisonment and those who are taking in to custody pending trial. The procedure for imprisonment before trial is set by the statute of imprisonment before trial.

U.S.S.R alternatives to pre-trial detention. Since the tendency of the penal policy of USSR has been to curtail the number of arrests, various legislative acts envisaging grounds for absolving the offender from criminal responsibility have been enacted. In India, on the other hand, since the legislature has been rather slow in taking steps to ameliorate the

sufferings of the undertrials prisoners the supreme court, in the various cases that have been brought before it through public interest litigation or legal Aid committees, has issued directions and orders to different state authorities, as the case may be to absolve the undertrials from criminal responsibility, either on humanitarian grounds or on acco-unt of a violation of technicalities of the criminal procedure.

In the USSR, provisions have been incorporated in the criminal

codes of various union republics providing alternatives to criminal punishment in cases of minor offences. These alternatives in-clude the transferring of cases by the court, or an investigator or agency of inquiry with the consent of a procurator to a comrade's court, to a collective of working people or to a social organization for re-education and correction or simply subject to the cases for administrative action.

The remedy of compensation. The right to compensation for illegal detention resulting from unlawful actions by state organiza-tions and public organization or by officials in the performance of their duties which is incorporated in the USSR constitution as a fundaments right to which an undertrial prisoner or convict is entitled to deserves a special men-tion. Through a similar provision is not inserted in the Indian constitution and criminal proce-dure code the Supreme Court has in a few recent cases awarded compensation.

A world-class agriculture research and high-tech farming training institute is to be set up in Gujarat in collaboration with Israel government. This was stated by chief minister Narendra Modi while inaugurating a national convention on 'The next frontier of agri-business and technology' at Mahatma Mandir on Monday.

Modi announced that the state will hold a 'Gujarat global agricultural event' once in every three years on the lines of the world's largest agricultural fair in Israel. He said during the biennial vibrant Gujarat summit that agriculture is given importance in Gujarat too.

Calling upon the farmers to take the country to such a height that they could cater to all the agricultural needs of Europe, Modi pointed that it would require farmers' pressure group to force the rulers to change the nation's agriculture related policies.

The two day event is being attended by envoys from seven nations including Israel, Holland and Chile along with 2,000 delegates from state public sector undertaking and agriculture related fields from 11 states of the country. An agricultural fair has also been arranged at the venue.

A white paper on Gujarat's achievements in agriculture was released on the occasion. Modi claimed that in a revolution of sorts, the state made great endeavors in rainwater conservation and water resource management.

While clearing junk from my old residence, I came across a “Hero” fountain pen. It was a vintage item dating back to the 1970's and one of the remaining legacies of my foreign employ-ment. The 60's saw the decline of the fountain pen and by the 70's, it was used only for signing cheques and other documents. The ball point pen replaced the fountain pen. I was surprised to find that this “Hero” pen had survived the ravages of time and was still beautiful. Its golden cap looked like new and glittered. It was made in China. In those days, “Hero” and its counterpart Wang-Sung (or something similar) sold for Rs. 10 per piece and were in great demand in India. Workers who came home from the Gulf always brought with them these pens as gifts for children.

I decided to keep for myself the “Hero”, which was an antique item. It seemed more valuable now than when it was bought. First of all, I had to make sure that it worked. For that ink was needed. Nobody uses fountain pens now. Where will I get ink? I went to the nearest stationery shop and asked for a bottle of ink. The shopkeeper, a lady, promptly brought out a bottle of ink, which was meant for the stamp pad. Stamp pads were still in use and she was not wrong in presuming that I wanted ink for the stamp pad. When I explained to her that I wanted ink for my fountain pen, she was a little surprised. Perhaps she thought that I was a quaint person.. After a search on the dusty corners of the shelves, she finally brought out a bottle of fountain pen ink - royal blue, Camel-KOKUYO. At Rs. 15, it was quite cheap and was sure to last for a year.

During my years in school and college, I remember, I used different brands of pens and inks. To be more exact, during high school and college, because in

those days, everyone used steel pens in primary and secondary classes.

My “Hero” pen was in good shape and it was a pleasant experience to write with a fountain pen after many years. In fact, I am writing this article with the fountain pen. You could get ink in different colours, but the popular ones were blue black and royal blue. Likewise, there were many brands, but Parker Quink was the most famous. The newspaper advertisements for the Parker Quink said, “Don't say ink, say Quink!”. It was one of the best and catchy slogans of that time. The Parker pen and Quink were made for each other.

There were several brands of fountain pens like Parker, Water-man, Ever sharp, Mont blank , Schaeffer's and so on. Inciden-tally, it was Lewis E. Waterman, an American, who invented the fountain pen in 1884. It would have taken a few years for it to be produced on a mass scale and a few more years for it to capture the market. There was the Parker 21 and also the costlier variety of gold plated Parker 51which few could afford. All of them were imported. However, the” Blackbird” also an imported one was the choice of students everywhere. A slim long pen, it wrote well and lasted long. Much later was the entry of the Indian Pen “Swan” which too became popular with the student community.

Prior to the era of fountain pens, people used 'steel' pens. The pen had a wooden handle, the size of a pencil and a steel tip at one end which held the metallic nib. You had to dip it into a bottle of ink every few seconds. This was the way even documents were written. The tables were full of ink stains as the bottles would accidentally tumble down. Since the flow of ink was not even while writing, one had to use the blotting paper to remove the excess ink.

School students too had to carry ink bottles to the school. Every desk in the class rooms had one or more slots for keeping the ink bottle. Till recently, one could see such desks in schools, though steel pens went out of use long ago.

In the heydays of the fountain pens, there were pen repairers at

every nook and corner. The neck, the tongue and the nib, in fact every part of the pen was replaceable. Since most of the ordinary pens would start leaking, some immediately after purchase and others after using for a while, repairmen were in demand. Some ingenious re-pairers displayed a board “Pen Doctor”.

There are three steps to acquiring writing skills. First, the child has to write on a slate with a slate pencil. Then comes the stage when one can use paper and lead pencil. The third step is the pen. Nowadays, in cities such as Mumbai, children start using notebooks and pencil from the nursery classes. My earliest memory of a pencil is that of 'Elephant' brand made in Bavaria, a town in Germany. Then, there was the Perumal Chetty pencil. The writing with this pencil was indelible. If you tried to erase, it would only smudge and leave a violet shade on the paper. Shopkeepers used Perumalchetty for writing their journals and ledgers. Sadly, these pencils are not available any more.

The invention of the ball point pen by LazioBiro, a Hun-garian, in 1938 revolutionized writing, instantly replacing the fountain pen. Ball pens used to be called 'Biro'. They are now used universally, by students for their examinations, by docu-ment writers, and the common man for recording all sorts of transactions. Fountain pens and Pen doctors are no more to be seen. Even the great pen makers like Parker and Shaeffer's have switched over to making ball point pens. Nothing is cheaper than a ball pen which is the most useful article of daily use. I have chanced upon a special ball pen which is 20 CMs long instead of the normal 15 and is available in different colours. Surprisingly, the long one is priced at Rs.3/- a piece while the short one is Rs. 5. I was fascinated by this unusual pen and have been using it for some time. Now I can us either the ball pen or the fountain pen as suits my mood!

outside NMMC Hospital is a cause of concern for pati-ents, as this results in traffic jams. Quite often, ambu-lances can be seen caught in these jam, thus putting lives at risk .

The very purpose of an ambulance is to ensure that the patient reaches the hospital on time. However, the traffic snarls of the city are not letting that happen. Locals allege that the traffic jams outside Navi Mumbai Municipal Corporation (NMMC) Hospital are particularly bad. Most often these jams are caused due to illegal parking outside the hospital. Illegal parking on either side of the road leaves no space for commuters. Suresh Jaiswal, a visitor to the hospital, says, “I just came to see my nephew, but got stuck in the traffic for 20 minutes. What makes the situation worse is the haphazard parking by rickshaw drivers.”

Another resident Anup Tiwari who visited the hospital says, “There is no parking space available for people who wish to visit their sick family members in the hospital. The problem has been there for years but authorities do not pay any heed to the same. I have seen ambulances getting stuck as they have no space to get into the hospital.”

An official from NMMC on condition of anonymity says, “As this is a municipal hospital there are a number of patients who are admitted here daily. Two or three relatives accompany every patient. This creates further chaos. Traffic officials also help by managing the area during peak hours. People can use one side of the road for parking, and leave the other for smooth movement of traffic.”Vijay Patil, DCP, Traffic Navi Mumbai, says, “According to the rule followed by the traffic department no one is allowed to park on the road. If it's a no parking area our official will tow the vehicles. But the situation at the NMMC Hospital is different. There is no parking space within the hospital vicinity. Sometimes the road gets congested, but otherwise the road is big enough for a smooth ride. Public coming to hospital should take some responsibility and park the vehicles properly so that some space is left for the ambulances.”

Four arrested for attack on sub-jailerNAVI MUMBAI: The Navi Mumbai crime branch has arrested

four persons involved in the recent firing on Taloja sub-jailer Bhaskar Kachare. Those arrested includes the main shooter, Prajyot Patil, who has a previous criminal record and was acquainted with the jailer.

On September 6, Kachare allegedly had an altercation with extortionist and gangster Vicky Deshmukh, an inmate at Taloja Central Jail. Deshmukh reportedly decided to teach the jailer a lesson by asking his aides outside to shoot Kachare. Deshmukh had managed to contact Patil while he was being taken to Panvel Court for his hearing. Kachare was shot on September 9, while he was travelling in a car with a friend.

The other three men arrested have been identified as Sangram Khopade, Rupesh Shinde and Rajesh Kaikadi. When the four accused were presented before mediapersons, Patil started shouting that he did not have any other crimes to his credit, as alleged by the police.

However, crime branch investigators confirmed that Patil has a criminal past and is a known acquaintance of Vicky Deshmukh.

Since such cases have become common in BARC Hospital, the Union staged a Dharna in the Hospital. Top officials of BARC such as Controller, Director Bio-Medical Group, Director (P&A) etc. had to visit the Hospital and convene a meeting with the employees who were staging the Dharna. All those who spoke at the meeting deplored the casual and negligent way of handling medical cases in BARC Hospital. After obtaining an assurance from the senior officers that the incident leading to the death of Sivan Kutty would be investigated by a Specialist doctor from outside and after the management agreed to implement the long pending demand for inclusion of Union Representatives in the Hospital Management Committee, the Dharna was called off.

Though the dharna was peaceful, the Security personnel directly under the supervision of Chief Security Officer and a contingent of police personnel were called and posted in the hospital premises by the Administration.

Sivan Kutty (53) who hailed from Kilimanoor near Thiruvanthapuram in Kerala had put in 30 years of service. He was an active member of the Employees Union and was popular in the social, literary and dramatic circles of Anushaktinagar. He leaves behind wife Valsala, an Officer in the Customs and two daughters Pooja and Priya.

According to him, this reversal would be a great blow to the country. The opposition parties may take joy in reversing the policies of the ruling party. But this would be the ruination of India. The government gives licenses and then cancels it. The Govern-ment gives coal blocks and then cancels it. Tomorrow, a new party will come to power and will undo everything what the earlier government has done. This pattern of wavering and volatility is not good for business. People and industries would just lose faith in the Government and prefer not to do any business because they are not sure of the outcome in future.

If coal block has been given to an industrial group and they have done nothing about it for years, then cancellation is justified. India imports coal and desperately need coal for our industries. India desperately needs power for households and industries... And India has coal blocks, which are not going to disappear. India has not made any efforts all these years to evacuate coal and use it for public purpose. Then when somebody uses it albeit through corrupt means, it talks of re-allocating them, These realloca-tions, according to him, would be a big disaster as power companies have borrowed money, put massive amount of equity and debt, domestic and international, to put up power plants. Power plants are ready or power plants are getting but the coal is not there. These mining companies have borrowed huge amounts of money from the banks and ordered goods, turbines, and have completed or nearly completed projects. Now, if they are not allowed to mine for coal, these industries will go into

massive losses and destabilize the economy.

Due to such reactions from the Government, no one wants to take a decision. Even transparent people and honest people are now not willing to take decision for fear of being made scape goats. Many people in the government do not want to take decisions in such circumstances and just keep pushing files. It is very critical that India finds alternative ways rather than resorting to de-allocation of all coal blocks. There are different solutions for different projects and knee jerk reactions are not one of the saner ones. Reversing every economic policy is the beginning of the end of the country. It would be better if India only penalizes corrupt corpora-tions through massive fines rather than cancelling licenses and giving new ones making that a new source for corruption. The famous adage “It only happens in India” is apt to describe the state of affairs of the country. The issue of corruption is far beyond redemp-tion and under such circum-stances, it paradoxically seems that it makes better sense for the Government to have a “chalta hai, hota hai” attitude in all matters of corruption.

Guru Purnima is the annual occasion for expressing gratitude towards the Guru or the Divine Teacher. It is observed in memory of the great Sage Veda Vyasa who is considered to be the supreme preceptor of mankind. The word Guru means “the remover of darkness.” Hence, Guru Purnima, celebrated on a full-moon day, is the day for eradicating ignorance and illuminating our lives with knowledge. In India, spiritual gurus are often equated with God and regarded as a link between the individual and the Immortal. Just as the Moon shines by reflecting the light of the Sun, the disciples gain from their Gurus. Guru is the only assurance for the individual to transcend the bondage of sorrow and experience the consciousness of the Reality. The Guru is con-sidered as an embodiment of the archetypes of Lord Brahma, Lord Vishnu and Lord Shiva, and through His grace one reaches the highest state of wisdom and bliss. Hence, the Guru's guidance helps in managing worldly affairs with ease.

Further, according to the Rishis of yore, cosmic energy flows through the human body: it enters through the crown chakra and leaves through the feet. It is believed that the cosmic energy flows from the Guru's feet in abundance.
