Cases by Filing Party Overall, the cases filed are comprised of 446 student filed cases, 70 district filed cases, two district filed expedited hearing, one district filed case involving expedited and non-expedited issues (dual hearing), and three student filed cases involving expedited and non-expedited issues (dual hearings).2 Additionally, 24 students filed and 18 district filed mediation only requests were received. In summary, OAH received 564 requests for mediation related to due process hearing or mediation-only this quarter.3 Of the 564 requests for mediation, 42 were requests for mediation only. 4 The remaining 522 requests for mediation were related to due process hearing requests.5 Of the total requests for due process hearing, six involved expedited issues.6

Issues and Remedies

Cases filed this quarter raised a variety of issues and requested remedies. The number of issues raised varied per case, with some cases only raising one issue and others raising several issues. The most common issues raised were placement (278 cases) and assessment (220 cases). Other issues included: speech and language services (178 cases), designated instruction and services (177 cases), ABA or one-to-one aide services (118 cases), goals and objectives (70 cases), occupational therapy services (115 cases), eligibility (61 cases), extended school year services (30 cases), mental health services (25 cases), procedural violations (14 cases), discipline (7 cases), and private services (71 cases). Compensatory education was requested as a remedy in 192 cases and reimbursement was requested as a remedy in 192 cases.9

Eligibility Category 10 The majority of cases filed involved students identified under the eligibility category of autistic-like behaviors (182 cases). Other identified areas of eligibility included: Specific Learning disability (93 cases), Emotional Disturbance (69 cases), Other Health Impaired (102 cases), Speech and Language disorder (95 cases), Mental Retardation (29 cases), Hearing Impairment (14 cases), Visually Impaired (18 cases), Multiple Disabilities (23 cases), orthopedic impairment (12 cases), traumatic brain injury (4 cases), Deafness (5 cases) and Deaf/Blind (4 cases). The student’s area of eligibility was not identified in 123 cases.11 10 In some cases, the parties identified more than one area of disability. CLOSED CASES

During this Quarter, 560 cases were closed. Currently, 515 matters remain pending. Of the 515 matters pending, 496 are related to due process hearing requests and 19 are related to Mediation Only requests. Of the 560 cases closed, 511 were related to due process hearing requests and 49 were related to Mediation Only requests.

Quarterly Report – 2nd Quarter Fiscal Year 2008-2009 January 30, 2009 Page 10 Overall this quarter, of the 511 due process cases, 492 (96%) were resolved in some manner without need for a due process hearing.12 For the fiscal year to date, 96 percent of cases have resolved without need for a due process hearing. The majority of cases were withdrawn by the filing party without explanation (212 cases), followed by those that resolved during mediation (154 cases) and those outside the mediation or resolution session process (117 cases). Additionally, 21 cases were dismissed due to inactivity, 12 cases resolved during the resolution session, seven cases were dismissed via a motion to dismiss, six cases were dismissed after failing to amend following a notice of insufficiency, and 11 cases were closed for other reasons. Mediations

This quarter 364 mediations were held. Of these mediations, 43 were continued for an additional mediation date. Of the 364 mediations held, 330 were related to due process hearing requests, two cases were related to a dual hearing request (which involve expedited and non-expedited issues) and 32 were related to mediation only requests. For mediation requests related to due process hearing requests, 186 cases reached an agreement,17 and 19 mediation only cases reached an agreement. In the two dual hearing cases that went to mediation, the parties in both cases reached an agreement.18 Mediation was successful in 20519 cases (68 percent of the time), with 116 mediations resulting in impasse. Due Process Hearings

During this Quarter, final decisions were issued in 20 cases. Of the 20 decisions issued, one decision was issued within the 45 day timeline, 17 were issued within the 45 day timeline plus extension, and two were issued late.22 Regarding cases with expedited issues, no decisions were issued and no changes of placement were ordered for this quarter.23 Overall, this quarter, 90 percent of decisions were issued within the requisite timeline. For the decisions issued this quarter, students prevailed in three hearings (15 percent). Districts prevailed in twelve hearings (60 percent). In five cases (25 percent), the decision was split between student and district with students prevailing on 14 issues and districts prevailing on 9 issues.24 For the current fiscal year, students have prevailed in seven hearings (16 percent), districts have prevailed in 20 hearings (45 percent), and 17 cases (39 percent) resulted in a split decision. Of the decisions issued, no cases involved a preschool student, 11 cases involved elementary school students, four cases involved middle school students, and five cases involved high school students. On average, the due process hearings lasted four days, with students using 48 percent of the hearing for presentation of their case and districts using 52 percent of hearing time for case presentation. During case presentation, each side called an average of six witnesses per case. Resolution Sessions

The IDEA requires school districts to hold resolution sessions within 15 days of receipt of a student’s complaint. While there is no legal requirement to report this data to OAH, we request that school districts inform us if they held a resolution and the outcome of that session. This quarter, 23 resolution sessions were reported as held and two were reported as not held. No resolution sessions that were reported to OAH were related to expedited issues.26

Motions

Prehearing motions and Notices of Insufficiency (NOI) comprise a substantial amount of the work completed by administrative law judges. For this quarter, 224 prehearing motions and 63 NOIs were considered and ruled upon by OAH. Of the 224 prehearing motions that were ruled on by OAH, 106 were filed by parents, 63 were filed by districts and 55 were stipulated.27

There were 224 prehearing motions filed this quarter. Of the 63 motions filed by districts, 36 were granted, two were granted in part and 21 were denied. Of the 106 motions filed by students, 60 were granted, three were granted in part and 42 were denied. The remaining motions filed by either students or districts were stipulated, moot, or withdrawn.28 Of the 57 NOIs filed, 18 were found insufficient, 14 were partially sufficient, and 25 were sufficient. No cases were dismissed for insufficiency.29

NON-ENGLISH SPEAKING STUDENTS AND INTERPRETERS During this quarter, 24 non-English speaking students were identified through the due process hearing request forms.30 Of the 24 non-English speaking students, 15 were Spanish speaking and two were Portuguese speaking. Additionally, one student was identified in each category for speaking Armenian, Indonesian, Korean, Mandarin, Tongan, Turkish, and one was identified as using American Sign Language. STUDENTS OF COLOR CDE has requested OAH collect data on the number of “students of color accessing the system.” To facilitate this request, effective January 1, 2007, OAH amended its due process hearing request form to include this request. TRANSCRIPT REQUESTS AND APPEALS This quarter, OAH received 18 requests for transcripts. This quarter, OAH was notified that an appeal was filed on two cases.32 Data on the number of appeals and appellate outcomes is collected on an ongoing basis. It includes all cases that OAH was notified were appealed since July 2005. Based on correspondence with the parties and filings that have been provided to OAH, 149 cases have been appealed since July 2005. Currently, 49 OAH decisions are on appeal. Since July 2005, 23 decisions have been upheld, six decisions have been remanded, five decisions were reversed, 21 cases settled, 38 were dismissed, and four cases were withdrawn by the filing party without explanation.

MEDIATION AND HEARING EVALUATIONS Under its contract with CDE, OAH is required to send evaluations to all parties attending mediations and hearings. The evaluations contain a 1 through 5 rating scale, with 1 being Poor/Very dissatisfied and 5 being Excellent/extremely satisfied. The evaluations ask the parties to evaluate the mediation, the administrative law judge and OAH in general. This quarter, 249 mediation evaluations were returned to OAH. Evaluations were completed by parents (61 cases), legal counsel for parents (18 cases), parent advocates (4 cases) school district representatives (77 cases), and legal counsel for district (24 cases). In 65 cases, the evaluator did not indicate their role in the mediation.

OVERALL AVERAGE MEDIATION RATING – 4.44

This quarter, 30 hearing evaluations were returned to OAH. Evaluations were completed by parents (three cases), legal counsel for parents (two cases), parent advocate (one case), school district representatives (eight cases), and legal counsel for district (five cases).
