SECTION I – GENERAL PERMIT INFORMATION This Stormwater Program Management Plan (SPMP) was developed for, and will be maintained by, the Maine Turnpike Authority (MTA). The primary location of this document is MTA Headquarters at 2360 Congress Street in Portland.
1.0 OVERVIEW OF REGULATORY PROGRAM On December 8, 1999, the United States Environmental Protection Agency (EPA) published the National Pollutant Discharge Elimination System (NPDES) Regulation for Revision of the Water Pollution Control Program Addressing Storm Water Discharges, which is commonly referred to as the NPDES Phase II Program. State authority was subsequently delegated to the State of Maine Department of Environmental Protection (DEP) in 2003. This document directly addresses the requirements of the NPDES Phase II Program as implemented and administered by the DEP as the regulatory authority for the State of Maine. The NPDES Phase II Program is implemented by the DEP through the issuance of general permits authorizing the discharge of stormwater. This SPMP has been prepared to meet the requirements for authorization of the State of Maine DEP Bureau of Land and Water Quality’s General Permit for the Discharge of Stormwater from Maine Department of Transportation (MaineDOT) and Maine Turnpike Authority (MTA) Municipal Separate Storm Sewer Systems (heretofore referenced as the "General Permit"). DEP originally issued the General Permit on June 3, 2003 and it was subsequently reissued by the Maine Department of Environmental Protection (DEP) on July 1, 2008 and again on July 1, 2013. According to Part I.A of the General Permit, DEP “authorizes the direct discharge of stormwater from a regulated small municipal separate storm sewer system (MS4) operated by MaineDOT or MTA to a MS4 or waters of the State other than groundwater. Discharges must meet the requirements of the General Permit and applicable provisions of Maine's waste discharge and water classification statutes and rules. Compliance with the General Permit authorizes MaineDOT and MTA to discharge stormwater, pursuant to 38 M.R.S.A. § 413.” The General Permit authorizes direct discharges from “operations or activities associated with stormwater runoff from the regulated small MS4 within an identified Urbanized Area1” in those parts of Maine for which the Department has received delegated authority under the Federal NPDES program. The General Permit is effective from July 1, 2013 until midnight June 30, 20182 provided that a completed Notice of Intent (NOI) to seek coverage under the General Permit was submitted by the regulated MS4 (hereafter referred to as “permittee”) and received by the

DEP prior to July 30, 2013. Upon DEP’s receipt of the NOI, interim coverage under the General Permit is authorized for up to 180 days from the effective date of this General Permit or until a complete SPMP is submitted to DEP, at which time the DEP shall provide written notice of coverage to the regulated MS4. A copy of the General Permit is presented in Appendix A.
2.0 REQUIREMENTS OF REGULATORY PROGRAM The General Permit establishes the specific requirements that must be met by MaineDOT and MTA in order for continuous authorization to discharge throughout the effective period described in Section 1.0 of this document.
2.1 NOI SUBMISSION MS4 Permit Part III.A. NOI requirements. MaineDOT and MTA each shall file with the Department a NOI form that meets the requirements of Part III of this General Permit. The NOI must be submitted no later than July 30, 2013. On July 29, 2013, MTA submitted to DEP a completed NOI Form and provided the information requested in Part III.D of the General Permit. A copy of MTA’s NOI submission, including permittee information (e.g., permit number, urban impaired streams and other water bodies, narrative of the roads and drainage ways), is presented in Appendix B.
2.2 STORMWATER PROGRAM MANAGEMENT PLAN MS4 Permit Part IV.A. Stormwater program management plan. Each permittee shall develop, implement and enforce a Stormwater Program Management Plan (“Plan”) implementing six minimum control measures that are designed to reduce the discharge of pollutants from the transportation entity’s regulated small MS4 to the maximum extent practicable to protect water quality, and to satisfy the appropriate water quality requirements of the Clean Water Act. For the purposes of this permit, narrative effluent limitations requiring implementation of BMPs are generally the most appropriate form of effluent limitations when designed to satisfy technology requirements (including reductions of pollutants to the MEP) and to protect water quality. The Plan and all Minimum Control Measures must be substantially implemented by June 30, 20133. The permittee shall describe in its Plan how it will reduce or eliminate polluted stormwater runoff to the maximum extent practicable from its separate storm sewer system within the UA. The permittee shall submit the regulated small MS4’s comprehensive Stormwater Program Management Plan for Department review by no later than December 2, 2013.

This SPMP, including the accompanying tables and figures, has been developed to satisfy the requirements of the General Permit, including descriptions of how MTA will reduce or eliminate polluted stormwater runoff to the maximum extent practicable within the UA. MTA’s SPMP, which includes Table 1 – SPMP Implementation Schedule, addresses each of the six Minimum Control Measures (MCMs) by (1) establishing Measurable Goals (MGs) for which BMPs will be evaluated; (2) identifying the MTA staff responsible for implementing each BMP; and (3) establishing a date for BMP implementation, as appropriate.
2.3 URBAN IMPAIRED STREAM STRATEGY MS4 Permit Part IV.A.1.b. Additional stormwater treatment controls within the UA are necessary for Urban Impaired Stream watersheds. For discharges from the permittee’s infrastructure and operations within the UA, to an Urban Impaired Stream, the permittee shall implement structural and non-structural measures to the maximum extent practicable necessary to control, the discharge of stormwater runoff including known pollutants of concern. Pollutant(s) of concern refer to the pollutant(s) identified as causing or contributing to the waterbody’s impairment. Urban runoff may be used as a surrogate pollutant of concern where information is lacking on specific causes of impairment. Consistent with previous MS4 permit cycles, MTA continues to consider the two highest priority watersheds within UA to be Hart Brook (also known as Dill Brook) and Goosefare Brook. As specified in Part IV.A.1.b, additional stormwater treatment controls for discharges from MTA infrastructure and operations are required for these two priority watersheds for MTA.
2.4 MINIMUM CONTROL MEASURES (MCMs) MS4 Permit Part IV H. Minimum control measures. For each MCM, the permittee shall: define appropriate BMPs; designate a person(s) responsible for each BMP; define a time line for implementation of each BMP; and define measurable goals for each BMP. This SPMP outlines a program of BMPs and MGs for each of the six MCMs:
1. Public education and outreach on stormwater impacts; 2. Public involvement and participation; 3. Illicit discharge detection and elimination; 4. Construction site stormwater runoff control; 5. Post-construction stormwater management in new development and
redevelopment; and 6. Pollution prevention and good housekeeping in community/facility operations.
For each of the MCMs, MGs will be used to evaluate the designated BMPs. These MGs have been assigned an implementation schedule and/or milestones for each applicable BMP. As mentioned above, additional stormwater treatment controls within UA for

MTA’s two highest priority Urban Impaired Streams are addressed and incorporated into the SPMP. These MCMs are discussed in detail in Section II and presented as a work plan in Table 1 along with an implementation schedule and identification of the designated MTA personnel responsible for implementing each BMP.
2.5 MAINTAINING AN UPDATED PLAN MS4 Permit Part IV(B) Keeping Plans Current. The permittee shall keep the Plan current. Circumstances when the Plan must be amended include the following:
1. Amended plan. The Plan must be amended if the Department or the permittee determines that:
a. The actions required by the Plan fail to ensure or adequately protect against pollution of the waters of the State other than groundwater;
b. The Plan does not prevent the potential for a significant contribution of pollutants to waters of the State other than groundwater;
c. The Plan does not meet one or more requirements of this General Permit; or d. New information results in a shift in the Plan’s priorities.
2. Department notification. The Department shall notify the permittee if it determines that the Plan must be amended. Within 30 days of such notification, unless otherwise specified by the Department in writing, the permittee shall respond to the Department indicating how the permittee intends to modify the Plan to address these requirements. Within 90 days of this response or within 120 days of the original notification, whichever is less, unless otherwise specified by the Department in writing, the permittee shall revise the Plan. The permittee shall perform all actions required by the revised Plan in accordance with the timelines in the revised Plan, and certify to the Department that the requested changes have been made and implemented.
3. Permittee information. The permittee shall provide such information as the Department requires to evaluate the Plan and its implementation. The permittee shall note minor modifications to the Plan in its annual report. Major modifications to the Plan such as a change in the Plan’s priorities must be submitted to the Department and approved prior to implementation.
In the event that one of the circumstances listed above occurs, this SPMP will be amended accordingly. MTA understands that failure to complete or update a SPMP in accordance with this General Permit does not relieve a permittee of responsibility to implement actions required to protect the waters of the State and to comply with all conditions of this General Permit.
2.6 EVALUATION AND ASSESSMENT
MS4 Permit Part IV(D) Evaluation and assessment. As specifiedin Part IV(J)(1), the permittee shall evaluate program compliance, the appropriateness of identified BMPs, and progress towards achieving identified measurable goals. With respect to the requirements of this General Permit, MTA will evaluate the program compliance, appropriateness of BMPs, and the progress towards achieving the MGs of the six MCMs identified in Table 1 as part of the annual reporting requirements.

2.7 PLAN SIGNATURES AND AVAILABILITY
MS4 Permit Part IV(F)(1) Signature. The Plan must be signed by the chief elected official or principal executive officer. The Plan must be retained by the chief elected official or principal executive officer for the duration of the permit period and copies must be available and retained by permittee’s officials or employees responsible for implementation of the Plan. This SPMP has been certified in accordance the General Permit. The certification is included on Page i. Copies of the SPMP are retained by the Environmental Services Coordinator. MS4 Permit Part IV(F)(2) Plan availability. The permittee shall make a copy of the Plan available to the following immediately upon request: (a.) The Commissioner of the Department; (b.) In the case of a regulated small MS4 adjacent to or interconnected with the permittee's storm sewer system, to the operator of that regulated small MS4; and (c.) In the case of a regulated small MS4 stormwater discharge to a water supply watershed, to the public water supply company. A copy of this SPMP and the associated records are retained at the MTA Headquarters facility. Upon request, a copy of the SPMP will be made available to the following:
The DEP Commissioner; The operator of a host MS4; and The public water supply company.
2.8 SHARING RESPONSIBILITY MS4 Permit Part IV(I)(1)Reliance on another entity. The permittee may satisfy the requirement to implement a BMP for a MCM by having a third party implement the BMP. If the permittee is relying on a third party to implement one or more BMP(s), the permittee shall note that fact in the Plan and annual report. If the third party fails to implement the BMP(s), the permittee remains responsible for its implementation. MTA will identify any BMPs that a third party may be responsible for implementing in the SPMP and subsequent annual reports. MTA understands that failure to implement the BMP by the third party remains the responsibility of the permittee. MS4 Permit Part IV(I)(2) Qualifying State or Federal Program. If a BMP or MCM is the responsibility of a third party under another NPDES or MEPDES permit, the permittee is not required to include such BMP or MCM in its stormwater management program. The permittee shall reference this qualifying program in its Plan. The permittee is not responsible for implementation of a qualifying program if the third party fails to perform. The permittee shall periodically confirm that the third party is still implementing this measure. If the third party fails to implement the measure, the Plan may be modified to address the measure, if necessary. In the event that a qualifying program is relied upon to implement a BMP, MTA will identify these BMPs in Table 1 in the last column entitled, Responsible Party. MTA

understands that periodic confirmation of BMP implementation with the third party may be necessary. MS4 Permit Part IV(I)(3) Other MS4 Permittees. The permittee shall identify interconnections within the regulated MS4s and find ways to cooperate with other regulated entities. These interconnections include both those leaving the system and those entering the system. To the extent allowable under State or local law, the permittee shall cooperate with an interconnected MS4 in instances of discharges impacting a regulated small MS4. Although some interconnections to other regulated small MS4s have already been identified to date as part of the previous MS4 permit, MTA will continue to cooperate with host MS4 communities that operate an interconnected MS4 system with MTA, if discharges impact one another.
2.9 ANNUAL REPORTING AND RECORD KEEPING
MS4 Permit Part IV(J) Reporting and record keeping requirements -- 1. The permittee shall keep records required by this permit for at least three (3) years following its expiration or longer if requested by the Commissioner. The permittee shall make records, including its Plan, available to the public at reasonable times during regular business hours. MTA will maintain this SPMP and the associated records required by the General Permit for at least 3 years following expiration of the General Permit, or longer if requested by the Commissioner. A copy of the SPMP and associated records will be maintained at MTA Headquarters and will be made available to the public upon written request at reasonable times during regular business hours. MS4 Permit Part IV(J) Reporting and record keeping requirements – 2. By September 15, 2014, and annually thereafter by September 15, the permittee shall submit a report for the Department's review and approval. The report must include the following: a. The status of compliance with permit conditions, an assessment of the appropriateness of
identified BMPs and progress towards achieving identified measurable goals for each of the MCMs.
b. Results of information collected and analyzed, including monitoring data, if any, during the reporting period.
c. A summary of the stormwater activities the permittee intends to undertake pursuant to its Plan during the next reporting cycle.
d. A change in any identified measurable goals that apply to the program elements. e. A summary describing the activities, progress, and accomplishments for each of the MCMs #1
through #6 (including such items as the status of education and outreach efforts, public involvement activities, stormwater mapping efforts, dry weather inspections, detected illicit discharges, detected illicit connections, illicit discharges that were eliminated, construction site inspections, number and nature of enforcement actions, post construction BMP status and inspections, and the status of the permittee’s good housekeeping/pollution prevention program).

MTA will continue to report annually to DEP the requirements listed above from Part IV(J) of the General Permit. On or before September 15 of each permit year, this annual report will be submitted to DEP at the following address:

In the event that comments are received as a result of DEP’s review of the annual report, MTA understands that the specified changes to the report must be submitted to the Department within 30 days of the receipt of the comment(s).
2.10 IMPAIRED WATERS AND TOTAL MAXIMUM DAILY LOAD (TMDL) MS4 Permit Part IV(K) Impaired waters and total maximum daily load (TMDL). If the waterbody to which a discharge drains is impaired and has an EPA-approved TMDL, then the discharge must be consistent with the TMDL waste load allocation and any implementation plan. This General Permit does not authorize a direct discharge that is inconsistent with the waste load allocation (“WLA”) of any EPA approved TMDL. If a TMDL is approved or modified by EPA subsequent to the effective date of this General Permit, the Department shall notify the permittee and may require any of the following. 1. Require the permittee to review its plan for consistency with the TMDL, and propose any
necessary modification to the plan to the Department within six months of the receipt of notification concerning the TMDL.
2. Issue a watershed-specific general permit for the area draining to the impaired water body. The watershed-specific MS4 general permit may reference parts of this General Permit.
3. Require an individual permit. In the event that a TMDL for an impaired water body within MTA’s ROW is approved or modified by EPA subsequent to the effective date of this General Permit, MTA will strive to comply with the requirements of Part IV(K) of the General Permit following DEP notification.

SECTION II MINIMUM CONTROL MEASURES MS4 Permit Part IV H. Minimum control measures -- For each MCM, the permittee shall: define appropriate BMPs; designate a person(s) responsible for each BMP; define a time line for implementation of each BMP; and define measurable goals for each BMP. In accordance with the Maine DEP’s General Permit for the Discharge of Stormwater from MaineDOT/MTA MS4 Facilities, this SPMP has been developed to outline a program of BMPs and MGs addressing each of the six MCMs designed to reduce the discharge of pollutants from the MTA’s MS4 to the extent practicable to protect water quality, and to satisfy the appropriate water quality requirements of the Clean Water Act (CWA). This section, along with Table 1, addresses BMPs, MGs, an implementation schedule for BMPs and/or MGs, as well as the delegated responsible party and methodology for implementation of the respective BMPs for each of the six MCMs. The following subsections provide a narrative of MTA’s methodology to satisfy the specific MCM requirements, while detailed information is presented in Table 1 of this SPMP. MS4 Permit Part IV.A.1.b. Additional stormwater treatment controls within the UA are necessary for Urban Impaired Stream watersheds. For discharges from the permittee’s infrastructure and operations within the UA, to an Urban Impaired Stream, the permittee shall implement structural and non-structural measures to the maximum extent practicable necessary to control, the discharge of stormwater runoff including known pollutants of concern. Pollutant(s) of concern refer to the pollutant(s) identified as causing or contributing to the waterbody’s impairment. Urban runoff may be used as a surrogate pollutant of concern where information is lacking on specific causes of impairment. As previously mentioned in Section I, Part IV.A.1.b of the MS4 General Permit requires additional stormwater treatment controls within UA for discharges from MTA infrastructure and operations within UIS watersheds. These UIS strategies to control the discharge of stormwater runoff are detailed in Table 1 for each corresponding MCM, generally in red text. The UIS strategies are primarily applicable to the two chosen highest priority watersheds; these are Hart Brook (also known as Dill Brook) in Lewiston and Goosefare Brook in Saco. A brief narrative summary of UIS strategies is also provided in the subsections below. 1.0 MCM 1 - PUBLIC EDUCATION AND OUTREACH MS4 Permit Part IV(H)(1) Public education and outreach on stormwater impacts. The three goals of this minimum control measure are: 1. To raise awareness that polluted stormwater runoff is one of the most significant sources of water quality problems for Maine’s waters; 2. To motivate staff and contractors to use Best Management Practices (BMPs) which reduce polluted stormwater runoff; and 3. To reduce polluted stormwater runoff as a result of increased awareness and utilization of BMPs.

The permittee will fulfill the requirements for Public Education and Outreach by continuing the existing efforts that were initiated under the previous 5-year SPMP. These BMPs include raising awareness, identifying target BMPs, evaluating process and impact indicators annually and maintaining on-going education and outreach efforts.
1.1 AWARENESS PLAN
MS4 Permit Part IV(H)(1)(a)(i) Raise Awareness (Goal 1): Beginning July 1, 2013, each permittee shall continue raising awareness of stormwater issues amongst employees and contractors. 1. Each permittee shall establish measurable goals. Progress of these goals must be reported annually for process indicators and in years 1 (background), 3, & 5 for impact indicators. 2. Each permittee shall include a review in its fifth year Annual Report. The review must include an analysis of the process indicators and impact indicators. MTA will continue to maintain and implement the existing Stormwater Awareness Plan, with an emphasis on raising awareness within the two designated highest priority watersheds. MTA’s progress in raising awareness of polluted stormwater runoff issues will be assessed and reported to DEP in accordance with the specified schedule in the General Permit for process and impact indicator assessments.
1.2 BMP ADOPTION PLAN
MS4 Permit Part IV(H)(1)(a)(ii) Targeted BMP Adoption (Goal 2): Beginning July 1, 2013, each permittee shall continue outreach efforts from the previous permit cycle while encouraging employees and contractors to utilize BMPs that minimize stormwater pollution. 1. Each permittee shall set measurable goals. Progress on these goals must be reported annually for process indicators and in years 1 (background), 3, & 5 for impact indicators. 2. The permittee shall include a review in fifth year Annual Report. The review must include an analysis of the process indicators and impact indicators. MTA will continue to maintain and implement the existing BMP Adoption Plan that identifies target BMPs to be utilized by employees and contractors that minimize stormwater pollution. 1.3 CONTINUATION OF EXISTING EDUCATION AND OUTREACH EFFORTS MS4 Permit Part IV(H)(1)(a)(iii) Compliance with this MCM will be based upon: 1. Continued existing education and outreach efforts; 2. Reported process and impact indicators; and 3. Completed annual reports and a 5-year analysis of the plans. MTA will continue the existing education and outreach efforts established during the previous 5-year SPMP, which are included in Table 1. As part of the UIS strategy associated with this MCM, information regarding MTA’s two designated highest priority watersheds will be incorporated into the existing education and outreach efforts continued from previous MS4 permit cycle. MTA’s progress in continuing education and outreach efforts will be assessed and reported to DEP in accordance with the specified schedule in the General Permit for process and impact indicator assessments. 2.0 MCM 2 – PUBLIC INVOLVEMENT AND PARTICIPATION MS4 Permit Part IV(H)(2) Public involvement and participation. The goal of this minimum control measure is to involve the permittee's community including various departments, bureaus or facilities, and when applicable involve regulated small MS4 communities in both the planning and implementation process of improving water quality and reducing quantity via the stormwater program. An active and involved participation process is crucial to the success of a stormwater management program because it allows for broader support, additional expertise and a conduit to other programs. The permittee will fulfill the requirements for Public Involvement and Participation by continuing to notify the public in accordance with FOAA requirements and coordinate with host MS4 communities, MaineDOT and other regional groups.
2.1 PUBLIC NOTICE REQUIREMENT
MS4 Permit Part IV(H)(2)(a)(i) Public notice requirements. The permittee shall comply with applicable state and local Public Notice requirements using effective mechanisms for reaching the public, and comply with the public notice requirements of the Maine Freedom of Access Act, 1 M.R.S.A. §§ 401 et seq. ("FOAA") when the permittee involves stakeholders in the implementation of this General Permit. The permittee shall document the meetings and attendance through the annual report as a way of measuring this goal. MTA will continue to maintain the written public notice policy, announcements, and meeting logs in compliance with FOAA requirements.

2.2 COORDINATION WITH REGULATED COMMUNITIES
MS4 Permit Part IV(H)(2)(a)(ii) Coordinate with regulated community(s). The permittee shall coordinate efforts by providing information on planned construction, and maintenance activities to Regulated Small MS4 municipal stormwater coordinators. The permittee shall develop a strategy to ensure involvement, mutual cooperation and coordination with Regulated Small MS4 municipalities, and report on such efforts annually pursuant to Part IV(J) on joint efforts, meetings attended, projects and coordination. MTA will continue open communication with host MS4 communities. Documentation of regular communication and/or meetings (i.e., Interlocal Stormwater Working Group (ISWG) meetings, meetings with MaineDOT and DEP, etc.) will be maintained to be included in the summary for the annual report. 3.0 MCM 3 – ILLICIT DISCHARGE DETECTION AND ELIMINATION (IDDE) MS4 Permit Part IV(H)(3) IDDE – (a) Required strategies. Each permittee shall develop, implement and enforce a program to detect and eliminate illicit discharges and non-stormwater discharges, as defined in 06-096CMR521(9)(b)(2), except as provided in Part IV(H)(3)(b) of this permit. MTA’s IDDE Program includes (a) watershed based storm sewer system infrastructure map(s); (b) prioritized dry weather outfall inspections; and (c) an illicit discharge detection strategy for the open ditch system within the two highest priority watersheds. Specific BMP options and requirements of the MS4 General Permit are discussed in the subsections below and summarized in Table 1.
3.1 VERIFY WATERSHED BASED MS4 INFRASTRUCTURE MAP
MS4 Permit Part IV(H)(3)(a)(i) By June 30, 2015, each permittee shall ground verify its watershed based storm sewer system infrastructure map(s) in its highest priority watershed within the UA showing the location of all stormwater catch basins, connecting surface and subsurface infrastructure depicting the direction of in-flow and out-flow pipes, and the locations of all discharges from all stormwater outfalls operated by the regulated small MS4. Each catch basin must be uniquely identified to facilitate control of potential illicit discharges, and to ensure proper operation and maintenance of the structures. For each outfall, the following information must be included: type, (e.g. 24” concrete pipe or ditch) material, and size of conveyance, or channelized flow the name and location of the immediate surface waterbody or wetland to which the stormwater runoff eventually discharges. If an outfall does not discharge directly to a named waterbody, identify the name and location of the nearest named waterbody to which the outfall eventually discharges. MTA maps of the separate storm sewer system within the two highest priority watersheds will be reviewed, ground verified and updated to reflect the required attributes, in accordance with the implementation schedule in Table 1.

3.2 IMPLEMENT COORDINATED INSPECTION PROGRAM
MS4 Permit Part IV(H)( 3)(a)(ii) Each permittee shall continue to implement a prioritized dry weather outfall inspection plan based on drainage areas such as an urban impaired stream watershed, or based on a watershed or sub-watershed that the permittee has identified as having the greatest potential threat to the receiving water. In the first permit year, each permittee shall petition regulated MS4 municipalities to conduct a coordinated dry weather MS4 inspection program. In permit years two through five each permittee shall implement at least two coordinated watershed based illicit discharge detection and elimination programs. Permittees shall continue to implement prioritized dry weather inspections for remaining urban impaired streams within the UA. MaineDOT/MTA shall continue to implement its procedure/policy or protocol that details the steps that must be taken when an illicit discharge is identified during these inspections to locate the source of the illicit discharge and eliminate it. MTA anticipates reviewing and updating the existing dry weather inspection procedure for outfalls within the two highest priority watersheds to identify the greatest perceived potential threat to receiving waters in accordance with the implementation schedule in Table 1. MTA also anticipates identifying two regulated MS4 host municipalities within UA, with which MTA will participate in conducting a coordinated dry weather inspection.
3.3 IMPLEMENT OPEN DITCH ILLICIT DISCHARGE PROGRAM
MS4 Permit Part IV(H)(3)(a)(iii) MaineDOT/MTA shall implement an illicit discharge detection and elimination program to their open ditch system within their two highest priority watersheds. MTA will continue to utilize existing mechanisms (i.e., IDDE Notification Form, Mobile SPCC Plan Spill Report Forms, Highway Safety Incident Response Procedures and the Annual Comprehensive Inspection conducted by MTA’s General Engineering Contractor) to detect and eliminate illicit discharges in the open ditch system within MTA's two highest priority watersheds. These mechanisms will be reviewed and updated as needed, as seen in Table 1.
3.4 IDENTIFY NON-STORMWATER DISCHARGES MS4 Permit Part IV(H)(3)(b) This permit authorizes the following non-stormwater discharges provided they do not contribute to a violation of water quality standards, as determined by the Department; these discharges must be addressed in the Plan if they are identified by the permittee as significant contributors of pollutants to the regulated small MS4.

Consistent with the previous MS4 cycles, a limited number of authorized non-stormwater discharges were identified and documented. These primarily included air conditioner condensate from window-mounted units at Fare Collection facilities (e.g., toll plazas). MTA will continue to identify and document additional authorized non-stormwater discharges as they are discovered.
4.0 MCM 4 – CONSTRUCTION SITE STORMWATER RUNOFF CONTROL MS4 Permit Part IV(H)(4). Construction site stormwater runoff control --–(a) Required Strategies. Continue to implement and enforce a program or modify an existing program, to reduce pollutants in any stormwater runoff including discarded building materials, concrete truck washout, chemicals, litter, and sanitary waste that may cause adverse impacts to water quality from construction activities that result in a land disturbance of greater than or equal to one acre. Reduction of stormwater discharges from construction activity disturbing less than one acre must be included in the program if that construction activity is part of a larger common plan of development or sale that would disturb one acre or more. Each permittee must include standard operating procedures for addressing and implementing compliance inspections and enforcement actions. As discussed with DEP and MaineDOT during previous MS4 permit cycles, MTA has proposed developing a MEPDES Memorandum of Agreement (MOA) with DEP in a coordinated effort with MaineDOT. The purpose of the MEPDES MOA would be to address the requirements of MCM #4 to reduce pollutants in stormwater runoff from construction activities, as well as other MCMs that are somewhat analogous and/or duplicative with other MEPDES general permits. However, when this MEPDES MOA was not developed, MTA instead developed a Construction Project Environmental Compliance (CPEC) Program under the previous MS4 permit cycle to address stormwater management issues, including runoff from construction activities conducted by MTA and/or their contractors. At this time, MTA is prepared to continue implementing (and revising as needed) the CPEC Program, unless or until a MEPDES MOA is established, to address construction site stormwater runoff controls.

5.0 MCM 5 – POST-CONSTRUCTION STORMWATER MANAGEMENT MS4 Permit Part IV(H)(5)(a)(i) Each permittee continue to implement, and enforce a program to address stormwater runoff from new development and redevelopment projects that disturb greater than or equal to one acre, including projects less than one acre that are part of a larger common plan of development or sale, that discharge into the MS4 or directly to waters of the State other than groundwater. This program must ensure that controls are in place that are designed to prevent or minimize water quality impacts. (ii) Each permittee shall develop and implement strategies that include a combination of structural and/or non-structural best management practices (BMPs) appropriate for its regulated small MS4. (iii) To ensure adequate long-term operation and maintenance of post construction BMPs, each permittee shall develop and implement, as part of its Stormwater Program Management Plan, an approved BMP inspection schedule that at a minimum stipulates that new BMPs are inspected at least once during the first year of installation. Post construction BMP inspections must determine if the BMP is adequately maintained and is functioning as intended or requires maintenance. If the post construction BMP requires maintenance, provide a record of the deficiency and corrective action(s) taken. Each permittee shall include the following in their annual report: The cumulative number of post construction BMPs discharging directly into waters of the State
other than groundwater or into or from their separate storm sewer system; The number of sites with documented functioning post construction BMPs; and The number of sites that required routine maintenance or remedial action to ensure that the
post construction BMP is functioning as intended. Similarly, MTA is prepared to continue implementing (and revising as needed) the CPEC Program, unless or until a MEPDES MOA is established, to address post-construction stormwater management in new development and redevelopment. 6.0 MCM 6 – POLLUTION PREVENTION/GOOD HOUSEKEEPING MS4 Permit Part IV(H)(6) Pollution prevention and good housekeeping in community/facility operations. This MCM has the ultimate goal of preventing or reducing pollutant runoff from MaineDOT’s/MTA’s roads, other paved surfaces, infrastructure, and facilities through the development and implementation of an operation and maintenance (O&M) program. MTA will continue to implement existing mechanisms (e.g., CPEC Program, Training Programs, etc.) to fulfill the requirements for Pollution Prevention and Good Housekeeping within UA at MTA facility operations, unless and until a MEPDES MOA is developed with DEP in cooperation with MaineDOT. 6.1 POTENTIAL POLLUTANT SOURCES AND OPERATIONS MS4 Permit Part IV(H)(6)(a)(i) Each permittee shall evaluate and maintain its inventory of potential pollutant sources and associated operations conducted in, on, or associated with facilities, buildings, roads, travel ways including right-of-way owned or operated by the permittee that have the potential to cause or contribute to stormwater or surface water pollution. Each permittee shall continue to implement its written operation and maintenance procedures that

include maintenance schedules and inspection procedures to ensure long-term operation of structural and non-structural controls that reduce stormwater pollution to the maximum extent practicable. These procedures must address, as applicable:
Proper use, storage and disposal of petroleum and non petroleum products, hazardous materials, waste materials, pesticides and fertilizers including minimizing the use of these products and an alternative product analysis;
Spill response and prevention; Vehicle and equipment storage, maintenance and fueling; Landscaping and lawn care including, where applicable and not subject to other
federal regulations, an evaluation of reduced mowing frequencies, establishing and maintaining buffers, cutting vegetation within 100 feet of a stormwater conveyance or surface water;
Erosion and sedimentation control; and Disposal of road-killed wildlife.
MTA will continue to rely on existing structural and non-structural controls to reduce stormwater pollution from MTA facilities, buildings, roads, and travel ways, such as:
Abbreviated Storm Water Pollution Prevention Plan (SWPPP) elements integrated into SPCC Plans at MTA Maintenance Facilities;
Standard contract language requiring contractors to utilize secondary containment and develop spill plans at construction sites;
Road kill policies and procedures; MaineDOT’s BMP Manual for Erosion and Sedimentation Control at construction
projects; or Other mechanism to be determined or as applicable.
6.2 MTA EMPLOYEE TRAINING MS4 Permit Part IV(H)(6)(a)(ii) Each permittee shall continue to implement annual employee training to prevent and reduce stormwater pollution from permittee operations and facilities. The permittee shall report annually on the types of trainings presented, the number of employees and contractors that received training, the length of the training, and training effectiveness. The existing training program addressing stormwater pollution prevention, and erosion and sediment control for MTA employees will be continued and revised, as appopriate. The annual report will include the required training information.
6.3 STREET SWEEPING MS4 Permit Part IV(H)(6)(a)(iii) The permittee shall continue to implement a program to sweep all paved streets and parking lots maintained by the permittee at least once a year as soon as possible after snowmelt. As reported in previous MS4 permit cycles and the Chapter 500 Stormwater Management MOA annual reports, MTA currently maintains a regular street sweeping program ensuring

that all paved areas are swept at least one time per year, with a greater priority given to paved areas within UIS watersheds (e.g., swept as soon after snowmelt as possible). 6.4 CLEANING OF STORMWATER STRUCTURES INCLUDING CATCH BASINS MS4 Permit Part IV(H)(6)(a)(iv) The permittee shall continue to implement a program to evaluate and, if necessary, clean catch basins and other stormwater structures that accumulate sediment at least once every other year and dispose of the removed sediments consistent with the requirements of current state law. The permittee shall clean catch basins more frequently if inspections indicate excessive accumulation of sediment. Excessive accumulation is greater than or equal to 50 percent filled. Consistent with previous MS4 permit cycles, MTA currently operates an annual catch basin cleanout program that also includes inspection of outfalls within UA. MTA expects to continue this program throughout the coming 5-year SPMP. 6.5 MAINTENANCE AND UPGRADING OF STORMWATER CONVEYANCES AND OUTFALLS MS4 Permit Part IV(H)(6)(a)(v) The permittee shall evaluate and implement a prioritized schedule, as necessary, for repairing or upgrading conveyances, structures and outfalls of the regulated small MS4. Consistent with previous MS4 permit cycles, a comprehensive inspection of the MTA infrastructure is conducted on an annual basis by MTA’s general engineering consultant. This annual inspection includes observation of all MTA-owned infrastructure, including conveyance structures and outfalls. A prioritized list of repairs and upgrades are then presented to MTA Highway Maintenance and/or Engineering for consideration. 6.6 STORMWATER POLLUTION PREVENTION PLANS (SWPPP’s) MS4 Permit Part IV(H)(6)(a)(vi) The permittee shall evaluate and implement their stormwater pollution prevention plan(s) (“SWPPP”) for vehicle maintenance facilities operated by the permittee within the UA unless the facility is currently regulated under Maine’s Industrial Stormwater Program. The SWPPP must meet the requirements including the quarterly visual monitoring per Maine’s Multi-Sector General Permit (“MSGP”) published April 26, 2011. Unless and until a MEPDES MOA is developed to address SWPPP requirements for Maintenance Facilities, MTA will continue to rely on existing mechanisms (e.g., SWPPP elements incorporated into SPCC Plans); however, all MTA Maintenance Facilities are located outside of MS4-regulated UA.

This potential MOA is expected to be
reasonably consistent with the standards
established by the DEP in MCMs #4 through #6
of this MS4 General Permit (GP), as well as the
analogous requirements in the Maine
Construction General Permit (MCGP) and
DEP's Multi-Sector General Permit (MSGP).
Each permittee shall include the following in
their annual report:
-the cumulative number of post construction
BMPs discharging directly into waters of the
State other than groundwater or into or from
their separate storm sewer system;

pollutant sources and associated
operations conducted in, on, or
associated with facilities, buildings,
roads, travel ways including right-of-

surface water pollution. Each
permittee shall continue to implement
its written operation and maintenance
procedures that include maintenance
schedules and inspection procedures

(4) landscaping and lawn care including,
where applicable and not subject to other
federal regulations, an evaluation of reduced
mowing frequencies, establishing and
maintaining buffers, cutting vegetation within
100 feet of a stormwater conveyance or
surface water;
(5) erosion and sedimentation control; and
(6) disposal of road-killed wildlife.

NOTES:
1.) UA for 2013 Permit is based on 2010 Census data downloaded from DEP'swebsite. The 2013 UA maps that apply to MTA ROW have been attached as Figures1 through 5. Corresponding MM designations were determined using featuresidentified on MTA's Mileage Chart with Stationing - 2012 (printed September 24,2012).
2.) Mile Marker (MM) designations for UA delineations should be consideredapproximate and will be confirmed and updated, as necessary and as more detailedmapping information is made available.
3.) MTA facility features identified within each host MS4 communities include theroadway (i.e., paved roads, bridges, etc.) and ROW (i.e., approximate 300-foot widecorridor along MTA roadway), as well as interchanges, park-and-ride lots and tollplazas as indicated (i.e., each interchange is estimated to be 25 acres on average)."None identified" indicates that only MTA roadway and ROW are present within theUA delineation. This table will be updated as more detailed mappinginformation is made available and/or in the event that MTA facility features areconstructed within UA delineations.
4.) In 2013, streams were identified by using the National Hydrography Dataset(NHD), available from USGS. The NHD is a digital vector dataset used bygeographic information systems (GIS). It contains features such as lakes, ponds,streams, rivers, canals, dams and streamgages. These data are designed to be used ingeneral mapping and in the analysis of surface-water systems."None identified"indicates that no waterbodies are present within the UA delineation.
5.) Maine DEP classifies several specific waterways within the state designated asUrban Impaired Streams (UIS) in Code of Maine Rules Chapter 502. These streamscrossing MTA's ROW in UA have been identified in emboldened text, includingHart Brook (aka Dill Brook, Lewiston), Capisic Brook (Portland), Nasons Brook(Portland), Red Brook (Scarborough), and Goosefare Brook (Saco). AlthoughThatcher Brook is not included in Chapter 502, the current CMR Chapter 500proactively identified Thatcher Brook; therefore, this waterbody is not emboldened.Streams included in the statewide Impervious Cover Total Maximum Daily Load (ICTMDL) Assessment for Impaired Streams are presented in red text.
