Art. 774. Succession is a mode of acquisition by virtue ofwhich the property, rights and obligations to the extent of the valueof the inheritance, of a person are transmitted through his death toanother or others either by will or by operation of law. 1Concept of Succession.

In general, succession maybe understood in either of two senses. In its broadest juridicalsense, it signifi es the substitution or subrogation of a person inthe transmissible rights and obligations of another. Under thisdefi nition, it embraces not only succession mortis causa, but evensuccession inter vivos. In its strict juridical sense, it signifi es thesubstitution or subrogation of a person in the transmissible rightsand obligations of a deceased person. Under this defi nition, it islimited to succession mortis causa.
