WHAT IS SR-22 INSURANCE?

An SR-22 is not an insurance policy; it’s simply a financial responsibility form that proves an individual has the minimum liability insurance as required by law.

Financial Responsibility for Crash, Conviction or Judgment

Any individual whose driving privilege has been suspended or revoked as the result of a car crash, conviction or judgment is required to file an SR-22 with DPS and maintain coverage for two years starting from the date of the conviction.

An insurance card or policy will not be accepted in place of an SR-22.

An insurance provider will automatically notify the Texas Department of Public Safety (DPS) when an SR-22 is cancelled, terminated or lapses.

How long is proof of financial responsibility (SR-22) required in crash, conviction or judgment cases?

The SR-22 is required for 2 years from the date of crash, date of conviction or date the judgment was rendered

Why would I need SR-22 insurance?

The State of Texas requires that an SR-22 be filed for many different reasons, such as:

• multiple no-insurance tickets• an occupational or essential needs driver’s

license• an unpaid judgment for a liability claim• convictions for driving under the influence of

alcohol or drug-related offenses• excessive violations

What happens if my SR-22 is cancelled?

Once the Texas Department of Public Safety (DPS) receives notification from the insurance company that the policy is cancelled, terminated, or lapses appropriate enforcement action may be taken. If the SR-22 is still required and there is not a valid SR-22 on file, the driving privilege and vehicle registration is suspended.

Driver Eligibility Status

For individuals who are required to submit an SR-22, their driver eligibility status will change from “ineligible” to “eligible” on the License Eligibility website once all documents have been processed and fees have been paid.

If you are an A-Affordable customer, we’ll file the actual SR-22 form with the DPS to show proof of insurance for you.

Once we file your SR-22, your license suspension will be removed and you can drive again legally. We’ll cancel or terminate an SR-22 by filing a separate form with the DPS (an SR-26), generally 10 days before the SR-22’s expiration.

At the present time, if you have an SR-22 in one state but move to another state, you must complete the SR-22 filing period for your former state, even though you no longer live there. Also, your insurance policy for your new state must have liability limits which meet the minimums required by law in your former (SR-22) state.

Driver License Reinstatement Requirements

To reinstate a driver license an individual must:

1. Pay the required reinstatement fee prior to the issuance of the driver license, and

2. Submit an SR-22 to DPS.

Minimum Liability AmountsThe minimum liability coverage amounts required by law are:

• $30,000 for bodily injury to or death of one person in one accident,

• $60,000 for bodily injury to or death of two or more persons in one accident, and

• $25,000 for damage to or destruction of property of others in one accident.
