The basis for using voluntary standards as part of public policy delivery
Better regulation:The UK Government’s Better Regulation Framework Manual (2013) sets the following principle:
‘The Government will regulate to achieve its policy objectives only…having demonstrated that satisfactory outcomes cannot be achieved by alternative, self-regulatory, or non-regulatory approaches’
This is consistent with the principle of ‘Smart regulation’ in the European Union:
Places the minimum possible administrative burden on business, especially SMEs, and:• is fit for the purpose identified,• has been through a rigorous impact assessment,• has been subject to a screening for simplification,• is evaluated periodically and amended/withdrawn as required.

• ‘New Approach’ European legislation: only sets high level essential requirements,
• Leaves the choice to industry as to the precise means of compliance with the law, with ‘harmonized’ European standards providing one way to meet requirements,
• Recognizes the differences between standards and regulation, and
• Enables innovative solutions for industry.

• Standards enable simple, flexible, ‘better’ regulation that in turn promotes innovation and industry transformation.
• However, this requires constant awareness raising: e.g. BSI and UKAS have published a ‘handbook for ministers’.
• This describes the three mechanisms of:
• Self-regulation, earned recognition, and co-regulation.

• Government does not want to regulate but needs to provide some assurance to the market,
• Businesses then voluntarily agree to meet certain standards,
• Government will work with the industry to agree codes of conduct, charters etc.
An example of this approach in the UK was the development of BS 8580: 2010 for Legionella risk assessment. Businesses use BS 8580 to comply with the HSE code of practice. Accreditation of inspection organisations provides further assurance.

• Government offers “Earned Recognition” to companies for certification against ISO 14001;
• Trusting that these are firms behaving responsibly:• Are certified to the standard by accredited auditor,• Enables regulators to reduce oversight and
inspection visits,• Reduces cost of regulation both for the state and
business, and• Encourages regulators to focus on finding the ‘bad
guys’.

BIM Level 2 standards in 2015: - information management for
operational phase of assets, - collaborative production of
information, - cyber security considerations.BIM portal was launched in 2016,

• Government sets top level regulatory requirements (New Approach model);
• The market defines how these general principles are met through technical solutions,
• Accreditation may be used to ensure competence of those organisations certifying compliance.
This approach was used by Government to support the flagship ‘Green Deal’ programme of energy efficiency improvements to domestic properties, with general requirements set out in the Energy Act 2011 and detailed requirements in PAS 2030.

• Greenhouse gas management: standards help
• organizations to assess, monitor and manage their emissions – within their operations, products and supply chains, and
• Support compliance with legal requirements.
• Standards have been developed around greenhouse gas management: assessment, reduction, offsetting and communications.
• PAS 2070:2013 was sponsored by Mayor of London.
